Communicating across cultures in South African law courts: towards an information technology solution*Kaschula, Russell H, Mostert, André January 2008 (has links)
Language rights in South Africa are entrenched in the Constitution of South Africa (Chapter 1, Section 6, Constitution of the Republic of South Africa, 1996). However, the concomitant infrastructure and organisational realities make this policy difficult to implement, especially in law courts (Kaschula and Ralarala 2004). Creating effective communicative environments has historically been constrained by lack of effective training of legal practitioners and by the lack of capacity for building translation structures. With the advancement of technology, potential solutions are becoming more apparent and it is incumbent upon the academic community to embark on a rigorous investigation into possible solutions and how these Information Communication Technology (ICT) solutions could be applied to the execution of justice in South African law courts. This article aims to open the discourse of possible solutions, via assessments of computer based translation solutions, ICT context simulations and other potential opportunities. The authors hope to initiate the interest of other language and legal practitioners to explore how the new technological capabilities could be harnessed to support the entrenchment of language rights in our law courts.

The dance of an intellectual mandarin : a study of Neville Alexander's thoughts on the language question in South AfricaDollie, Na-iem 08 1900 (has links)
This study distils some of the principal political and sociological lines of enquiry that Neville Alexander embarked upon in his published writings. It initially sets out to sketch the political, economic and intellectual milieu that he encountered after his release from Robben Island in 1974, and then it addresses the language question, as a part of the national question, in South Africa. The researcher argues that Alexander’s “dance” in the world of political and educational interventions has at times been solitary but that his discourse is substantively girded by the writings and experiences of established practitioners in the fields of sociolinguistics, political economy and cultural activities. This thesis is a transdisciplinary study of leading South African Marxist intellectual, political activist and sociologist of language Neville Edward Alexander’s written work in English. It is an attempt to explore the “dialogical narratives” as a proposition in my assessment of his work and it is also a description of a method he employs to arrive at his own political and literary compositions. In tracking his formation as a political subject and an activist, Alexander’s and other writers’ interpretations of his meetings with and his stories about people are explored. His writings cover the spectrum of politics, education and language, and he employed a political economy approach in all his written expositions. The study argues that he had an exceptional ability to “argue against himself” because he was a dialectical reasoner and because he embraced the political and sociological toolkit of historical materialism as the philosophical matrix of his work. / History / D.Lit et Phil. This study explores the challenges related to language policy and planning in the City of Tshwane Metropolitan municipality. The study sets to look at the at the challenges affecting successful implementation by the City of Tshwane Metropolitan Municipality as a state organ charged with local development and service delivery for the communities. In terms of the Municipal Systems Act of 2000 municipalities are expected to respond to the language use and preferences of their local communities by making sure that their language policies are fully implemented. The researcher highlights that in instances where municipalities communicate information they are required to make special provision for the speakers of African languages in the communities that they serve in the languages they best understand. This work looks at various statutory language policy documents in South Africa in particular, that give the task of language policy implementation to municipalities as they are the local extension of the national government. This study also argues that municipalities are critical to implementation of language policy. It further notes that in order for the full social, economic and political transformation to take place in municipalities they have to be transformed linguistically in a radical way whereby all the official languages play a major role in all these spheres than before. This view is held by many scholars and researchers in the areas of language policy and planning. This study highlights that the challenges to successful language planning and policy in the government sectors are due to lack of commitment by the government, language practitioners and planners and increased monolingualism in the municipality. The study further explores the language policy and plan of the City of Tshwane Metropolitan Municipality and the the strategies that can contribute to successful optimization of language resources of the Tshwane Metropolitan Municipality in order to give effect to the use of local languages as contained in policy documents and also establish how the city of Tshwane can better reinforce its strategies to implement this language plan and policy. The main focus area of this research is on the language policy and plan of the City of Tshwane Metropolitan Municipality and assesses whether the language practices in these institutions are reflective of their policy and plan. It is hoped that the study will be able to give policy makers and those tasked with implementation, especially at government municipalities’ strategies for improvement in the functionality and the implementation of their language policies and plans. It is also hoped that recommendations and challenges highlighted by this research will be of a better assistance on how to better reinforce strategies to implement the language plan and policy in the government sectors.

