Since 1940, Taiwan has carried out the Local-self Goverment system, Township¡]Country/Town/City¡^has been the front line status of local authority. Because the Constitution does not expressly protect the autonomous status, together with the practical operation of manipulation of local factions and the drawbacks of corruption, as well as the lack of people, money, lack of influence of factors such as the right, resulting in poor functional autonomy, therefore the cancellation of legal status, and that the abolition of self-government elections have been put forward, and caused heated discussion and debate from all walks of life, due to support and oppose the two factions has its own rationale, controversy over the years has not yet come to a conclusion. In this paper, analysis of the Department to collect the relevant papers, periodicals, books, letters Release Act, the meeting information, network information, such as newspapers and magazines as a source of research data and study the use of the rule of law, historical research, secondary data analysis based supplemented by participant observation method of research methods, to be on view. The present paper is divided into five chapters. The first chapter includes introduction, background studies, the motive, the goal, the research framework and the method on this article. The second chapter deliberates origin, the localization and the connotation and the law transformation of the township autonomous status of Autonomous bodies. The third chapter analyzes and explains the design, the implementation and the development of Autonomous bodies. The fourth chapter focuses on the form, the argument of the system, the populace view and analysis of system transformation. The fifth chapter, a conclusion, provides an outcome of the studies, and attempts to propose a strategic solution to the question that has been brought up.

The dissertation analyzes the subsidiarity principle as one of the key methods of social performance of modern jurisprudence, protection of human rights, social harmony, state governance and self-government. The dissertation presents the evolution of the concept of subsidiarity, analysis of the meanings of its use to enable the understanding of subsidiarity as an ethical and social value, which is important in shaping the value orientations, in further development of the social state, improving the efficiency of institutional system management, protection of individual rights and their effective implementation in the state organization. The dissertation analyzed the European Union legislation and documents of institutions important for the understanding of the concept of subsidiarity and its practical application, by demonstrating how through the application of this principle the competences of the institutions of the European Union and national authorities are identified and, based on the principle of decision making in the lowest link of the management chain (closest to the citizens) the state distributes authorisations for the institutions of the different management level (national, regional or local). Från sockenkommun till storkommun : En analys av storkommunreformens genomförande 1939-1952 i en nationell och lokal kontext

The primary aim of this study is to provide a deeper and more complete understanding of why the great municipal amalgamation (storkommunreformen) during the 1940s became the political solution to the problem that the Government believed many of Sweden’s municipalities had in satisfactorily providing for a local welfare society. The study also describes the results of this large-scale reorganization process. The events examined include the political decision-making process at the national level that took place during 1939-1949, as well as the regional/local realization of these decisions during 1946-1952. The parliamentary treatment of the municipal division issue should be viewed as a good example of what researchers have termed a Swedish decision-making model. One clear manifestation of this was the fact that the national commission that investigated the question primarily formulated the principles for the reform. The committee’s proposal received strong endorsements in the reports from the reviewers of the proposal. The government authorities and many of the municipalities felt that a new division of municipalities was justified. Opposition that did occur came mostly from rural municipalities with small populations. Many of these municipalities believed that the present municipal divisions functioned well as they were. Of those municipalities that were affected by amalgamation, 39 percent of them did not agree with the decision. The majority of these could agree to merge with other municipalities, but not with the municipalities stipulated by the authorities. Considering the fact that the then current divisions were based on a long tradition, demands for retaining independence could have been greater. At the same time, it should be borne in mind that 66 percent of all larger municipalities were formed using some level of force. This still indicated a relatively widely distributed opposition to the amalgamation decisions, however.

