La sociedad de la información, como nueva forma de organización de la sociedad y la economía, se caracteriza principalmente por el uso intensivo de las tecnologías de la información y comunicación (TICs), lo cual, ha implicado el cambio de la vida diaria de las personas, la forma de organización de la sociedad y gestión de las empresas, transformando a su vez las relaciones de espacio y tiempo, que involucran una conectividad permanente, manejo de información en gran magnitud, comunicaciones instantáneas entre personas sin importar el lugar donde se encuentren y teniendo dos efectos a evaluar: la hiperinformación e hiperconectividad. Es a raíz de este nuevo contexto, nuevos fenómenos y cambios que surge la razonabilidad y estudio de la presente tesis, la cual, plantea abordar e investigar la protección y alcances del derecho al descanso frente al uso de las TICs. Así se tiene como objetivos principales estudiar los fundamentos del derecho al descanso, analizar la legislación actual y disposiciones que resultarían idóneas para garantizar el goce efectivo del derecho al descanso, evaluar la lógica y sustento de regular el derecho a la desconexión digital en el ordenamiento peruano, régimen laboral vigente emitido en la coyuntura actual de pandemia COVID-19. Asimismo, se busca identificar los mecanismos de protección en nuestro ordenamiento actual que tiene el trabajador frente a la vulneración de su derecho al descanso, evaluar si la contravención al derecho al descanso configura un acto de hostigamiento laboral y finalmente analizar el impacto de las TICs en las relaciones laborales. El estudio de los objetivos que abordaremos nos permitirán concluir que a través del derecho al descanso se protegen otros derechos y que otorgarle una sola finalidad es limitar sus alcances y naturaleza. Finalmente, entre las diversas conclusiones a las que hemos llegado en la presente tesis, tenemos que el derecho a la desconexión no es un nuevo derecho, sino que se trata de medidas complementarias que refuerzan la protección al derecho al descanso, sin embargo, no son suficientes pues a partir de lo analizado y como parte de las recomendaciones brindadas se deben reforzar aspectos de nuestro ordenamiento y legislación actual, así como el trabajador debe conocer todas las garantías y fundamentos que lo protegen frente al exceso de trabajo y no respeto de su derecho al descanso, los cuales también son abordados en la presente tesis. Asimismo, el deber de buena fe y protección que le corresponda al empleador involucra no solo el respeto de los derechos laborales sino garantizarlos a través de una fijación idónea del horario y jornada de trabajo, adecuada distribución de carga de trabajo y políticas que protejan y garanticen el derecho al descanso. / The main feature of the information society, as a new social and economic organization, is the intensive use of the communications technology that have changed people´s life and the companies administration, transforming, in turn, the relationships of space and time. This latter involves permanent connectivity, large-scale information management, instant communications between people regardless of where they are; all that have two effects to evaluate: hyper information and hyper-connectivity. Due to the above, the present thesis is important and pertinent because through it we plan to investigate and analyze the protection and scope of the right to rest in an information society ruled by communications technology. To that, our main objectives are as follows: study the foundations of the right to rest; analyze current legislation and provisions that would be suitable to guarantee the effective enjoyment of the right to rest; evaluate the logic and support of regulating the right to digital disconnection in the Peruvian legal system and the current Covid-19´s labour regime; identify the protection mechanisms in our current legislation that workers have against the breach of their right to rest; evaluate if the violation of the right to rest constitutes an act of workplace harassment; and, analyze the impact of communications technology on labour relations. The study of the above will allow us to conclude that, through the right to rest, other rights are protected and giving it a single purpose limit its scope and nature. Finally, among different conclusions reached in the present work, we have that the right to disconnection is not new, but a complementary measure that reinforces the protection of the right to rest. However, there are many aspects of our current labour legislation that must be reinforced in order to improve the right to rest protection, as well as the worker must know all the guarantees that assist him against overwork and non-respect of his rights, which are also addressed in this thesis.

En años recientes, se ha evidenciado un aumento de accidentes de tránsito ocasionado por vehículos patrulleros a nivel nacional. En 2018 se registraron ocho accidentes de este tipo; en 2019, catorce y en el 2020, cuarenta y siete accidentes de tránsito ocasionado por conductores policiales. Es por ello que en el presente trabajo se ha aborda como problema público el incremento de accidentes de tránsito ocasionado por conductores policiales de patrulleros pertenecientes a comisarías de la División Policial Lima Sur 2 entre los años 2018, 2019 y 2020. A partir del análisis de la información recopilada y recogida a través de una encuesta realizada al personal de diversas comisarías, se han identificado tres causas del mencionado problema público, siendo estas: horas continuas de conducción del vehículo policial sin horas de descanso establecidas; falta de experticia e impericia por parte de los conductores policiales de vehículos patrulleros; y, falta de capacitación y entrenamiento permanente de conductores. Es por ello que, se propone la implementación de un sistema de capacitación, selección y horarios de trabajo rotativos para el personal policial que desempeña la función de conductores policiales de vehículos patrulleros en las comisarías a nivel nacional, con la finalidad de reducir el índice de accidentes ocasionados por conductores policiales en los vehículos patrulleros. / In recent years, there has been an increase in traffic accidents caused by patrol vehicles at the national level. In 2018, eight accidents of this type were recorded; in 2019, fourteen and in 2020, forty-seven traffic accidents caused by police drivers. That is why in the present work the increase in traffic accidents caused by police drivers of patrol cars belonging to police stations of the Lima Sur Police Division 2 between the years 2018, 2019 and 2020 has been addressed as a public problem. Based on the analysis of the information compiled and collected through a survey carried out on the personnel of various police stations, three causes of the aforementioned public problem have been identified, these being: continuous hours of driving the police vehicle without established rest hours; lack of expertise and inexperience on the part of police drivers of patrol vehicles; and, lack of qualification and permanent training of drivers. For this reason, the implementation of a training, selection and rotating work schedule system for police personnel who perform the function of police drivers of patrol vehicles in police stations at the national level is proposed, to reduce the rate of accidents caused by police drivers in patrol vehicles.
