Este estudo tem por escopo explorar o instituto da reserva de jurisdição, analisando suas origens, motivações e conseqüências. Outrossim, visa estabelecer os critérios para se eleger as situações que devem ser submetidas a ela quando não houver previsão expressa no ordenamento jurídico, além de aplicá-lo ao âmbito do Processo Penal, avaliando a necessidade de sua aplicação nos meios de prova e nos meios de obtenção de prova. A reserva de jurisdição consiste no impedimento de outros órgãos exercerem atividades pertencentes ao núcleo essencial da função jurisdicional, sendo corolário do princípio da separação dos poderes, um dos pilares do Estado Democrático de Direito. Embora se admita uma interpenetração entre as funções estatais, existe uma parcela de cada uma delas que só permite a intervenção do órgão mais adequado e aparelhado para desenvolvê-la. No caso da função jurisdicional, isso ocorre quando o conflito de interesses a ser resolvido de forma definitiva envolve um bem constitucionalmente protegido ou um direito fundamental e só pode ser solucionado pelo Poder Judiciário. Não obstante, pretende-se aplicar as conclusões extraídas acerca da reserva de jurisdição a uma situação prática que se costuma se apresentar problemática, a investigação perpetrada por meio das Comissões Parlamentares de Inquérito. O objetivo é dar ao §3º do artigo 58 da Constituição Federal, que confere aos membros das CPIs poderes investigatórios próprios de autoridades judiciais, interpretação mais consoante com a tese desenvolvida, ou seja, defender que apenas os magistrados podem autorizar a efetivação de medidas restritivas de direitos fundamentais necessárias no bojo de um inquérito parlamentar, ainda que não haja expressa previsão no ordenamento jurídico. / This work aims to explore the scope of the institute Judicial Reserve, analyzing its origins, motivations and consequences. It also seeks to establish the criteria to choose the situations that should be subjected to it when there is no express provision in the legal system, and apply it to the scope of Criminal Proceeding, evaluating the need of its implementation in the evidence and in the means of obtaining evidence. Judicial Reserve is the prevention of other agencies carry out activities belonging to the core of the judicial function, which is a corollary of the principle of separation of powers, one of the pillars of the Democratic State. Although it is accepted interpenetration between the state functions, there is a portion of each that only allows the intervention by the most suitable and equipped agency to develop it. In case of the judicial function, this occurs when the conflict of interests to be resolved definitively involves a constitutionally protected good or a fundamental right, and can only be resolved by the Judiciary. Nevertheless, we intend to apply the conclusions drawn about the Judicial Reserve to a practical situation that used to present problems, the investigation conducted by the Parliamentary Committees of Inquiry. The goal is to give the § 3 of article 58 of the Constitution, which gives members of CPI investigative powers similar to the judicial powers, interpretation more consonant with the thesis developed, ie, defending that only judges can authorize the execution of measures restricting fundamental rights on an parliamentary inquiry, although there is no express provision in the law.

Program Leniency v kartelovém právu a jeho následky v praxi / The Leniency programme in cartel law and its consequences in practice

The final thesis deals with the Leniency programme, as one of the most important instrument of the Office for the Protection of Competition and the European Commission for detecting of cartel agreements. The aim of the thesis is to analyze regulation of the Leniency programme in the Czech Republic, from the practical point of view find out how participants of cartel agreements use the programme and whether it is effective from the view of the Office for the Protection of Competition. The thesis should also involve formation and development of the programme and how it is influenced by European law. The thesis is divided into 4 parts. The first part deals with cartel agreements. The second part focuses on cartel law enforcement which is divided in term of law regulation into public and private enforcement. The third part is the core of the theoretical part of the thesis, it presents in detail the regulation of the Leniency programme within the European Union and in the Czech Republic, there are problems of the program and their possible solutions outlined as well. The fourth part concerns the practical point of view of the Leniency programme, its harmonization among the member states of the European Union and its application in the Czech Republic in decisions of the Office for the Protection of Competition.

O presente estudo, partindo da premissa de que o processo, assim, como o próprio direito, sofre intensa influência dos valores sociais e das determinantes históricas, políticas e culturais da sociedade em que se insere, tem por escopo analisar a influência das concepções instrumentalista e publicista, do robustecimento de seu conteúdo ético e das demais premissas metodológicas do processo civil atual, na denominada divisão de trabalho entre juiz e das partes em todo o iter procedimental, e, notadamente, na atividade probatória, de sorte a reconhecer, com fundamento no modelo constitucional do processo civil brasileiro, a existência de autênticos deveres das partes e do juiz em matéria de prova e analisar as consequências jurídicas de sua inobservância. / This study, working on the premise that procedural law, as well as law itself, suffers intense influence of social values and societys historical, political and cultural determinants in which it operates, has the scope of analyzing the influence of the instrumentalist and publicist conceptions, the toughening of its ethical content and other methodological premises of the current civil procedure in the denominated division of labor between judge and parties throughout the procedural path, and notably in the evidentiary activity, so as to recognize, based on the constitutional model of the Brazilian civil procedure, the existence of genuine obligations of the parties and the judge regarding evidentiary matter and analyze the legal consequences of their noncompliance.

The Master's thesis describes and analyses the legislation of the on-site inspections conducted by the Czech Office for the Protection of Competition and the European Commission. The competition authorities may investigate business and other premises in order to find evidence proving the violation of competition rules. The on- site inspection or so called dawn raid is a main investigative and the most effective tool of the competition authorities in proceedings concerning the possible breach of competition law. The main aim of this thesis is to provide a detailed description of the relevant legislation and case law, to highlight any legal issues connected with on-site inspections and offer solutions of these issues, and finally to examine guarantees of the fundamental rights of the undertakings during the inspection. The thesis consists of eight chapters. Chapter One and Two are introductory and describe basic terms connected with the competition law. In Chapter Three the thesis deals with the scope of relevant Czech and EU legislation. Chapter Four is concerned with the guarantees of fundamental rights within on-site inspections. Práva podniků při vyšetřování deliktů v soutěžním právu Evropské unie / Rights of enterprises in the investigation of delicts within EU competition law

As it is evident from the title, in my thesis I would like to provide an overview of the undertakings' procedural rights in proceedings under Article 101 and/or 102 of the Treaty on the Functioning of the European Union. Given the extensive investigative powers that are granted to the European Commission by the Council Regulation No 1/2003 and the consequences of being found guilty of violating Article 101 and/or 102 of the TFEU, it is necessary to ensure that the undertakings have enough ways available to exercise their right to defence and other rights and privileges guaranteed by the EU law and international treaties such as European Convention on Human Rights (e.g. the right to respect for private life). For this reason the EU law provides a range of procedural rights that should guarantee that both all the fundamental rights are observed and also serve as a system of checks and balances that prevents the misuse of the Commission's investigative powers. My thesis will focus individual rights of undertakings that are provided to them by the Council Regulation No 1/2003 and EU courts judicature. I will analyse their scope and purpose, the conditions under which they can be exercised and their limitations.
