Direito e educação: possibilidades e entraves de aprendizagem dialógica em empresa jurídica

Realizado em uma empresa jurídica, teve como enfoque central a relação entre as pessoas situadas em seus “nichos” de trabalho e sua forma de aprender uma nova cultura. Os principais autores que embasaram o estudo foram: Paulo Freire, Terezinha Azeredo Rios, Boaventura de Sousa Santos, Sérgio Vasconcelos, Léa das Graças Camargo Anastasiou, Maria Isabel Cunha, Jorge Larossa Bondía, Marilena Chauí e Heloisa Lück. A metodologia utilizada teve enfoque qualitativo, descritivo, etnográfico, uma vez que acompanhou com observações e registros todas as etapas do processo vivido; utilizou-se também, para ouvir os sujeitos ao final do processo, de entrevistas por e-mail. Os resultados demonstraram o potencial da metodologia dialógica-participativa, especialmente na melhor integração da equipe e na troca de informações, qualificando o trabalho e o atendimento ao cliente. Habilidades como autonomia e autoria, construídos coletivamente, foram destacadas pelos sujeitos. Por outro lado, entraves técnico-políticos também foram identificados, especialmente porque o trabalho provocou algumas mudanças na cultura da empresa, nem sempre almejadas por todos. Concluiu-se que por melhores resultados que um trabalho desta natureza traga, exige continuidade e, fundamentalmente, mudanças de concepções, para que se consolide com uma prática efetiva. / This research work analyzes the implications, barriers and advances, a process of building a dialogic - participatory methodology implemented in a space where it was unknown.Held in a legal firm, had as its central focus the relationship between people located in its " niche" and work your way to learn a new culture. The main authors that supported the study were: Paulo Freire, Azeredo Terezinha Rios, Boaventura de Sousa Santos, Sergio Vasconcelos, Léa das Graças Camargo Anastasiou, Maria Isabel Cunha, Jorge Larossa Bondia, Marilena Chauí and Heloisa Lück .The methodology used was qualitative approach, descriptive, ethnographic, as accompanied with observations and records all stages of the living process; we used also, to hear the subject at the end of the process, interviews via email. The results demonstrated the potential of the dialogic - participatory methodology, especially in better integration of staff and exchange of information, describing the work and customer service. Skills such as autonomy and authorship, collectively built, were highlighted by the subjects. On the other hand, technical and political obstacles have also been identified, especially because the work has caused some changes in the company's culture, not always almejadas by all. It was concluded that for better results that a work of this nature bring, requires continuity and fundamentally changing conceptions, that is consolidated with an effective practice.

