On June 8, 2007, the Supreme Court of Canada [SCC] overruled its jurisprudence of the past twenty years on freedom of association. The majority of the judges agreed that section 2d) of the Canadian Charter of Rights and Freedoms protects the right to the process to collective bargaining. In doing so, the SCC rejected the ratio of the majority enunciated in the 1987 trilogy and, at last, gave place to international labour law, in particular to freedom of association principles elaborated by the International Labour Organization's supervisory bodies. The analysis of these principles, focused on three related rights, i.e. the right to collective bargaining, the right to strike and the right not to associate, allows the author to conclude that for the first time, Canada is showing greater respect for its international obligations. What the SCC will decide for the right to strike remains to be seen.

What is Chinese behaviour like in the International Labour Organization (ILO) - is China a Status Quo or a Revisionist Actor? Despite the prominence of the issue of China's rise in international relations studies, little research has been published on China's behaviour in international organizations in other realms than the economic. This thesis, therefore, seeks the answer to the posed question. Chinese statements are examined concerning forced and child labour, as well as other distinct themes, their structure and a potential underlying strategy. The findings are retrieved from an analysis of Chinese statements in sittings of ILO organs and checked against information provided in ILO reports to detect discrepancies. A major finding is that the overall behaviour of China in the ILO can categorized as reform-minded status quo, even though there are some factors which could be interpreted as revisionist tendencies. Due to this categorization, a continued peaceful rise of China is considered to be possible.

This thesis also focuses on the problems associated with the agency employment. The labour law is variable depending on social and economical changes not only in our country but also worldwide. It is related to the employment which should reflect the actual situation mostly on the labor market. In this situation there are a lot of people who can not find work and who must search for some alternative options. One of opportunities which are offered is the agency employment. This is the point of accent on quality legislation to minimize the risk of abuse and discrimination of the agency employees. The author analyzes the present legislation and outlines possible solutions of problems. This thesis is divided into eight main chapters. This dissertation analyzes the effects of the ILO’s 1998 Declaration on Fundamental Principles and Rights at Work, taking as a case study ILO’s promotion of freedom of association in Brazil. It suggests that the 1998 Declaration’s promotional approach offers mechanisms that have the capacity to change a country's behaviour. In the case of Brazil, this change would involve reform of a corporativist trade union law that violates the principle of freedom of association. The peculiarities of compliance with the freedom-of-association principle represent a significant challenge to the ILO, especially when a country lacks the political will to comply with the principle. This dissertation shows that the 1998 Declaration provides mechanisms − information, qualification of the bureaucracy and support of independent actors − that can be used in these situations even outside the scope of a cooperation program to reform the law and modify public policy.

An international history of unemployment through the League of Nations and the International Labour Organization, 1931-1937Timpson, Mark January 2017 (has links)
Late in 1931, the International Labour Organization (ILO) estimated that worldwide unemployment had reached 20-25 million. The ILO was also mindful that the consequences of unemployment were borne by dependents and concluded that the number of people directly affected by unemployment was therefore probably in the region of 50-60 million. The thesis revisits this old theme of the 'Hungry Thirties' but considers it in a new and different way. Most histories of unemployment during the Great Depression have been presented in national terms but this study examines unemployment from an international perspective by utilizing the League of Nations and ILO as sites through which to explore how debates about unemployment and how to respond to it were being internationalized. Utilizing the vast archives of the League of Nations and ILO, the thesis focuses on a series of interconnected themes - public works and economic policy, migration, housing, and nutrition - themes that the League and ILO identified as being the 'fallout' from unemployment. It builds on recent research of the League and ILO that has revealed more complex histories of these two international organizations and that has recognized that the 'technical' agencies were core functions that consumed significant resources of personnel and money. Crucially, this work not only continued during the 1930s but thrived even as the political atmosphere darkened; it is, therefore, a history that offers another side to the autarky and nationalism of the 1930s. The thesis also connects the technical agencies of the League of Nations to the ILO and, in contrast to the customary treatment of the interaction of these two organizations that emphasizes inter-agency tension, it identifies how the collaboration was an important step in the rediscovery of the fundamental connection between economy and society by linking economic policy to social and physical welfare.

