Os princípios gerais do direito e os standards jurídicos no código civil / The general principles and juridical standards in the civil code.

Falavigna, Maria Clara Osuna Diaz 13 February 2008 (has links)
The Civil Code became effective bringing an innovation as interpretation parameter: rules with ductile aspect, as the legislator intended that flexibility, without that meaning any compromise with the so acclaimed legal security. For that reason, the due knowledge of the contents and nature of the legal rules is important. With the scope of understanding and approaching the subject, knowledge was searched from the general principles of Law and the legal standards, and the work takes a position for recognizing a natural Law, not solely based on reason, as men are not mere mathematical formulas or a computer program, but on the classic natural Law, the same one that had its doctrine outlined by Aristotle, that permits its evolution, however, has as unchangeable its reference to the human being. It is in that sense that, for the correct interpretation of the legal texts, one must find in the other what exists in ourselves, susceptible of having individualities respected, understood as an identification, in which the other one is not considered as a mere thing, but continues so human as one recognizes him/herself. As a method for interpretation that permits to distinguish the institutes, validating the process of disclosing law, it was opted for the phenomenological current, because the return of things to themselves, not as it manifests, because manifesting is not only about what it appears and not something in itself, they bring to the consciousness that justice is intention of the interpretation wherefore such essentiality must be disclosed. In the phenomenological reduction, the essences of the interpreted object must be perceived, recognizing the influences that are external to the object, but internal to the subject that interprets it in a comprehensive and not explanatory attitude. Accordingly, what was sought was the return to the same things, in the appreciation of the phenomena that Heidegger indicates as the being-with, in which the assumption of my existence assumes he existence of the other, as well as the existence of the other for me and my existence for the other, since thinking, saying and being has the same acknowledgement.

« Un soir, ils allèrent au théâtre... » Scènes de théâtre dans les romans France-Québec, 1871-1949 / "'On one evening, they went to the theatre" Theater scenes in novels France-Québec 1871-1949

Labeille, Veronique 24 October 2011 (has links)
The theater scene, key element of several novels yet unexplored, questions the bounds between the medium and the œuvre within. Supported by a corpus made of French and French Canadian novels published between 1871 and 1949, this work argues the recurrent specificities of the theater scene, whatever the time, the aesthetics or the place from which the novelist writes. Becoming a privileged topos for the text that operates « a return on itself », the questions of reflexivity and specularity enlighten what theater can do to the text. From a sociocritic reading articulating social and art matters, our study on the theater scene covers not only the dramatic art’s aspect but also the theater aspect thought as a social classification tool. The costume, the body of the artist, the lights, but also the theatrical spaces, the category of public and the society life happening in the theater hall are, if anything else, some facets our work would like to point out. The prism of the theater scene once revealed goes beyond the interiority of art and the exteriority of the social behavior through and thanks to the body. Between what André Belleau calls the « code » and the « parole (speech)», the theater scene embodies both aspects, links them both tight and goes past them thanks to the bodies that are both eroticized and socialized.

Lopes, Mayara Marin. January 2019 (has links)
The objective of this study was to characterize the socioeconomic profile and eating and hygiene habits of young people., aged 18 to 24 years old, caries-free, benefiting dentistry in order to study data related to health and not the disease as already reported in the literature. Through a simple clinical examination, caries-free students were selected (88), who then answered a questionnaire with questions about the family's socioeconomic profile, eating habits, hygiene, routine dental appointments, and indulcement of parents or guardians for childhood to the present day. The most prevalent socioeconomic profile was between the strata A and B2, with the level of schooling of the parents between full middle and postgraduate. Regarding fluoridated water and oral health information, 93% said they had access. Brushing has been reported at least 1 to 3 times a day, up to 5 times. Private practices were the most visited, with a 3-6 month interval between consultations due to prevention. Brushing was supervised by parents up to 7 years of age by 63.64% of the interviewees. Study Of Symbolic Expressions In Peking Opera'scostumes And Lyrics

Li, Yiman 01 January 2008 (has links)
This thesis represents an analysis of symbolic expressions used to convey traditional Chinese cultural values in marital relations as expressed through costumes and lyrics in Peking Opera plays and performances. Two symbols, dragon and phoenix, were selected from the costume collection. Four symbols--bird, tiger, wild goose, and dragon--were selected from compilations of lyrics. These symbols were selected because they expressed Chinese core cultural values, an imperial ideology based on Confucian thoughts, which were practiced rigidly during Qing Dynasty (1644-1911). Modeling Theory is applied to argue that dragon and phoenix as visual symbols convey ideas about characters' background, marital relationship, social status shifts, and socio-culturally desirable values. Social Drama Theory is employed to analyze the lyrics to understand how ideal images of husband and wife are constructed. The archetypes of Chinese traditional culture that have influenced Chinese thought and action for centuries are discovered and discussed.

A historical study of women's costumes as a reflection of the culture in Virginia from 1608-1900

Cocke, Doris Lanier 06 February 2013 (has links)
A historical study of women's costumes for selected periods as a reflection of the culture in Virginia was designed to gain some understanding of the costumes worn, to observe the role that clothing played in the lives of the settlers and of the influences that brought about changes in costume. Much information pertaining to this subject was found in books on history. The researcher conducted this study by visiting various museums, reviewing related books and studying historical portraits. The researcher found that most of the information that is recorded about clothing belonged to persons of some wealth and station of life. The costumes, fabrics, shoes, and other apparel still in existence are relics of past days. Thirty-eight illustrations on costumes have been included in this study. / Master of Science
