The role of social dialogue (civil society participation) in policy decision-making in South Africa: the case study of NEDLAC

Submitted in partial fulfilment of the degree: Masters in Development Theory and Policy in the Faculty of Commerce, Law and Management at the University of Witwatersrand / South Africa enshrines itself as a democratic developing country that adheres to the principles of good governance and acknowledges the role that civil society participation in state affairs can have. The purpose of this study was to establish the role and effectiveness of NEDLAC’s social dialogue process through evaluating the contribution of civil society participation in the Development Chamber; and to understand the relationship between NEDLAC’s social dialogue model and the World Bank ideology on civil society participation in policy making. The study highlights that NEDLAC remains one of the key vehicles for social dialogue in South Africa and there have been positive contributions by civil society participation in the NEDLAC process. It takes its premise from the ILO model of social dialogue, whilst it also adapts from the World Bank ideology of civil society participation by including civil society in the process, through the Development Chamber. However, the effectiveness of civil society participation in policy making through NEDLAC is at risk due to the impact of the changing socioeconomic environment. In many ways this study highlights contradictions in South Africa’s social dialogue process. The Development Chamber is not being optimally used for its intended purposes as representativity and accountability of the community organisations are a concern; whilst there is an increasingly active civil society, demonstrated by civil unrest, which is not part of this social dialogue process.

The state of readiness of Limpopo Health Department to implement a result-based monitoring and evaluation framework

(Public Policy))--University of the Witwatersrand, Faculty of Commerce, Law and Management, Graduate School of Public and Development Management, 2013. / Globally, there is an increasing emphasis on results-based monitoring and evaluation (M&E) systems. The emphasis on M&E systems is driven by the need to: promote good governance; improve government’s performance and public accountability; comply with international donor funding requirements; achieve the millennium development goals; and respond to economic and social pressures experienced by countries. A readiness assessment is considered a critical first step and the foundation of results-based M&E system. In light of limited evidence, the aim of this study was to examine the state of readiness of the Limpopo Department of Health (LDOH) to implement the new results-based M&E policy framework. The research approach selected for this study was qualitative in nature, and provided a systematic inquiry of the state of readiness of the LDOH for the implementation of the new results-based M&E policy framework. The study employed in-depth interviews and document analysis to obtain information, in order to bring rich insights, meaning, values and holistic views to the study questions. A key finding that emerged from the study is the existence of an enabling legislative and policy environment for the implementation of the results-based M&E system. However, there are several factors that mitigate against the successful implementation of the results-based M&E system. These included sub-optimal leadership and accountability; structural weaknesses with high vacancy rates and unclear roles and responsibilities; lack of integrated management information and M&E systems; inadequate infrastructure and resources; and problems with M&E culture, capacity and skills development. The overall conclusion of the study is that the LDOH is not ready to implement a results-based M&E system. Key recommendations include dedicated resources (finances, staff, etc.) for implementation, strong leadership at political and management level, strengthening capacity and systems; and focus on the establishment of an integrated results-based M&E system, without neglecting processes and the organisational culture.

'Good governance' of the extractive resources sector : a critical analysis

This doctoral thesis presents a critical analysis of the global debate on the ‘good governance’ of the extractive resources sectors. Its starting point is that over the past decade this debate has seen a remarkable elevation, while at the same time the governance concept itself has been subjected to critique. To understand how the sector-focused ‘good governance’ agenda compares against this critique, the thesis uses a conceptual framework that identifies the different uses of this concept. Against this background, it reviews the main scholarly debates on the opportunities and challenges of countries producing extractive resources and identifies four critical questions, which it then sets out to answer. The main argument is that the global debate on the ‘good governance’ of the extractive resources sectors has been built on the widely endorsed conclusion that ‘good institutions’ make for better outcomes and that therefore producer countries need to improve their sector institutions. However, this seemingly obvious conclusion has ignored the complexity and confusion around ‘governance’ and ‘institutions’ that prevails across the broader social science literature. This argument is based on the answers the thesis provides to four critical questions: what are institutions; how do institutions change; how are they enforced; and do existing institutions matter for the design of interventions aimed at improving institutions. The thesis lays open that the policy conclusions of the global debate are premised on the dominance of a particular reference point paired with a particular methodology where the emphasis has been on, first, identifying the types of institutions that have apparently led to desired results, and then to promote these as a means to steer towards these results. It concludes that this focus has premised the global agenda on a false sense of clarity on what producer countries ought to be improving.

Disaster planning and preparedness : The case of Protea-South, Johannesburg

Despite increasing philosophical knowledge of disaster planning and preparedness, disasters still remain a challenge in many communities. As a result, communities, environment and economies remain considerably vulnerable and at the risk of disaster destruction hence, sustainable development is undermined. The purpose of this study is to review and assess the state of community readiness in order to prevent and mitigate common hazards in the City of Johannesburg, especially in previously disadvantaged communities such as Protea-South. A survey and interviews was conducted with the local community members. Results show that, this community like many others, is at high risk, due to their living circumstances. e.g. the presence of densely built shacks on a flood plain; poor hygiene and sanitation, pollution, poverty etc. There is therefore a need for a paradigm shift by institutions from emergency response and the provision of hard infrastructure to disaster prevention, preparedness and soft infrastructure provision by means of an approach encompassing collaborative planning.

