Kroniskt sjuka och utvecklingen av digitaliseringen inom vården - En kvalitativ studie om hur äldre personer med kroniska sjukdomar upplever digitalisering.

The increased influence of digitalizing in the Swedish healthcare is a change that some people find it hard to adapt to. For most youths and people from the younger generations this is not considered a problem, since they have been exposed to different aspects of digitalization throughout their lives. However, how do older people and especially older people with chronic diseases feel about the digitalization and the changes it brings? The purpose of this study is to explore how people with chronic diseases experience this progresses in the society that has contributed to the digitalization within healthcare and the increased utilization of digital platforms. Previous studies indicate that both the change in the doctor-patient relationship and the increased possibilities for patient to access health information from their homes, is an effect of the digitalization. In this study, which is conducted with a qualitative method, we come to understand that older people with chronic diseases find it difficult to adapt to the digitalization. None of the participants are opposing it, rather they experience the changes as complicated. Furthermore, the participants stress the prerequisite of the physical contact with a doctor to enable a correct medical assessment. Whether or not this means that health centers will be dismantled is still unknown. However, our study shows that there is no resistance to digitalization among the participants, provided it is executed in a correct and trustworthy manner.

Civil disputes between doctor and patient in medical healthcare The issue of civil disputes between doctor and patient in medical healthcare is characterized by a high degree of interdependence of substantive and procedural questions. The main issue here is inequality between doctor and patient in their relationship, which is based more on factual inequality than inequality in rights. The patient as consumer and therefore the weaker party has limited access to relevant information concerning the subject of the relationship between doctor and patient. On the other hand, a doctor is a subject which has in its power almost all the relevant information. As can be seen, for a given relationship is characteristic a high degree of inequality of information. This inequality, which arises in the relationship always, is not sufficiently addressed by the substantive regulation and its effects are present in subsequent court proceedings in the form of an information deficit. Intention of this paper is to present the fundamentals of the relationship between physician and patient, the reasons for the information deficit and its consequences in legal proceedings and ways of its compensation. A linguagem da dor: um estudo dos enunciados de sujeitos portadores de disfunção temporomandibular

A presente dissertação teve o objetivo de estudar os enunciados dos sujeitos portadores de Disfunção Temporomandibular (DTM) acerca da experiência da dor na suas vidas. Isso foi possível analisando a percepção dos sujeitos em relação às abordagens profissionais anteriores, investigando a existência de metáforas conceituais que descreviam a manifestação da dor, e em seguida, categorizando-as e compreendendo os impactos particulares de ser portador de DTM. Tratou-se de um estudo qualitativo e exploratório, realizado no período de junho a agosto de 2007. Participaram 18 sujeitos de ambos os sexos, com faixa etária variando entre 14 e 64 anos, com dor músculo-esquelética temporomandibular, atendidos no Centro de Controle da Dor Orofacial da Faculdade de Odontologia da Universidade de Pernambuco Brasil, selecionados a partir do Questionário Anamnésico Simplificado DMF. Para a constituição do corpus foram realizadas entrevistas semi-estruturadas que foram gravadas e posteriormente transcritas. A discussão dos resultados foi baseada na análise de conteúdo e dividida em três partes. A primeira referiu-se à representação que os sujeitos fazem dos tratamentos anteriores e apontou uma atitude dos profissionais de saúde como sendo predominantemente de encaminhar os pacientes a outros serviços sem explicações. Na segunda parte foram discutidos os dados referentes à descrição da experiência da dor e constatouse a existência de metáforas conceituais, sendo possível categorizá-las em orientacionais, ontológicas e personificadas. Por fim, na terceira parte da análise/discussão dos resultados, foram investigados os impactos gerais e específicos causados pela dor nas vidas dos sujeitos. Verificou-se que a DTM causa impactos gerais sobressaindo no lazer e no trabalho e, entre os impactos específicos, causa transtornos relevantes para mastigar, bocejar, fazer higiene oral, sorrir ou gargalhar e falar. Concluiu-se que existe uma lacuna no processo de interação entre os profissionais de saúde e os sujeitos portadores de DTM, e que a Ciência da Linguagem, através do estudo das metáforas, pode tornar-se um importante recurso para a compreensão da experiência dolorosa, auxiliando na atenuação dos impactos causados pela dor na vida dos sujeitos / This thesis was to study the particulars of the subjects carrying Temporomandibular Disorder (TMD) on the experience of pain in their lives. Page 1 of 2 Abstract The diploma thesis deals with the topic of autonomy of the mother's will during childbirth. The main goal of the work is to analyze the legal regulation concerning the provision of healthcare in connection with childbirth and the limits of the autonomy of the patient's will in this situation. The aim of the thesis is to examine the issue of the autonomy of the patient's will according to the valid and effective legal regulation in the Czech Republic, with respect to gradual enforcement of the principle of patient and healthcare provider equality, this issue being related to a relatively specific area of childbirth. There is general legal regulation, relating to the position of the patient, healthcare provider and their mutual relationship outlined in this thesis. This legislation is then subsequently used for the provision of healthcare in relation to childbirths. The case law of both domestic courts and the European Court of Human Rights is then applied to specific problems in this area. One of the described problems is the legal nature of the delivery plan as one of the basic means of expressing the autonomy of the patient's will. Negligência informacional médica : um estudo interdisciplinar dos julgados do Superior Tribunal de Justiça

