Legal regulation of public librarianship Abstract: This diploma thesis focuses on legal regulation of public librarianship. It is divided into two main parts. Part I deals with the actual state of legal regulation in this field. It presents an overview, a detailed analysis and evaluation of all librarianship-related legislation. Following chapters are dedicated to copyright aspects of library services, personal data protection and the institute of obligatory copy. This first part concludes with suggestions where and how the current regulation could be improved. Part II brings historical comparison of three library acts. Czech librarianship was from the very beginning of the existence of independent Czechoslovakia influenced by special legal regulations - library legislation. Fundamental directives, which were adopted in the course of approx. 80 years [Law No. 430/1919 Coll. - The General Public Libraries Act, Law No. 53/1959 Coll. - the Unified System of Libraries Act (Librarian Act) and Law No. 257/2001 Coll., on Libraries and Terms of Operating Public Library and Information Services (Library Act)] were very dissimilar; each addressed the issue differently and from a different perspective depending on the political and social situation of the time. Recent legislation in Sweden mandates that all students beprovided access to a school library. In addition, schools areexpected to help students become independent and life-longlearners. Various national organizations stress theimportance of a school library in this process; however,reportedly independent schools use public libraries and theInternet for information activities instead. This studyexplores: 1) how independent schools in Sweden can meetboth government requirements to provide library accessand the information literacy demands of their students, and2) the function of digital libraries in this context. After acomparison of previous research, a qualitative method waschosen based on socio-cultural theoretical assumptions.Semi-structured interviews were conducted with aprincipal, a teacher, and a focus group of students from twoindependent schools. Through a process of open coding,important themes emerged concerning how libraries andinformation literacy are conceptualized. There is a strongtendency to see libraries in terms of a physical function(books on shelves) over social activities (e.g., integrationwith teachers, development of information literacies,collection management). Students rely first and foremoston Google during the information seeking process, but alsoconsult each other for help. There are also signs thatstudents are discouraged from asking their teachers for helpduring the information seeking process. Die polnischen Bibliotheksgesetze - eine Analyse ihrer Bedeutung für das polnische Bibliothekswesen

Die polnische Bibliotheksgesetzgebung hat eine gefestigte Tradition. Seit der Wiedererrichtung des polnischen Staates im Jahr 1918 streben polnische Bibliothekare eine rechtliche Grundlage für das Bibliothekswesen im Land an. Ihre Bestrebungen münden letztlich im Dekret über Bibliotheken und die Betreuung von Bibliotheksbeständen vom 17. April 1946, das später durch das Gesetz über Bibliotheken von 1968 ersetzt wird. Im Zuge der Transformation nach 1989 tritt am 27. Juni 1997 ein neues Bibliotheksgesetz in Kraft. Die vorliegende Arbeit setzt sich mit der polnischen Bibliotheksgesetzgebung auseinander. Sie macht den deutschen Leser mit dem polnischen Verständnis der Begriffe „Bibliotheksrecht“ und „Bibliotheksgesetz“ vertraut, gibt einen Überblick über den Verlauf der Entstehungsgeschichte der polnischen Bibliotheksgesetze, beschreibt ihren Inhalt und beleuchtet ihre Realisierung. Auf der Basis der theoretischen Erkenntnisse setzt der anschließende empirische Teil der Studie auf, in dem die Bedeutung der polnischen Gesetze für das polnische Bibliothekswesen ermittelt wird. Dabei wird die Eignung dieser rechtlichen Grundlage als ein Instrument zur Gestaltung des polnischen Bibliothekswesens fokussiert. Die Bedeutung der polnischen Bibliotheksgesetze für das polnische Bibliothekswesen wird mithilfe von Experteninterviews untersucht. Als Akteure wurden fünf Bibliothekare, welche die polnische Bibliotheksgesetzgebung in besonderem Maße kennen, in polnischer Sprache befragt. Ihre Aussagen dienen der Bewertung der polnischen Bibliotheksgesetze in Bezug auf ihre Bedeutsamkeit. / Polish library legislation has a strong tradition. Ever since the re-establishment of the Polish state in 1918, Polish librarians have been striving towards a legal basis for the library system in the country. Their efforts ultimately led to the Decree of April 17, 1946 on libraries and on the protection of library collections, which was then replaced by the law on libraries in 1968. As part of the transformation after 1989, a new library law came into effect on 27 June 1997. This thesis will deal with the law-making for libraries in Poland. It will introduce the German reader to the Polish understanding of the terms 'library law' and 'library legislation', provide an overview of how the history of Polish library laws unfolded, describe their content and shed some light on how they are implemented. Based on the theoretical findings, the subsequent empirical part of the study will demonstrate the significance of the Polish laws for the Polish library system. In doing so, it will focus on the suitability of this legal basis as an instrument for shaping and re-shaping the Polish library system. The significance of the Polish library laws for the Polish library system is examined with the help of expert interviews. Surveys were held in Polish with five librarians who know the ins and outs of library legislation in Poland. Their comments serve to the evaluation of Polish library laws in regard to their significance.