Leadership and the ANC: The Thabo Mbeki Era in South Africa

South Africa has been considered a bastion of democracy on the continent of Africa since its first fully democratic election in 1994. Yet, under its second president since apartheid, Thabo Mbeki, the consolidation of South Africas democratic gains tended to slow or even stagnate. This thesis develops a theoretical backdrop by explaining competing theories of leadership and development in Africa. With Thabo Mbekis promotion of the African Renaissance he should be considered to of promoted a good governance model of growth and leadership within South Africa. To determine whether Mbeki actively followed through in implementing good governance practices as leader of South Africa and the ANC this thesis analyzes three aspects of the African National Congress (ANC): centralization, corruption and the 2007 leadership succession. Through this analysis of these three aspects of the ANC under Mbeki the thesis moves to determine whether the former president should be considered to have cultivated a good governance regime while in office or whether his leadership of South Africa embraced more neopatrimonial logic.<p> This study finds that under Mbeki neopatrimonialism expanded significantly, particularly within the ruling ANC, and can to a certain extent be used to explained Mbekis actions while president of South Africa. Despite actively promoting a good governance agenda this thesis argues that Mbeki contributed to the stagnation of democratic gains in South Africa. This legacy will continue to effect future South African leaders including Mbekis arch-rival Jacob Zuma.

The affairs of public financial management in the local government operates within two legal frameworks, one adopted by national government and one adopted by legislatures at local level (Mikesell, 2007:36). A legislative framework for public financial management includes a vast number of legislation and public policies that have a direction bearing on the way in which financial management is dealt with in the different spheres of government. The financial affairs in the local government are guided by various legislative frameworks which regulate financial management in the three spheres of government. The Municipal Finance Management Act (MFMA) Act 56 of 2003 in addition provides guidelines for securing sound and sustainable financial management. The need to achieve sound public financial management and assurance of acceptable and transparent levels of financial risk has become paramount. To realize the developmental mandate, the Integrated Development Plan (IDP) and budgeting are seen as the most significant tool towards effective public financial management. Government activities require funds to undertake the planned activities and such funds require special care to safeguard the public funds. This study aimed to assess the budgetary control practices in the Ngwathe Local Municipality. The objectives were realized by means of literature review, questionnaires and participant observations. The results of the interviews with the participants (community) revealed that the public is somehow not interested in local government affairs. It was indicated that they are mostly concerned about the social affairs and the job opportunities. The interviews with the municipality revealed that the budgetary control mechanisms are effective. Budget management is a requirement that covers budget preparation, budget implementation, and budget control. The Municipality established the budget office which serves as a mediator between the municipal council and the departmental managers. A good budget is characterized by participation, comprehensiveness, standards, flexibility, feedback and analyses of cost and revenues. The core of the work consists of analyzing Ombudsman's Institute in the Czech Republic, Greece and the European Ombudsman. The base of analysing is a comparison with regard to the legal status, legal basis of institutions and good governance principles.

Governing water pollution effectively: A comparative study of legal frameworks &amp; their implementation in India &amp; Sweden.

Case studies from India have shown that the legal regime governing water pollution control in India has miserably failed. Sectoral approach to water management is quite evident. On the other hand Sweden has shown a remarkable change with regard to environment management. The poor management of a resource makes the resource further poor. Thus effective management of the resources becomes crucial. Good governance has been vital in conservation of a resource. But the issue is what constitutes good governance with respect to water? Law has always played a steering role in governance aspect. But despite having pollution control laws the effective governance of water pollution has not been attainable in India. Are the pollution control laws fundamentally wrong or some other factors prevail which is beyond the reach of law to control the pollution problem. The thesis which is a comparative study of legal framework and their implementation in India and Sweden attempts to explore how control of water pollution has been effectively governed in Sweden and what needs to been done in India.

Taking The Initiative: Exploring The Influence Of Citizen Legislating On Good Goverance In The American States

The citizen legislator is both a controversial and recurring phenomenon of interest in political science research. A longstanding concern for the discipline has been whether or not involvement of the public in the lawmaking process is an asset or a liability to quality governance. This study explores the desirability of citizen legislating in the American states. A four dimensional index is created that includes empirical indicators of "substantive" and "procedural" governance. These indicators include voter turnout, fiscal health, the ideological distance between government and the citizenry, and the diversity of a state's interest group system. The total number of initiatives and popular referendums that appear biennially within each of the fifty states is employed as the key explanatory variable to capture the degree of citizen legislating that is occurring in the states between 1980 and 2000. A random-effects generalized least squares regression reveals that higher ballot measure counts are statistically and substantively associated with better quality governance, indicating that citizen legislation is a quality input into the political system. Key control variables such as divided government, interparty competition, citizen ideological extremism, state legislative term limits, and legislative professionalism also tell particularly poignant stories about the road to good governance.
