Strategie žalovaného v medicínskoprávních sporech o odčinění nemajetkové újmy způsobené postupem non lege artis / Strategy of the defendant in medical litigations over damagesformedical malpractice resulting in injury or death

1 Abstract The thesis is focused primarily on medical litigations in which either patient or (usually) his family apply for a remedy due to a medical malpractice (deviation from medical proffesional duty of care (lex artis) resulting in injury or death of the pacient. Author concentrate on this problematics from the perspective of defendant. At first, he think about setting targets of the hospital (defendant) in the dispute, then he consider ways to achieve these goals (which instruments can be used) . The thesis also consists of analyses of 20 medical litigations. Before the main part author introduces general theoretical questions and refer to the literature on which he based his thesis, as he decided to not deal with general issues. In this context he mentions areas to which, according to him, the doctrine does not yet provide answers. The author's research follows these questions and in following text he concentrates on them and tries to find the answers to controversial questions. These includes, for example, whether in practice the concept of "další nemajetkové újmy" is fulfilled the intention of the lawgiver, wheter the regulation of liberation of liability is applicable in medical litigations and what is its relationship with the "lex artis corrections". Configuración actual del consentimiento informado en la lex artis y como garantía de los derechos constitucionales; presupuestos de la responsabilidad civil ante su vulneración

La evolución de la profesión sanitaria y de la sociedad han dado lugar al abandono del paternalismo clásico y al nacimiento de la etapa de toma de decisiones compartida. La manifestación más directa de este cambio de paradigma ha sido el reconocimiento del derecho al consentimiento informado. En nuestro país, la plasmación del mismo se produjo con la aprobación de la Ley 41/2002, de 14 de noviembre, básica reguladora de la autonomía del paciente y de derechos y obligaciones en materia de información y documentación clínica. En suma, se concreta en un derecho de configuración legal que supone el reconocimiento, a todos los pacientes, de dos facultades íntimamente conectadas: de un lado, poder conocer el estado de su salud y las implicaciones de la intervención que, en su caso, deba llevarse a cabo; de otro, tras recibir esta información, decidir lo que estime más adecuado en este ámbito. Además, como tuvo ocasión de destacar nuestro Tribunal Constitucional, el consentimiento informado tiene implicaciones constitucionales en tanto en cuanto opera como una garantía del derecho a la integridad física y moral (art. 15 CE). Asimismo, lo cierto es que también pueden verse comprometidos otros derechos constitucionales como la libertad o la dignidad. De esta suerte, la tutela del consentimiento informado aparece como imprescindible, ya que, de otro modo, los usuarios de los centros de salud no podrán desarrollar su facultad de autodeterminación y su autonomía de la voluntad. En este sentido, entendemos que la responsabilidad civil merece ser repensada a la luz de los mandatos de nuestra Carta Magna, ofreciendo un sistema de reparación que sea respetuoso con los mismos.

Pojem lege artis v systému veřejného zdravotního pojištění / The concept of lege artis in the system of public health insurance

Summary: The subject of this paper is providing of lege artis health care in the system of public health insurance. The aim of the thesis is to analyse the basic terminology, current legislation and its application in practice. Lex artis is in law an uncertain term, difficult to define, therefore its frequent usage should be restricted in the future. Due to the personal experience of the author there are many practical examples from the Czech health care system used in the paper. Related case law is taken into account continuously with the exception of the separately stated recent court judgment of the Constitutional Court of the Czech Republic. The study is divided into four main chapters, introduction and conclusion. The first chapter is dedicated to the concept of lege artis in detail, its terminology and relation to the current legislation. Further subchapters deal with available health care standards and their obligation. The final parts analyze the lege artis restrictions and way of its assessment. The second chapter is dedicated to the concept of public health insurance. First, the term is defined and the current law is considered. An issue that has always caused controversy, both in the theory and in the practice, is the application of the law over time, which becomes more complex in terms of its non-retroactivity or retroactivity. In the present article, the author develops theretroactivity of the most favorable rule principle. First, the author describes the concept and fundamentals of retroactivity. Then, he reports its normative support and its delimitation. Finally, the author exposes the most discussed and controversial assumptions on its application and non-application, making parallels with its regulation in Spain. / Un tema que siempre ha causado controversia, tanto en la teoría como en la práctica, es la aplicación de la norma jurídica en el tiempo, la cual se complejiza en cuanto a su irretroactividad o retroactividad. En el presente artículo, el autor desarrolla el principio de la retroactividad de la norma más favorable. En primer lugar, describe el concepto y fundamentos de la retroactividad. A continuación, informa sobre su sustento normativo y su delimitación. Finalmente, expone los supuestos discutidos sobre su aplicación e inaplicación, haciendo un paralelismo con su regulación en España.

