Finding law about life: a cross-cultural study of indigenous legal principles in Nishnawbe Aski Nation

This is a cross-cultural study of Indigenous legal traditions in Nishnawbe Aski Nation (NAN), a political territorial organization in northern Ontario. By analyzing NAN’s resolutions (passed by NAN Chiefs-in-Assembly to direct NAN’s mandate), I identify legal principles. As law arises from worldviews, law’s function is to protect the values of that worldview. This study discusses two values (creation and interdependence) as analytic tools, used to recognise legal principles. Context grounds the conclusions, as they relate to specific people and land. Four legal principles are identified: earthbound need, sacred/natural supremacy, gifted responsibility and relational jurisdiction. These principles together reveal that law in NAN is focused on the protection of life. Overarching the results is a broader purpose, to take up the educative work previously shouldered by NAN alone. The duty to learn is more than political obligation, but as I argue, is a matter of life itself. / Graduate / 2019-05-11

A review of the ethical and legal principles used in the decision making process for feticides at seven sites in South Africa

(Bioethics and Health Law), Faculty of Health Sciences, University of the Witwatersrand, 2009 / This study set out to perform an ethical-legal analysis of the current practices across the seven public health centres in South Africa that perform feticide for congenital abnormalities. Ideally, such decisions need to be guided by multidisciplinary discussions with the parent(s) and the parties included in the team, e.g. Obstetricians, Neonatologists, Nursing, Genetics counsellors and Social Workers and following the ethical principles of beneficence and respect for autonomy. Prior to the study, it was unknown as to whether all seven centres were using multidisciplinary groups in the decision-making process and on what basis approvals were being granted for feticide. The objectives of the review were to assess the number of feticides performed, who made the decision to offer the feticide and for what ethical or clinical indications. The results showed that all public health facilities in South Africa differed in the criteria that were used in making the decision to offer feticide. The clinicians varied in terms of who was represented in the team that reviewed the cases of congenital abnormalities. An analysis of the literature, together with a review of the data received on the current practices, guided the development of an ethical guideline for this service as well as making recommendations as to how the law could be strengthened in order to protect both health workers and patients.

This work focuses on the contemporary form of the constitutional principles of equality and non-discrimination. These are human rights which have been formed in the society during last decades, and these changes have usually been dynamic and also crucial. For the purpose of understanding these principles and their position in the society, this work deals with analysis, development and influential factors related to these principles. First of all, this work provides general description of principles, which is a terminological basis, it also analyses constitutional principles and legal interpretation. Then it focuses on the principles of equality and non-discrimination, their relation and possibility of restriction. Besides from explanation of the relevant terms, this work also contains their more detailed analysis. The second chapter describes the process of enshrining these principles and strengthening their role in the society. Furthermore, it focuses on the process of enshrining itself, and provides examples of subjects and processes supporting this extension. The end of this chapter is a thought about the name of this work, and it contains primarily the examples from today, which demonstrate the scope of changes regarding these principles. Separation, connection, integrationThis work is intended to establish relationships between legal and bioethical principles especially when bioethical principles complement and enrich legal ones in order to solve a specific case. Prior author’s contributions on bioethical principles as legal topics and legal bioethics creation in terms of a branch of bioethics which studies legal regulations as well as legal implementation and scope of bioethical problems are referred, making a critical reflection on growing and fruitful relationships between bioethics and law. An Interdisciplinary integration proposed in order to realize cooperation between both fields rejecting a separation or mere connection is suggested: «hetero integration», an integrating system produced by development of common and related principles. The article concludes stating that law structure is a «textual» subject not just involve on the writing of the law but capable to be analyzed from a social sense point of view, conferred to different manifestation of this discipline together with several social practices; a path warning by the need to broad theoretical-practical frameworks in order to move towards the interdisciplinarity taking into account bioethics from its foundations. / El objetivo de este trabajo es examinar la relación que existe entre los principios jurídicos y los principios bioéticos, en particular cuando los principios bioéticos enriquecen y complementan los principios jurídicos en la solución del caso concreto. Se acude a aportes anteriores del autor sobre los principios bioéticos como tópicos jurídicos y la creación de la bioética jurídica como rama de la bioética que estudia la regulación jurídica y las proyecciones y aplicaciones jurídicas de la problemática bioética y permite, como se procura aquí, una reflexión crítica sobre las crecientes y fecundas relaciones entre bioética y derecho. Desechada la separación y aun la mera vinculación, se propone una integración interdisciplinaria tendiente a instrumentar la cooperación entre ambos campos: heterointegración, producida por desarrollo de principios comunes y afines. Se concluye que el derecho constituye una materia textual, susceptible de ser analizada desde una perspectiva que no se agota en la mera escritura de la ley, sino que intenta captar la producción de sentido social que se inviste en las diversas manifestaciones de esta disciplina y que abarca distintas prácticas sociales, senda por la que se advierte la necesidad de ampliar los marcos teórico-prácticos para poder transitar la interdisciplinariedad y en la que no debe faltar la bioética desde sus principios

