Enhancement of the quality of outpatient services and the problems of accessibility of services become more and more important part of the health care reform. The importance of increasing the provision of the services in outpatient institutions and developing of outpatient services of physicians-specialists are the priorities in the plan of re-structuring of health care. Aim of the study. To analyze the provision and tendencies of the secondary and tertiary level outpatient services to inhabitants of the area Vilnius Territorial Patient Fund in 2003-2005. Objectives. To evaluate the provision of the secondary level outpatient services by specialty, by municipalities and age groups. To analyze the tertiary level outpatient services by municipalities. To evaluate the changes and tendencies in providing secondary and tertiary level outpatient services. Materials and methods. Analysis was done using the data of health insurance information system SVEIDRA on inhabitants registered to primary health care institutions and outpatient services provided to inhabitants of the area of Vilnius Territorial Patient Fund in 2003-2005. In order to evaluate distribution of services by municipalities, the number of outpatient services per one inhabitant, registered to primary health care institution, was calculated. Vienodos teismų praktikos formavimas: raida, būklė, perspektyvos / The formation of uniform court practice: development, state, lookout

Vienodos baudžiamųjų ir baudžiamojo proceso įstatymų taikymo praktikos formavimas yra vienas pagrindinių Lietuvos Aukščiausiojo Teismo uždavinių, kurį, remiantis galiojančių teisės aktų nuostatomis, šis teismas turėtų įgyvendinti taikydamas ir derindamas tarpusavyje tris vienodos teismų praktikos formavimo priemones: priimdamas ir skelbdamas nutartis bylose, išnagrinėtose kasacine tvarka, apibendrindamas teismų praktiką ir šių apibendrinimų pagrindu teikdamas rekomendacinius išaiškinimus bei konsultuodamas žemesniųjų teismų teisėjus teisės aiškinimo ir taikymo klausimais. Vis dėlto šiuo metu praktiškai taikoma tik viena iš minėtų vienodos teismų praktikos formavimo priemonių – tai Aukščiausiojo Teismo nutartys kasacine tvarka nagrinėjamose bylose. Kitos dvi priemonės, nors ir nėra eliminuotos iš Lietuvos teisinės sistemos, dabar nėra taikomos dėl Konstitucinio Teismo išreikštos nuomonės, jog tokios vienodos teismų praktikos priemonės, kurios nėra tiesiogiai susijusios su teisingumo vykdymu konkrečiose bylose, yra nesuderinamos su konstitucine teismų paskirtimi vykdyti teisingumą bei kelia grėsmę teismų ir teisėjų nepriklausomumui. Panašių nuomonių galima aptikti ir teisės doktrinoje. Nors argumentai, dėl kurių šios vienodos teismų praktikos formavimo priemonės laikomos nepriimtinomis, yra gana svarūs, atsižvelgiant į dabartines Lietuvos teisinės sistemos funkcionavimo problemas, Lietuvos Aukščiausiojo Teismo Senato nutarimai ir toliau turėtų būti naudojami kaip veiksminga ir... [toliau žr. visą tekstą] / The formation of uniform court practice in the field of criminal law and law of criminal procedure is one of the main tasks of the Supreme Court of the Republic of Lithuania. In accordance with Lithuanian laws which are in force at the moment, the Supreme Court can use three separate measures of the formation of uniform court practice: these are the Court’s decisions in individual criminal cases; recommendatory interpretations of law which are based on the review of lower courts’ decisions and are passed by the Senate of the Supreme Court; advisory opinions delivered by the justices of the Supreme Court. Although at the moment all the measures mentioned above are legal to use as they are provided by the Lithuanian Law on Judiciary, at the moment only the Supreme Court’s decisions in individual criminal cases are actually applied. The other two are not in use because of the criticism expressed by the Constitutional Court in its decision of March 28, 2006. The Constitutional Court said that the only way of the formation of uniform court practice which is compatible with the Constitution of the Republic of Lithuania are the interpretations of law witch are expressed when hearing and deciding individual cases. Other measures such as recommendatory interpretations based on the review of court practice or advisory opinions are inconsistent with the Supreme Court’s mission to administer justice.
