Disproportionality in NHS Disciplinary Proceedings

Yes / This article investigates the representation of black, Asian and minority ethnic staff in NHS disciplinary proceedings. The study involved an in-depth knowledge review and analysis of literature on the representation of black, Asian and minority ethnic staff in NHS disciplinary proceedings from 2008 to 2017, as well as semi-structured interviews with 15 key stakeholders. Participants were stakeholders from both primary and secondary care and included equality and diversity leads, human resource professionals, NHS service managers, representatives of trade unions and health professional regulatory council representatives. The knowledge review indicates that to date, black, Asian and minority ethnic staff are disproportionately represented in NHS disciplinary proceedings. Evidence gathered demonstrates the continuation of inappropriate individual disciplinary action and failure to address organisational shortcomings against black, Asian and minority ethnic members of staff. Overall, six factors were identified as underpinning the disproportionate representation of black minority ethnic staff in disciplinaries: closed culture and climate; subjective attitudes and behaviour; inconclusive disciplinary data; unfair decision making; poor disciplinary support; and disciplinary policy misapplication.

Právní postavení soudce v České republice / Legal position of a judge in the Czech Republic

This diploma thesis deals with various aspects of the status of a judge as it is stated in the Czech legal order. Firstly, author focuses on the formation of the office of a judge. There is also described controversial approach of the former president of the Czech Republic Václav Klaus on the appointment of new young judges. Final part of the chapter deals with comparison with the United Kingdom in the way of becoming the judge. In the next chapter, there are described particular duties arising from the Czech legislation. Attention is focused on preserving the dignity of the judicial function, confidentiality and maintaining a certain standard of professionalism The section dealing with duration of the status ends with third chapter relating to a termination of the office of a judge. There are mainly described legal terms that could be confusing, because they sound similar, but have different meaning. At the end of this part, author discusses the age limits for termination of the office of the judge. Next chapter analyze guarantees of independence and impartiality of the judge. Disrupting disproportionality proceedings: The recommendations

Yes / An in-depth knowledge review and analysis of literature on the involvement of Black and Minority Ethnic (BAME) staff in NHS disciplinary proceedings from 2008 to 2017 as did 15 semi-structured interviews with key stakeholders. The research findings indicate that BME staff are disproportionately represented in NHS disciplinary proceedings, there is a continuation of inappropriate individual disciplinary action and a failure to address organisational shortcomings. Six factors emerged: closed culture and climate; subjective attitudes and behaviour; inconclusive disciplinary data; unfair decision making; poor disciplinary support and disciplinary policy mis-application were all identified as underpinning the disproportionate representation of BME staff in disciplinary procedures. Disciplinary policy needs streamlining and greater clarity needs to be achieved regarding the difference between disciplinary, capability and performance issues and to this respect we make several recommendations.

1 Legal Status of Judges in the Czech Republic - Disciplinary Liability Summary This diploma thesis focuses on the disciplinary liability of judges in the Czech Republic. The introduction of the thesis describes judiciary legislation and the individual responsibilities of a judge in performing judicial duties. The next part defines disciplinary liability and its legal nature and it also mentions the relationship of liability for damages and disciplinary liability. The third part focuses on the course of disciplinary proceedings and the structure of the disciplinary court that deals with disciplinary offences. Next, the fourth part offers a practical view on the individual disciplinary offences. The final part describes disciplinary measures and concentrates on one of them in particular - the concept of complaints of minor imperfection. The conclusion summarizes the findings and provides a comprehensive overview of the disciplinary liability of judges in the Czech Republic. La juridictionnalisation des procès de l'exécution des peines / Jurisdictionalisation of enforcement of the sentences proceedings

