From the analysis of the constitucional law to the secrecy, of the principle of the proportionality as alternative to the solution of conflicts of basic rights, of the test in criminal proceeding, it will be presented the concept of the fortuitous meeting and the possible legal consequences of its application in the efetivação of the process as allowed test. The method will be dogmatic-prospective in the perspective of analysis of the national and foreign doctrine as well as of the national jurisprudence. Tramita em processo legislativo, anteprojeto de reforma da Lei acima citada. Neste, há a previsão de descobertas inusitadas, entretanto, apenas nas hipóteses que a doutrina convencionou chamar de conhecimentos de investigação. A Lei que poderá vingar silencia, novamente, quanto à hipótese do encontro fortuito propriamente dito. A partir da análise do direito constitucional ao sigilo, do princípio da proporcionalidade como alternativa à solução de conflitos de direitos fundamentais, da prova em processo penal, será apresentado o conceito do encontro fortuito e as possíveis conseqüências jurídicas de sua aplicação na efetivação do processo como prova lícita. O método será dogmático-prospectivo na perspectiva de análise da doutrina nacional e estrangeira bem como da jurisprudência nacional. A dissertação propõe compreensão de lege lata para adequar a legislação brasileira, adotando, contudo, também como referencial Anteprojeto de Lei de iniciativa do Ministério da Justiça.

It will be studied the correlation between the concepts of process and procedure and the practice of each procedural act which culminates in the penal transaction: since the transcription of the Detailed Occurrence Term by the police authority to the Preliminary Hearing. The starting point of this investigation is the eventual tension between the legal process principles which is a way of guaranteeing the legal jurisdiction service and the search for efficiency of the penal jurisdiction service as a way of undermining the legal guarantees due to the imbalance of this equation in the current practice of the penal transaction. The investigation starts from a bibliographical revision about the subject and also the analysis of statistical data about the typology of the occurrences and the nature of the legal sentences handed down in the year of 2009 in the Special Criminal Court of the State of Pernambuco. Samples of real cases submitted to the criminal courts are analyzed in order to confront the praxis of the penal transaction with the legal process principles used as basis for that matter. This research demonstrate the existence of the imbalance between garantism and efficiency in the praxis of the Penal Transaction in Brazil and it proposes the basis to materialize this institute together with the constitutional process principles, specially the principle of the due process of law and its corollaries of the wide defense and contradictory. / Esta dissertação investiga o instituto jurídico da transação penal, aplicado no âmbito dos Juizados Criminais e a sua relação com os princípios constitucionais que garantem aos cidadãos direitos fundamentais de natureza processual, inclusive. São estudados a correlação entre os conceitos de processo e procedimento e a prática de cada ato procedimental que culminam com a transação penal: da lavratura do Termo Circunstanciado de Ocorrência pela autoridade policial à Audiência Preliminar. O ponto de partida da investigação é a eventual tensão entre os princípios processuais de viés garantista e a busca pela eficiência da prestação da tutela jurisdicional penal, como geradora de déficit de garantias por causa do desequilíbrio dessa equação na atual prática da transação penal. A investigação parte de uma revisão de bibliografia sobre o tema e também da análise de dados estatísticos a respeito da tipologia penal das ocorrências e sobre a natureza das sentenças prolatadas no ano de 2009, nos Juizados Criminais do Estado de Pernambuco. São analisadas amostras de casos reais submetidos a juízo para cotejar a prática da transação penal com os princípios processuais que a informam. A pesquisa demonstra a existência de desequilíbrio entre garantismo e eficiência na prática da Transação Penal no Brasil e propõe bases para concretização do instituto sob o pálio dos princípios processuais constitucionais, notadamente do devido processo legal e seus corolários da ampla defesa e do contraditório.

O consenso como meio de simplificação do procedimento criminal : perspectivas e possibilidades no processo penal brasileiro

