Private copying in the digital environment

Digitalisation and the internet have enabled ordinary individuals to make copies of copyrighted content easily, costlessly and with no degradation in terms of quality. While digital private copying is permitted in Europe under Article 5(2)(b) of Directive 2001/29/EC, it represents a major challenge to the interests of the copyright owners and a thorny issue in the context of digital copyright. Despite the fact that all EU Member States, with the exception of Ireland and the UK, have incorporated a statutory limitation for acts of private copying in their national statutes, there is legal uncertainty as to the scope of this limitation. To be permitted, the use of copyrighted content ought to be private and non-commercial; these concepts, however, do not translate well in the digital environment. For instance, one can only wonder whether facebook friends qualify as a private circle and whether downloading works for free from file-sharing networks is a non-commercial act. This thesis provides answers to these questions and determines the actual scope of the private copying limitation. Yet, perfectly lawful private uses of copyrighted content may have an aggregate impact on the interests of the rightholders in the digital environment, where these activities are more widespread. To deal with the digital impact of private copying, Directive 2001/29/EC sets forth a twofold approach; while private copying is premised on condition that the rightholders are compensated for the unauthorised uses of their works, at the same time, the application of technological protection measures is rigorously protected. We examine the efficacy of these approaches in dealing with digital private copying and their adequacy for policy reasons. This thesis concludes that, even though private copying is permissible under the set of conditions laid down by Article 5(2)(b) of Directive 2001/29/EC, its legitimate exercise is jeopardised in the digital environment due to the fact that this limitation is not mandatory. This means that the ability of end users to make private copies may be either technologically or contractually restricted. Yet, the private copying limitation is a manifestation of the fundamental right to privacy, which prevails over copyright enforcement. We therefore urge for an explicit declaration of the imperative status of the private copying limitation against technological or contractual constraints.

Information, communication and technological competencies in a digital working environment : a case study in the Netherlands Defence Organization

This research is an attempt to obtain insight in the influence of ICT and the information society on the labour environment of the officers of the Netherlands Defence Organization and to determine the competence of those officers in a number of information, communication and technological areas associated with the changed ways of working in the information society as they are discussed in the literature. What was found is that a substantial number of officers are not fully prepared to participate in the new ways of working required in the information society. (in English): The diploma thesis deals with the role of multimedia teaching aids in the teaching of students with special educational needs in the specific environment of the secondary schools of the Jedlička's Institute. The aim of this diploma thesis is to find out, through pedagogical research, the use of multimedia learning aids and the attitudes of students and teachers to multimedia teaching aids in the process of teaching. The thesis is divided into the theoretical and practical part. In the theoretical part, which is primarily focused on teaching aids, the term "multimedia teaching aid", which is further worked at thesis, is defined. Practical part of the thesis is the pedagogical research at the secondary schools of Jedlička's Institute, starting points, results and evaluation.The research takes the form of a case study. The methods used are questionnire surveys, participated attendance at classes and interiews with students and teachers.

The backward cooperation of universities with their graduates should be among the priorities of each quality educational institutions, because through this relationship it is possible to obtain invaluable feedback in the form of practical knowledge from the graduates and many other benefits. The goal of this thesis is to evaluate the alumni system of the University of Economics in Prague, in comparison with similar systems of other universities and based on this comparison and research results to propose changes for the development of the system. This thesis contains theoretical viewpoints, the characteristics of the selected systems for graduates, their comparison and the suggestion of concrete recommendations for an alumni system of the University of Economics. Part of the thesis is research in the form of a questionnaire survey, in which opinions of graduates and students at University of Economics in the sphere of backward cooperation with the school were collected.

