Pagrindinės sąvokos: konkurencijos teisės subjektas, viešasis konkurencijos teisės subjektas, teisinis vienetas, ekonominis vienetas, ekonominė veikla, valstybės funkcijos. Darbe autorė siekia nustatyti ir išanalizuoti ūkio subjekto kaip konkurencijos teisės subjekto požymius, atskleisti jų turinį bei teisingo nustatymo praktinę svarbą. Šiame darbe analizuojama ūkio subjekto kaip konkurencijos teisės subjekto samprata Lietuvos Respublikos ir Europos Sąjungos konkurencijos teisėje, aptariamos Lietuvos bei Europos Sąjungos konkurencijos teisėje egzistuojančios konkurencijos teisės subjekto sąvoką aiškinančios teorijos (teisinė ir ekonominė ūkio subjekto koncepcijos), išryškinami konkurencijos teisės subjekto sampratos Lietuvos Respublikos ir Europos Sąjungos teisėje neatitikimai ir prieštaravimai. Šiame darbe taip pat įvardinami bei atskirai analizuojami būtini, esminiai ūkio subjekto požymiai, kuriais savo jurisprudencijoje rėmėsi ETT pripažindamas ūkio subjektus konkurencijos teisės subjektais, t.y. ekonominės veiklos vykdymas, ūkio subjekto savarankiškumas. Aptarus esminius ūkio subjekto kaip konkurencijos teisės subjekto požymius, teisiniu požiūriu įvertinama ir pagrindžiama jų teisingo nustatymo praktinė svarba taikant konkurencijos teisės normas bei atsakomybę už konkurencijos teisės pažeidimus. The main aim of this work is to find out the features of undertakings, exhibit their content, and evaluate the practical significance of these features’ right identification. The author analyses the concept of undertaking according to European Union and Lithuanian competition law, discusses the theories which exist in Lithuania and in European Union (the concept of economic unit and the concept of legal unit) and points out the most important dissonances and contrarieties of the concepts of undertaking in Lithuanian and European Union competition law. In this work the author also identifies and analyses the main fundamental features of undertakings, which followed European Court of Justice (according to explications of the European Court of Justice independent entity engaged in an economic activity must be acknowledged as an undertaking). The charge for improving the services provided by the Judiciary arises as the new social reality clashes with the former remnants of the bureaucratic management of the Judiciary. The answer to this social demand is made necessary by the revision and reformulation of concepts, structures and organizational culture. In this way, management concepts and their consequent implementation are also necessary for judicial activities. In this sense, the present work aims to provoke a critical analysis and reflection about the management of the first-level judicial units included in the organizational structure of the Labor Justice of the 2nd Region - SP, responsible for beginning of the process and for the initial management of labor demands. The analysis, as well as the reflection proposed by this work, will fall on the public service provided by labor judicial units, according to the provisions of Article 37, “caput”, of the Brazilian Political Charter and of the Constitutional Amendment (EC) n.45/2004. It will be analyzed the principle of efficiency inscribed in the Brazilian Federal Constitution applied to the Public Administration, as well as the state judicial structure of the Labor Court, the management system of the judicial units available for the realization and delivery of the judicial service. This work proposes the abandonment of the bureaucratic management model, seeking the development of a judicial management that allows the maximized and rational use of the available human resources, technological and financial materials, so that the efficiency of the judicial performance is recovered, enriching the results of the organization of the Labor Justice - 2nd Region and that consequently strengthens the legitimacy of the Judiciary Power. Therefore, this scientific research aims at enriching the discussion that is held in Line 1 of the Master's Program in Law at Nove de Julho University called ‘Justice and the Efficiency Paradigm’, in order to foster study in this field and to propagate critical debates about reality experienced by the Judiciary. / Atualmente, na sociedade brasileira, a prestação jurisdicional eficiente e eficaz constitui uma exigência social e constitucional. A cobrança pela melhoria dos serviços prestados pelo Poder Judiciário surge à medida que a nova realidade social se choca com os antigos resquícios da gestão burocrática do Poder Judiciário. A resposta para esta exigência social se faz necessária com a revisão e reformulação de conceitos, estruturas e cultura organizacional. Desta maneira, os conceitos de gestão e sua consequente implementação se fazem necessários também às atividades judiciais. Neste sentido, o presente trabalho almeja provocar uma análise e reflexão crítica acerca da gestão das unidades judiciais de primeiro grau inseridas na estrutura organizacional da Justiça do Trabalho da 2ª Região – SP, responsáveis pelo início do andamento processual e pelo gerenciamento inicial das demandas trabalhistas. A análise, assim como a reflexão proposta pelo presente trabalho, recairá sobre o serviço público prestado pelas unidades judiciais trabalhistas, a teor do disposto no art. 37, “caput”, da Carta Política brasileira e da Emenda Constitucional (EC) nº. 45, de 2004. Será analisado o princípio da eficiência insculpido na Constituição Federal brasileira aplicado à Administração Pública, bem como a estrutura estatal judiciária da Justiça do Trabalho, o sistema de gestão das unidades judiciais disponíveis para a realização e a entrega da prestação jurisdicional. Este trabalho propõe o abandono do modelo burocrático de gestão, buscando o desenvolvimento de uma gestão judicial que viabilize o aproveitamento maximizado e racional dos recursos humanos, materiais tecnológicos e financeiros disponíveis, de modo que seja resgatada a eficiência da prestação jurisdicional enriquecendo os resultados da organização da Justiça do Trabalho – 2ª Região e que consequentemente fortaleça a legitimação do Poder Judiciário. Destarte, esta pesquisa científica almeja enriquecer a discussão que se trava na Linha 1 do Programa de Mestrado em Direito da Universidade Nove de Julho designada ‘Justiça e o Paradigma da Eficiência’, no intuito de fomentar o estudo neste campo e propagar debates críticos acerca da realidade vivenciada pelo Poder Judiciário.
