‘Judging’ Lesbians: Prospects for Advancing Lesbian Rights Protection through Courts in NigeriaObani, Pedi 07 October 2023 (has links)
Yes / Nigeria is one of many countries in Africa that criminalize same-sex relations, and this has been reinforced by law enforcement agencies and the courts. As part of efforts to protect LGBTQ (lesbian, gay, bisexual, transgender, and queer) persons from various forms of discrimination and violence, the growing LGBTQ movement sometimes approaches the court for rights enforcement. There is a dearth of cases specifically focused on lesbian rights except for a 2018 case, Pamela Adie v. Corporate Affairs Commission. This limits empirical evidence for assessing the role of the courts but also strengthens the case for an enquiry into how the courts can protect lesbians in Nigeria against discrimination on the grounds of their sexual identity. This chapter analyzes how intersecting categories of gender, sexual orientation, class, and location affect lesbians’ experiences of discrimination. It also explores impediments in laws and the formal justice system that result in discrimination, thereby affecting access to justice. The analysis reveals opportunities for the courts to adopt a proactive approach to interpreting fundamental rights guarantees in the constitution of the Federal Republic of Nigeria 1999. Pragmatic recommendations are made for a multi-stakeholder approach and cross-jurisdictional learning.

Democracy and Gender and Sexual Minority Rights: Brazil, Bulgaria and Namibia compared - How can we understand the importance of democracy to furthering LGBTQ human rights?Fontán Álvarez, Jonathan January 2019 (has links)
Democracies are argued to be imperative for the advancement of LGBTQ human rights. In the last two decades, however, the picture regarding LGBTQ rights has been extremely contradictory with countries adopting ‘LGBTQ friendly’ policies such as same-sex marriage or adoption while other democratic nation-states have constrained or not developed the rights of sexual minorities. Flaws in the democratic political system and the international human right regime are believed to be responsible for that. The aim of this paper is to investigate the significance of democracy in relation to sexual and gender minority human rights. This is done by (a) framing the study through previous studies related to the topic, the use of Queer IR and democratic theory, and (b) conducting a small-N comparison with content analysis where Brazil, Bulgaria and Namibia are analysed to answer the research question. Democracy is demonstrated to be a necessary factor in the process of LGBTQ right advancement, but not essential. Other factors are believed to influence the process, especially social movements and their effect in norm internalisation processes.

This study aims to assess the Swedish national value framework (Svenska statliga värdegrunden) in light of liberal multicultural theory, with a particular focus on the perceived conflict between theoretical principles and actual political practices, exemplified by Swedish authorities' participation in Stockholm Pride. To achieve this, an ideological analysis applies three contemporary liberal multicultural theories to evaluate the alignment of the Swedish national value framework with these theories. The subsequent examination of Swedish authorities' involvement in Stockholm Pride seeks to determine whether such participation is endorsed or discouraged by the identified theoretical framework. The analysis supports a fundamental premise of this study – that state authorities' active support for LGBTQ+ rights and participation in Stockholm Pride is not only acceptable but also encouraged by liberal multicultural theory. Importantly, this endorsement does not compromise the principles of state neutrality integral to liberal ideals.
