Legal Analysis of Cable TV Routing Conflicts

Cable TV refers to the transmission of visual and audio signals to the public by laying cables. Article 5 of the Cable Radio and Television Law says: ¡§System operators installing the networks themselves shall apply to the roads authority for approval if the networks are to be laid underground¡K¡¨ The roads authority on the regional level is the Township Office. Road right granted by the roads authority is usually valid for one year. Cable TV is a licensed business; business licenses issued by the Government Information Office, Executive Yuan are in 9-year term. Although it is subject to the restrictions and regulations of the same laws as public utilities, the business does not enjoy the deserved protection. Hence, system operators often come across setbacks in their operation, which are undoubtedly potential threats to their survival and development. However, contrasting this to the development history of Taiwan¡¦s cable TV industry, it seems from the result that the government institution has played a critical role. Importance of the government¡¦s initiative to moderately liberalize the public goods for creation of an open environment, and to put more emphasis on the overall system planning for the industry development at different stages is beyond words. This study not only analyzes the impact of the Cable Radio and Television Law and regional laws on the system, but also takes real-life examples into consideration, to explain the importance of public interest and freedom of speech for liberalization of routing rights. The question is tackled in different approaches and from different viewpoints, in order to understand the problems and difficulties that system operators face when applying for routing rights from the Township Office. The study expects to provide some positive assistance and suggestions to the industry and the government, for avoidance of improper market intervention.

The main aim of this thesis is to discuss the role of innovation in the capitalist mode of production so as to achieve the domination of capitalism in the human world by capitalizing it. The idea of freedom is handled as a reason for politics when one confronts another in this quest. Process innovations are accepted as methods of improving the profitability of production which deprives dispossessed masses from their productive power outside the workplace while product innovation is claimed to be the process of improving profitability of consumption which results in increased intervention of capitalism in the relation between the human being and his wants through pacification. Thus, as capitalism continues growing, it becomes more a mediator between the human being and materials, which gives it more authority in society.

Freedom and duty: the political philosophy of R. G. Collingwood

When individualism and liberalism rose from the western history, a new form of the conflict between individual and community had emerged. From this time, people start thinking that because we have the liberal right which belongs to every person, everyone can pursue his own self-fulfillment. However, when this kind of view becomes an ¡§atomistic individualism¡¨ conviction, it seriously threatens the peace and stability of our community. If the most important thing everyone cares about is his self-fulfillment, how can we reconcile the conflict between various values? How can we avoid the disruption of our community? The purpose of this thesis is to examine whether the conflict between individual and community is inevitable, and if it is inevitable how we can find a way to face up to this distress by exploring R. G. Collingwood¡¦s political thought. For this purpose, in chapter one, I will more clearly expound my concern which will be explored in this thesis, and why we can answer the above two questions by exploring Collingwood¡¦s political thought. After this, I will start to explore Collingwood¡¦s view of the concept of freedom in chapter two, and we will find out that, for Collingwood, anyone¡¦s freedom can only be realized by interacting with others. Then I will further elaborate Collingwood¡¦s view about the relation of individual and community in chapter three. Following the proceeding two chapters, in chapter four, I will firstly point out that in Collingwood¡¦s view what is the meaning of freedom for us, and then show how he can provide us a way to face up the inevitable conflict between individual and community. Finally, I will conclude what Collingwood can inspire us who live in the twenty-first century today.

The theory and practice analysis of domestic legal system of communication protection and interception

Article 12 of Constitution of Republic of China, ¡§ people have the freedom of secret communication¡¨, protecting basic human rights aims to prevent people¡¦s communications from any arbitrary interference by others in the country except for evidence collection and crime investigation. For ensuring national security and maintaining social order, it is necessary to actually implement the communication interception. In order to balance the relationship between human rights of freedom and public interest, most of the democratic and advanced countries have set the rules of communication interception, which regulate the element of legal interception and punishment of illegal one to prevent the violations in rights of people from interception caused by abuse of power. July 14, 1999, the law of communication protection and interception was published and implemented to stipulate the operating procedure related to communication interception conducted by judiciary, procuratorial organ, executive bodies, building authorities, telecommunication corporations, and so on. This significantly symbolized that the execution of national communication interception was formally working forward to legal system, and finished the history of designated communication interception violating the constitution in the past decades. July 11, 2007, communication interception book was replaced with the provisions in the significant amendment issued by judge, and further created a new record of implementing the provision¡§people¡¦s freedoms of secret communication¡¨ secured by constitution, and formally connected with the trend of global democracy. It was undeniable that the design of this regulation still allowed much room of improvement and the circumstance of illegal wiretapping on the street stalls was definitely not restrained by the implementation of communication security law. Moreover, police units seldom dealt with the related reports or impeachments, and actively worked on the wiretapping cases. For most general public, it significantly pointed out that the effects of education did not come to the original expectation leading people to be aware of the importance of freedom of secret communication and privacy. This surely was the great defect and regret after the implementation of the relevant law. Based on the principles in the area of administrative law, the led five main structures (basic principles, framework, permission use, relief channel and monitoring mechanism,) in this research mainly analyzed and explored the current rules of communication protection and interception step by step, and further evaluated the potential deficiency and the matter of essential improvement through the modes of theory interpretation and practice review. The mentioned suggestions in this study were available to make the communication protection and interception mechanism with much better functions.