This study is justified by procedural changes arising from art. 187 of the Code of Criminal Procedure, with the wording included by Law No. 10,792 of 1 December 2003, which prescribes the manner in which the judge must conduct the examination of the defendant. The motivation for this work came from the need to employ new perspectives in legal research determined by the principle of transdisciplinarity. Hence the use of theoretical and methodological assumptions of linguistics and ethnography, which will enable such transgress legal boundaries in order to devise possible solutions to complex problems and present, such as those related to Information Society and application of Information and Communication Technologies in proceedings. The objective of this work is the description of the event taking of testimony in the electronic process of Brazilian justice, comparing where possible to take the deposition event traditionally, using ethnographic description of the taking of testimony from the methodology developed by Virginia Necklaces, as parameter to our research. The methodology used, it is an Ethnographic Case Studyexplanatory descriptive observational research developed through the event making audiovisual testimony. The survey was conducted in two stages: first, observational, which includes the notes of testimony taken audiovisual event, the second descriptive, explanatory, which includes the analysis of the main features of the electronic process, but notably, the testimony of the audiovisual which may involve the use of standardized techniques for data collection. Search to find out that the traditional system of registration statements, by reducing the term made by the judge, after hearing the witness, is flawed because it does not allow the complexity of the testimony be effectively reflected in the paper, not capturing the expressions, doubts, certainties and other relevant aspects of the testimony. The audiovisual record of the testimony allows the overcoming of certain incompleteness of the taking of testimony with reduced term because it will reflect all with unmatched reliability of the testimony, not just the impression that the judge had his instructor and, personally, sent to paper / O presente trabalho aborda o evento tomada de depoimento audiovisual a partir da metodologia de Estudo de Caso Etnográfico. Este estudo justifica-se pelas alterações processuais decorrentes do art. 187 do Código de Processo Penal, com redação incluída pela Lei nº 10.792, de 01 de dezembro de 2003, que prescreve a maneira pela qual o magistrado deve realizar a inquirição do réu. A motivação para esta dissertação partiu da necessidade de se empregar nas pesquisas jurídicas novas perspectivas determinadas pelo princípio da transdisciplinaridade. Daí a utilização de pressupostos teórico-metodológicos da lingüística e da etnografia, que possibilitará transgredirmos tais fronteiras jurídicas, no intuito de arquitetar soluções possíveis a problemáticas complexos e atuais, como aquelas ligadas a Sociedade da Informação e a aplicação das Tecnologias da Informação e Comunicação, nos procedimentos judiciais. O objetivo deste trabalho é a descrição do evento tomada de depoimento no processo eletrônico da justiça brasileira, comparando sempre que possível ao evento de tomada de depoimento tradicional, utilizando a descrição etnográfica da tomada de depoimentos, a partir da metodologia desenvolvida por Virgínia Colares, como parâmetro para nossa pesquisa. Quanto a metodologia empregada, trata-se de um Estudo de Caso Etnográfico descritivo-explicativo desenvolvido através de pesquisa observacional do evento tomada de depoimento audiovisual. A pesquisa foi realizada em dois estágios: o primeiro, observacional, o qual compreende as anotações do evento tomada de depoimento audiovisual; o segundo, descritivo-explicativo, que compreende a análise das principais características do processo eletrônico, mas destacadamente, da depoimento audiovisual do qual poderá envolver o uso de técnicas padronizadas de coleta de dados. Busca-se averiguar que o sistema tradicional de registro de depoimentos, com a redução a termo feita pelo juiz, após ouvir o depoente, é falha, pois não permite à complexidade do depoimento ser efetivamente refletida, no papel, não captando as expressões, as dúvidas, as certezas e outros aspectos relevantes do depoimento. O registro audiovisual dos depoimentos permite a superação de certas incompletudes da tomada de depoimentos com redução a termo, pois irá refletir com incomparável fidedignidade a totalidade do depoimento, e não apenas a impressão que o juiz instrutor dele teve e, de forma pessoal, transmitiu para o papel

The challenge and the crisis facing the educational publishing industry in the dissemination of information in South Africa

In this study the role of the educational publisher as an information intermediary is considered. The focus is on the developmental role of the publisher, against the background of the information age the world is entering today. The publishing industry is regarded as both a vehicle for and the product of development, which entails a twofold responsibility: the development of society in general and the development of the industry in particular. This study highlights the role of the publisher in the development of society, and it is argued that the recent changes in the education system and the language policy potentially offer a great challenge to educational publishers in South Africa to help create suitable educational material in order to facilitate the successful implementation of the new curriculum, thereby contributing to the development of South African society as a whole. This work concentrates on the informational aspects of becoming information literate for the Information Society in secondary education. The importance of this study is linked to the information age - an era in which most people rely on information in their occupations and private lives. This need for information acquires more explicit information related skills to be able to retrieve, evaluate, use, store and disseminate information. To be able to address these issues, the study is subdivided as follows. The first section (chapters 3&4) addresses the concepts of the informatisation of society and information literacy. Models are presented for both the informatisation process and information literacy. In the discussion of the concept information literacy the following issues are emphasized: the individuals realisation of an information gap, the formulation of a query, the knowledge of relevant sources, the knowledge of information and communication technologies (ICT), the knowledge, skill and ability to use, store and disseminate information in an effective and efficient way. In the second section (chapters 5 - 10), ensuing from the first, attention is given to position of The Netherlands and South Africa related to being or becoming an Information Society (chapter 5), the relationship between ICT and education (chapter 6) and the introduction of ICT and information related subjects in secondary education in respectively The Netherlands (chapter 7) and South Africa (chapter 8). It is illustrated that the infrastructure in The Netherlands to implement information literacy at school level is much better that in South Africa. Chapters 9 and 10 consist of an empirical study with the aim to determine the way in which information literacy is teached in two schools – one in South Africa and the other in The Netherlands, and which relevant entities are present. The main outcome of the empirical study was that, although pupils were adequate trained in the use of technology, they were not trained to become information literate as the emphasize is on acquiring computer skills in stead of acquiring information. The third and final part comprises firstly an evaluation of the study (chapter 11) and of the summary, conclusions and recommendations (Chapter 12). The main recommendation is the introduction of the subject information literacy as a compulsory school subjects at all levels enabling students to be prepared for their role in the knowledge society.
