Para sistematizar a produção, majorar a produtividade, suprimir gastos e economizar tempo, empresas aderiram ao telemarketing, principal atividade terceirizada no Brasil e uma das maiores empregadoras do país (665 mil teleoperadores). Todavia, doenças desencadeadas pela atividade laboral são freqüentes em teleoperadores, fato que tem motivado empresas a buscarem recursos no próprio ambiente laboral, como a implementação de uma sala de descanso para seus funcionários, para atender ao recém aprovado Anexo II, da Norma Regulamentadora 17, que instituiu a obrigatoriedade da realização do intervalo para refeição/descanso fora do posto de trabalho. O presente trabalho teve por objetivo verificar, junto a teleoperadores e supervisores de telemarketing, o uso da sala de descanso implementada na empresa e suas opiniões sobre a relação entre uso e afastamentos por motivo de saúde, promovendo uma intersecção entre Psicologia Ambiental e Direito Ambiental do Trabalho. Realizou-se, primeiramente, um estudo piloto com 15 teleoperadores (10 mulheres e 5 homens) e 1 advogado da empresa, resultando em algumas alterações no questionário para teleoperadores. Participaram da pesquisa, fora do ambiente e expediente de trabalho: 80 teleoperadores (48 mulheres e 32 homens), 56% entre 18-25 anos; 73% solteiros; 59% do turno manhã/manhã-tarde; 74% sem ou cursando nível superior, sendo 39% de indicações de ensino médio completo e 35% de ensino superior incompleto; 56% iniciaram na atividade de telemarketing entre 2004-2007 e, nesse mesmo período, 60% ingressaram nessa empresa em que atualmente trabalham; e três supervisores de telemarketing do sexo masculino, entre 26-28 anos, nível superior completo, turno M/M-T, dois solteiros e um casado, contratados entre 2000-2001. Evidenciou-se que: (1) tanto teleoperadores (97%) como supervisores (100%) consideram a atividade parcialmente ou plenamente estressante; (2) durante as curtas pausas, a maioria freqüentemente permanece no refeitório (teleoperadores 71%, supervisores 100%); (3) seja antes (50%), durante (43%) ou após o expediente de trabalho (74%), a maioria nunca utiliza a sala de descanso; (4) relaxamento (41%) e interação (teleoperadores 31%, supervisores 100%) são as atividades mais realizadas pelos teleoperadores, quando do uso da sala; (5) cerca da metade dos teleoperadores (53%) nunca se afastaram, embora 75% dos supervisores indicassem certa freqüência de afastamentos na empresa, porém 60% dos participantes entraram na empresa entre 2004-2007; (6) a maioria atribui fatores positivos à sala (76%) e acredita em sua influência na saúde e bem-estar (teleoperadores 84%, supervisores 75%); (7) 67% dos teleoperadores e 100% dos supervisores julgam necessário ou relevante a implementação de políticas de saúde na empresa, para estimular o uso da sala de descanso e reduzir afastamentos por doenças ocupacionais. Em suma, os resultados evidenciaram o não uso dessa sala de descanso por diversos fatores (ambientais, cultuais, sociais e econômicos), embora os participantes a considerem relevante para a questão da saúde do trabalhador, sugerindo a necessidade de se repensar este espaço, bem como a organização do trabalho, observando-se as sugestões dos participantes apontadas neste estudo, como recreação e interação, atividades que se contrapõem às características rígidas e penosas do telemarketing. This study aimed to check, next to the teleoperators and supervisors of telemarketing, the use, for teleoperators, of the quiet room implemented in the company and its opinions about relation between use and removal for reason of health, proposing an intersection between Environmental Psychology and Enviromental Labour Law. There was a pilot study with 15 teleoperators (ten women and five men) and a lawyer of the company, resulting in some changes in the final questionnaire for teleoperators. Participated on the survey, out of the company and expediency of work, 80 teleoperators: 48 women and 32 men; 56% between 18-25 years; 73% single; 59% of the turn morning/morning-late; 74% without or taking higher level, with 39% of indications of complete average education and 35% of incomplete higher education; between 2004-2007, 56% had started in the activity of telemarketing and 60% joined the company in wich they work. Three male supervisors had also participated, between 26-28 years, higher level complete, turn morning/late-morning, two singles and one married, recruited between 2000-2001. The results showed no significant differences between the teleoperators (sex/shift of work) and had showed that: (1) 97% of the teleoperators