A presente tese objetiva analisar o redimensionamento conceitual do Princípio da Igualdade no Direito Internacional Público, assim como a aplicação desse princípio na Organização das Nações Unidas, em especial no órgão judiciário, a Corte Internacional de Justiça, e nas Resoluções da Assembleia Geral da ONU sobre o princípio. A mudança mais relevante da sociedade internacional é a sua expansão horizontal de Estados, que impacta na validade das regras do Direito Internacional. A metodologia da escolha dos casos e das resoluções analisados serão precedidas por um estudo exploratório da doutrina sobre o princípio da igualdade. O novo entendimento sobre o princípio visa garantir uma igualdade material no plano internacional. Admite a possibilidade de buscar a realização da igualdade material com as desigualdades compensatórias ou vantajosas. O tratamento diferenciado ocorre apenas na presença de condições que são desfavoráveis na prática. Num primeiro momento, busca-se articular diversas teorias que explicam o princípio da igualdade na teoria do Direito e no Direito Internacional Público, para, num segundo momento, compreendê-lo a partir de um novo entendimento - uma igualdade solidária e pluralista. / This dissertation aims to analyze the conceptual dimension of the Principle of Equality in Public International Law, as well as its application in the United Nations, particularly in the International Court of Justice, in addition to the UN General Assembly resolutions on thhe principle. The most significant change in international society is its horizontal expansion of States, which impact on the validity of the rules of international law. The methodology for choosing the cases and the analyzed resolutions will be preceded by an exploratory study of the doctrine on the principle of equality. The new understanding of the principle aims to ensure a substantive equality internationally. The principle allows the possibility of seeking the realization of the fulfilment of material equality in counter or advantageous inequality. The differential treatment occurs only in the presence of conditions that are unfavorable in practice. At first, several theories that explain the principle of equality in the theory of law and public international law are articulated in order to develop a new understanding - a plural and a solidarity equality.

Toward a Buddhist Philosophy and Practice of Human RightsKelley, Christopher January 2015 (has links)
The 14th Dalai Lama-Tenzin Gyatso (DL) has expressed strong support for the Universal Declaration of Human Rights (UDHR). While this may seem to be consistent with his outspoken promotion of basic "human values" and "universal responsibility" (Piburn, 2002), there is an unresolved metaphysical conflict between his endorsement of the UDHR and concomitant ideas like "inherent dignity" and "inalienable rights," on the one hand, and, on the other, his espousal of the Buddhist "Middle Way" or "Centrist" (Madhyamaka) thesis that all phenomena (i.e., persons, things, and ideas like "human rights") lack "intrinsic existence" (svabhāva). In this dissertation I argue that an "unforced consensus" (Taylor 2011) on rights can be achieved through an application of the Madhyamaka interpretation of the "two truths" (dvasatya; bden pa gnyis). Metaphysics, however, is only one dimension of the Madhyamaka account of reality. There is an equally (if not more) important "cognitive dimension" that pertains to how one sees and interacts with the world (Westerhoff, 2009). I believe this can be effectively applied to an analysis of the psychology of human rights foundationalism (i.e., the mindset that reifies rights). The DL believes that ultimately the safeguarding of human rights culture depends on a cognitive shift at the individual level. I explore the philosophical implications of this belief, and I contend that it is consistent with the concept of human development and education in the UDHR. I conclude that Tibetan Buddhist ideas and practices can potentially help bridge the divide between human rights foundationalism and anti-foundationalism in a manner that reinvigorates the utility of the UDHR, and yet does not philosophically yield to an essentialist world-view.

