Government Regulations and Housing Markets: An Index to Characterize Local Land Use Regulatory Environments for Residential Markets in the Houston - Galveston Area

Affordability continues to be a major challenge for housing in America. According to the Joint Center for Housing Studies of Harvard University (JCHS), in 2006, 57 million households were moderately and severely cost burdened in America. Although high housing prices and the lack of real income growth are cited as the main factors behind the housing affordability problem, it has been proven that land use regulations have some responsibility in this matter as well. Data from the JCHS suggests that between 2002 and 2005, the average appreciation percentage in housing prices was greater in most stringent regulatory environments when compared to less restrictive environments. Despite this fact, and compared to analyses performed in other states, the relationship between the stringency of local land use regulatory environments and housing has not been fully addressed in Texas. The methodological approach used to characterize this relationship has been by means of the creation of a composite index measuring the stringency of local regulatory environments. In response to this lack of evidence of the characteristics of local land use regulatory environments in Texas, this research created the first city-level index characterizing local regulatory environments for housing markets in the Houston-Galveston Area. The index was created taking into account both the different and the most recent practices for the creation of indices. The index created proved to be a valid and reliable measure capable of taking into account the different aspects of the relationship between land use regulations and housing markets. Correlation procedures allowed the detection of a significant relationship between the stringency of local land use regulatory environments and local traits such as median family income, race distribution, poverty, and median housing values. After alternative indices were developed for a sensitivity and uncertainty analysis, the index proved to be a statistically robust measure against modifications on the different assumptions used for its creation. Further research could use this new composite index in empirical analysis to look at the statistical effect of regulatory environments on variables such as housing values and rent prices.

Affordable Housing Policy: Integration of Land Use Tools and the Role of State Growth Management

Affordable housing is recognized as a problem in many localities throughout the United States. Local governments have the power to influence housing affordability through land use policies. Land use tools exist to address affordable housing.. However, these tools are primarily used to address other environmental, economic, and social issues. When implemented to serve other land use objectives, these tools can have a negative impact on affordable housing. This paper will describe the link between land use regulations and affordable housing, suggest the land use tools necessary to encourage affordable housing from a state growth management perspective, and examine how California, Oregon, and the Portland Metropolitan Region have utilized the tools in their affordable housing policies. Finally, this paper applies the lessons learned from the cases to recommend further action to assist in the integration of land use tools as a means of advancing affordable housing goals. / Master of Urban and Regional Planning

How Land Use Regulations Inform Sustainable Development: A Look at Commercial Development in Bakersfield, California

This research analyzes the relationship between local land use regulations and commercial development in the City of Bakersfield, California, specifically focusing on how the regulations are used to inform commercial development to be sustainable or not. This research contributes to similar research efforts through its contribution of the Sustainable Development Indicator Checklist, the tool used to measure sustainable development within the regulations as well as the built environment. Analysis of six case study locations falling under the C-B (Central Business), C-C (Commercial Center), and PCD (Planned Commercial Development) zone designations indicated the local land use regulations were not informing development to be particularly sustainable, mostly due to vague language, constraining language, and sometimes a combination of the two. Recommendations are made for how the City of Bakersfield can improve the land use regulations to be more pertinent to the process of informing future commercial development to be more sustainable.

Rural Character in the Hilltowns: Understanding Attitudes About Planning in the Context of Attachment to Place

This research examines the perceptions and attitudes of residents in five rural communities located in the Hilltowns of Western Massachusetts: Ashfield, Chesterfield, Conway, Goshen, and Williamsburg. The research aims to explore the divide between local residents’ strongly held support for private property rights and a concomitant desire to maintain the qualities that contribute to the social, ecological, and aesthetic experience of a rural town, including a viable farm and forest economy. Previous research in the same project utilized mailed, written surveys. In this case, in-depth, in-person interviews were conducted with ten residents of the study area in order to complement the breadth of information gleaned from these earlier studies. The research goal was to inform planning efforts that strive to balance the preservation of rural character with growth and change. Questions were asked to ascertain the individual’s connection to the rural community, including length of residency, occupation, and other demographic variables. Further questions were posed to learn how participants felt that landowner rights to develop property and government intervention to preserve land could be effectively balanced. Results showed that landowners’ desire to retain their property rights remains in conflict with their wish to see their communities remain rural in the face of new development. Medium-term residents may be the most motivated group to get involved in ways to balance landscape change and development with a need to preserve town character. According to study participants, local governments should focus their efforts on voluntary, cooperative measures. Such measures should ideally minimize bureaucracy and maximize a multi-jurisdictional approach in considering a variety of techniques to resolve tough land-use conflicts. Local land trusts emerged as the best-positioned entity to forge cooperative ventures with farmers, landowners, and others in protecting the places of greatest value to those who live and work in the rural landscape. The need for education and communication was vitally expressed. This study sheds new light on the different nuanced and sometimes conflicting attitudes about preserving the rural landscape, but also offers hope for solutions based on collaborations between local governments, land trusts, and local residents.
