Disproportionality in NHS Disciplinary Proceedings

Yes / This article investigates the representation of black, Asian and minority ethnic staff in NHS disciplinary proceedings. The study involved an in-depth knowledge review and analysis of literature on the representation of black, Asian and minority ethnic staff in NHS disciplinary proceedings from 2008 to 2017, as well as semi-structured interviews with 15 key stakeholders. Participants were stakeholders from both primary and secondary care and included equality and diversity leads, human resource professionals, NHS service managers, representatives of trade unions and health professional regulatory council representatives. The knowledge review indicates that to date, black, Asian and minority ethnic staff are disproportionately represented in NHS disciplinary proceedings. Evidence gathered demonstrates the continuation of inappropriate individual disciplinary action and failure to address organisational shortcomings against black, Asian and minority ethnic members of staff. Overall, six factors were identified as underpinning the disproportionate representation of black minority ethnic staff in disciplinaries: closed culture and climate; subjective attitudes and behaviour; inconclusive disciplinary data; unfair decision making; poor disciplinary support; and disciplinary policy misapplication.

1 Legal Status of Judges in the Czech Republic - Disciplinary Liability Summary This diploma thesis focuses on the disciplinary liability of judges in the Czech Republic. The introduction of the thesis describes judiciary legislation and the individual responsibilities of a judge in performing judicial duties. The next part defines disciplinary liability and its legal nature and it also mentions the relationship of liability for damages and disciplinary liability. The third part focuses on the course of disciplinary proceedings and the structure of the disciplinary court that deals with disciplinary offences. Next, the fourth part offers a practical view on the individual disciplinary offences. The final part describes disciplinary measures and concentrates on one of them in particular - the concept of complaints of minor imperfection. The conclusion summarizes the findings and provides a comprehensive overview of the disciplinary liability of judges in the Czech Republic. A Qualitative Study of How Students Experienced Exclusionary Discipline Practices

As a result of zero tolerance policies, a significant percentage of students who experience exclusions from schools also experience negative outcomes such as high dropout rates, academic failures, and encounters with juvenile justice agencies. While several researchers have found a relationship between unintended consequences of exclusions and juvenile delinquency, few have examined this phenomenon from the perspectives of juveniles who experienced exclusions. Guided by the framework of operant conditioning, the purpose of this phenomenological study was to understand how students experienced exclusions from school. Purposive sampling was used to recruit participants who experienced both exclusions from schools and involvement with juvenile delinquency. Of the 30 potential participants who initially agreed to participate in the study, 26 actually participated. Data collection and analysis included capturing and grouping emerging themes and patterns from face-to-face interviews and observations that revealed the essence of how juveniles experienced exclusions from schools. According to participants, failure on the part of administrators to listen to their accounts of events that led to referrals for disciplinary action resulted in avoidable suspensions. Participants' narratives further highlighted the prevalence of disruptive behavior in schools throughout the United States. School administrators and policy makers should not only use data from this qualitative study to inform disciplinary policies and practices, but they should also consider input from students and other community stakeholders who are impacted by those decisions. These findings will promote the understanding that effective disciplinary practices are needed to meet the educational needs of all students. Even participants in this study were concerned about the impact that suspensions had on their education.

Using a Social Semiotic Perspective to Inform the Teaching and Learning of Physics

This thesis examines meaning-making in three different areas of undergraduate physics: the refraction of light; electric circuits; and, electric potential and electric potential energy. In order to do this, a social semiotic perspective was constituted for the thesis to facilitate the analysis of meaning-making in terms of the semiotic resources that are typically used in the teaching and learning of physics. These semiotic resources include, for example, spoken and written language, diagrams, graphs, mathematical equations, gestures, simulations, laboratory equipment and working practices. The empirical context of the thesis is introductory undergraduate physics where interactive engagement was part of the educational setting. This setting presents a rich data source, which is made up of video- and audio recordings and field notes for examining how semiotic resources affect physics teaching and learning. Theory building is an integral part of the analysis in the thesis, which led to the constitution of a new analytical tool – patterns of disciplinary-relevant aspects. Part of this process then resulted in the development of a new construct, disciplinary affordance, which for a discipline such as physics, refers to the inherent potential of a semiotic resource to provide access to disciplinary knowledge. These two aspects, in turn, led to an exploration of new empirical and theoretical links to the Variation Theory of Learning. The implications of this work for the teaching and learning of physics means that new focus is brought to the physics content (object of learning), the semiotic resources that are used to deal with that content, and how the semiotic resources are used to create patterns of variation within and across the disciplinary-relevant aspects. As such, the thesis provides physics teachers with new and powerful ways to analyze the semiotic resources that get used in efforts to optimize the teaching and learning of physics.

