Deforestation and environmental laws : an awareness study at Platklip village in the Limpopo Province, South Africa.

(Environmental Law and Management)--University of Limpopo, 2006. / This study investigated the knowledge and awareness of Platklip residents about the existing environmental laws and deforestation. The target population for the study was Platklip residents with the following characteristics: age 15 and above; period of 1 year and above as Platklip resident; educational attainment from SUB-A and above. The sample consisted of 130 respondents, 56 men and 74 females. Questionnaires were used to assess the awareness of Platklip residents. The processing of the results was done by using the Statistical Package of Social Science (SPSS). The findings were presented through descriptive analysis and frequencies. The aim was to find out if Platklip residents have any knowledge or awareness about deforestation. Their knowledge and awareness of the existing environmental laws were also investigated. The recommendations to the escalating problem of deforestation at Platklip were also discussed / Not available in document

The effectiveness of legal provision of low-cost housing and environmental laws in South Africa with special reference to Limpopo Province

(Environmental Law and Management) --University of Limpopo, 2008 / This study intends to assess the effectiveness of legal provision of low-cost housing and environmental laws in South Africa. Limpopo Province was chosen and used as area of study. The study was designed to determine whether environmental laws in South Africa hamper the provision of low-cost housing or not. Thirty participants were randomly selected from employees of the Department of Local Government and Housing as well as those of the Department of Environmental Affairs. The participants consisted of seventeen from the former department while the remaining thirteen were from the latter. The study focuses on the concept of adequate housing. Adequate housing in this study means the provision of quality housing units that are well supplied with running water and electricity. The study also discusses the issue of renovation of existing housing units. It will thereafter determine the level of commitment of government to provide adequate low-cost housing units. Housing will be looked at in terms of environmental laws which are being criticized for the lack of adequate provision of housing. Housing is regulated by law. The White Paper on Housing forms the basis of the post 1994 housing laws. This is the policy that is contained in the 1994 White Paper on Housing. In this paper, the government commits itself to providing adequate low-cost-housing units and to facilitate the process of housing provision in South Africa. The laws regulating housing include the Housing Act 107 of 1997, the Rental Housing Act 50 of 1999, the Extension of Security of Tenure Act 62 of 1997 and the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998. Section 26 of the Constitution of South Africa, 1996 provides the right of all citizens to housing and reference is made for court arbitration in this regard. The findings of the study indicate that several factors hamper the provision of housing in the Limpopo Province. These factors consist of bureaucracy, nepotism, corruption, incompetent contractors and inability to complete projects of low-cost housing units.

Analysis of safety and environmental regulations for downstream petroleum industry operations in Nigeria: Problems and prospects

No / The Nigerian economy depends on the petroleum industry for revenue and fuel to drive its growth. However, the petroleum industry has been associated with major issues of accidents and disasters which have contributed to vast safety and environmental problems. This is especially true for all sectors of the industry including the downstream. Against this back-drop, this paper critically examines the provisions in various environmental and petroleum laws and the institutional arrangements for monitoring and enforcement to evaluate their adequacy for ensuring safety and proper environmental management within the downstream sector. The review revealed the limitations of the framework such as incoherent laws, overlaps, duplications and conflicting regulatory functions. In addition, the paper looked beyond the regulatory framework to factors within wider socio-political and governance context that contribute to the lack of effectiveness of the regulatory framework. Poor governance, rent seeking culture and inadequate funding were also identified as the key contributing factors to implementation deficit. However, the paper did find that provisions in the Petroleum Industry Bill (PIB) (Draft) and National Oil Spill Detection and Response Agency (NOSDRA) Amendment Bill offers some prospects that address some of the limitations within the reviewed framework.