Bemanningsföretagen har sedan legaliseringen 1993 fått fäste på den svenska arbetsmarknaden. Bemanningsbranschen innebär en förändring av det traditionella anställningsförhållandet som vanligtvis är tvåpartsrelation till att bli en trepartsrelation. Det har skapat viss problematik, då arbetsrättslig lagstiftning främst är anpassad efter den tvåpartsrelation som ännu anses vanligast. Den reglering som styr arbetsmiljöfrågor är främst Arbetsmiljölagen, vilken kom till då trepartsförhållande var främmande för den svenska arbetsmarknaden. Därmed väcktes frågan om vilken aktör som bär arbetsmiljöansvaret vid uthyrning av arbetskraft samt om arbetsmiljöansvaret skiljer sig vid anlitandet av entreprenad.Syftet blir därför att, genom den rättsdogmatiska metoden, utreda gällande rätt och därigenom få djupare förståelse för komplexiteten kring ämnet. Stora delar av uppsatsen är av deskriptiv karaktär, en beskrivning av rådande rättsläge. För att få en internationell koppling berörs även International Labour Organizations konvention nr. 181 i syfte att utreda vilken inverkan den har för arbetstagare som hyrs ut av bemanningsföretag och deras arbetsmiljö.I mina slutsatser konstaterar jag att skyddet för den”traditionella arbetstagaren” är omfattande, medan skyddet för en arbetstagare i en trepartsrelation är betydligt mer komplex. Arbetsmiljöansvaret vid uthyrning av arbetstagare är i behov av ett förtydligande, vilket enligt mig borde ske genom lagstiftning. Till skillnad från personaluthyrning råder det ingen tvekan om ansvarsfördelningen vid anlitandet av entreprenad i Arbetsmiljölagen men enligt mig finns det ett behov av en definition av begreppet entreprenad. Definitionen bör syfta till att förebygga feltolkning av begreppet, då arbetssituationen, i vissa fall, kan bidra till att ett annat rättsförhållande skapas och att arbetsmiljöansvar då förskjuts till kundföretaget. International Labour Organizations konvention nr. 181 har ingen direkt inverkan på arbetsmiljöansvaret för uthyrda arbetstagare, då Sverige valt att inte ratificera konventionen. / Recruitment companies have since legalization in 1993 gained a foothold on the Swedish labour market. The staffing industry is a change from the traditional employment relationship which usually is a bilateral relationship to become a trilateral relationship. This has created some problems, when labour legislation primarily is adapted to the bilateral relationship, which still is considered most common. The regulations governing health and safety issues at the working place are mainly found in the Work Environment Act, which was written before the trilateral relationship appeared on the Swedish labour market. Thus, the question arose as to which player has the safety responsibility for rented labour and if the work environment responsibility differs in the employment of subcontracted employees.The aim of this thesis is therefore, through the legal dogmatic method, to investigate the law and thereby gain a deeper understanding of the complexity of the subject. A large section of my paper is of descriptive character, a description of the current legal position. To get an international connection, I also refer to the International Labour Organization Convention 181 in order to investigate what impact it has on rented labour and the work environment.In my findings, I conclude that the protection of the "traditional worker" is extensive while the protection of a worker in a trilateral relationship is much more complex. Work environment responsibility for hiring of workers is in need of clarification, which according to me, should be by legislation. Apart from rented labour, there are no uncertainties regarding work environment responsibilities for subcontracted employees in the Working Environment Act. However, according to me, there is a need of a definition of the term outsourcing. The definition should aim to prevent misinterpretation of the concept. In some cases the work conditions can contribute to the fact that a different legal relationship is created and work environment responsibilities are shifted to the client company. International Labour Organization Convention 181 has no direct impact on the work environment responsibility for rented labour since Sweden decided not to ratify the Convention.