nÃo hà / A compreensÃo dos aspectos biopsicossociais dos sujeitos que buscam atenÃÃo em saÃde surge como carÃter atrelado a uma boa prÃtica. Nesse contexto apresentamos a prÃtica do profissional fisioterapeuta cuja formaÃÃo apresenta resquÃcios da concepÃÃo biomÃdica de educaÃÃo em saÃde caracterizada pelo forte enfoque na doenÃa em detrimento do sujeito que a apresenta. Consideramos a relaÃÃo dialÃgica que ocorre durante o atendimento fisioterapÃutico elemento importante na mediaÃÃo para a compreensÃo da integralidade do sujeito-paciente. A pesquisa A relaÃÃo dialÃgica na prÃtica clÃnica do profissional fisioterapeuta e a visÃo integral do sujeito-paciente, tem como objetivo compreender como ocorre a comunicabilidade relacional dialÃgica na prÃtica desse profissional de Fisioterapia visando a identificaÃÃo de aspectos subjetivos e objetivos que estabelecem uma visÃo integral do sujeito-paciente. Ã, portanto, uma pesquisa cientÃfica do tipo qualitativa com abordagem fenomenolÃgica hermenÃutica dialÃtica. O campo de pesquisa foi a Universidade de Fortaleza â UNIFOR. As fontes utilizadas na pesquisa foram: fisioterapeutas egressos da UNIFOR, coordenadora do curso de Fisioterapia da referida instituiÃÃo e documentos oficiais que regem a profissÃo. As tÃcnicas de coleta de evidÃncias foram: anÃlise documental e entrevista reflexiva. Os resultados da pesquisa indicam que o diÃlogo que acontece durante a prÃtica clÃnica em Fisioterapia configura-se momento que favorece a compreensÃo do sujeito-paciente e seu contexto. PorÃm, tal compreensÃo nÃo supera a importÃncia que o componente fÃsico estabelece durante o tratamento. Assim, com vistas à reabilitaÃÃo do sujeito-paciente, o fisioterapeuta lanÃa mÃo de conhecimentos tÃcnicos cientÃficos para tal fim. A tese inicial proferida: na relaÃÃo fisioterapeuta/sujeito-paciente, hà indÃcios da valorizaÃÃo da intersubjetividade com forte presenÃa de condutas clinicas que privilegiam o corpo fÃsico nÃo ocorrendo uma comunicabilidade que supere a dicotomia corpo/mente, foi parcialmente confirmada pelos dados e anÃlises realizadas. ConcluÃmos que os discursos dos sujeitos desta pesquisa anunciaram uma conscientizaÃÃo acerca da compreensÃo dos aspectos subjetivos dos sujeitos-pacientes evidenciando ainda a importÃncia da perspectiva da visÃo integral dos mesmos a partir da intersubjetividade. Constatamos, portanto, nÃo apenas indÃcios e sim afirmaÃÃes acerca de que somente a utilizaÃÃo de condutas voltadas para a funcionalidade nÃo dà conta da demanda do cuidar no Ãmbito da prÃtica em Fisioterapia e que a comunicabilidade exercida durante a prÃtica clÃnica promove o desenvolvimento da compreensÃo das dimensÃes biopsicossocial daquele que busca tratamento. / Understanding the biopsychosocial aspects of the subjects who seek health care emerges as a character tied to good practice. In this context we present the practice of physiotherapist whose training has remnants of biomedical conception of health education characterized by strong focus on disease rather than the subject that presents. We consider the dialogic relationship that occurs during physical therapy important element in mediation for understanding the entirety of the subject-patient. The research The dialogical relationship in clinical practice of the physiotherapist and the full view of the subject-patient, aims to understand how does the dialogic relational communicability in practice this professional physiotherapy for the identification of subjective and objective aspects that establish a comprehensive view of the subject -patient. It is therefore a scientific qualitative study with a phenomenological hermeneutic dialectic approach. The research field is the University of Fortaleza - UNIFOR. The sources used in the research were: graduates of UNIFOR physiotherapists, physiotherapy course coordinator of that institution and official documents governing the profession. Evidence collection techniques were: document analysis and reflective interview. The survey results indicate that the dialogue that happens during clinical practice in Physiotherapy set up time that favors the understanding of the subject-patient and their context. But this understanding does not outweigh the importance of the physical component sets during treatment. Thus, with a view to rehabilitating the subject-patient, the therapist makes use of scientific expertise for this purpose. The given initial thesis: the physiotherapist relationship / subject-patient, there is evidence of the appreciation of intersubjectivity with a strong presence of clinical behaviors that favor the physical body is not experiencing a communicability that overcomes the body dichotomy / mind, was partially confirmed by the data and analyzes. We conclude that the speeches of the subjects of this research announced an awareness of the understanding of the subjective aspects of the subjects-patients still showing the importance of the perspective of integral vision of the same from the intersubjectivity. We note, therefore, not only evidence but statements about that only the use of targeted behavior for functionality not cope with the demand of care within the practice in Physiotherapy and communicability exercised during clinical practice promotes the development of understanding of biopsychosocial dimensions of those who looks for treatment.

THE EFFECTIVENESS OF DIALOGIC RELATIONSHIP ON THE MILITARY-PUBLIC RELATIONSHIP

This study investigates the influence of dialogic relationship and organizational cultures on the military-public relationship. College students (N=218) participated in a 2 x 2 (dialogic relationship: high vs. low x organizational culture: military vs. civilian) independent groups factorial quasi-experiment. To induce dialogic relationship, two versions of the U.S. Army internet webpage screenshots were created. Organizational culture was controlled by purposive sampling two groups of military and civilian subjects. The results indicate that dialogic relationship and organizational culture combine exerts an effect on the military-public relationship by increasing perceptions of control mutuality, trust, commitment and communal relationship for civilians but not the military. In addition to its theoretical contributions, the results of this study have important practical implications for the military public affairs.

