Socialinių paslaugų administravimas: Šiaulių rajono savivaldybės atvejis / Social services administration: case study of Šiauliai district municipality

Bakalauro baigiamajame darbe nagrinėjamas socialinių paslaugų administravimas savivaldos lygmenyje. Tyrimo tema neabejotinai aktuali ir svarbi šiandieninei savivaldybių praktikai, nes socialinių paslaugų administravimo sistema, kaip tokia šiuolaikinėje valstybėje, reikia pripažinti, dar nėra iki galo sukurta Lietuvoje. Sparčiai kintantys visuomenės socialiniai poreikiai skatina ieškoti optimalių socialinių paslaugų administravimo būdų. Tačiau neefektyviai administruojant socialines paslaugas gali sulėtėti jų plėtros procesas ir nespėti atitikti šių dienų poreikių bei tendencijų. Baigiamąjį darbą sudaro dvi dalys. Pirmoje dalyje nagrinėjamas socialinių paslaugų administravimas teoriniu aspektu. Apžvelgiamas socialinių paslaugų administravimas mokslinės literatūros šaltiniuose, Lietuvos Respublikos įstatymuose ir poįstatyminiuose aktuose. Antroje baigiamojo darbo dalyje pristatomas socialinių paslaugų administravimo Šiaulių rajono savivaldybėje tyrimas. Tyrimo tikslas – atskleisti socialinių paslaugų administravimo ypatumus Šiaulių rajono savivaldybėje. Pagrindinė socialinių paslaugų įgyvendintoja vietos savivaldoje yra Šiaulių rajono savivaldybė, nes joje labiausiai išryškėja žmonių socialinės problemos, identifikuojamas tikrasis vietos gyventojų poreikis socialinėms paslaugoms. The theme of the research is certainly relevant and important for today’s practice of municipalities since the social services administration system as a phenomenon in modern state, is not completely finished in Lithuania. Rapid changes of the social needs of the society induce to look for optimal ways of social services administration. However, inefficient administration of social services may slow down their development process and may not meet today’s needs and tendencies. The work consists of two parts. The first part analyses the social services administration in theoretical terms. Social services administration is overviewed in scientific literature sources, the laws of the Republic of Lithuania and executive acts. In the second part of the final thesis the research on the social services administration in Šiauiai district municipality is presented. This thesis deals with the essential aspects of the local referendum as a widely used complement of representative democracy and with the particular forms it appears in the Czech and Slovenian legal orders. The main objectives of this thesis are following: describing Czech and Slovenian legal regulations concerning the local referendum in detail, exploring certain areas of its practical use and finally concluding whether there is any significant difference in the way these two countries, that share similar experience historically and of the recent years too, approach direct democracy and the institute of the local referendum in particular. The body of the thesis is made up of nine chapters. In the first chapter Introduction I clarify what led me to focus on the respective issues. The second chapter Idea of Direct Democracy tackles the origins and the essence of direct democracy, its potential to be used in the modern world and also briefly describes those institutes of direct democracy that are used in the Czech and Slovenian practice. 55 Abstract This diploma thesis gives an insight into the system of control and supervision procedures applied to local self-governments. The aim of this work is to evaluate possible problematic aspects of established supervisory procedures applied to budgetary management and to assess whether it is needed to extend the Supreme Audit Office's competence by enable it to control the budgetary management of local self-governing units with their own assets. The introductory chapter briefly summarizes the issue of budgetary management of local governments, while a more detailed interpretation is devoted to the duty of the local self-goverments to comply with the rules of budgetary responsibility, which was brought by Act No. 23/2017 Coll., On rules of budgetary responsibility, as amended. Fiscal Decentralization and Municipal Budget Policy in Countries with Economies in Transition: Comparing Local Revenue Systems

The thesis explores the effect of fiscal decentralization on local governments budgeting and fiscal autonomy in selected transition countries of Central and Eastern Europe. The implications of legislative changes on local budgets and revenue authority are analyzed. Discrepancies between legal provisions and actual fiscal practices are identified on the basis of case studies of four countries: Bulgaria, Georgia, Hungary, and Lithuania. The study explores some specific approaches to dealing with local finances based on the respective countries' fiscal legislation. An attempt is made to evaluate local revenue authority based on both comparable statistical data and legal provisions of the selected countries. Following a comparative conceptual framework, the thesis reveals both unique and common patterns of budget policy and local revenue raising authority in each of the four countries. The results of the inquiry indicate that despite the greater fiscal authority and independence which local authorities gained during the transition, local governments in many CEE countries continue to operate within old centralized fiscal structures and budget policies. The right balance between the need for decentralization of governance and the ability and desire of local authorities to control and steer the local revenue policies is still to be found. / Master of Urban and Regional Planning

"Ústavněprávní vymezení kontrolních mechanismů územních samosprávných celků" / Constitutional definition of the mechanisms of control of territorial self-governing units