O objetivo do presente estudo é analisar como o consenso tem sido utilizado para abreviar, interromper ou encerrar antecipadamente o procedimento criminal. A inserção do consenso ou dos acordos entre acusação e defesa nos sistemas jurídicos de civil law exigiu a abertura de espaços de oportunidade ao exercício da ação penal (princípio da legalidade), e tem contribuído para a superação da ideia de que todo o processo penal deve contar sempre com as fases preliminar, intermediária e decisória. O estudo de Direito Comparado revela como Itália, Alemanha e Espanha incorporaram as soluções negociadas norte-americanas em seus respectivos ordenamentos, ora oferecendo soluções diversionistas à aplicação da lei penal, ora admitindo que a declaração de culpa e a consequente aplicação da pena tomem em conta o acordo firmado entre acusação e defesa. A pesquisa prossegue com a averiguação dos principais óbices à admissibilidade dos acordos no processo penal, notadamente a eventual violação aos direitos ao silêncio e de não produzir prova contra si mesmo, e a suposta privatização do processo com a admissão de uma verdade consensuada. Diante deste cenário internacional, analisam-se as alterações legislativas levadas a efeito pelo Brasil para admitir os acordos em seu processo penal, bem como a principal inovação no projeto de novo Código Processual Penal brasileiro: os acordos penais. O estudo conclui que o consenso não é incompatível com os princípios e valores do devido processo legal, mas reconhece a necessidade de aprimoramento dos mecanismos de controle judicial daquele, salvaguardas essas que não só protegem o acusado mas também reforçam a natureza pública e indisponível do processo penal. / The purpose of the present study is to analyze how the consensus has been used to shorten, interrupt or close the criminal procedure in advance. The insertion of consensus or agreements between prosecution and defense in the civil law legal systems has required the opening of opportunities for criminal prosecution (the principle of legality), and has contributed to overcoming the idea that all criminal proceedings must always have the preliminary, intermediate and decision-making phases. The Comparative Law Study reveals how Italy, Germany, and Spain incorporated US negotiated solutions into their respective jurisdictions, sometimes offering diversionary solutions to the application of criminal law, or assuming that the guilty plea and the consequent application of the penalty take into account the agreement between accusation and defense. The investigation proceeds with the investigation of the main obstacles to the admissibility of the agreements in criminal proceedings, namely the possible violation of the rights to silence and of not producing evidence against itself, and the supposed privatization of the process with the admission of a truth agreed upon. In view of this international scenario, we analyze the legislative changes carried out in Brazil to admit the agreements in the criminal process, as well as the main innovation present in the draft new Brazilian Criminal Procedure Code: penal agreements. The study concludes that consensus is not inconsistent with the principles and values of due process, but recognizes the need to improve judicial control mechanisms, which safeguards not only protect the accused but also reinforce the public nature and unavailability of criminal proceedings.

L’autorité de la chose jugée, expression de l’exigence de stabilité des décisions juridictionnelles et de la capacité de l’Etat souverain à exercer son pouvoir juridictionnel en tranchant définitivement l’affaire lui étant soumise, est fortement liée à l’enchainement processuel dont elle constitue l’aboutissement naturel. Ces dernières années, en raison de l’influence du droit supranational, la chose jugée subit également un processus d’érosion de son caractère irréfragable. En particulier, alors que le conflit entre chose jugée et décisions de la Cour de justice de l’UE apparait comme « pathologique », les spécificités du système conventionnel de protection des droits de l’homme provoquent un conflit quasi « physiologique » avec la chose jugée de droit interne. La nature particulière de ce dernier type de conflit s’explique non seulement en raison du principe de subsidiarité et de l’épuisement des voies de recours internes qui caractérisent la saisine de la Cour EDH, mais aussi du fait de la nécessité d’une « restitution in integrum » du requérant victime d’une violation conventionnelle qui impose une obligation de réouverture de la procédure interne, en exécution de l’article 46 Conv. EDH. La thèse analyse, sous l’angle comparé du droit italien et français, les notions qui sous-tendent ce conflit, à savoir la valeur de la res iudicata et l’incidence des systèmes européens de protection des droits fondamentaux sur l’ordre processuel interne pour ensuite se pencher sur les modalités concrètes par lesquelles les deux ordres juridiques ont permis le dépassement de l’autorité de la chose jugée pour garantir l’exécution des arrêts de la Cour EDH. Dans le cadre ainsi tracé, la récente entrée en vigueur du Protocole n. 16 à la Conv. EDH, introduisant un mécanisme consultatif devant la Cour EDH, ainsi que les perspectives offertes par le Protocole n. 15 à la Conv. EDH et par la possible adhésion de l’Union au système conventionnel, viennent recentrer le rôle reconnu à la Cour EDH en tant que juridiction régulatrice d’un système européen de protection des droits fondamentaux, et favorisent le dépassement du conflit entre la chose jugée et les décisions européennes en faveur du paradigme du "dialogue" entre les juges. / The effect of res judicata (also known as “a thing adjudged), an expression of the stability requirement of the jurisdictional decisions and the sovereign state’s capacity to exercise its jurisdictional power by making the final judgement on the matter, is a concept strongly connected with the criminal process which constitutes its natural result. In the last few years, as a result of solicitations of supranational origin whose domestic law is subject, res judicata also undergoes a process of erosion of its irrefutable nature. In particular, while the conflict between res judicata and decisions of the Court of Justice of European Union appears to be “pathological”, the specificities of the conventional system of human right protection provoke a virtually “physiological” conflict with the the doctrine of res judicata in domestic law. This is done considering the principle of subsidiarity and the exhaustion of domestic remedies which characterize the appeal to the European Court of Human Rights jointly with the fact that the requirement of the effective "restitutio in integrum" of the applicant victim of a recognized breach of his rights imposes an obligation to reopen the domestic proceedings, according to article 46 ECHR. The thesis analyses under the angle of Italian and French law, the concepts underlying the conflict, especially the value of res judicata and the impact of European systems of protection of fundamental rights on the internal criminal process, secondly, to examine the concrete ways in which the two legal orders have allowed the effect of res judicata to be exceeded in order to guarantee the execution of ECHR judgments. In this context, the recent entry into force of the Protocol n. 16 at EDH, introducing a consultative mechanism before the ECHR, as well as the prospects outlined by the Protocol n. 15 at ECHR and by the possible accession of the European Union to the conventional system, refocus the recognized role of the ECHR as a regulatory jurisdiction of the European protection system for fundamental rights, and promote the overcoming of the conflict between res judicata and European decisions in favor of the "dialogue" between judges.