Infant care is an essential part of the healthcare industry and an aspect of healthcare where the multi-disciplinary teams work closely together. Within this collaboration of teams, the term "infant wellbeing" is frequently used. Yet even though wellbeing on its own is a multi-faceted concept, when pertaining to the infant, this concept can become very complex and difficult to understand and apply. Dictionary definitions of wellbeing emphasize a state of being healthy, happy or prosperous. However, despite its common-sense appeal, it was found that the term wellbeing is not a particularly well- defined outcome, especially in reference to the infant. Despite the fact that scrutiny of the literature indicated that the term "infant wellbeing" is used by different members of the multi-disciplinary team, a clear concise universal definition for healthcare settings and professionals is missing from published literature. In fact, no recorded definition for the concept was to be found. Consequently, the aim of this study was to develop an operational definition for the concept "infant wellbeing" that can be used congruently between different members of the multi-disciplinary team. This is done by means of a concept analysis as described by Walker and Avant (2014). The findings revealed that the infant consists of certain dimensions which all play a role in the infant's wellbeing. Equally the infant also functions within a certain system or domain which also affects the wellbeing of the infant. These aspects are discussed in detail. Reflecting on multi-, inter- and trans-disciplinary (MIT) research at the Central University of Technology, Free State (CUT)

Published Article / In their research as well as their teaching, universities of technology (UoTs) expect to be infused by the application of technology and to be integrally related to the world of work. At the same time, research at UoTs is characteristically innovatory, in the specific sense of transforming research discoveries into products or services that are user-oriented and commercially viable. Since practical problems and user needs do not respect disciplinary boundaries it follows, firstly, that such research at a UoT will in some sense not respect disciplinary boundaries, i.e. it will have to connect, cross, or integrate traditional disciplines. This paper seeks accordingly conceptually to differentiate the relevant senses of multi-, inter- and trans-disciplinary (MIT) research. It then characterises the fourteen current research programmes at Central University of Technology (CUT) in these regards, comparing the findings from interviews with the programme leaders with the insights of the authors. Secondly, in that most research at UoTs is also expected to be innovatory, it is demanded of researchers that they also master the skill of researching the feasible applications of findings, developing products, and envisaging commercialisation; and handing the stakeholder relationships that arise in these interactions. The interviews further indicate the extent to which the respective programmes have moved down the MIT road. They also reveal that the challenges that are faced by the programmes are overwhelming generic rather than specifically MIT-related. Some strategic recommendations are extracted from the findings.

Development of a novel method for cross-disciplinary hazard identification

Hazards and risks are currently identified in generic risk silos using top-down tools and methods which are incorporated into whole system risk management frameworks such as enterprise risk management. The current methods of identification and documentation are linear in approach and presentation. However, the world is multi-dimensional requiring a method of identification which responds to complex non-linear relationships. A method is required to identify cross- disciplinary hazards and formulate a register method to evidence the identified hazards. This study uses expert elicitation, web, survey and case studies to develop a method for cross-disciplinary hazard identification by application of the dimensions of generic, interface, causation and accumulation. The results of the study found many of the tools and methods used for hazard and risk identification such as hazard and operability studies took a top down approach commencing with a known failure and establishing cause and effect. The starting position of a known failure or event precludes identification of new types of failure or events and perpetuates a linear approach to hazard identification. Additionally the linear design of a risk register does not facilitate the presentation of multidimensional hazards. The current methods do not accommodate multiple lifecycles and components within cross discipline relationships. The method was applied to three case studies. The first case study had an existing risk register of 50 risks, post method application an additional 531 hazards were identified; case study (2) a register of 49 hazards and post method application additional hazards of 261; case study (3) an initial register of 45 hazards and an additional 384 hazards after method application. The impact of the method application highlights inconsistencies in the initial risk register and provides a tool which will aid the identification understanding and communication of hazards. Additionally it documents previously unidentified cross-disciplinary hazards and provides a proactive register method for identification and documentation by application of the dimensions of interface, causation and accumulation.

This diploma thesis deals with various aspects of the status of a judge as it is stated in the Czech legal order. Firstly, author focuses on the formation of the office of a judge. There is also described controversial approach of the former president of the Czech Republic Václav Klaus on the appointment of new young judges. Final part of the chapter deals with comparison with the United Kingdom in the way of becoming the judge. In the next chapter, there are described particular duties arising from the Czech legislation. Attention is focused on preserving the dignity of the judicial function, confidentiality and maintaining a certain standard of professionalism The section dealing with duration of the status ends with third chapter relating to a termination of the office of a judge. There are mainly described legal terms that could be confusing, because they sound similar, but have different meaning. At the end of this part, author discusses the age limits for termination of the office of the judge. Next chapter analyze guarantees of independence and impartiality of the judge. Those are an essential part of just decisions of the courts. Major part deals with disciplinary proceedings and its procedure. The fifth chapter deals with specific issues of the office the judge.