Estudos indicam que a população humana deverá apresentar um crescimento significativo nos próximos anos e a produção de alimentos deverá apresentar um aumento de 70% (setenta por cento) a fim de se assegurar segurança alimentar em todo o mundo. São aguardadas mudanças no padrão de consumo, elevando-se o consumo de carne vermelha. Os sistemas produtivos de gado de corte enfrentam o desafio de manter e elevar sua produção, lidando com escassez de recursos naturais e pressões para diminuição de impactos ambientais. Nas últimas décadas o Brasil vem se destacando no cenário mundial como grande produtor de alimentos e, consequentemente, como potência agrícola mundial, com exportação crescente dos excedentes de sua produção. No Brasil, em especial no Estado de São Paulo, o aumento do preço das terras e a competição com outras culturas agrícolas de maior lucratividade, têm contribuído para a adoção de sistemas mais intensivos na pecuária de corte. A partir do final dos anos 90, o número de animais confinados no Brasil cresceu rapidamente, devido, principalmente, ao aumento nas exportações de carne, aumento da produção agrícola e da boa oferta e preço dos animais aptos a abastecerem os confinamentos. O Estado de São Paulo figura entre os Estados que mais confinam no país. Assim, questões ligadas a possíveis impactos ambientais decorrentes da atividade e sua regulação pela legislação ambiental, bem como a automação do setor surgem. A presente pesquisa teve como objetivos gerais avaliar as legislações ambientais passíveis de incidência e as tendências de automação relacionadas à atividade de criação de gado de corte em confinamento no Estado de São Paulo. A metodologia se valeu de levantamento bibliográfico, levantamento da legislação ambiental pertinente, visita a um confinamento de gado de corte situado no Estado de São Paulo e entrevistas a pessoas pertencentes a quatro grupos definidos para a pesquisa, quais sejam, confinadores de gado de corte do Estado de São Paulo, professores universitários/pesquisadores ligados ao tema, órgãos ambientais e proprietários de empresas fabricantes de máquinas para pecuária. Os resultados da pesquisa indicam que é crescente a incorporação de tecnologias nos confinamentos de bovinos de corte do Estado de São Paulo. Em relação à legislação ambiental, constatou-se a existência de legislação ambiental passível de incidência nos confinamentos de bovinos de corte paulistas, contudo, uma carência de legislação que regule especificamente a atividade no Estado. Também verificou-se ser reduzida a fiscalização da atividade, que ocorre majoritariamente diante de acidentes ambientais ou denúncias, o que pode gerar um enfraquecimento da previsão legislativa. / Studies indicate that the human population is expected to present a significant growth in the coming years and food production will present an increase of 70% (seventy percent) in order to ensure food security worldwide. Are expected changes in the consumption pattern, rising consumption of red meat. The production of beef cattle systems face the challenge of maintaining and increase production, dealing with scarcity of natural resources and pressures to decrease environmental impacts. In recent decades, Brazil has stood out on the world stage as a major producer of food and, consequently, as a global agricultural powerhouse, with growing export of surplus production. In Brazil, especially in São Paulo state, the increase in land prices and competition with other crops of higher profitability, have contributed to the adoption of more intensive systems in livestock. From the late 90s, the number of animals confined in Brazil grew rapidly, mainly due to the increase in exports of meat, increased agricultural production and good supply and price of animals capable of supplying feedlots. The State of São Paulo is among the states that more confined in the country. Thus, issues related to potential environmental impacts of the activity and its regulation by environmental legislation, as well as industry automation arises. This research was general objectives assess environmental legislation likely to impact and automation trends related to beef cattle breeding activity in confinement in São Paulo. The methodology is worth a literature review, survey of the relevant environmental legislation, visit to a beef cattle feedlot located in São Paulo state and interviews with people belonging to four groups defined for the study, namely, beef cattle feedlots of State of São Paulo, academics professors / researchers involved in the area, environmental agencies and owners of livestock for machine manufacturers. The survey results indicate that increasing the incorporation of technologies in the confines of São Paulo state beef cattle. Regarding environmental legislation, there was the existence of environmental legislation likely to impact on the confinements of São Paulo state beef cattle, however, a lack of legislation specifically governing the activity in the state. Also found to be reduced to monitoring the activity that takes place mostly on accidents or complaints environmental, which can lead to a weakening of the legislative prediction.