Curriculum outcomes, teaching practices and learner competencies in isiXhosa in three Grahamstown schoolsFobe, Mila Pamella January 2014 (has links)
This study looks at the curriculum outcomes, teaching practices and learner competencies in isiXhosa at three Eastern Cape schools and across three different grades, 7-9. It explores the link between language learning and teaching as well as the teaching strategies used within the classroom. In particular, the study seeks to analyse how isiXhosa is taught at three different levels of instruction, namely at Home Language (HL), First Additional Language (FAL) and Second Additional Language (SAL) levels. Qualitative methods were used, and the study took the form of interpretive case studies within the respective schools. The purpose of using multiple case studies was to investigate the reality within the three sites selected. The three schools had three extreme settings, in the sense that one of the schools is a rich isiXhosa environment and the other two schools are English environments. The tools used for data gathering were interviews, classroom observations, and an analysis of documents from the Department of Basic Education. Data was then presented and analysed in Chapter 4 and 5 against the backdrop of an extensive literature review in Chapter 2 as well as a detailed methodological approach as outlined in Chapter 3. One of the findings of this research indicates that in two of the schools the teaching culture is largely from a western perspective, whereas in one of the schools the learners are primarily isiXhosa speaking and teachers use a different linguistic approach to imparting knowledge. In the private and ex-Model C school it was found that a lack of exposure to isiXhosa is the primary cause of language problems for L2 learners. Secondly the L1 is not appropriately maintained or promoted in the school environment because it is presumed that learners are sufficiently exposed to their L1 at home. The research found therefore that in this particular schooling environment there is an inconsistency between the curricula that is taught in relation to the linguistic abilities of the learners, many of whom are mother tongue speakers of isiXhosa. Furthermore and more generally, it was found that teachers are still not well informed concerning South Africa’s Language-in-Education-Policy and there is a need for more inservice training that will focus on the nature of additional language acquisition in order to address the challenges of teaching these languages. The thesis concludes that extensive work needs to be done in order to reposition the teaching of isiXhosa at all three levels, but particularly at FAL level. This research shows that there is a disjuncture between the proposed curriculum/learning outcomes and the standards or levels achieved by the learners, more especially at FAL and SAL where oral proficiency in isiXhosa remains a challenge. Specific recommendations are contained in the final chapter of the thesis which also makes reference to the draft policy of the Ministry of Basic Education regarding the incremental introduction of the teaching of African languages from 2014 onwards. This thesis also makes takes as a point of departure the importance of multilingualism in a multicultural society such as South Africa where language is suggested as a strong factor in the fostering of social cohesion. It is for this reason that the thesis argues that the expert teaching of African languages, in this case isiXhosa, at both mother tongue and second language levels is of fundamental importance to the future of South African society.