In my diploma thesis I deal with the history of the Německý (today Havlíčkův) Brod in the nineteenth century. I am watching the fate of Josefa Menšíková, Czech patriot and the local mayor's wife. But the diploma work is not limited to one region. Partly I devoted to the town history of Třebíč and Tišnov or phenomenon of Czech emigration to the United States related to the area of Nebraska. Throughout my diploma thesis, I notice the local self-government of the Německý Brod, transformation of the city and its inhabitants and fates of Josefa Menšíková friends. The position of local self-government in the regulation of lotteries and other similar games This thesis covers the position of local self-government in the Czech republic in the regulation of gambling. The role of local self-government, especially the municipalities, was rather recently reinforced thanks to a series of changes during the last two years. My objective is to describe the development of the position of local administration in this area and through an impartial opinion show the consequences of the aforementioned changes. My thesis is composed of three parts. Before I start dealing with the essential topic of my thesis, I have to define the basic notion in the first part of my work, by which I mean the notion of lotteries and other similar games of chance not only according to Act No. 202/1990 Coll., but also according to the foreign legislation (e.g. Belgian). I mention two basic aspects of this notion. The first one is based on the civil law and the second one much more important to my thesis is based on the norms of public law. After this selection I continue with classification of games of chance, but accordnig to my thesis, I try to show the differences between the games of chance that are object of the regulation of local self-government and the games of chance that are not. La péréquation française est devenue un enjeu fort des finances publiques locales. La croissance des moyens financiers et du nombre de dispositifs consacrés à la réduction des inégalités entre collectivités territoriales en est l’illustration. Malgré la mise en œuvre de péréquations nationales aux résultats encourageants, la cohérence et la complexité des mécanismes restent à parfaire. L’incapacité législative à contenir la péréquation dans un cadre stable et délimité n’est pas étrangère aux difficultés à appréhender la conciliation entre deux grands principes : la liberté et l’égalité. A ce titre, les grandes théories de la justice redistributive développées depuis le siècle des Lumières sont à considérer. Au contraire de la Loi fondamentale allemande, la Constitution française permet au législateur d’organiser très librement la solidarité inter-collectivités, d’autant que le juge constitutionnel, précurseur et gardien du droit à la péréquation, exerce en la matière, un contrôle incomplet au détriment de l’autonomie financière et fiscale des collectivités. A partir des fondements théoriques et positifs de la péréquation, un droit effectif et respectueux de l’autonomie locale reste à construire afin de corriger les insuffisances d’un système péréquateur récemment modifié par la réforme des lois de finances pour 2010 et 2011. / The financial equalisation system in France has become crucial in the management of local authorities. By way of illustration, there is an ongoing growth of financial resources, systems and plans of action to reduce inequalities between local governments and districts. Despite the encouraging results in the national equalisation implementation, its consistency and complexity mechanisms are to be enhanced. The disability to define freedom and equality contains the legislator in the design of stable and defined framework for equalisation. As such, the theory on a uniform distribution raised since the Age of Enlightenment, is to be considered. Unlike the German laws and regulation, the legislator is free to set up rules of financial interdependency among local authorities in the French Constitution. The constitutional judge, precursor and equalisation decision-maker, supervise an insufficient control to the detriment of financial and fiscal autonomy of local authorities. From the basis of equalisation benefits, there are some evident difficulties surrounding the limit of this system in respect to the degree of local authority’s financial autonomy. An operational review of both horizontal and vertical equalisation mechanisms, as well as the choice of redistribution criteria should be undertaken. The stakes are high to adjust and put right the shortcomings of the equalisation system, recently modified by a financial regulation reform for 2010 and 2011.

