Podpora intermodální dopravy v Evropské unii / Promotion of the Intermodal transport in the European union

The thesis deals with an intermodal transport and its development within the European Union. The aim of this work is to analyze the current state of EU transport infrastructure and transport modes. According to these information the paper assess the benefits of this traffic and barriers hampering its development. The aim of the thesis is also to find out how is intermodal transport supported by European Union. The paper focuses on the characteristics of various transport modes and identifies major bottlenecks in the functioning of intermodal transport. The paper approaches the activities of the EU, its main objectives in the field of transport and a relation between intermodality and Union's goals. In conclusion of the thesis, there are discussed the advantages and benefits of intermodal transport, barriers and projects that has helped remove these barriers.

La thèse a parcouru les étapes de l’affirmation progressive d’une véritable politique infrastructurelle européenne cohérente, en examinant trois volets : juridique, institutionnel et financier. Tout d’abord, la thèse a souligné le processus d’autonomisation horizontale (rapport de complémentarité et spécialité vis-à-vis d’autres politiques de l’UE) et verticale («communautarisation ») de la politique de réseaux transeuropéens. En deuxième lieu, l’analyse a mis en évidence le rôle des différents processus d’institutionnalisation et « d’intégration organique » des régulateurs nationaux entrepris par le législateur européen dans la centralisation et la communautarisation de la politique des réseaux. Enfin, la thèse a relevé l’affirmation du caractère central de l’aide financière de l’UE à la création de réseaux, accompagnée par une dérogation partielle des limites imposées par le droit européen aux politiques budgétaires expansionnistes des États membres. / The thesis highlights the development of a coherent and instrumental european infrastructure policy. First, the thesis shows the process of vertical (communitarization) and horizontal (complementarity and specialty vis-à-vis other EU policies) autonomisation of Trans-European Networks (TENs) policy. Secondly, the thesis points out the role played by the processes of « networkation » and « agencification » of national regulators in promoting interconnection and access to networks. Finally, the thesis emphasises the growing relevance of EU financial support to the establishment of TENs, and a competing tendency towards the reconciliation of national expansionary fiscal policy with EU law constraints. The thesis concludes by noting that Member States will continue to play a decisive role in TENs policy, not only by improving the actual degree of its implementation, but also allowing, in a forthcoming Treaty revision, to overcome the TENs intergovernmental legacy. / Le reti transeuropee sono uno dei vettori della competitività, dell’integrazione e dello sviluppo sostenibile dell’Unione. La tesi mette in luce la progressiva affermazione di una coerente politica infrastrutturale europea a carattere strumentale, esaminando tale evoluzione sotto tre profili: normativo, istituzionale e finanziario. In primo luogo, sotto il profilo normativo, la tesi evidenzia, da un lato, la progressiva emancipazione delle istituzioni dell’Unione dall’influenza degli Stati membri nell’esercizio delle proprie competenze in materia di reti transeuropee e, dall’altro, lo sviluppo di relazioni di complementarietà e specialità tra la politica di reti e altre politiche dell’Unione (capitoli 1 e 2). L’elaborato sottolinea, in secondo luogo, sotto il profilo istituzionale, il ruolo del processo di «integrazione organica» dei regolatori nazionali e del processo di «agenzificazione» nel perseguimento degli obiettivi di interconnessione e accesso alle reti nazionali. La tesi osserva, infine, sotto il profilo finanziario, l’accresciuta importanza del sostegno finanziario dell’UE alla costituzione delle reti, che si è accompagnata al parziale superamento dei limiti derivanti dal diritto dell’UE alla politiche di spesa pubblica infrastrutturale degli Stati membri. Da un lato rispetto al diritto della concorrenza e, in particolare, al divieto di aiuti di stato, grazie al rapporto funzionale tra reti e prestazione di servizi di interesse economico generale, e dall’altro lato riguardo ai vincoli di bilancio, attraverso un’interpretazione evolutiva della cd. investment clause del Patto di stabilità e crescita. La tesi, in conclusione, rileva gli sviluppi decisivi della politica di reti europea, ma sottolinea il ruolo che gli Stati membri sono destinati a continuare ad esercitare nel suo sviluppo. Da questi ultimi, infatti, dipende la concreta attuazione di tale politica, ma anche il definitivo superamento, in occasione di una prossima revisione dei Trattati, dei retaggi intergovernativi che continuano a caratterizzare il diritto primario in materia.

Friedrich Gentz était un fonctionnaire prussien né en Silésie, un publiciste, un expert des finances publiques et de l'économie politique, un diplomate autrichien et un homme d'État. Après le congrès de Vienne en 1814-1815, il devient le "secrétaire de l'Europe" tout en restant un intellectuel indépendant, et un orientaliste à la tête de la politique ottomane de l'empire autrichien. Il fut aussi l'un des penseurs et acteurs de premier plan dans les réseaux antirévolutionnaires et antinapoléoniens et un européen convaincu. Après une partie biographique dans laquelle les correspondances et les sources inédites sont mises en valeur, la première partie de cette thèse porte sur l'étude de sa formation intellectuelle et sur la mise en perspective de sa pensée politique post-Lumières dans les réseaux d'opposition modérés à la Révolution Française. L'accent étant aussi porté sur les réseaux de diffusion de sa pensée politique. La deuxième partie est tournée sur l'analyse de sa pensée et de son action en faveur de l'ordre et de la stabilité pour la « République européenne ». Son rôle dans la théorisation et la création du Concert européen en tant qu'institution de maintien de la paix et de la sécurité en Europe est mis en exergue ainsi que la période plus conservatrice de sa pensée politique à travers les Décrets de Carlsbad et son interprétation restrictive de l'article 13 de la Confédération germanique. Enfin, sa position favorable aux mouvements révolutionnaires des années 1830 et le coeur de sa pensée politique, à savoir l'idée de réconciliation des extrêmes et de réformes progressives des régimes politiques et des constitutions, sont analysés à la fin de la thèse. / Friedrich Gentz was a publicist, an expert in public finance and political economy, an Austrian diplomat. After the Congress of Vienna in 1814-1815, he became the "Secretary of Europe" whilst remaining an independent intellectual and an Orientalist, at the head of the Ottoman policy of the Austrian Empire. He was also one of the architects and leading players in the anti-Revolutionary and anti-Napoleonic networks and a convinced European. Beginning with a bibliographical section in which correspondence and unpublished sources are examined, this thesis, in its first part, will focus on the study of the intellectual formation of Friedrich Gentz, and will put into perspective his post-Enlightenment political views in the opposition networks moderately opposed to the French Revolution. Particular emphasis will be placed on the networks he used to convey his political views. The second part of this thesis will analyse his thoughts and actions with regard to the order and stability of the "European Republic". Two specific aspects will be highlighted, namely: that of his role in the theorising and creation of the Concert of Europe as an institution for the maintenance of peace and security; and that most conservative moment in his political thought, his role in the Carlsbad Decrees (1819) and the Conference of Vienna (1820) with its restrictive interpretation of Article 13 of the German Confederation. At the end, both his favourable position regarding the revolutionary movements of the 1830s and the kernel of his political thought, in other words, the idea of reconciliation of extremes and the progressive reform of political systems and constitutions will be considered.