and all the three supervisors had considered the activity partially or fully shessful; (2) during short breaks, 71% of the teleoperators had indicated the frequent use of the cafeteria, also indicated for the three supervisors; (3) the majority of the teleoperators never uses the quiet room, either before (50%), during (43%) or after hours of work expedient (74%); (4) when the use of the room, activities were held more relaxing (indicated by 40% of the teleoperators) and interaction (indicated by 29% of the teleoperators and two supervisors); (5) 54% of the teleoperators has never moved away for health reason, however two supervisors had indicated frequent removals and one, sometimes; (6) 84% of the teleoperators and two supervisors had indicated the influence of the use of the quiet room in health; (7) 67% of the teleoperators and all the supervisors had judged necessary or relevant the implementation of politics of health in the company, to stimulate use of the quiet room and reduce injuries by occupational diseases. In conclusion, although the results showing the non-use by teleoperators of the quiet room, which had the many factors (environmental, personal, cultural, social, economic, etc.), the participants had considered it excellent for the health of the worker, suggesting the need to reflect about this space and the organization of the work, in compliance with the suggestions of participants, such as the need for recreation and interaction, activities no common on the rigid and heavy context of telemarketing. Previous issue date: 2015-09-04 / The protection of religious freedom under the Brazilian legal system now requires a new look meet the demands arising in the exercise of faith and their acts of worship, namely, rest days, ornaments, places of worship etc. Taking as its starting point the historical construction of the right to religious freedom as guarantees of legitimizing instrument in the midst of a pluralistic and democratic society, raises the prospect of religious rest day protection as bias to be safeguarded as a means of demonstration respect for diversity and the exercise of religious tolerance. While the Legislature is omitted on the scope and protection of religious rest day, the Judiciary Power come constantly creating and abridging rights making up clearly see through the case study of this work, which courts have diametrically opposed decisions, which sometimes they relate to the literalness of the law disregarding the fact that a fair decision must be based on arguments of principle that will make the decisions seek equality and justice. The example of the United States and European Union reinforce the discussion, since there are accommodation mechanisms that comply well with the role of mediators in the search for safeguarding the full exercise of religious freedom in those countries. It is not a perspective that goes against the pillars of formation of the secular State. Before, it is on a quest to give effect to the right of a minority that is still little heard. / A proteção da liberdade religiosa no âmbito do ordenamento jurídico brasileiro passa a requerer um novo olhar frente às demandas que surgem em virtude do exercício da fé e dos seus atos de culto, quais sejam, dias de descanso, adornos, locais de culto etc. Tendo como ponto de partida a construção histórica do direito à liberdade religiosa enquanto instrumento de legitimação de garantias no bojo de uma sociedade pluralista e democrática, levanta-se a perspectiva da proteção do dia de descanso religioso como viés a ser resguardado como forma de demonstração de respeito às diversidades e exercício da tolerância religiosa. Enquanto o Poder Legislativo se omite quanto à abrangência e tutela do dia de descanso religioso, o Poder Judiciário vêm, constantemente, criando e cerceando direitos fazendo-se perceber claramente, através do estudo de caso do presente trabalho, que Tribunais possuem decisões diametralmente opostas, as quais, por vezes, prendem-se à literalidade da lei não atentando para o fato de que uma decisão justa deve pautar-se em argumentos de princípios que irão fazer com que as decisões busquem igualdade e justiça. O exemplo dos Estados Unidos e União Europeia reforçam a discussão, posto que, existem mecanismos de acomodação que cumprem bem com o papel de mediadores na busca por resguardar o pleno exercício da liberdade religiosa nesses países. Não se trata de uma perspectiva que vai contra os pilares de formação do Estado Laico. Antes, constitui-se em uma busca em dar efetividade ao direito de uma minoria que ainda pouco é ouvida.