A tese estuda a evolução histórica do atitude multilateral do Brasil. Parte da noção que o multilateralismo é um aspecto significativo da política externa brasileira, desde as primeiras conferências internacionais dos países americanos, que começam ainda no fim do século XIX. Em tempos recentes, na Liga das Nações, mas sobretudo nas Nações Unidas, a importância das instituições multilaterais só fez crescer. O estudo parte, no ângulo teórico, da perspectiva de que o multilateralismo tem uma lógica própria e que, ao aceitá-la, o comportamento diplomático dos Estados deve naturalmente estar em sintonia com o que aquela lógica impõe. A concepção de John Ruggie apóia a parte teórica da tese e sustenta o seu objetivo central, que é o de procura definir o que seriam constantes do comportamento multilateral do Brasil. Procura-se mostrar que suas origens estariam nas reações que a diplomacia brasileira teve ao Pan Americanismo, se fixaram com nossa participação na II Conferência da Haia, quando, com Ruy Barbosa, defendemos que as instituições multilaterais deveriam estar fundadas na igualdade entre os Estados e com a aspiração a uma participação influente nos processos decisórios internacionais, expresso recentemente com a aspiração a um lugar permanente no Conselho de Segurança das Nações. / The thesis studies the evolution of Brazil´s multilateral attitude. It accepts the notion that multilateralism has been a meaningful aspect of Brazilian foreign policy since the first conferences of American States, a series of international gatherings that began at the end of nineteenth century. From them on, after the creation of the League of Nations and, specially, the United Nations, the importance of multilateral institutions for Brazil has grown consistently. From the theoretical perspective, the thesis accepts the idea that multilateralism is defined by a singular logic and States, when working in multilateral institutions, are bound by that logic. John Ruggie´s conception of nultilateralism supoorts that idea and frames the main goal of the thesis, that is, a investigation of the constant patterns of Brazil´s multilateral behavior. The origins of those patterns could be identified in the diplomatic reactions to the challenges of the Pan American conferences. But, the patterns became more evident during our participation in the II Peace Conference (Hague, 1907) when our delegation, headed by Ruy Barbosa, advocated the understanding that necessary foundation of the multilateral institutions is the equality among States. Another constant is the Brazilian wish to have a more influential participation in the decision making process of the international institutions, as today shown in our aspiration to occupy a permanent seat at the Security Council of the United Nations.

This thesis explores the languages of Native policy in New Zealand’s General Assembly from 1858 to 1862. Continuidade e mudança na política externa dos estados latino-americanos (1945-2008) / Continuity and change in Latin American Foreign Policy (1945-2008)Ítalo Beltrão Sposito 24 March 2016 (has links)
: Este trabalho tem como objeto o redirecionamento na política externa (RPE) - conceituado como as mudanças mais radicais, abrangentes e rápidas em política externa. Para analisar este fenômeno, são buscadas as principais condições conjunturais que podem aumentar a chance de ocorrência deste evento. Estas condições estão relacionadas ao conceito de Janela Política, que representa o período em que é rompida a inércia política e os tomadores de decisões têm condições de iniciar um processo de RPE. Objetivo: encontrar e delimitar quais as condições conjunturais que aumentam as chances de ocorrência de um RPE. Método: são utilizadas ferramentas metodológicas qualitativas e quantitativas. No segundo capítulo, a análise é feita por meio de um modelo de sobrevivência (Cox Proportional Hazard Model) que analisa o efeito das variáveis sobre os riscos de ocorrência do evento em foco, definido como as alterações mais extremas de comportamento nas votações da Assembleia Geral das Nações Unidas. No terceiro capítulo, é desenvolvida uma análise qualitativa histórica focando especificamente nos casos mais radicais de RPE, buscando identificar padrões comuns no desencadeamento dos processos em estudo; com base nestes casos, são desenvolvidas tipologias explicativas para identificar diferentes caminhos causais que levam ao evento em tela. Resultados: foi identificado que mudanças de regime e de líder político, no âmbito doméstico, e intervenções militares de potências estrangeiras aumentam os riscos de ocorrência de RPE; adicionalmente, a alta polarização política e a mudança de regime, a crise política doméstica com envolvimento de atores internacionais, os processos de isolamento internacional com imposição de sanções econômicas e os períodos de crise econômica com questionamento do modelo econômico vigente por parte dos atores políticos podem combinadamente levar à ocorrência de RPE. Conclusões: apesar da importância do interesses de atores políticos em empreender um projeto de RPE, foi identificado que determinados eventos aumentam os riscos deste processo ocorrer. / This thesis object is the foreign policy restructuring (FPR) - conceptualized as the most radical, encompassing, and fast changes in foreign policy. To analyze this phenomenon, there will be sought the main conjuncture conditions that might enhance the chances of this event occurrence. These conditions are related to the Policy Window concept, that represents a period during which the political inertia is disrupted and decision makers have the circumstances to undertake a FPR process. Objective: find and outline the conjectural conditions and variables that increase the chances of occurrence of a FPR. Methods: it will be used qualitative and quantitative methodological tools. In the second chapter, a survival model (Cox Proportional Hazard Model) analyses the effect variables related to the Policy Window concept over the risks of happening a FPR, defined as the most extreme changes of behavior in United Nations General Assembly roll-call votes. In the third chapter, a historical qualitative analysis is undertaken focusing exclusively on the most radical cases of FPR to develop explanatory typologies in order to identify causal conjunctures and common patters that lead to the outcome. Results: we identified that regime and political leader changes, in the national context, and military interventions by foreign powers enhance the risks of FPR occurrence; additionally, high political polarization combined with regime change, political crisis with international forces involvement, processes of international isolation with economic sanctions enforcement, and economic crises with political actors questioning the current economic model might be combined, configuring causal paths to a FPR. Conclusion: despite the importance of main political actors interest in implementing a FPR process, we identified that specific conjunctures and events raise the risks of a positive outcome.