O objeto de estudo da presente dissertação - negligência informacional médica - situa-se na esfera da responsabilidade civil médica, restringindo-se o escopo à esfera privada, que é compreendida majoritariamente, tanto pela doutrina como pela jurisprudência, como uma relação de consumo. A pesquisa empírica levanta as decisões do Superior Tribunal de Justiça STJ em seu site na internet. A partir da filtragem lexical, é constituído um corpus constituído de oito julgados analisados a partir do eixo epistêmico da Análise Crítica do Discurso ACD. Para tanto a revisão de literatura busca na dogmática jurídica suporte para compreender a responsabilidade civil médica pela violação do dever de informar. Estuda-se a natureza e o conteúdo da obrigação médica, além de analisar o direito subjetivo do consumidor à informação, bem como o dever de informar do médico contido em seu Código de Ética Médica. Investiga-se a importância do Termo de Consentimento Informado TCI para a concreta autonomia e escolha livre e consciente do pacienteconsumidor. A critical analysis of exclusionary clauses in medical contracts

This thesis examines the validity of exclusionary clauses in medical contracts, more especially, hospital contracts in which the healthcare provider exonerates itself against edictal liability arising from the negligent conduct of its staff, resulting in the patient suffering damages. In assessing whether these types of clauses should be outlawed by our courts, this thesis attempts to synthesize six major traditional areas of law, namely, the law of delict, the law of contract, medical law and ethics, international and foreign law, statutory law and constitutional law into a legal conceptual framework relating specifically to exclusionary clauses in medical contracts in South Africa. This thesis highlights systemic inconsistencies with regard to the central issue, namely, whether these types of clauses are valid or not, especially, given the fact that the practice of exclusionary clauses or waivers in hospital contracts has hitherto traditionally been assessed within the framework of the law of contract. The alignment of the various pre-existing areas of statutory and common law with the Constitution highlights that an inter-disciplinary and purposive approach under the value-driven Constitution, brings about a less fragmented picture in assessing the validity of these types of clauses. This approach accords with the new solicitude of the executive, the judiciary, the legislature and academia to transform the South African legal system not only in terms of procedural law but also substantive law. This has resulted in the alignment with constitutional principles and the underlying values to test the validity of these types of clauses, alternatively, contracts. Whereas pre-constitutionally the assessment of disclaimers in hospital contracts was done against the stratum of antiquated principles, namely, freedom of contract and the sanctity of contract, ignoring values such as reasonableness, fairness and conscionability, post-constitutionally, because the values that underlie the Bill of Rights and which affects all spheres of law, including the law of contract, concepts such as fairness, equity, reasonableness should weigh heavily with the decision-maker. In this regard, broader medico-legal considerations, normative medical ethics and the common law principles of good faith, fairness and reasonableness play a fundamental role in the assessment of contractual provisions, including the practice of disclaimers or exclusionary clauses in hospital contracts. This thesis critically examines how these types of clauses or contracts ought to be adjudicated eventually against the background of such alignment. It concludes that the entering into a hospital contract, in which the patient exonerates a hospital and its staff from liability flowing from the hospital or its staff's negligence causing damages to the patient, would be inconsistent with the Constitution and invalid. In the old order in which traditional divisions of law have been encouraged, a fragmented approach resulted in legal in congruencies which, in turn, created turbulence and a lot of uncertainty. This approach is apposite to that which the new constitutionally based legal system, aims to achieve. The rights in the Bill of Rights which are interconnected and which influences all spheres of law, including contract law, offers a fairer basis upon which, the validity of contracts, or contractual provisions, can be measured than, the pure contract approach. In this regard, although contracts or contractual provisions in the past may have been unfair and unreasonable, the courts, however, refused to strike them down purely on this basis. The law of contract, as a legal vehicle for adjudicating the validity of exclusionary clauses or waivers in hospital contracts, is therefore not ideal. This is primarily due to the antiquated approach the South African courts have always taken in this area of law. The law of delict, statutory law and medical law, standing alone, also does not provide a satisfactory answer. What is needed is an integrated approach in which the traditional areas of law are united and wherein constitutional principles and values, give much guidance and direction. Alternatively, should the unification of the traditional areas of law not be possible in bringing about fair and equitable results, the introduction of legislative measures may very well be indicated. / Thesis (LLD)--University of Pretoria, 2009. / Public Law / unrestricted