La sociedad de la información, como nueva forma de organización de la sociedad y la
economía, se caracteriza principalmente por el uso intensivo de las tecnologías de la
información y comunicación (TICs), lo cual, ha implicado el cambio de la vida diaria de las
personas, la forma de organización de la sociedad y gestión de las empresas, transformando a su
vez las relaciones de espacio y tiempo, que involucran una conectividad permanente, manejo de
información en gran magnitud, comunicaciones instantáneas entre personas sin importar el lugar
donde se encuentren y teniendo dos efectos a evaluar: la hiperinformación e hiperconectividad.
Es a raíz de este nuevo contexto, nuevos fenómenos y cambios que surge la razonabilidad y
estudio de la presente tesis, la cual, plantea abordar e investigar la protección y alcances del
derecho al descanso frente al uso de las TICs. Así se tiene como objetivos principales estudiar
los fundamentos del derecho al descanso, analizar la legislación actual y disposiciones que
resultarían idóneas para garantizar el goce efectivo del derecho al descanso, evaluar la lógica y
sustento de regular el derecho a la desconexión digital en el ordenamiento peruano, régimen
laboral vigente emitido en la coyuntura actual de pandemia COVID-19. Asimismo, se busca
identificar los mecanismos de protección en nuestro ordenamiento actual que tiene el trabajador
frente a la vulneración de su derecho al descanso, evaluar si la contravención al derecho al
descanso configura un acto de hostigamiento laboral y finalmente analizar el impacto de las
TICs en las relaciones laborales. El estudio de los objetivos que abordaremos nos permitirán
concluir que a través del derecho al descanso se protegen otros derechos y que otorgarle una
sola finalidad es limitar sus alcances y naturaleza. Finalmente, entre las diversas conclusiones a
las que hemos llegado en la presente tesis, tenemos que el derecho a la desconexión no es un
nuevo derecho, sino que se trata de medidas complementarias que refuerzan la protección al
derecho al descanso, sin embargo, no son suficientes pues a partir de lo analizado y como parte
de las recomendaciones brindadas se deben reforzar aspectos de nuestro ordenamiento y
legislación actual, así como el trabajador debe conocer todas las garantías y fundamentos que lo
protegen frente al exceso de trabajo y no respeto de su derecho al descanso, los cuales también
son abordados en la presente tesis. Asimismo, el deber de buena fe y protección que le
corresponda al empleador involucra no solo el respeto de los derechos laborales sino
garantizarlos a través de una fijación idónea del horario y jornada de trabajo, adecuada
distribución de carga de trabajo y políticas que protejan y garanticen el derecho al descanso. / The main feature of the information society, as a new social and economic organization, is the
intensive use of the communications technology that have changed people´s life and the
companies administration, transforming, in turn, the relationships of space and time. This latter
involves permanent connectivity, large-scale information management, instant communications
between people regardless of where they are; all that have two effects to evaluate: hyper
information and hyper-connectivity. Due to the above, the present thesis is important and
pertinent because through it we plan to investigate and analyze the protection and scope of the
right to rest in an information society ruled by communications technology. To that, our main
objectives are as follows: study the foundations of the right to rest; analyze current legislation
and provisions that would be suitable to guarantee the effective enjoyment of the right to rest;
evaluate the logic and support of regulating the right to digital disconnection in the Peruvian
legal system and the current Covid-19´s labour regime; identify the protection mechanisms in
our current legislation that workers have against the breach of their right to rest; evaluate if the
violation of the right to rest constitutes an act of workplace harassment; and, analyze the impact
of communications technology on labour relations. The study of the above will allow us to
conclude that, through the right to rest, other rights are protected and giving it a single purpose
limit its scope and nature. Finally, among different conclusions reached in the present work, we
have that the right to disconnection is not new, but a complementary measure that reinforces the
protection of the right to rest. However, there are many aspects of our current labour legislation
that must be reinforced in order to improve the right to rest protection, as well as the worker
must know all the guarantees that assist him against overwork and non-respect of his rights,
which are also addressed in this thesis.