Educators' experiences with the implementation of Grade 11 NCS English first additional language in selected schools in the Fort Beaufort Education DistrictBesman, Shirley January 2012 (has links)
One of the essential sectors that needed a drastic change in the post apartheid era in South Africa, was the education system or policy of the country. The government had a responsibility of combining together the nineteen different Departments of Education into which the schools were fragmented. It is in the interest of the country that, out of the eleven official languages of the country, learners should at least be fluent in two languages namely, the learner‟s mother language and any official language which will be treated as an additional language, thus, promoting additive bilingualism. This is on line with the country‟s constitution which has granted equal status to the eleven languages. That resulted in the formulation of two very imperative policies pertaining to schools; 1) The South African Schools Act (SASA) of 1996 which repeal all discriminatory policies of apartheid. On the issue of language the SASA placed the responsibility of choosing the school subjects to the School Governing Bodies (SGB) and 2) The Language-in- Education Policy (LiEP) of 1997 which is based on the recognition that South Africa is multilingual, and promotes learning of more than one official language. In an attempt to accomplish the constitutional obligation, and establish uniformity or equality in education, Curriculum 2005 which was later revised and known as the Revised National Statement and later revised and known as the NATIONAL Curriculum Statement, with the Outcomes Based Education as its approach, was introduced. The study investigated the experiences of educators with the implementation of NCS EFAL in Grade 11 in the Fort Beaufort Education District. English First Additional Language is used by the majority of schools as the Language of Learning and Teaching (LoLT). The study is located in the interpretive paradigm which sought to explore people‟s experiences and their views. Qualitative research approach was adopted in the study with the intentions of finding as much detail as possible on the experiences of educators with the implementation of NCS EFAL in the Grade 11 classrooms. Six EFAL educators in the Fort Beaufort Education District in the Nkonkobe Municipality were purposely selected for the study. Semi structured interviews consisting of precisely defined questions that were pre-prepared, yet at the same time permitted the EFAL educators to answer beyond what the researcher enquired, were also employed in the study. The results pointed out that all EFAL educators interviewed were qualified teachers and had specialized in English teaching. In addition, the study revealed that in the Fort Beaufort Education District, there were two categories of EFAL educators who were trained for the implementation of NCS EFAL; those who only received one week departmental workshop and those who on top of the one week departmental workshop, received a two year training in Advanced Certificate In Education (ACE) English Language Teaching (ELT) from a Higher Education. The dissimilarity between the two groups manifested in their respective schools between the educators and their Heads of Departments (HOD) who happen to have little knowledge of the implementation of the curriculum. It became evident that the group of educators who were trained in ACE ELT were more familiar with the requirements of the NCS EFAL. The other group which was not conversant with the NCS EFAL policies decided to maintain their old teaching methods. Key recommendations of the study: Policy makers should clarify terminology to be understood by all educators, the Department of Education should take full responsibility of retraining educators to ensure uniformity in training through the in-service trainings yearly.

This study aims to discover the perceptions of young adults towards their mother tongue due to being exposed to multiple languages in their daily environment at a very young age. The study further investigates whether young adults acquire their mother tongue whilst growing up in an environment that has multiple languages. It also seeks to determine the role that parents play in the acquisition of mother tongue by their children.
Literature was reviewed in order to explain and understand the standing of African languages in South Africa. This study is guided by the theories of first language development and acquisition and Cummins’ concepts of Basic Interpersonal Communication Skills (BICS) and Cognitive Academic Language Proficiency (CALP) theories.
The study employed a mixed-method approach. Empirical data was collected by means of questionnaires and semi-structured interviews from young adults and parents. Data collected was analysed by a statistician using categorical data analysis. The researcher used graphs to present findings from analysed data.
Findings from the empirical data show that young adults who grew up in a multilingual environment acquire more than one language. Parents also play a role in nurturing the acquisition of the mother tongue / Ubuliminingi yisimo esijwayelike kakhulu ezindaweni zasemadolobheni zalapha eNingizimu Afrika. An evaluation of the implementation of the new language-in-education policy in selected secondary schools of the Limpopo ProvinceMabiletja, Matome Meriam 04 1900 (has links)
The elections of the democratic government in South Africa in 1994 led to the formulation of the new Language-in-education policy (LiEP), which was adopted by government in July 1997. This study evaluated the implementation of this policy in selected secondary schools of the Limpopo Province. In making this evaluation the study wanted to answer the question: How should schools implement the new LiEP in Limpopo Province?
The major findings of the study are that the new LiEP remains largely ignored and unimplemented in Limpopo Province. The status quo remains unchanged in most schools and English and Afrikaans continue to be the language of learning and teaching (LoLT) in all schools investigated. The study therefore argues that there is a serious discrepancy between policy and practice. The study concludes by making recommendation to address the problems identified and to provide guidelines on how the policy may be implemented in Limpopo Province, such as the gradual phasing in of African languages as LoLTs. / Linguistics / M.A. (Specialisation in Sociolinguistics)