Attention-deficit-hyperactivity disorder (ADHD) describes children that show inappro-priate behaviour in two categories, i.e. 1) Inattention and 2) Hyperactivity-impulsivity and which are maladaptive and inconsistent with their developmental level. ADHD impacts the whole life of a child diagnosed with it. One of these areas that is impacted is the relationship between child and parent. As found in a thorough literature study, much research has been done on the relationship between parents and their children diagnosed with ADHD. No research has been done on parents’ experience of the dialogic relationship, according to the Gestalt theory, with their children that are diagnosed with ADHD. The dialogic relationship was research specifically in the context of the five principles of the dialogic relationship, i.e. inclusion, presence, confirmation, commitment to dialogue and non-exploitation. In this qualitative study nine parents’ experience of their dialogic relationship with their child in the middle childhood, diagnosed with ADHD was explored and described. A case study was used as research design to study how participants give meaning to the phenomenon that is being studied. Semi-structured interviews were conducted with seven mothers and two fathers after which data was thematically analysed. The trustworthiness of the study and ethical aspects applicable to the study were discussed and the limitations of the study were listed. It was found that parents apply inclusion and presence in their relationship with their child with ADHD. The application of confirmation and commitment to dialogue is a bigger challenge because the children’s behaviour results in parents reacting negatively rather than giving acknowledgement. Sometime it is difficult for parents to commit to the dialogue because the children withdraw from the interaction. Nesse contexto apresentamos a prática do profissional fisioterapeuta cuja formação apresenta resquícios da concepção biomédica de educação em saúde caracterizada pelo forte enfoque na doença em detrimento do sujeito que a apresenta. Consideramos a relação dialógica que ocorre durante o atendimento fisioterapêutico elemento importante na mediação para a compreensão da integralidade do sujeito-paciente. A pesquisa A relação dialógica na prática clínica do profissional fisioterapeuta e a visão integral do sujeito-paciente, tem como objetivo compreender como ocorre a comunicabilidade relacional dialógica na prática desse profissional de Fisioterapia visando a identificação de aspectos subjetivos e objetivos que estabelecem uma visão integral do sujeito-paciente. A tese inicial proferida: na relação fisioterapeuta/sujeito-paciente, há indícios da valorização da intersubjetividade com forte presença de condutas clinicas que privilegiam o corpo físico não ocorrendo uma comunicabilidade que supere a dicotomia corpo/mente, foi parcialmente confirmada pelos dados e análises realizadas. Concluímos que os discursos dos sujeitos desta pesquisa anunciaram uma conscientização acerca da compreensão dos aspectos subjetivos dos sujeitos-pacientes evidenciando ainda a importância da perspectiva da visão integral dos mesmos a partir da intersubjetividade. Constatamos, portanto, não apenas indícios e sim afirmações acerca de que somente a utilização de condutas voltadas para a funcionalidade não dá conta da demanda do cuidar no âmbito da prática em Fisioterapia e que a comunicabilidade exercida durante a prática clínica promove o desenvolvimento da compreensão das dimensões biopsicossocial daquele que busca tratamento.

Study analysis prove advances in medical and technology fields do not replace the doctor-patient relationship. Such relationship is taken as a first and essential source to adhere to treatments, support to face the obstacles arising out of acute and chronic illnesses. We also discuss the Fritz Perls Gestalt-therapy approach, focusing on the theoretical scope of the individual relationship to its environment. The main concepts of the Gestalt-therapy are: contact, contact roles, contact limits, support and awareness, and they are part of men s relationship to his environment, favoring an integrative presence in the self and the world. We believe such approach may provide facilitating instruments to improve the quality of presence, hearing and integrating understanding of the doctor-patient relationship. Buber s Dialogic Relationship inserts the dialogue in the between and the alternation of the encounter. It indicates a therapeutic attitude based on Inclusion, Presence and Commitment to the dialogue, as well as the conditions required to have a high-quality encounter. Those are suggestions for a better clinical practice of the doctor-patient relationship / Por meio desse estudo sobre a relação médico-paciente, pretende-se usar uma revisão bibliográfica para obter um panorama histórico desde os primórdios da medicina, com foco na atitude da relação médico-paciente e a qualidade da escuta e presença diante da dor e sofrimento, até a atualidade. A análise dos estudos demonstrou que os avanços da medicina e da tecnologia não substituem a relação médico-paciente, considerada uma fonte primeira e fundamental para adesão de tratamentos, suporte para o enfrentamento das adversidades advindas das doenças agudas e crônicas. Apresenta-se a abordagem Gestalt-terapia de Fritz Perls com escopo teórico cuja ênfase é na relação do indivíduo com o seu meio, e uma abordagem que visa a relação. Os conceitos principais da Gestalt-terapia são: contato, funções de contato, fronteira de contato, suporte e awareness, e os conceitos são compreendidos na relação do homem com o seu meio, favorecendo uma presença integrativa no seu ser e estar no mundo. Acredita-se que essa abordagem pode oferecer instrumentos facilitadores para a qualidade na presença, escuta e compreensão integrativa da relação médico-paciente. A Relação Dialógica de Buber insere o diálogo no entre e na alteridade do encontro. Apresenta uma Atitude terapêutica com base na Inclusão, Presença e Compromisso com o Diálogo, bem como condições necessárias para estabelecer um encontro de qualidade, caminhos sugeridos para uma melhor prática clínica na relação médico-paciente