Criterios para la implementación de jornadas acumulativasTasayco Pardo, César Augusto 09 January 2023 (has links)
El análisis de las jornadas acumulativas genera especial interés a partir de un
pronunciamiento del Tribunal Constitucional emitido en el año 2006, incluso en la
actualidad, existen diversos documentos y resoluciones expedidas por la autoridad
administrativa de trabajo. Antes de la emisión de la sentencia en comento los
empleadores podían implementar, de conformidad con sus necesidades operacionales
y atendiendo a la especial naturaleza de su actividad, distintas jornadas acumulativas
de trabajo, sin que ello implicara mayor cuestionamiento o incumplimiento de alguna
norma de parte del empleador. En este sentido, de acuerdo con la regulación
existente hemos podido constatar que la misma se orienta a establecer el promedio de
horas que debe respetarse en el período respectivo conforme lo establece el artículo
25 de la Constitución. No obstante, del análisis de cada jornada se verifica que no
existe regulación expresa de cómo determinar una jornada acumulativa, esto es,
¿cómo así se determina que en un caso concreto los descansos acumulados
correspondan a 7 días, y no de 6, 9 o más días? ¿Qué criterio es el que determina que
a 14 días de labor (en función a 11 horas diarias) corresponda 7 días de descanso?
¿En el mismo supuesto, si la jornada diaria es de 10 o 12 horas, también tendría que
otorgarse 7 días de descanso (los empleadores normalmente lo hacen)? ¿Incide en
algo si la jornada diaria fuera de 10, 11 o 12 horas? Así, consideramos que no existen
parámetros o criterios que nos permitan implementar de manera adecuada una
jornada acumulativa de trabajo. Por consiguiente, la presente investigación no sólo
advierte la necesidad de establecer criterios, sino que propone los mismos lo que
permitirá conocer con certeza cómo se implementa una jornada acumulativa y en
especial cómo se determina los descansos acumulados del período.

[EN] One of the greatest challenges of companies from its beginnings has been to improve productivity through efficiency in all processes, especially in production processes. To do this, has used different tools, being the study of working methods and standard times a powerful tool for improving productivity in companies, especially measuring and improving the productivity from the human viewpoint factor.
The literature review to contextualize this thesis shows that there is a lot of literature on the definition of productivity, the evolution of the term over time, factors affecting it, different ways of measuring, different ratings for definitions productivity, etc. A significant search and a profound classification has been made refuting some statements.
Initially this thesis is focused on identifying the situation of different sectors of Valencia in productivity, techniques and tools used to measure it, two sectors - automotive and lighting companies - have been thoroughly studied conducting surveys to companies in both sectors. Both qualitative and quantitative results as shown. Interesting findings are extracted from this study, such as, among others, that different sectors have diferent needs, different tools are used depending on the sector or the same tools are used for different purposes.
This studies has been supported by a thorough review of the supplement tables provided by the International Labour Organization, which has been undertaken by the author supported by the work of experts in this field. To reinforce this last point, interviews to experts timekeepers has been made to see the deficiencies found in time studies conducted in companies and what are the causes. / [ES] Uno de los mayores retos de las empresas desde sus inicios ha sido mejorar la productividad a través de la eficiencia en todos sus procesos, especialmente en los procesos productivos. Para ello, han utilizado distintos métodologías, siendo el estudio de métodos y tiempos una poderosa herramienta para la mejora de la productividad en las empresas, sobre todo la medición y la mejora de la productividad desde el punto de vista del factor humano.
La revisión bibliográfica realizada para contextualizar la presente tesis muestra que existe una extensa literatura sobre la definición de productividad, la evolución del término con el tiempo, factores que inciden en la misma, distintas formas de medirla, distintas clasificaciones de las definiciones de productividad, etc. Se ha realizado una importante búsqueda y una profunda clasificación de la misma y se ha refutado alguna afirmación al respecto.
