Regular Appeal in civil proceedings As it is the case in ordinary life also in judicial decision making, errors cannot always be omitted. A judicial decision can suffer from various defects that may have different characteristics or the judicial decision may not necessary suffer from such defects, but the litigants may consider it as defective due to them being unsatisfied with the unfavorable outcome. For this reason, the civil procedural code contains institutes that enable the modification, revocation or affirmation of a judicial decision. These institutes constitute the appellate procedure are subdivided into regular and extraordinary, depending on whether the litigants are appealing a decision that has already became valid or not. The aim of this diploma thesis is to focus on the current legal regulation of the appellate procedure with a strong emphasis on regular appeal in dispute proceedings. I chose this topic as the focus of my diploma thesis because it is the only regular remedy contained in the czech civil procedural code and therefore the most commonly used in judicial practice and also the one, I am most familiar with from my own professional experience. Appeal in civil procedure The aim of this diploma thesis is to describe the law regulation of appeal in czech civil procedure in connection with application of law by judges. I tried to describe the process of appeal procedure in Czech Republic and also describe a practical problem connected with application of law. This type of legal remedy is the most applied way how to examine or change the verdict of the judge. I have choosen the topic Appeal in civil procedure, because I am interested in civil procedure at all and in the future I would like to become a judge assistant. I think that knowledge of civil procedure is very important for each lawyer. The legal regulation of appeal and other legal remedies is enshrined in the legal act No. 99/1963, called Občanský soudní řád (Civil Procedure) in Czech Republic. The regulation we can find also in other legal acts (e.g. No. 292/2013 called Zákon o zvláštních řízeních soudních). This thesis is divided into twelve chapters, each charter is focused on different issue of this topic Appeal in civil procedure. Vliv daňové judikatury na průběh daňové kontroly v ČR / The impact of tax judicature on the process of tax audit in Czech Republic

The thesis focuses on the impact of courts tax practice on the procedure of tax audit in Czech Republic. The main purpose of the thesis was to evaluate the impact of tax judicature on the process of tax audit including the successive acts. Furthermore, the thesis should evaluate the view on tax administration of tax audit procedure reflecting the changes in judicature. The interpretation given by the judicature should be helping by illustration of the tax audit particular phases. Moreover, it should guarantee adequate level of peace to the tax subjects and tax administrators as well during this procedure. In the second part of the thesis, the particular phases of tax audit procedure were evaluated from the perspective of the tax code. This will be effective after January 1st 2011. In the course of the analysis it was shown the currently effective tax code is no more sufficient code of tax administration. It includes lots of deficits affecting the tax audit procedure. The courts tax practice covered these shortages greatly indeed. It also helped for better understanding of the current tax code tax audit paragraphs. Anyway, from the point of view of the controversy between two Czech main courts - the Constitutional Court and the Supreme Administrative Court - the absolute peace during the tax audit procedure is not achievable. From all these facts, as well as from the difficultness of following all the actual judicature concerned, I concluded, the function of the new tax code is unavoidable.

La protection internationale du travailleur migrant / The international protection of the migrant worker

La protection des travailleurs migrants est au cœur de l’actualité internationale. En effet, la mondialisation a relativisé la notion d’espace, et malgré la réticence des Etats à ouvrir leurs frontières à la circulation des personnes, les migrants représentent aujourd’hui 3% de la population mondiale, et les travailleurs migrants et les membres de leur famille 90% du nombre total de migrants. L’objet de cette étude est de s’interroger sur la manière dont le droit international protège les travailleurs migrants, et sur l’émergence d’un statut international à leur profit. Le traitement des travailleurs étrangers reste une question politiquement sensible, comme l’atteste le faible succès de la Convention des Nations Unies sur la protection de tous les travailleurs migrants et des membres de leur famille de 1990. Par ailleurs, la circulation internationale des personnes ne fait, sauf quelques rares exceptions, l’objet d’aucune concertation internationale. Pourtant les droits des travailleurs migrants, traditionnellement définis à partir de l’obligation internationale de traitement, vont considérablement s’étoffer grâce à une complémentarité du droit international du travail et du droit international des droits de l’homme. La complémentarité de ces matières offre également aux travailleurs migrants un nombre croissant de voies de recours dans l’ordre juridique international. Mais surtout la protection des droits des travailleurs étrangers fait l’objet d’une concertation international particulièrement dynamique, élément clé de l’effectivité de leurs droits. / The protection of the migrant workers is at the heart of the international current events. Indeed, the globalization put in perspective the notion of space, and despite the reluctance of states to open their borders to the movement of people, the migrants represent 3% of the world population today, and the migrant workers and members of their families representing 90% of the total number of migrants. The purpose of this study is to wonder about the way the international law protects migrant workers, and the emergence of an international status for their benefit. The treatment of foreign workers remains a politically sensitive question, as evidenced by the low weak success of the United Nations Convention on the Protection of All Migrant Workers and the Members of their Families in 1990. Moreover, the international movement of persons is not, with few exceptions, subject to any international consultation. Nevertheless the rights of migrant workers, traditionally defined from the international obligation of treatment will be considerably expanded through a complementarity of international labor law and the international law of human rights. Such complementarity also offers to migrant workers an increasing number of international legal remedies. But especially the protection of the rights of foreign workers is the object of a dialogue with international particularly dynamic cooperation, key element of the effectiveness of their rights.