The Juristic Construction of the Separation of Public Affairs between Central and Local Governments in Taiwan, ROC.¢wA New-Institutionalist Approach

Abstract Whether the public affairs are executed by central or local government in Taiwan is based on the constitution, law and orders. The clauses of constitution were derived from the ¡§Principle of proper separation of competence¡¨, asserted first by Dr. Sun Yet-sen. From these clauses local and central governments in Taiwan should deal with different things which are properly divided according to their nature. But those clauses were not executed because of the unpredicted failure in mainland. For the reasons to initiate and regulate the local-self government institution, many acts and decrees had enacted after 1949, which gradually twisted the meaning of previous clauses that are ought to be obeyed. Besides, the increasing chaos happened recently about the struggle of expenditure in local and central authorities, showed the problems as the result of deviation. This thesis elaborates on the articles of institution which combines the clauses in the constitution and the ultimate aim of local self-government, includes democracy, separation of power in vertical level, and how the local governments are protected by law. This thesis also describes and analyses the whole juristic construction in separating local and central affairs, and, with a new-institutionalist approach, tries to find the key factors which make this institution evolved, changed and disobeyed the principles which they should be fulfilled. With these factors, this thesis finds that the deviation of the institution which is ought to be fulfilled is evolved by the ¡§path¡¨, the way it changed the previous aim or purpose. Consequently, once the ¡§path¡¨ had formatted, the actors of institution-local governments and central governments, will not obey the constitutional clauses and will keep exercising the deviated system of institution about the separation of central and local affairs.

Syftet med denna uppsats är att analysera fyra statliga offentliga dokument för att se vad problemen är representerade att vara som leder politiken mot en riktning där den kommunala planeringen, i form av den fysiska planeringen och bostadsförsörjningsplaneringen, i större utsträckning ska ordnas i- och ta hänsyn till ett regionalt perspektiv. Syftet med denna uppsats blir således också att analysera villkoren för det kommunala självstyret när en av dess grundbultar, den kommunala planeringen, i ökad utsträckning ska ordnas i- och ta hänsyn till den regionala nivån. Den här uppsatsen teoretiska- och metodologiska ansats bygger på ett vetenskaplig paket av Carol Bacchi. Hennes ansats studerar problemrepresentationer och för att besvara den här uppsatsen övergripande frågeställningar använder jag mig av ett diskursanalysverktyg som är inspirerad utifrån hennes ansats. Den empiriska analysen visar att en av problemrepresentationerna är att det pågår en regionförstoring med växande funktionella regioner. En annan problemrepresenation som framträder i de undersökta dokumenten är att det anses vara betydande av en ökad samordning av den kommunala planeringen. Det kommunala planmonopolet, som är en del av det kommunala självstyret, problematiseras att vara av stor vikt i de undersökta dokumenten, men att det finns brister i tillämpningen m.m. Alla dessa problematiseringar ovan som funnits i de undersökta dokumenten kan spåras till en diskurs där hållbar utveckling, konkurrenskraft och tillväxt är det självklara och eftersträvansvärda. Villkoren för kommunalt självstyre kan förstås på det sättet att en av dess grundbultar, den kommunala planeringen, i större utsträckning ska ordnas i- och ta hänsyn till en nyregional logik som bygger på en viss typ av politik med en konsensustradition. / The purpose of this essay is to analyze four public document published by the Swedish state to see what the problems is represented to be, which makes the politics move to a certain direction where municipal planning, more specifically spatial and social planning and housing planning, should take into account regional perspectives. Also, the purpose of this essay is to analyze the terms of the local self-government in a context where the municipal planning is increasingly to be arranged in a regional perspective. This essays theoretical- and methodological approach contains of a scientific package created by Carol Bacchi. Her theoretical- and methodological approach studies problem representations and to answer this essay overall questions I use a discourse analysis tool inspired of Bacchis approach. The empirical analysis shows that there is a problem representation about an ongoing regional expansion, thus expanding functional regions. Another problem representation is that it is considered necessary to have a greater coordination of the municipal planning. The municipal monopoly, which is a part of the local self-government, is problematized in the examined document to be of great importance, but there are some shortcomings in the application. All of these problem representations and problematisations can be traced to a discourse in which sustainable development, competitiveness and growth is desirable. The terms of the local self-government can be understood in the sense that one of its cornerstones, the municipal planning, greater will be arranged in a new regional logic, which builds upon a certain kind of politics with a consensus tradition