Ideal och praktik : En fallstudie av ungdomsbiblioteket PUNKTmedis i relation till bibliotekslagen / Ideals and Practice : A case study of the youth library PUNKTmedis in relation to the Swedish Library Act

This two-year master thesis aims to examine how the Swedish Library Act affects the youth library PUNKTmedis and its librarians. Through a case study and by using a socio-cultural and a norm critical perspective, the study discusses three main questions: 1. How do the librarians view the new law and how do they apply its new directives at PUNKTmedis? 2. Have they made any changes to the planning and execution of reading promotion activities since the law came into force? What activities are there currently in the library and how are they considered to promote reading? How does the library work with a broader literary concept and a broader view of what reading is? 3. How do the librarians at PUNKTmedis work with the assignment to give special attention to children and young people to promote their reading, with their specific focus on girls who already read, especially since research and reports all too often lifts boys' reading as waning? How deeply rooted is the librarians’ commitment? The study finds that the effect the Library Act has on PUNKTmedis is that it inspires the work of the librarians, due to formulations such as a “broader literacy concept” and the ability to work with different formats regarding the media in the library. The library offers many different reading promotional activities due to this. But the library has not really changed their way work since the new law was enforced, which might be because they are a youth library and don’t need to be as traditional as a regular public library. In addition to that, the librarians feel that the law is rather weak. Regarding to how the librarians at PUNKTmedis work with the assignment to promote reading, the study finds that the librarians try to work towards the individual, but by having a profile towards girls who already like to read, they make them visible in contrast to the boy norm.

Det mångspråkiga skolbiblioteket : En viktig fråga i teorin men en icke-fråga i praktiken? / The Multilingual School Library. : An Important Question in Theory, but not in Reality?

While almost 23 percent of the students in the Swedish upper secondary school are foreigners, only a fraction of the school libraries’ collections consists of literature written in other languages than Swedish or English. This study examines how five school librarians experience the task of working with literature composed in foreign languages in the multicultural and multilingual school of today. The results of the qualitative interviews are analyzed in relation to the legislation and policy documents that the school libraries are working by, and also in relation to the theoretical framework of sociocultural theory and the theories on second language acquisition developed by linguist Jim Cummins. The study shows that while multilingualism is discussed as an important matter in the legislation and policy documents that the school libraries work by, the librarians in this study largely view the question of foreign literature as peripheral. Most part of the librarians connects first language reading to leisure-time activities rather than curricular activities, and stresses that the Swedish language should be prioritized in Swedish schools. The paper is a two years master’s thesis in Archive, Library and Museum studies.

Prezentace knihovních služeb veřejnosti : analýza současného stavu v Nizozemsku a v České republice / Presentation of Library Services to the Public : Analysis of Current Situation in the Netherlands and Czech Republic

The aim of this thesis is to compare the actual presentation and communication of library services to the public in the Dutch and Czech public libraries. Monitored were primarily legislative frameworks of mentioned countries, branch organizations and their marketing activities supporting public libraries. Theoretical knowledge was supplemented by practical findings gained during the study tour undertaken in the Netherlands. During this study tour were identified specific methods of promotion of public library services. Thesis explores these methods and outlines the possibility inspiration from Dutch library practice. The work proposes an innovation of Czech public library services using the retail concept as part of the open access collections, which was observed and verified in the Netherlands. The final comparison of selected factors on the national level provides a brief overview of librarianship in both countries.

Its aim is to assess the current state of museum libraries in Prague, using a questionnaire survey accomplished in early 2011. In the descriptive part of the thesis is first briefly mentioned the history and basic legislation of museum libraries in Prague. Then follows a detailed description of the current state according to the specifics (founders, focus and scope of the collections, acquisition and processing of library collections, services and access to the collections, digitization, library presentation on the Internet, the current methods of financing options for museum libraries, library position within the museum etc.), activities and cooperation of the museum libraries in Prague and the illustrated examples of four museum libraries in Prague (National Museum Library, Library of the Jewish Museum in Prague, Library of the Museum of Decorative Arts in Prague and Library of National Technical Museum). In further part of the thesis is described in detail survey questionnaire method based on established facts and summary by the current state of museum libraries in Prague and their respective strengths and weaknesses. The importance of legislation in the provision of national and public library services in Zambia

Text in English / Legislation plays an important role in the provision of public and national library services. However, in Zambia libraries that perform the functions of public and national libraries are operating without a legislative mandate. As a result, there is a fragmentation of library services as there is no single institution which performs all the functions of a national library service. Although several efforts were made before to enact national library service legislation, no Act of Parliament has been passed to date (2014). This study sought to provide empirical evidence to refine our insight of the benefits of having national library service legislation and the consequent implications of not having any legislation in the provision of library services. Quantitative data was collected through questionnaire administration to public library staff; interviews with senior government officials, and executive members of the ZLA and ZALICO; and document analysis on text from grey literature. The existence of the statistical significance of association between “Importance of library legislation” and “Provision of library services in Zambia” was measured and confirmed using Pearson chi-square χ2. Public library facilities, services and collections in Zambia were found to be below par, and it was concluded that this was due to lack of library legislation. The study recommends that appropriate legislation that puts together the functions of public and national libraries under one institution be enacted in Zambia as soon as possible. It is also recommended that further research be undertaken to investigate the current status of library facilities, services and collections in selected neighbouring countries where library legislation has been passed. / Information Science / M.A. (Information Science)