Konstituierungsbezogene Rechtsbehelfe im schiedsrichterlichen Verfahren nach der ZPO

Mit den konstituierungsbezogenen Rechtsbehelfen behandelt die Arbeit den Aspekt personeller Konfliktsituationen eines schiedsrichterlichen Verfahrens nach der ZPO. Es geht insbesondere um die Fragen, wie Schiedsrichter bei unterbliebener Mitwirkung einer Partei bestellt werden, auf welchem Weg eine Verfahrenspartei einen Schiedsrichter ablehnen oder dessen Amt sonst beenden kann und wie gegen einen Schiedsspruch vorzugehen ist, wenn die Konstituierung nicht ordnungsgemäß verlief. Definiert und systematisiert werden die Grundsätze und Begriffe der Konstituierung (Kapitel 1 und 2) sowie die Konstituierungshindernisse und Kriterien für die Bestellung von Schiedsrichtern (Kapitel 3 und 4). Im Detail und mit Blick auf die Praxis folgt die Erörterung aller konstituierungsbezogener Rechtsbehelfe (Kapitel 5 bis 8): Während des schiedsrichterlichen Verfahrens handelt es sich dabei um die Verfahren der Ersetzung von Schiedsrichtern (§ 1034 ZPO), der Ersatzbestellung von Schiedsrichtern (§ 1035 ZPO) und der Nachbestellung (§ 1039 ZPO), der Ablehnung von Schiedsrichtern (§ 1037 ZPO) und der Beendigung des Schiedsrichteramts (§ 1038 ZPO). Abschließend wird untersucht, wie Fehler der Konstituierung in den Verfahren nach dem Schiedsspruch geltend zu machen sind, also im Aufhebungsverfahren (§ 1059 ZPO) und im Vollstreckbarerklärungs- oder Anerkennungsverfahren (§§ 1060 f. ZPO). Ausgewertet ist neben der schiedsverfahrensrechtlichen Literatur und Kommentierung insbesondere die umfangreiche Rechtsprechung. / The text discusses the legal remedies for and in connection with the constitution of the arbitral tribunal, in regards to any personal conflict of arbitral proceedings as per the German Code of Civil Procedure (CPO). Hence the focus is on questions of how an arbitrator is to be appointed if one party fails to cooperate, of how a party may challenge an arbitrator or otherwise terminate an arbitrator''s mandate, and of how to proceed with an arbitral award issued by an unduly constituted arbitral tribunal. Chapters 1 and 2 deal with the principles, terms and definitions of the arbitral tribunal’s composition. Chapters 3 and 4 systematise obstacles to such a tribunal’s composition, and the criteria for an arbitrator’s appointment. Chapters 5 to 8 continue with a detailed examination, and focus on current practice with all corresponding remedies. During the arbitral proceedings such remedies make provision for an arbitrator’s replacement (section 1034 CPO), the appointment of an arbitrator (section 1035 CPO) or substitute arbitrator (section 1039 CPO), the challenge of an arbitrator (section 1037 CPO), or the termination of an arbitrator’s mandate (section 1038 CPO). Finally, for cases where an arbitral award has already been granted, the text discusses how an unduly constituted tribunal may be dealt with through proceedings for setting aside an award (section 1059 CPO), or for an award’s enforcement or recognition (sections 1060 f. CPO). In addition to the literature on arbitration and the annotations of the CPO, the substantial amount of legal precedent is particularly evaluated.