Inicialmente la presente tesis se centra en identificar la situación de diferentes sectores de la Comunidad Valenciana en cuanto a productividad, métodos, técnicas y herramientas utilizadas para medir la misma, para lo cual se ha realizado un profundo estudio en dos sectores: luminarias y automoción. Para ello se ha realizado encuestas a empresas de ambos sectores. Se muestran los resultados tanto cualitativos como cuantitativos. De dicho estudio se extraen conclusiones interesantes, cómo son, entre otras: que distintos sectores tienen distintas necesidades, se utilizan distintas herramientas dependiendo del sector o que las mismas herramientas se utilizan para diferentes finalidades.
También se ha querido apoyar estos estudios con una profunda revisión de las tablas de suplementos de descanso de la Organización Internacional del Trabajo, tarea que ha sido realizado por la autora de la presente tesis apoyándose en el trabajo de expertos en la materia. Para reforzar este último punto se han realizado entrevistas a cronometradores expertos, para ver las deficiencias encontradas en los estudios realizados en las empresas y cuáles son las causas. / [CAT] Un dels majors reptes de les empreses des dels seus inicis ha sigut millorar la productivitat a través de l'eficiència en tots els seus processos, especialment en els processos productius. Per a això, ha utilitzat distintes metodologies, sent l'estudi de mètodes i temps una poderosa ferramenta per a la millora de la productivitat en les empreses, sobretot el mesurament i la millora de la productivitat des del punt de vista del factor humà.
La revisió bibliogràfica realitzada per a contextualitzar la present tesi mostra que hi ha una extensa literatura sobre la definició de productivitat, l'evolució del terme amb el temps, factors que incidixen en la mateixa, distintes formes de mesurar-la, distintes classificacions, etc. S'ha realitzat una important recerca i una profunda classificació de la mateixa i s'ha refutat alguna afirmació al respecte.
Inicialment la present tesi se centra a identificar la situació de diferents sectors de la Comunitat Valenciana quant a productivitat, tècniques i ferramentes utilitzades per a mesurar la mateixa, per a la qual cosa s'ha realiztat un profund estudi en dos sectors: lluminàries i automoció. Per a això s'ha realitzat enquestes a empreses d'ambdós sectors. Es mostren els resultats tan qualitatius com quantitatius. Del dit estudi s'extrauen conclusions interessants, com són, entre altres: que distints sectors tenen distintes necessitats, s'utilitzen distintes ferramentes depenent del sector o que les mateixes ferramentes s'utilitzen per a diferents finalitats.
També s'ha volgut recolzar estos estudis amb una profunda revisió de les taules de suplements de descans de l'Organització Internacional del Treball, treball que ha sigut realitzada per l'autora de la present tesi recolzant-se en el treball d'experts en la matèria. Previous issue date: 2009-03-05 / Financiadora de Estudos e Projetos / OBJECTIVE: To translate and culturally adapt the Need for Recovery Scale (NFR) to Brazilian Portuguese and to assess the psychometric properties of the Brazilian version among industrial workers. METHODS: The translation process followed a guideline for cultural adaptation of questionnaires, which included the stages of translation, synthesis, back-translation, committee review and pretesting. The NFR Portuguese final version (Br-NFR) was evaluated regarding reliability by tests of stability (n=52) and internal consistency (n=192); convergent validity by simultaneously assessment with other instruments: the Borg Scale (n=59); the Chalder Fatigue Questionnaire (n=57) and 3 subscales of the SF-36 (n=56). RESULTS: Stability and internal consistency achieved the criterion for a reliable measure (ICC=0.80 and Cronbach s α =0.87, respectively). The convergent validity between Br-NFR and other instruments also showed good results: Borg Scale (r=0.64); Chalder Questionnaire (r=0.67); SF-36 subscales: Vitality (r=-0.84), Physical Functioning (r=-0.54), and Role- Physical (r=-0.47). CONCLUSIONS: The Br-NFR revealed to be a reliable instrument to evaluate work-related fatigue symptoms in industrial workers. Furthermore, it showed significant and good correlations with accepted