Previous issue date: 2014-06-18 / The "judicial reorganization" of Brazilian companies, instated with the enactment of Law 11.101/2005, brought a series of interpretative difficulties. One of the current issues is the contrast between the power exercised by the creditors in the reorganization, conferred by the Law, and its dimension within a procedure of a public nature, subject to confirmatory ruling. The work studies the organizing power of creditors in its main body - the General Assembly of Creditors (Assembleia-Geral de Credores) - the legal nature of the reorganization and its proposed plan. With the research, in particular the U.S. and the Italian foreign law, the thesis presents paradigms for application and interpretation of the law to this case, specifically in relation to court approval of the plan approved by the General Assembly of Creditors, in order to provide predictability and legal certainty to the judicial reorganization proceedings. / O processo de "recuperação de empresas" brasileiro, inaugurado com a vigência de Lei nº 11.101/2005, trouxe consigo uma série de dificuldades interpretativas. Uma das questões mais atuais encontra-se na contraposição entre o poder exercido pelos credores no processo, conferido pela Lei, e sua dimensão no interior de um procedimento de natureza pública, sujeito à decisão judicial confirmatório. O trabalho estuda a organização do poder dos credores em seu principal órgão - a Assembleia-geral de Credores - a natureza jurídica do processo de recuperação e do plano nele proposto. Com pesquisa no direito estrangeiro, em especial o norte-americano e o italiano, a tese apresenta paradigmas para aplicação e interpretação da Lei ao caso concreto, especificamente em relação ao juízo de homologação do plano aprovado pela Assembleia-Geral de Credores, de forma a prover previsibilidade e segurança jurídica ao processo de recuperação judicial.

and keywords This diploma thesis deals on the competence of general assembly in a limited liability company. In the introduction the author made a brief historical summary presenting the previous legislation of the Czech republic. The thesis is divided into four parts. The first part concerns with the general findings on the competence of general assembly including its classification. The second part is special to the first one, since it concerns with particular cases of competencies. This part is the most voluminous one because of its goal to interpret various conditions to take a decision depending on case of competency. In the third part the author made description of the French legislation and compared it to the Czech one. From the previous findings the author made a critical evaluation of contemporary legislation in the fourth part as well as specific suggestion for law-making changes.

The United States imposed the longest lasting sanction regime on Cuba in 1960 as a result of strained relations in recent years. Each US administration modified form of the sanctions regime, depending on the attitude toward the Cuban issue. General Assembly, the highest authority of the UN, adopts not legally binding but politically significant resolutions. Resolution condemning US sanctions regime has been adopted annually since 1992. Discussion on changes of the sanction regime in the General Assembly is a sign of reflection on current events and unrigid process of resolutions adoption. The main purpose is to determine whether the changes of the sanction regime were mentioned in the discussions on the adoption of the resolutions. The result of the analysis shows the reflection of the events in the speeches of ambassadors. The amount of mentioned events in speeches depends whether they were positive or negative step toward easing the embargo, and also how important the event was.
