An employee is usually entitled to representation in a disciplinary hearing. The question arises whether this representation includes legal representation or whether it is limited to representation by union representatives or a fellow employee? An employee's right to legal representation will in most cases be determined by a collective agreement, the employment contract or a disciplinary code. Over the years the Courts have indicated that they are not prepared to grant an absolute right to legal representation in disciplinary enquiries. Yet in some cases the courts found legal representation to be a sine qua non for a fair hearing and an intrinsic part of natural justice. It seems that the conclusion that can be drawn from this research is that legal representation might soon become a requirement for a fair disciplinary hearing in serious and complex matters. This research looks at numerous decisions both in die public and private sector before and after 1994. The right to legal representation is also discussed in the light of a fair hearing. The various advantages and disadvantages of legal representation are briefly examined. It is argued that all employees should be granted legal representation in complex and serious matters where the employee is likely to be dismissed. It is thus said that all presiding officers should be granted a discretion to allow legal representation in serious and complex matters. / Thesis (LL.M. Processo colaborativo: atuação laboriosa dos sujeitos processuais / Collaborative process: the role of the laborious procedural subjects.

A relevância da atuação colaborativa dos sujeitos do processo para o resultado tempestivo e efetivo da prestação jurisdicional. Análise dos modelos de estruturação processual, em adequação ao Estado Constitucional. A invasão dos valores éticos e a releitura do princípio do contraditório, num viés amplo de participação democrática, em configuração dos pressupostos lógicos da colaboração processual. Os deveres das partes, e seus procuradores, potencializados pela parcialidade envolta e pela relação profissional desenvolvida. A pertinência de um juiz ativo e diligente no ideal cooperativo e os deveres extras daí decorrentes. A probidade processual e sua proteção normativa, através das técnicas repressivas de controle social: a litigância de má-fé e os atos atentatórios à dignidade da justiça. O abuso do processo como desvio das situações legais permissivas e sua contenção, sobretudo através do mote da boa-fé objetiva na restrição do exercício de direitos. A preocupação normativa em encorajar/desencorajar comportamentos e o formato disponível para estimular o cumprimento da norma jurídica. O mote da boa-fé objetiva como caminho a ser seguido pelos operadores do Direito na exegese normativa, através da majoração da responsabilidade dos litigantes. Contextualização através do exame de situações específicas. / The relevance of the collaborative work in the procedural actions and their contribution to improve adjudication results. Analysis of the systems of structuring procedural and adequacy to our Constitution model. The invasion of ethical values and rereading of the fair hearing principle in logical setting of the assumptions of procedural collaboration. The duties of the parties and their attorneys, fueled by partisanship wrapped and professional relationship developed. The relevance of an active and diligent judge on the cooperative ideal and the extra duties resulting from this. The procedural probity and protection rules through the repressive techniques of social control: the bad-faith litigation and contempt to dignity of justice. The abuse of process as a deviation from permissive legality and the reasoning of the objective good-faith to restrict the exercise of rights. The normative concern in encouraging or discouraging behaviors and the available format to encourage compliance with the rules of law. The reasoning of the objective good-faith, additionally, as a path to be followed by operators of the law in the allocation of more responsibility to the litigants. This contextualization through examination of specific situations.

Estreia, na Constituição Federal de 1988, de forma expressa, a incidência dos princípios da ampla defesa e do due process no processo administrativo, consagrando, pois, a presença efetiva do modelo Estado de Direito a emoldurar e balizar a atividade desenvolvida pelo Poder Público. Considerando, destarte, que o Estado atua não apenas por intermédio de atos administrativos isolados, mas também por via de processos, cada dia mais complexos, demandando um particular debruçar por parte dos analistas, pareceu-nos oportuno o estudo da incidência da teoria das nulidades em sede de processos administrativos. A perspectiva deste estudo, sem abandonar a teoria da invalidez dos atos administrativos, busca o aprofundamento no domínio da ocorrência de fatores que possam conduzir à nulidade e invalidade do processo administrativo tanto geral, como disciplinar perquirindo as condições necessárias para assegurar aos processos trâmites regulares, afastando os vícios e mantendo-os sempre no campo da legalidade. A perspectiva do trabalho, destarte, busca recolocar tema tão polêmico em debate e, sob a lente da investigação científica, apresentar, de modo sistematizado, as doutrinas, as teses desenvolvidas e a jurisprudência construída de modo a assegurar a evolução do tratamento jurídico oferecido ao processo administrativo para o efetivo atingimento de suas finalidades públicas. Ao administrado, de outro lado, a pesquisa se revela de interesse, porquanto põe à luz, evidenciando, os princípios pelos quais a Administração deve se pautar para que determinado ato seja válido e eficaz. Cuida-se de preservar a supremacia do interesse público, em prol dos objetivos fundamentais do standard do Estado Democrático de Direito, dentre eles, uma sociedade livre, justa e solidária / For the first time, the 1988 Brazilian Federal Constitution expressly provides for the application of the principles of fair hearing and due process of law to administrative procedures, thereby enshrining the tangible presence of the rule of law approach, whose purpose is to frame and limit the activities performed by the Government. Therefore, considering that the Government does not operate only through isolated administrative acts, but also through increasingly complex processes that require particular examination by analysts, it seems fitting to study the application of the theory of nullities in administrative procedures. Although it does not depart from the theory of invalidity of administrative acts, the focus of this study is to inquire into facts that may result in the nullity and invalidity of administrative procedures both of a general and disciplinary nature and establish the necessary conditions to ensure the regular course of procedure, thereby avoiding errors and preserving its legal integrity. Thus, this paper aims to rekindle the discussion on this controversial subject and, based on a scientific analysis, presents a systematized portrayal of the relevant doctrines, theses and case law that were produced with a view to the development of the legal framework that underpins administrative procedure and the fulfillment of its public mission. On the other hand, this research is of interest also to private individuals, as it brings to light the principles the Public Administration must observe for any given act to be considered valid and effective. Particular care is taken to preserve the paramount importance of public interest as a fundamental objective that determines the standards of a state founded on the rule of law, including a free, equal and fair society.