instruments in the field like the Borg Scale, the Chalder Questionnaire and SF-36 Vitality subscale, providing support for the validity of the scale. / OBJETIVO: Traduzir e adaptar culturalmente a Need for Recovery Scale (NFR) para a Língua Portuguesa do Brasil e investigar os parâmetros psicométricos da versão Brasileira em trabalhadores industriais. MÉTODOS: A tradução da escala seguiu um guia para adaptações culturais de questionários, que envolveu as etapas de tradução, síntese, tradução reversa, revisão por Comitê e pré-teste. A versão final em Português da escala (Escala de Necessidade de Descanso - ENEDE) foi avaliada quanto a confiabilidade pelos testes de
estabilidade (n=52) e consistência interna (n=192) e quanto a validade convergente em avaliações simultâneas com outros instrumentos: Escala de Borg (n=59), Questionário de Fadiga de Chalder (n=57) e 3 Escalas do SF-36 (n=56).RESULTADOS: A estabilidade e consistência interna da escala atingiram o critério de medida confiável (ICC=0.80 e α de Cronbach=0.87,
respectivamente). A validade convergente entre a ENEDE e os outros instrumentos também apresentaram bons resultados: Escala de Borg (r=0.64); Questionário de Fadiga de Chalder (r=0.67); escalas do SF36: Vitalidade (r=-0.84), Capacidade Funcional (r=-0.54) e Aspectos Físicos (r=-0.47). CONCLUSÕES: A ENEDE apresentou boa confiabilidade para avaliação de sintomas de fadiga relacionada ao trabalho em trabalhadores industriais. Além disto, a ENEDE também apresentou correlações satisfatórias e significativas com outros instrumentos aceitos pela literatura, como a Escala de Borg, o Questionário de Chalder e a Escala Vitalidade do SF-36, que fornecem suporte para a sua validade.

La importancia de la Jornada Atípica Acumulativa en la minería en nuestro país radica en que facilita mayores niveles de producción y utiliza para ello la fuerza laboral de los trabajadores mineros en ciclos de trabajo (o también llamados sistemas de trabajo) que consisten en períodos acumulativos de trabajo y que son compensados también con períodos acumulativos de descanso, pero para ello debe cumplirse con diversos parámetros constitucionales (Constitución Política de 1993, Sentencias del Tribunal Constitucional y Convenio 01 de la Organización Internacional del Trabajo - OIT) así como con diversos parámetros legales (TUO de la Ley de Jornada y su Reglamento, Consolidación de los Descansos Remunerados y su Reglamento) y otros parámetros interpretativos sumamente importantes (Directivas e Informes del Ministerio de Trabajo – MTPE). De contar con dichos parámetros la jornada atípica acumulativa en la minería será constitucionalmente y legalmente válida.
Más, luego de precisar la constitucionalidad y legalidad de este tipo de jornada de trabajo, corresponde ahora definir algunos aspectos importantes de casuística respecto al cálculo de la Jornada Atípica Acumulativa en la Minería que servirán para despejar algunas dudas en este tema poco estudiado aún en el Derecho Laboral y en el Derecho Minero. Y finalmente corresponde desarrollar una propuesta normativa que regule todos los aspectos necesarios para la aplicación de este tipo especial de jornadas de trabajo. / The importance of Atypical Cumulative Working Day in mining in our country is that it facilitates increased production and uses for this labor force miners to work cycles (also called work systems) consisting of periods cumulative work and are also offset by cumulative periods of rest, but this should be met with various constitutional parameters (1993 Constitution, Constitutional Court rulings and Convention 01 of the International Labour Organization - ILO) as well as various legal parameters (Journey Act and Regulations, Consolidation of Remunerated Breaks and Regulations) and other highly important interpretative parameters (Directives and Reports of the Ministry of Labour - MLEP). Moreover, after specifying the constitutionality and legality of this type of working day, it is now necessary to define some important aspects of casuistry regarding the calculation of the Cumulative Atypical Working Day in Mining that will serve to clear up some doubts in this little studied subject still in the Labor Law and Mining Law. And finally it corresponds to develop a normative proposal that regulates all the necessary aspects for the application of this special type of working days. / Tesis
