Problems of Trademark Licensing / Teisių į prekių ženklus licencijavimo probleminiai aspektai

Analysis of dissertation is focused on problematic aspects of trademark license agreement that exist throughout the conclusion, validity and termination of a contract. Problematic aspects are understood as legal interpretation cases where common and special norms have to be interpreted taking into account specifics of a contract object (right to a trademark). Problematic aspects are conditioned by two reasons: non comprehensive regulation of trademark license and sui generis nature of a contract. Those aspects are related to registration of license in trademark register, legal status of parties of license agreement, right to a trademark (its validity and modifications), transfer of a right to trademark, competition law, delimitation of trademark license agreement from other types of agreements and other problematic aspects. It is concluded that trademark license registration system does not correspond to the tendencies of modern trademark law anymore and registration system should be transformed by refusing of license registration as a condition to use license against third parties, however, leaving a possibility to register license if any of the parties wish to do so; right to apply to a court should be broadened for a non-exclusive license; licensee should not be per se deemed acting unfairly if he takes an action to revoke a trademark that is being license to him because of non use or invalidate it is because of non compliance to absolute grounds; absence of quality... [to full text] / Disertacijoje nagrinėjami prekių ženklo licencinės sutarties probleminiai aspektai, egzistuojantys licencinės sutarties sudarymo, jos galiojimo ir pasibaigimo metu. Probleminiai aspektai darbe suprantami kaip sutartį reglamentuojančių teisės normų aiškinimo atvejai, kuriems esant bendrąsias ir specialiąsias teisės normas būtina aiškinti atsižvelgiant į sutarties objekto (teisės į prekių ženklą) specifiką. Probleminiai aspektai yra sąlygojami dviejų priežasčių: neišsamaus licencinės sutarties reglamentavimo ir sui generis sutarties pobūdžio. Tai aspektai, susiję su sutarties registracija prekių ženklų registre, su sutarties šalių teisiniu statusu, su teise į prekių ženklą (jos galiojimu ar modifikavimu), šios teisės perdavimu, konkurencijos teise, licencinės sutarties atribojimu nuo kitų sutarčių ir bei kiti probleminiai aspektai. Darbe daromos išvados, jog prekių ženklų licencinių sutarčių registracijos sistema neatitinka šiuolaikinės teisės tendencijų ir licencinės sutarties registracijos kaip sąlygos sutartį panaudoti prieš trečiuosius asmenis turėtų būti atsisakyta, tačiau paliekant galimybę registruoti sutartį vienos iš sutarties šalių valia; siūloma išplėsti neišimtinio licenciato teisės kreiptis į teismą ribas; pažymima, kad licenciato veiksmai ginčijant jam licencijuojamą ženklą remiantis absoliučiais ženklo negaliojimo pagrindais ar dėl ženklo nenaudojimo neturėtų būti laikomi savaime nesąžiningais; licenciaro atliekamos kokybės kontrolės licencinėje sutartyje... Utveckling av licenshanteringssystem för kontroll av programåtkomst

Ett system utvecklades för företaget Monitor i Hudiksvall. Syftet var att skapaett system som kan kontrollera vilka funktioner ett program kan komma åtutifrån den licens som kunden har betalat för, i form av en licensfil. En analysav företagets befintliga licenshanteringssystem gjordes för att identifiera vilkaproblem som behöver lösas i det nya systemet. Arbetet har använt en agilmetod med små inkrementella leveranser och ständig kundkontakt. Eftersomsystemet fungerar som ett API och använder sig av nätverkskommunikationöver potentiellt osäkra nät, har kryptering av datatrafik med tekniken SSL/TLSanvänts. Eftersom licensfilen lagras på en klients dator har det utvecklats enmetod för att verifiera att den filen inte har manipulerats hos klienterna för attpotentiellt ge extra funktioner som de inte har betalat för. Det resulteradesystemet är en fungerande prototyp som implementerar två stycken klienter: ettadministrationsverktyg och ett fingerat kundprogram med olika funktioner däråtkomst bestäms av licensfilen som kan verifieras både off-line och on-line. Detresulterande systemet har testats i form av ett prestandatest ochanvändningstest. Resultateten av de testerna visar att prestandan är god ochsystemet är korrekt.