I Lex Aquilia and delict damnum iniuria datum of roman law Abstract The subject of this thesis is the Lex Aquilia and the delict of unlawfully caused damage (damnum iniuria datum) contained in this law. The aim of the thesis is a comprehensive analysis of the Lex Aquilia as one of the most important Roman laws and the introduction of damnum iniuria datum contained in it as a universal delict for cases of damage claims in a wide range of cases of killing animals or slaves, cases of damaged things or complete destruction of property. The first part of the thesis serves as an explanation of key concepts from a general point of view, which are necessary to grasp the subject. The concepts of obligation and delictual liability, Roman categorisation of delicts into delicta privata and crimens, and the role of lawsuits (actio) and standing in Roman law are introduced. Furthermore, the sources of the regulation of delict law, primary sources including the Corpus Iuris Civilis, and also various authors most notably Roman lawyer Ulpian, are presented in a brief manner. La production de règles d'origine non étatique se développe dans les rapports internationaux privés. L'analyse de ces règles dans les activités commerciale et sportive construit progressivement une définition unifiée de la notion de droit non-étatique : ensemble des règles écrites et unilatéralement élaborées par des acteurs privés et/ou publics, ayant vocation à s'appliquer eu égard à l'activité considérée, indépendamment des frontières étatiques. Cette proposition est mise à l'épreuve des diverses interactions entretenues par le droit non-étatique, visant à en expliquer le fonctionnement. L'arbitrage atteste sa réception, la fréquence de son application, voire sa promotion, jusqu'à l'exclusion de législations nationales impératives. L'ordre juridique français, par principe, refuse la réception de ce droit, hormis action exceptionnelle des juges, du législateur ou d'organes auxquels il est reconnu compétence. À un niveau supra-étatique, la Cour de justice contrôle directement les règles non-étatiques susceptibles d'entraver les libertés garanties par l'Union européenne, dont la libre circulation des travailleurs. La Cour européenne des droits de l'homme a la possibilité de contrôler indirectement les règles non-étatiques transposées par des États, en raison d'atteintes potentielles aux libertés individuelles, dans le cadre de la lutte contre le dopage par exemple. Le droit international privé, par ailleurs, contribue à rendre compte de l'application du droit non-étatique, en renforce l'efficacité, et participe, potentiellement et à titre prospectif, de la résolution de conflits de normes produits par des règles non-étatiques. / The production of non-state norms is growing in private international relations. The analysis of these norms in commercial and sporting activities is progressively building a unified definition of the notion of non-state norms: set of rules written and unilaterally drawn up by private and/or public actors, has intended to be applied with regard to the activity concerned, regardless of State borders. This proposal is put to the test of the various interactions maintained by non-state norms, in order to explain how these norms work. Arbitration attests to its receipt, the frequency of its application and even its promotion, up to the exclusion of imperative national rules. The French legal system, as a matter of principle, refuses to accept these non-state norms. Exceptionally, this principle is contradicted by the action of judges, legislators or bodies whose competence is recognized by the French legal system. At a -supra-state level, the Court of Justice directly controls non-state norms which may hamper the freedoms guaranteed by the European Union, including the free movement of workers. The European Court of Human Rights has the possibility of indirectly controlling non-state norms transposed by States, due to potential breach of individual freedoms, for example in the fight against doping. Moreover, Private International Law helps to explain the application of non-state norms, enhances their efficiency, and potentially and prospectively participates in the resolution of conflicts of norms produced by non­state norms.

Smluvní závazkové vztahy v mezinárodním právu soukromém / Contractual obligations in private international law

The objective of this Master's thesis is to analyze the rules of law governing contractual obligations in private international law. First, the relevant sources of law and their concrete application are examined through descriptive and analytical method. The thesis is then focusing on two specific phenomena that have significantly influenced the development of the field in the last few decades. The first one is a gradual process of unification taking place at the legislation level. The second one is called "new lex mercatoria" and represents a non-sate source of rules governing contractual obligations with a cross-border element. Both of the phenomena are analyzed from both theoretical and practical point of view. The thesis is divided in five chapters and the analysis progresses from a general to a more specific level. The first chapter focuses on the legal definitions indispensable for a more detailed analysis provided in the following chapters. In order to better contextualize the rules governing contractual relationships in the international private law, the second chapter is dedicated to its historical evolution.