En droit de l’exécution des peines, deux procès essentiels peuvent se jouer pour le condamné : le procès disciplinaire et le procès d’application des peines. En dépit du clivage droit privé-droit public qui les caractérise, ces deux procès se sont inscrits ces dernières années dans une même logique juridictionnelle. Souvent envisagés de manière distincte, l’intérêt de notre étude sera de démontrer qu’au delà du polymorphisme du droit et des organes juridictionnels ou non juridictionnels auxquels ces procès se rattachent, ces derniers ont connu une évolution concomitante en termes de reconnaissance de garanties procédurales. Ainsi, aujourd’hui, on peut affirmer qu’un véritable droit commun de l’exécution des peines est né. Néanmoins, ce tronc commun présente encore de nombreuses insuffisances au regard des principes qui doivent caractériser un procès équitable (indépendance, impartialité, publicité...). Malgré cela, les juridictions françaises refusent toujours de reconnaître l’applicabilité de certains principes supra-législatifs au milieu carcéral en se fondant sur des critères qui leur sont propres et sur une qualification erronée du contentieux disciplinaire. Dès lors, cette étude se propose de mettre en exergue la véritable qualification "pénale" de ce contentieux et prône le principe d’unicité de l’action répressive. De ce fait, il s’agira de déterminer l’organe le mieux à même de protéger les droits des condamnés. Se posera alors la question de l’hypothèse d’un procèscommun par la prise en compte du lien existant entre les procès de l’exécution des peines au travers des retraits de réductions de peine / In the law of enforcement of the sentences, two essential proceedings are at stake for the sentenced person : the disciplinary proceeding and the enforcement proceeding. In recent years and despite the division between private law and public law that characterizes them, these proceedings have come within the framework of a unique jurisdictional logic. Although they are often envisaged as different, the interest of this study is to demonstrate that beyond the polymorphism of the law, on the one part,and the jurisdictional and non jurisdictional organs to which these proceedings are connected, on the other part, the last ones have known a concomitant evolution in terms of recognition of procedural safeguards. Thus, today, we can assert that a real general law of enforcement of the sentences was born. Nevertheless, this common-core syllabus still shows numerous inadequacies towards the principles which must characterize a fair trial (independence, impartiality, public hearing…). In spiteof this, French courts still refuse to admit the applicability of certain supra-legal principles in prison environment, basing themselves on proper criteria and on an erroneous legal definition of disciplinary proceedings. Therefore, this study intends to underline the real criminal definition of these proceedings and advocates the principle of unity of law enforcement. As a matter of fact, the question is to determine the organ best to protect the rights of the sentenced person. Supervision in notarial self-government Abstract The diploma thesis deals with the topic of supervision in notary self-government. The aim of this work is to develop a comprehensive overview of supervision, its types and course in the notarial state. This overview also includes the sanction phase of supervision, in which corrective measures for identified errors are examined. In addition, the work aims to examine the functionality of the current form of supervision, draw attention to its shortcomings and outline possible solutions. All this on the basis of available literature, professional articles, legal regulations and especially the case law of higher courts. This work is divided into six chapters, which logically follow each other. The introductory chapter, which deals with the institute of self-government, is focused mainly on the self-government of professional, public corporations and professional chambers for a better anchoring of the institute of supervision in notarial self-government. Análise dos processos administrativos disciplinares e sindicâncias acusatórias da UFT nos anos de 2015 e 2016