This work concerns with possibilities of licensing. There are mentioned advantages and disadvantages of particular models. Further on, the prediction of future situation in the IT market, new techniques, trends and reasons of these changes are introduced. Work addresses to both types of software -- proprietary software and Open Source software. Next part of work deals with software piracy and problems, which are connected with it. In second part of the work are theoretical knowledge converted into practice. There is examined license politics of Microsoft and possibilities which are offered to different customers. The final part concerns with two firms which operate on Czech market. There is a view to licenses, which are owned by firms, followed by recommendation of optimization.

Correct and financially optimal covering of licensed software is one of the aims of all companies. Microsoft Corporation offers a wide range of software products and also various types of license financing that significantly affect their financing. License models stating the correct rules of using the licenses for software groups are also very specific and require a thorough understanding of its principles. These two areas include a range of partial aspects that are to be considered from the point of view of company benefit. However, a complex view combining license programs and license models is equally important. Hence the issue of license management is problematic not only for the management of the company, but also for the IT specialists. This thesis embeds the issue of licensing into the frame of strategic IT planning and by means of annotated principles, descriptions of everyday situations and accentuating details significantly affecting licensing provides a perspective of the issue that has not been dealt with in such an elaborate way so far. The aim of this thesis is to provide a complex analysis of license programs and models, their principles and possibilities. In many companies, a detailed knowledge and understanding of the issue of Microsoft licensing is very important. Therefore, this thesis provides some specific output instances in the form of both financial and functional comparison of individual licensing programs. The crucial services of license programs and characteristics of license models are investigated in detail and subject to critical evaluation for purposes of utilization in companies of various sizes and types.

The United States of America is facing an important decision. Should illegal immigrants be allowed to obtain driver’s licenses? Thus far ten states and the District of Columbia as well as Puerto Rico have passed laws permitting this to come into fruition. The purpose of this thesis is to gain an understanding of the significance that licensing laws have on this country. This thesis will compare the views and beliefs of both the proponents and opponents to this law. This thesis also discusses how Florida is deeply affected due to its large Hispanic immigrant population. This issue is laden with passion and emotion due to the desire of many to see this group of people that are currently undocumented, have the ability to lead a more normal life and conversely the fear that allowing licenses will give undocumented aliens privileges of citizens and encourage illegal immigration. The views on these laws are divided throughout the nation. The lawfulness is examined in reference to rewarding and promoting illegal immigration and the cumulative negative effects that this can have on this country. The driver’s license requirements were analyzed for each individual state. News articles were researched and used to enrich the pros and cons on this topic. This research was then used to give a recommendation for Florida law

The purpose of this thesis is to deal with copyright law institutes which are applied in a theatre field. It is important to bear in mind that there is not special legal regulation of copyright law when it comes to the theatre field. The reason is most likely because of diversity within art, which is not easy to be covered by legal regulations. Also there is not enough space for theatre field as it is necessary in Czech copyright law. Another goal of this thesis is to provide audience from theatre field with information included in this work. That fact was also taken into account. Besides introduction and conclusion the thesis is devided into ten chapters. Firstly there is a list of theoretical terms which are essential for understanding the thesis and later there is analysis of specific institutes. Introducing chapter number two defines list of theoretical terms from both theatre and copyright law field. Only a few of them are explained for easier understanding of following chapters. Author's Contract Law The aim of the thesis is to analyze legal regulation of license agreements within the legal branch of "droit d"auteur", or "author"s right". The main object of interest is typified license agreement, which serves as a standard contractual type to exercise authors" economic rights to their works. Recently issued Czech Civil Code shall become applicable on January 1, 2014. Unlike the currently applicable Civil Code, which leaves the regulation of license agreements to special acts, the new code includes provisions which regulate license agreements for the whole area of intellectual property, i.e. author"s right, as well as industrial property. This regulation is in line with a tendency to unite provisions that deal with license agreements, since a unification process concerning contract licenses within author"s right, has already happened with the enactment of the current authors" code in the year 2000. A comparative review of the current "droit d'auteur' and future civil regulations of author"s type license agreement takes a significant part of the thesis. Thesis advisor: Hideo Konishi / This paper will review prior research to support the notion that innovation does in fact lead to a competitive advantage for business, and that this competitive advantage is translated into increased profitability and productivity. Though the body of work reviewed here will by no means unequivocally prove that this relationship always holds true in real-world markets, it will provide a convincing argument that fostering innovation will likely have positive economic affects. Building off this assumption, this paper will then focus specifically on examining the relationship between environmental regulation and innovation in more detail. This paper looks to answer the question: Under what conditions will environmental regulation cause firms to begin choosing to innovate technologically rather than simply to meet regulation with compliance?