A qualitative with quantitative data survey was delineated having interpretative and descriptive aspects through which a content analysis was planned Bardin and carried out with 186 students majoring engineering, mathematics, physics and chemistry enrolled in a Public Federal University. The data collection was done through three different approaches, the first and the second revealed subjective hypothesis identified from the investigated subjects talk, and the third, conducted by representations shown in Initial Concept Maps. It was concluded that the experience in Calculus 1 classes has been of reciprocity, in a two-way action that includes contents and subjects of the experience; of singleness, by the subjectivity and identity of each subject; of unpredictability, by the uncertainties, dangers and possibilities of the experience; of temporality, because it dispenses the recognition of distinct time and space to the subjects of the experience. The investigated subjects showed aspects apparently contradictory that however, denoted complementarities. They showed that students who had a weaker base in mathematics reached as many positive results as the negative ones, and that personal goals contributed to the adaptation and development in the school subject, showing aspects of co-responsibilities although they were not the same among the subjects, revealing marks of a process particular in choices as well. Yet, it was highlighted that the strengthening of the transparency mechanism and institutional communication could contribute to the process of development of those subjects. Facing Calculus 1, the students showed emotions, feelings. Facing the derivative they were incipient. However, they revealed marks of experiences that consolidate themselves in the construction of knowledge / Com o objetivo de apontar possibilidades de experiências de estudantes em aulas de Cálculo 1, especificamente, em relação ao conteúdo Derivada, as escolhas teóricas foram conduzidas em torno da relação dialógica de Buber, a relação inter-humana, também das escolhas que conduzem a vida humana Bauman e May e da dimensão da experiência de Larrosa, o campo de subjetividades no qual se assenta a problemática do Cálculo 1. Delineou-se uma pesquisa qualitativa com dados quantitativos, com aspectos interpretativos e descritivos, por meio dos quais se planejou uma análise de conteúdo constituída junto a 186 estudantes de cursos de Engenharias e Licenciaturas, matriculados em uma Universidade Pública Federal. A coleta de dados ocorreu em três abordagens, sendo a primeira e segunda reveladoras de hipóteses subjetivas identificáveis a partir dos relatos dos sujeitos investigados, e a terceira, conduzida por representações exteriorizadas em Mapas Conceituais Iniciais. Concluiu-se que a experiência em aulas de Cálculo 1 tem sentidos de reciprocidade, na ação de mão dupla que engloba conteúdos e sujeitos da experiência; de unicidade, pela subjetividade e identidade de cada sujeito; de imprevisibilidade, pelas incertezas, perigos e possibilidades da experiência; de temporalidade, pois prescinde o reconhecimento de tempos e espaços distintos aos sujeitos da experiência. Os sujeitos investigados deixaram transparecer aspectos aparentemente contraditórios, que, todavia, denotaram complementaridades. Apontaram que estudantes com uma base mais fraca em Matemática alcançaram tanto resultados positivos quanto negativos, e que buscas pessoais contribuíram em favor da adaptação e desenvolvimento na disciplina, demonstrando aspectos de corresponsabilidades, embora não unânimes entre os sujeitos, revelando também marcas de um processo particular de escolhas. Ainda, evidenciou-se que o fortalecimento de mecanismos de transparência e de comunicação institucionais pode contribuir para o processo de formação desses sujeitos. Diante do Cálculo 1, os estudantes revelaram emoções, sentimentos. Diante da Derivada se mostraram incipientes, entretanto, revelaram marcas de experiências que se consolidam na construção desse conhecimento