O presente trabalho tem por propósito a análise dos processos disciplinares julgados pela Universidade Federal do Tocantins nos anos de 2015 e 2016. Levou-se em consideração para a pesquisa aqueles processos em que havia a possibilidade de aplicação de penalidades para os envolvidos. Portanto, foram incluídos na coleta de dados os Processos Administrativos Disciplinares do Rito Ordinário, que envolve a investigação de faltas mais graves; os de Rito Sumário, que envolvem a possível ocorrência dos ilícitos de acumulação ilegal de cargos, abandono de cargo ou inassiduidade habitual; a Sindicância Acusatória, que apura faltas leves; e, também, o processo disciplinar que tem como acusados discentes da UFT. O estudo do tema é atual e possui relevância não só para que se conheça a situação dos processos disciplinares pela comunidade acadêmica da UFT, servidores técnico-administrativos, professores e discentes, mas para toda a sociedade que tem o desejo de saber se os processos são regularmente julgados. A pesquisa baseou-se em informações repassadas pela Coordenação de Processos Disciplinares (CPAD) da UFT e, em seguida, após o recebimento de cópias digitais dos processos foram coletados dados das principais peças dos mesmos, tais como portaria de instauração, relatórios conclusivos das comissões, pareceres da Procuradoria Federal junto à UFT e decisões da autoridade instaurada para se verificar a ocorrência ou não do devido processo legal, conforme instituído na Lei nº 8.112/1990, bem como se os acusados tiveram seus direitos humanos resguardados, em especial o direito ao contraditório e a ampla defesa. Assim, a pesquisa buscou responder se os processos são eficientes e cumprem sua função social. O estudo, em sua primeira parte, traz a evolução do processo punitivo da Administração Pública a partir da redemocratização do Brasil com a Constituição de 1998. São explicados os procedimentos dos processos disciplinares em análise, os princípios aplicáveis e o papel da Procuradoria Federal no seu desfecho. Em seguida, são apresentados os dados coletados pela pesquisa a partir da análise dos autos dos processos. Posteriormente, os resultados encontrados foram expostos, demonstrando a falta de eficiência na resolução dos conflitos disciplinares da UFT, descumprindo, assim, a sua função social, inclusive, com ofensa a direitos fundamentais. No final, a pesquisa indica algumas possíveis soluções para o aperfeiçoamento do trâmite dos processos disciplinares e desenvolvimento dos membros envolvidos nas comissões, em especial, com recomendação para criação de Câmaras Permanentes de Processo Administrativo Disciplinar. / The purpose of this paper is to analyze the disciplinary processes judged by the Federal University of Tocantins in 2015 and 2016. Consideration was given to those processes in which there was the possibility of applying penalties to those involved. Therefore, it were included in the data collection the Disciplinary Administrative Procedures of the Ordinary Rite, which involves the investigation of more serious faults; those of Summary Rite, which involve the possible occurrence of illegal acts of illegal accumulation of positions, abandonment of office or habitual inassiduity; the Accusatory Syndication, which corrects minor offenses; and also the disciplinary process that has as accused students of UFT. The study of the subject is current and has relevance not only to know the state of the disciplinary processes by the academic community of the UFT, technical-administrative servants, teachers and students, but for the whole society that has the desire to know if the processes are regularly judged. The research was based on information provided by the Coordinating of Disciplinary Processes (CPAD) of the UFT and then, after the receipt of digital copies of the processes, data were collected from the main pieces of the them, such as introduction order, conclusive reports of the commissions , opinions of the Federal Attorney's Office and decisions of the established authority to verify the occurrence or not of due process, as established by Law nº. 8.112 / 1990, as well as whether the defendants had their human rights protected, in particular the right contradictory and ample defense. Thus, the research sought to answer if the processes comply are efficient and fulfill their social function. The study, in its first part, brings the evolution of the punitive process of Public Administration from the redemocratization of Brazil with the Constitution of 1998. The procedures of the disciplinary processes under analysis, the principles applicable thereto, and the role of the Federal Attorney's Office in its outcome. Next, the data collected by the survey are presented based on the analysis of the case files. Subsequently, the results were exposed, demonstrating the lack of efficiency in the resolution of the UFT's disciplinary conflicts, thus failing to fulfill its social function, even with an infringement of fundamental rights. In the end, the research indicates some possible solutions for the improvement of the process of disciplinary processes and the development of the members involved in the commissions, especially with recommendation for the creation of Permanent Chambers of Disciplinary Administrative Procedures.

It starts with the background of Due Process in the Brazilian legal and a brief historical description of the principle and its analysis, based on the phenomena of constitutionalization of the law. The study of administrative disciplinary proceedings is made, initially from the general approach of this process at the federal level, from the perspective of Law 8112/90, with the analysis of each of its phases, moving after, the study of principles that give concreteness to the Due Process of Law as well as the consequences of its impact on the process under study. The work contains, therefore, the study in furtherance of the principles of due process of law, namely: contradictory and full defense, natural judge, reasonableness and proportionality and, finally, a reasonable duration of proceedings. In items where the above principles are studied, sought to conceptualize them and examine its foundations, scope and direction in the processes of disciplinary sanctions in order to verify their impact in specific cases, as well as the understanding of the Superior Courts on the matter / O presente trabalho tem por objeto o estudo do devido processo legal e suas implicações no processo administrativo disciplinar. Parte-se da contextualização do Devido Processo Legal no ordenamento jurídico brasileiro e de uma breve descrição histórica do princípio e da sua análise, tomando por base o fenômeno da constitucionalização do Direito.