The aim is to answer the question of whether effective control mechanisms exist in the Czech Republic which would guarantee the fulfilment of legal regulations by municipalities and regional authorities dealing with public property. It is also my aim to explore whether such control mechanisms result from the constitutionally guaranteed rights to local government and, if they do, to what extent they may be incorporated in the Czech legislation. My diploma thesis is based on specific case studies, the case law of general courts and the current jurisprudence of the Czech Constitutional Court. After the description of the current state of affairs in the Czech Republic, I further focus on the definition of the control mechanisms of local governments in Czechoslovakia between the two world wars (1918 - 1938) and partly also during the Austro-Hungarian Empire. This diversion leading to this era has been selected to reflect the efforts to resume the local government traditions in the context of the renewal of the local government scheme in the Czech Republic after 1989. It is proven towards the end of the historical survey that unlike today, there were effective control mechanisms available before World War II, with several alternatives. The aim of this diploma thesis is analysis of roots KPC's successes in elections among Prague voters during interwar period. In the centre of the interest is readiness of historical actors for political activism, active participation in demonstrations and the reasons of less evident support, which was manifested through preferences of voters. By methods of social and cultural history this work reconstructs social nets of participants, supporters, activists and voters of KPC during interwar period with special attention on cause of shift individuals toward communist movement. The complex built from ideological discourse and social representations of power of working class, which was transmitted through organizational structures of party, was created with intention to make working class with strong political consciousness - in the other words, with purpose to create group of convinced communists. Nationell likvärdighet eller kommunal självstyrelse? : Staten, kommunerna och de kommunala tjänstemännens dubbla lojalitet / National Equality or Local Self-Government? : The State, the Municipalities and the Double Loyalty of MunicipalOfficials

The relationship between the state and municipalities has for the recent decades become increasingly complex, strained and infected. The education policy has for several decades been surrounded by different governing logics and conflicts where the conflict between the state’s pursuit of national equality and the local self-determination is prominent. This study examines how this conflict affects the municipal official’s approaches to the state’s control of the municipal compulsory school through aimed government grants. The study consists of aqualitative interview study of six municipalities with 23 respondents. In each municipality, I have conducted interviews with municipal officials, principals and municipal politicians. The findings show that the aimed government grants should be seen in the field of tension between state and municipality and between politics and professions. Conflicts arise between the municipalities’ different conditions as well as their local needs and the state’s pursuit of national equality between schools. The municipal officials are assigned significant power regarding how the state and municipal governance is to be put into practice and are therefore given a coordinating central position where they must balance between state requirements, local requirements and school’s requirements. The findings indicate that they seem to prioritize the state’s target of national equality in favor of the local target of self-determination. The relationship between the state and the municipalities gets exposed through the role conflicts of the municipal officials, which both compete and cooperate. The conclusion is that the municipal officials should be regarded as the state’s extended arm, or as “state municipal officials”. They possess a double loyalty to the state and local government and must, with this double loyalty, be the guardians of the local and national democracy at the same time. There is a risk that the municipal officials' double democracy loyalty demonstrates that the local democracy is weakening as the municipal officials must balance between their two guardian roles since role conflicts can arise in their daily work.This, in combination with the fact that they have gained increased power at the expense of local politicians and should thereby be regarded as political actors, sets high standards on the municipal officials, especially in an education department where the state governance is highly present.

The dissertation deals with the municipal self-government specifically focusing on its theoretical and historical background. The aim of this work was to elaborate the municipal self-government, not only to transcript or write a comment on the legal regulation, but also to inspect the assigned problem by the optics of legal theory, legal history and political science perspectives. This dissertation should provide a comprehensive perspective on the issue of municipal self-government, not only in its current legal regulation, but also identifying its theoretical backgrounds and historical roots. This paper primarily defines a set of institutions that can be summarized as fundamental theoretical aspects of public self-government (emphasizing the specifics of local or municipal self-government). In the context of the origin and development of modern public administration the work examines the main causes which led to the incorporation of elements of self-government into the modern administration. The State of St Petersburg’s Municipalities : Conditions for Local Governance in Russia

<p>The study’s focus is put on the lowest level of Russian local politics, empirically represented by two municipalities in St Petersburg. It aims at identifying factors that influence the work of municipal councils. Municipal organs are since their establishment in 1998 officially self-governing and responsible for a wide array of activities within their territories. They are perceived as administrative domains in this paper, parts of a hierarchic domain-structure. The municipal domains are both fiscally and politically restricted by upper political levels – mainly the regional authorities – that heavily reduce the capabilities of the municipal councils’ activities. Besides being dependent on resources from the regional and federal level, the municipal councils’ budgets are reliant on taxing of commercial retailing within its boundaries. Joint with the basic social and demographic circumstances of a municipality, this factor is likely to shape the extent of the council’s activity. The field study conducted specifies that while a geographically central municipality is engaged in infrastructure-maintenance and cultural activities, a peripheral ditto is mainly concerned with social help. Deputies in both districts perceive the current prospects of local government as being limited by outer influence, most of the people involved in the councils are unpaid and the resources needed to communicate with the inhabitants do not exist. The general and actual weakness of local governments is mirrored in the public attitudes, influenced by state-controlled media and revealed in participatory election turnouts. The election in December 2004 produced turnouts exceeding the legitimate limit of 20 % in almost all municipalities. However, the figures are to some extent the results of administrative pressure and liberals claim that plain frauds determined many outcomes. Tendencies point towards a politicization of municipal organs, whereas presently many perceive them as simply administrative. The municipal domain is characterized merely by responsibility instead of actual authority, ownership and substantial spatial impact. It is reliant on higher-level domains while competing for resources with neighboring domains.</p>
