Law Professors’ Conceptualization and Use of Students’ Prior Knowledge and Experience in Developing Subject-Matter Understanding

This study was an attempt to better understand how law faculty search for and create linkages between subject matter being taught and law students’ existing (that is, prior) knowledge and experience. For faculty who do search for and create these linkages, the study can help them understand, and potentially give them access to, specific practices and resources that can support their teaching in this manner, while also helping them understand this approach to teaching. The study was informed and guided by three conceptual frames: pedagogical content knowledge, culturally framed theories of teaching and learning, and convergent teaching. The study included 14 faculty teaching first-year required classes at one of four law schools: two elite and two broad-access (two to four faculty members per campus). I collected data via a combination of interview, observation, and document analysis methods. The study’s findings are summarized as follows: First, a significant amount of participating faculty members’ first-year doctrinal teaching drew on students’ prior knowledge to support students in making connections to course material. It is possible, then, that teaching from students’ prior knowledge is common, at least in certain law schools, yet it is not acknowledged as such. Second, study participants described significant barriers to or stated concerns about the possibility of teaching in this way, including: hesitation to engage in sensitive or controversial discussions, limited instructional time, large class sizes, and a large amount of material to cover in a course. Third, teaching with attention to students’ prior knowledge is likely to be particularly challenging in subject matter areas that are distant from students’ everyday lives (though law school faculty can develop strategies for overcoming this challenge). Fourth, in study participants’ views, their institutions offered virtually no formal support for this kind of teaching to faculty wishing to engage in it. Fifth, virtually all participating faculty members identified as deeply committed to teaching in a way that draws on students’ prior knowledge worked at broad-access (non-elite) law schools, suggesting that these sites may be particularly amenable to such teaching. These faculty members also had certain characteristics in common—for example, possessing significant prior experience in full-time legal practice, being inclined to care for students and being attentive to their well-being, and having been educated themselves in non-elite law schools. The study concluded with discussion of the implications of these findings for law school institutional policy and leadership, faculty practice and professional development, future research, and theory. There was a particular focus on: (a) factors that encourage this type of teaching at broad access law schools and position such institutions as important leaders in this regard; and (b) the possibility that such teaching may help to democratize legal education in broad-access and elite institutions.

Partimos da hipÃtese de que as trajetÃrias de vida e de trabalho dessas mulheres estÃo intimamente relacionadas, hipÃtese essa reforÃada pelo seu ingresso devido a interesses polÃticos geralmente envolvendo seus pais ou familiares ou ainda pelo fato de que recebiam baixÃssimo salÃrio, fazendo com que continuassem as suas vidas como agricultoras, pequenas artesÃs ou ainda vendendo produtos como leite, pÃes e queijos. O objetivo principal da pesquisa à conhecer o processo identitÃrio da formaÃÃo docente, a partir de relatos orais das trajetÃrias de vida e trabalho docente de mulheres que se tornaram professoras leigas na zona rural de Lavras da Mangabeira nas dÃcadas de 1970 e 1980. TambÃm usamos como fontes escritas documentos como fichas funcionais e folhas de pagamento das mesmas / This present text came from an inquiry on professional trajectories of Law Teachers in Lavras da Magabeira city countryside, during the period of 1970s and 1980s. Our research hypothesis is that these womenâs life and work trajectories had a closed relactionship, and this is reinforced because these people started working as law teachers due to political interests envolving their fathers or relatives. Another evidence is that their remuneration was very low, and they kept working as farmers and peasants, small crafters or even selling milk, bread and cheese. Our main objective is to know the process of identity formation as law teachers, starting on oral evidence from women who were law teachers in Lavrasâcountryside between 1970âs and 1980â s. Our theoretical basis were writers and researchers like FÃtima LeitÃo AraÃjo, Maria das GraÃas de AraÃjo, Jacques Therrien e AntÃnio NÃvoa, among others. Our methodology consists in half-structured interviews with some teachers who would be available to be interviewed and stay according to research time and place parameters. So we compare their different oral evidences and we will get some important ideas about law teachers in that region. We also intend to research on written evidence, e.g., functional registration and payment lists

O modo tradicionalmente adotado para se pensar o Direito e seu ensino não é mais suficiente diante de um mundo que vive em constantes transformações. As demandas deste tempo exigem um profissional apto a pensar de modo transdisciplinar, capaz de enfrentar um contexto repleto de complexidades, riscos, paradoxos e contingências. Os ideais de certeza e segurança jurídica não mais se fazem presentes nos dias de hoje, exigindo do profissional do Direito a capacidade de reconectar os saberes. Nesse sentido, destaca-se a relevância dos conteúdos denominados propedêuticos no processo de formação do bacharel, pois têm o papel de promover uma visão integrada, crítica e reflexiva acerca dos fenômenos jurídicos e sociais. Apesar de sua importância, constata-se que os conteúdos propedêuticos são pouco valorizados por parte do corpo discente, que tende a resumir a formação jurídica à prática profissional. A partir dessa problemática, o presente trabalho apresentará a inclusão desses saberes nos currículos dos cursos jurídicos brasileiros desde a sua criação, em 1827. Em seguida, buscar-se-á identificar o perfil dos alunos em início e final de curso e qual a sua avaliação sobre os conteúdos propedêuticos. Após essa etapa, o trabalho se propõe a identificar o perfil dos professores que atuam nessas áreas e constatar quais as suas percepções sobre os desafios da educação jurídica. O contato com os docentes e discentes ocorreu por meio de pesquisa de campo realizada no Centro Universitário Ritter dos Reis e na Universidade do Vale do Rio dos Sinos. Por fim, abordar-se-á o paradigma de ensino tradicionalmente adotado pelos cursos jurídicos e, em seguida, serão apresentadas algumas alternativas para o processo de ensino e aprendizagem dos conteúdos propedêuticos. / To study the law education in 21st century requires building new answers to the problems. The traditional adopted way to think the law and its teaching are not enough considering a world which lives in constant transformation. The demands of present time require a professional both able to think in an transdisciplinary way and able to face a context full of complexity, risks, paradoxes and contingencies. The ideal of certainty and legal security are no longer present today, requiring of the law professional the ability to reconnect knowledge. In this sense it is highlighted the relevance of contents called propaedeutic in the process of bachelor formation considering these bachelors have the role to promote an integrated, critic and reflexive vision about the legal and social phenomena. Despite of its importance, it is noticed that propaedeutic disciplines have little appreciation by students which tend to summarize the law education to the professional practice. From this proposition this paper will present the inclusion of these disciplines in the curricula of Brazilian law schools since its inception in 1827. Then it will search the profile of the students in the beginning and end of the course and what are their assessment of the propaedeutic disciplines. After, the study aims to identify the profile of the teachers who work in these disciplines and find what are their perception on the challenges of law education in this area. The contact with the faculty and students occurred through field research conducted in the Centro Universitário Ritter dos Reis and in the Universidade do Vale do Rio dos Sinos. Finally it will approach the traditional teaching paradigm adopted by law schools and then will present some alternatives for teaching and learning process of propaedeutic contents.