Legal principles are fundamental elements for every branch and sub-branch of the law. The same it is in the case of budget principles which are leading principles of the budgetary law. Due to their importance it is necessary to establish these principles to the law effectively. This work, entitled Budgetary principles and their reflection in valid legislation discusses to what extent is this requirement fulfilled in the Czech Republic. This diploma thesis is divided into an introduction and six chapters, the conclusions and list of sources. The aim of the work is the analysis of budgetary principles in terms of their reflection in the laws of the Czech Republic and the European Union. General characteristics of legal principles, as defined legal theory is outlined in the first chapter which follows after brief introduction. The second chapter of this thesis is devoted to mainly budgetary principles. The budget law and budgetary principles are defined in the introduction to this chapter. The attention in this chapter is focused on the analysis of the individual budgetary principles and their reflection in the current legislation. The main point is to understand the role of the principles in dworkinian theory of judicial decision trying to reveal its underlying justification model. This thesis is subdivided into three parts. In the first one, addressed for the famous Hart-Dworkin debate, the goal is to try to understand whence came the emphasis on principles, not as a repetition of the argumentative struggle, but, above all, demonstrating the theoretical and philosophical limitations of the hartian project and how the principles evidence them. In the second part, it is developed an overview of the legal set of principles in Dworkin, relating to the key concepts of his theory, such as: the critique of the judicial discretion; the thesis of the rights; the thesis of (only one) correct answer; the commonality of principles and the "Law as Integrity" conception. In the third and last part, the discussion will turn to Coherentism, specifically to the procedure of Rawls' reflective equilibrium and its incorporation in Dworkin's adjudication theory, and, therefore, indispensable to the role of the principles for the legal system coherence and to the verifiability of the correction of judicial responses.

En la práctica jurídica contemporánea es usual que muchas discusiones giren en torno a elementos tales como "derechos fundamentales", "bienes constitucionalmente protegidos", "valores superiores" y otros aspectos sustantivos, normalmente de rango constitucional. Asimismo, la distinción entre "principios" y "reglas", o conceptos como el de "ponderación", han pasado en las últimas décadas a formar parte del bagaje teórico básico de los juristas. En esta obra se intenta ofrecer un análisis riguroso de los conflictos entre principios constitucionales, de la ponderación y de la posibilidad de obtener una única respuesta correcta en todo caso, y se intenta mostrar cómo desde el positivismo jurídico y la filosofía analítica puede darse perfecta cuenta de estas cuestiones, señalando además cómo algunas afirmaciones ampliamente compartidas sobre los principios y la ponderación deberían ser abandonadas o cuanto menos matizadas, y que en esencia las situaciones de conflicto entre principios son muy similares, tanto en su estructura como en su modo de resolución, a las antinomias entre reglas. / In the contemporary legal practice, there are very often discussions related with legal elements labelled as “fundamental rights”, “constitutionally protected goods”, “superior values” and other substantive aspects, usually of a constitutional level. Also, the distinction between “legal principles” and “legal rules”, or concepts such as “weighing and balancing” have become in recent years some of the most basic theoretical tools of legal scholars and jurists. This work tries to offer a rigorous analysis about the conflicts between constitutional principles, weighing and balancing and the possibility of a single correct answer, and tries to give account of these matters from the scope of legal positivism and analytic philosophy. Some of the conclusions are that some deeply shared claims about legal principles and weighing and balancing should be abandoned or at least qualified, and that, in sum, conflicts between rules and conflicts between principles are very similar, both in their structure and in the procedures or mechanisms for solving them.

Vývoj uplatňování zásad daňového řízení v ČR / The development of application of the principles of tax process in the CR

This diploma work has, as its main objective, the investigation of the influence of the court judicature on the interpretation and application of the tax procedural rules, particularly their principles of the tax process and tax administration in the CR. The object of the investigation was to ascertain if the Act No. 337/1992 of Collection of Law, respecting the administration of taxes and charges, was a satisfactory and suitable procedural norm in the tax process, and if the principles of the tax process and existing judicature provided the tax subject and the tax administrator with an adequate legal certainty in these problems. First, I examined constitutional principles in the CR and the general principles of the administrative law in relation to the tax theory and tax administration. Then I moved on from principles of the tax theory to a detailed analysis of the court judicature in the interpretation and application of the principles of the tax process. I carried out a comparison of the existing, and the new, principles of the tax process and tax administration, which are govern commencing January 1, 2011, when the new Tax Rules came into force. In the diploma work, in the area of the principles of the administrative law, I dealt with the investigative question: To what extent it might be possible to use the existing Administrative Rules, in a subsidiary manner, in the tax process and tax administration, mainly focusing on all the principles stated in it, which are not included in the new Tax Rules.