In order to achieve this end, we made a gradual rapprochement to the main object by fixing some fundamental ideas. In this sense, the first step was to identify the fundamentals of legislative discretion and its correlation with the separation of powers. Then we delimited the concept of environmental laws and studied the distribution of the competence for its issuance under the constitution, a fundamental subject to the later developments associated with formal judicial review. Then we evaluated the content and status of the right to an ecologically balanced environment in the Federal Constitution, a central theme for the subsequent construction of criteria for material judicial review. After studying this issues directly related to environmental laws and to the environmental right to a balanced environmental, we began to analyze the fundamentals of judicial review and its conformation in the Federal Constitution of 1988. We also evaluated issues related to the legitimacy of judicial review, a theme closely correlated to the discussions about the boundaries between judicial action and legislative discretion. We finished the study of the fundamental ideals that form the foundation of this work through the analysis of constitutional interpretation and its importance to the exercise of judicial review. After we established these bases, we seeked to identify specific parameters to be used for the exercise of formal and material judicial review of environmental laws. Finally, we analyze some specific cases in order to test the use of parameters identified by the Judiciary / Esta dissertação tem por objeto identificar parâmetros aptos a viabilizar o exercício do controle de constitucionalidade de leis ambientais harmonizando a efetividade do direito ao meio ambiente ecologicamente equilibrado e a discricionariedade legislativa. Partimos da hipótese de que o tratamento dado a esse direito pela Constituição e a natureza do bem jurídico por ele protegido tornam esse controle especialmente desafiador, justificando um estudo específico sobre o tema. Para alcançar essa finalidade, buscamos realizar uma progressiva aproximação do objeto principal por meio da fixação de algumas ideias fundamentais. Nesse sentido, o primeiro passo foi identificar os fundamentos da discricionariedade legislativa e sua correlação com a separação dos poderes. Em seguida delimitamos o conceito de leis ambientais e estudamos a distribuição da competência para sua edição na Constituição, tema relevante para os posteriores desenvolvimentos associados ao controle de constitucionalidade formal. Avaliamos em seguida o conteúdo e o status do direito ao meio ambiente ecologicamente equilibrado na Constituição Federal, aspectos cruciais para a posterior fixação de critérios relacionados ao controle de constitucionalidade material. Superadas as questões relacionadas diretamente às leis ambientais e ao direito ao meio ambiente equilibrado, passamos a analisar os fundamentos do controle de constitucionalidade e sua conformação na Constituição Federal de 1988. Meditamos também sobre as questões associadas à legitimidade do controle, tema intimamente correlacionada às discussões sobre os limites entre a atuação judicial e a liberdade de conformação do legislador. Finalizamos o estudo das ideias fundamentais que formam o alicerce do trabalho por meio da análise da interpretação constitucional e sua importância para o exercício do controle. Fixadas essas bases, identificamos parâmetros a serem utilizados para o exercício do controle de constitucionalidade formal e material das leis ambientais. Por fim, analisamos algumas decisões judiciais com vistas a identificar e avaliar o emprego dos parâmetros identificados pelo Poder Judiciário

An investigation into the trade of medicinal plants by muthi shops and street vendors in the Limpopo Province, South Africa

(Botany)) --University of Limpopo, Turfloop Campus, 2010 / A study of the role played by muthi shops and street vendors on the trade of indigenous medicinal plants of the Limpopo Province was undertaken in order to develop strategies that will prevent further loss of wild population. This study further investigated the conservation status and in situ availability of targeted medicinal plants, as well as suitable methods to replace wild collections with cultivated ones. Existing environmental legislation was interrogated to ascertain its effectiveness in practice. Nearly 231 medicinal plants were traded at the 16 investigated muthi shops and street vendors, accounting for a calculated 0.96 tonnes of plant material traded annually. Roots were the most preferred item traded. Open access communal lands are the main supply source for muthi markets, coupled with the destructive harvesting methods and involvement of unscrupulous middlemen in collecting medicinal material possesses a serious impact on the survival of medicinal plants. The above factors have already led to a significant decline in the availability of some species in the Limpopo Province. The cultivation of the eight most frequently encountered medicinal species was investigated. Cultivation information provided by indigenous nurseries indicates that medicinal plant species can be cultivated. Efforts to protect species through national and provincial legislation have been ineffective. Environmental laws were totally unknown by all of muthi traders interviewed. Unregulated exploitation of medicinal plants continued regardless of the fact that environmental compliance officers are aware of legislative protection given to specific species and plants in general. Failure to stabilize the status of medicinal plants in Limpopo Province will have not only negative effect on the Province environment, but also on the overall health status of the majority of people living in Limpopo Province. / N/A

Sound pollution, visual pollution, water pollution, air pollution, soil pollution, all the principal kinds of environment pollution have raised in the path of economy development. In Mossor? it is not different; the environment has suffered a long and continuous damage caused by predatory abuse. The river is polluted, the ciliar vegetation of Carnauba was totally altered and with it a part of the local fauna disappeared. In fact, the city urban environment has, and continues to be, deeply altered and the sound pollution is a reflex of the urban modifications undergone in the city as time goes by. Through bibliographic review, the gauging of noise and fieldwork, this research project had the objective of analyzing the principal activities that cause sound pollution in the urban perimeter of the city of Mossor?, RN, emphasizing the causes, effects and spacial distribution of the polluter agents, as well as understanding how the environmental laws treat the sound issue in the urban environment of the city. The President Dutra avenue, where popular events of Mossor? take place and an important access for the city, was the chosen place to study this pollution that became, recently, another hindrance that interferes on the life quality of the local population. The results of this brief research emphasizes the urgency to alert society, specially about the importance of law and public organs that are located in our city, therefore solving problems such as the aforementioned above / Nas ?ltimas d?cadas constatamos altera??es ambientais de grandes propor??es em nosso planeta.