Il semble aujourd'hui possible de considérer que le numérique et le cyberespace ont complètement changé les rapports de force dans notre société moderne. En se numérisant, la société permet à ses membres un accès quasi illimité et instantané à des millions de ressources et données. Par ailleurs, il facilite largement les relations personnelles et professionnelles entre les individus. Si le numérique peut être présenté comme une véritable révolution, celui-ci expose son utilisateur à de nouvelles vulnérabilités, à de nouveaux risques. Le droit pénal, en ce qu'il régit la société et choisit les valeurs sociales à protéger, s'est donc intéressé au développement du numérique et à ses conséquences. La présente étude constate un arsenal législatif étendu pour lutter le plus efficacement possible contre la délinquance numérique. Néanmoins, l'analyse observe qu'il existe de nombreux obstacles à l'application du droit pénal au cyberespace en raison des particularités liées aux réseaux. La délinquance numérique n'est, en outre, pas la seule menace générée par le numérique, puisque désormais, il est possible de parler du cyberespace comme d'un nouvel espace de confrontation. Ainsi, à la délinquance numérique s'ajoute la menace militaire puisque les États investissent les réseaux par la mise en place d'armes numériques. Il s'agit alors de s'interroger sur la pertinence de ces choix étatiques et sur les solutions permettant d'accentuer la lutte contre la délinquance numérique. / Today, it seems possible to consider that digital technology and cyberspace have completely changed the balance of power in our modern society. By digitizing, the society gives its members almost unlimited access to millions of resources and data. Digital technology also facilitates personal and professional relationships between individuals. If digital technology can be presented as a real revolution, it exposes its user to new vulnerabilities and risks. The criminal law, insofar as it governs society and chooses the social values to be protected, has therefore been concerned with the development of digital technology. The present study notes the extensive legislative arsenal for fighting in the most effective manner against digital delinquency. Nevertheless, the analysis observes that many obstacles are against the application of criminal law into the cyberspace because of networks particularities. Moreover, digital crime is not the only threat generated by digital technology, since it is now possible to consider the cyberspace as a new space for confrontation. Thus, military threat is added to digital delinquency as the States set up electronics weapons into networks. Then, the arised question is about the relevance of these state choices and the solutions to intensify the fight against digital delinquency.

The protection of children's identities in the criminal justice system: an analysis on section 154(3) of the Criminal Procedure Act 51 of 1977

Thesis ( LLM.) --University of Limpopo, 2019 / The Constitution of the Republic of South Africa, 1996 provides that a child’s best interests should be of primary consideration in any matter concerning him or her. Contrary to this value, and thereby excluding protection of child victims, section 154(3) of the Criminal Procedure Act 51 of 1977 simply focusses on anonymity protection of child offenders and witness involved in criminal proceedings. It currently expressly prohibits the publication of the identities of child offenders and witnesses when the media makes publications on the relevant criminal proceedings. However, this protection terminates once such child offenders and witnesses attain majority, therefore arbitrarily stripping them of the identity protection. As a result, media houses are not only at liberty to publish on criminal proceedings identifying child victims, but also to expose the identities of child offenders and witnesses upon attaining majority. Such publications have proved to impede on children’s rights, as well as to contribute to the psychological challenges faced by the children whenever they are exposed to the criminal justice system. In this study the constitutional validity of section 154(3) is investigated and it is argued that it is unconstitutional in all respects. The section contradicts the specific right afforded to all children in the Bill of Rights, as well as other ancillary rights, which ought to ensure the progressive realisation of the protection afforded in terms of section 154(3). It is recommended, firstly, that section 154(3) be declared unconstitutional, and be amended to include child victims within the ambit of its protection. Secondly, the protection should extend beyond the age of 18, in respect of all children involved in criminal proceedings. / National Research Foundation

An Empirical Examination of Conflict Theory: Race and Sentence Length

The conflict perspective of criminology and societal reaction to crime suggests that the administration of criminal justice is determined and controlled by those segments of society which are relatively powerful. Based on this perspective, it is reasonable to expect that relatively powerful groups or categories will be far less subject to severe criminal sanctions than will those who are relatively powerless. This proposition may be tested at points in the criminal justice system where decisions are made relative to the application of criminal sanction. The findings are that the relationship between race of offender and sentence length considered both with and without selected control variables is a uniformly weak relationship. In certain categories of control variables the relationship between race of offender and sentence length does strengthen slightly, but in no case are the relationships sufficiently strong to be significant at the .05 level. Partial correlation coefficients show the relationship between race of offender and sentence length to be little affected by the control variables. Therefore, the relationship between race of offender and sentence length is in all cases considered, and by every form of analysis, quite weak. Proportional reduction in error in virtually every case considered in this study is less than 1 percent.
