2	Užívací práva k půdě / Rights to use the land Ševelová, Marie January 2016 (has links) The subject of this thesis is to complexly discuss the rights to use the land. The purpose of this thesis is particulary to analyse the valid legal regulation of the right to use the land after the Civil Code recodification, but for better ceherence we must also discuss the history and development of the rights to use the land that the actual legislation comes from. Pivotal part of the thesis presents the institute of lease the land and emphyteutic lease, while it is just emphyteutic lease, which plays significant role in presented issue. The thesis also informs about another land-use institutes such as commodatum, precarium and fructus a ususfructus of the land. Last part of the thesis is focused on the special legal regulation which is contained out of the Civil Code. The thesis discusses the managment of the state property and restrictions which are contained in several special acts such as Forestry Act or Act on the Protection of Nature and the Landscape.

4	Markupplåtelse till förnybara energikällor : påverkan och utmaningar vid generationsskifte / Land lease for renewable energy sources : impact and challenges in generational transitions Lövgren, Josefin January 2023 (has links) Mer än 300 000 enskilda skogsägare äger tillsammans 48% av den produktiva skogsmarken i Sverige. Många värdesätter att fastigheten överlåts till kommande generationer inom familjen. Vind- och solkraftsproduktion blir allt vanligare och ger ekonomisk kompensation till markägaren. För att möta efterfrågan på klimatsmart el kommer sannolikt markupplåtelse för ändamålet öka, och förändrade förutsättningar på fastigheten kan påverka generationsskiftet. Studier visar att närliggande vind- och solcellsanläggningar sänker huspriser, men det saknas studier med fokus på markägar- och överlåtelseperspektivet samt intrångsersättningen som upplåtelsen innebär. Studien genomfördes som en kvalitativ intervjustudie i syfte att undersöka hur markupplåtelse till vind- och solkraft påverkar fastighetens marknadsvärde samt hur det påverkar generationsskiftet. Resultatet visade att markupplåtelsen genererar intäkter som ur ett strikt ekonomiskt perspektiv ökar fastighetsvärdet och därmed kan bli utmanande då den övertagande parten kan få svårare att finansiera generationsskiftet. Västerbotten är en av de ledande regionerna inom vindkraftsproduktion och utgjorde studiens geografiska fokusområde. 5	Land utilisation by small and emerging commercial farmers in the Greater Tzaneen Municipality in Mopani District of Limpopo Province Tshilowa, Phathutshedzo Fancy 20 May 2016 (has links) Land is a major factor in agricultural production, so agricultural land allocated to smallholder farmers through Land Reform Program or by traditional leader need to be actively utilised for enhancement of agricultural business. The study assessed land utilisation by small and emerging farmers in the Greater Tzaneen Municipality. Data was collected from 86 farms and analysed using SPSS Version 23. The results indicate that 74% of the farmers fully utilised their farm lands. Results of Logit model revealed that, the amount received from leasing, value adding to products, annual farm income and savings had positive significant impact on the area of cultivation, while skills pertaining to farming activities and the proportion of farm inputs purchased with the farmer’s own money had negative impact. The significant variables should be considered to influence full farmland utilisation by small and emerging farmers in the study area; farmers need production inputs, affordable loans and other forms of funding to improve farmland utilisation / Agriculture, Animal Health and Human Ecology / M.
