The Brazil attracts many workers, especially the poor and undocumented. With intensification of the processes of globalization of the economy, there are a considerable number of Bolivian immigrants and Haitian toward the cities. These individuals, because of their vulnerability from a legal point of view, are subject to the precarious conditions in the search for better opportunities. The precarious employment of immigrants infringe the rights linked to human dignity, such as those guaranteed by the International Labour Organisation (ILO) and other national and international diplomas. Notwithstanding national legislation does not regulate satisfactorily the migration issue, we must consider the case of these workers in the light of the principles of Human Dignity, Equality, Non-Discrimination and labor theory of nullity. For the rest, all immigrants is a member of a society and as such should have your work recognized and protected, both by national law and the international. / A imigra????o ocorre por diversificados motivos, mas a busca pelo trabalho ?? uma das maiores causas de mobilidade de um pa??s a outro. O Brasil atrai in??meros trabalhadores, principalmente os mais pobres e n??o documentados (indocumentados). Com intensifica????o dos processos de globaliza????o da economia, h?? um n??mero consider??vel de imigrantes bolivianos e haitianos em dire????o ??s cidades brasileiras. Esses indiv??duos, devido ?? sua vulnerabilidade do ponto de vista jur??dico, sujeitam-se ??s mais prec??rias condi????es na busca por melhores oportunidades. A precariza????o do trabalho dos imigrantes afronta os direitos ligados ?? dignidade da pessoa humana, como aqueles garantidos pela Declara????o da Organiza????o Internacional do Trabalho (OIT) e demais diplomas nacionais e internacionais. N??o obstante a legisla????o nacional ainda n??o regule de forma satisfat??ria a quest??o migrat??ria, h?? que se analisar o caso desses trabalhadores ?? luz dos Princ??pios da Dignidade da Pessoa Humana, da Igualdade, da N??o-Discrimina????o e da Teoria Trabalhista das Nulidades. No mais, todo imigrante ?? integrante de uma sociedade e, como tal, dever ter seu trabalho reconhecido e protegido, tanto pela ordem jur??dica nacional como pela internacional.
