Postavení a činnost české obchodní inspekce / The position and activities of the Czech Trade Inspectorate

Thesis deals with the position and proceedings of the Czech Trade Inspection (CTI). The introductory chapter discusses the theoretical and general bases associated with the role and activities of the CTI in public administration as a public authority, forms of administrative activities and administrative supervision. Afterwards, the work describes the history of consumer's protection legislation and freely moves in a special section dealing with on the above mentioned theoretical aspects in a practical context. First, it discusses the status of the CTI in public administration and organizational structure including the structure of the particular inspectorates and then powers and authority under applicable law. The following section is devoted to an inspection process systematically as the main activity of the CTI, including the description of the rights and duties of inspectors in its exercise. During the inspection inspectors determine the facts that are recorded in the inspection report, which serves as the main basis for eventual administrative proceedings. This section presents a number of my practical experiences, but also the decisions of administrative courts, which may provide some guidance on how to proceed when revising in ambiguous cases. The purpose of the study is to analyse and to compare the reign of two rulers of Francia Orientalis - Henry II and Henry III. The reason for the author's research is that the conception of the legitimization of kingship is nowadays a highly discussed issue and it is one of the most significant tasks the medieval research is facing. Methods used in this study are analysis and comparison. The study is composed of six chapters, each of them dealing with different aspect of the legitimization of kingship. Chapter One is introductory and defines basic terminology used in the study. Chapter Two examines relevant specialized discursus. Chapter Three deals with the sources of medieval thinking and consists of three parts. Part One explains the terms of sacrality and legitimacy. Part Two focuses on the roots of sacral kingship. Part Three investigates the history of legitimization of kingship in the Frankish Empire. In terms of government structure, the constitutional system of the Czech Republic is based on the principles of the parliamentary form of government. That means executive powers are vested in the Government (Council of Ministers), which is accountable to the Parliament through the vote of confidence. The Head of State as a pouvoir neutre plays usually a representative and integrating role in this system. On the contrary the President lacks the political accountability and the Parliament (or another voting body) does not have any direct way of holding him accountable for his action. Except for high treason he also cannot be prosecuted for his actions during his term. The Government therefore usually influences the exercise of his powers by countersigning his acts or decisions. Nevertheless, the role of the Czech President within the constitutional system is not only ceremonial; through his powers he can also actively participate in the adoption of political decisions. He can even exercise some of his expressly granted powers not subject to approval of the Government or any other constitutional body. Au niveau système, un ensemble d'experts spécifient des propriétés fonctionnelles et non fonctionnelles en utilisant chacun leurs propres modèles théoriques, outils et environnements. Chacun essaye d'utiliser les formalismes les plus adéquats en fonction des propriétés à vérifier. Cependant, chacune des vues d'expertise pour un domaine s'appuie sur un socle commun et impacte direct ou indirectement les modèles décrits par les autres experts. Il est donc indispensable de maintenir une cohérence sémantique entre les différents points de vue, et de pouvoir réconcilier et agréger chacun des points de vue avant de poursuivre les différentes phases d'analyse. Cette thèse propose un modèle, dénommé PRISMSYS, qui s'appuie sur une approche multi-vue dirigée par les modèles et dans laquelle pour chacun des domaines, chaque expert décrit les concepts de son domaine et la relation que ces concepts entretiennent avec le modèle socle. L'approche permet de maintenir la cohérence sémantique entre les différentes vues à travers la manipulation d'événements et d'horloges logiques. PRISMSYS est basé sur un profil UML qui s'appuie autant que possible sur les profils SysML et MARTE. Le modèle sémantique qui maintien la cohérence est spécifié avec le langage CCSL qui est un langage formel déclaratif pour la spécification de relations causales et temporelles entre les événements de différentes vues. L'environnement proposé par PRISMSYS permet la co-simulation du modèle et l'analyse. L'approche est illustrée en s'appuyant sur une architecture matérielle dans laquelle le domaine d'analyse privilégié est un domaine de consommation de puissance.

Corporate social responsibility, multinational oil companies and local communities in the Niger Delta : exploring relations, contracts and responsibilities

Corporate social responsibility (CSR) has been a subject of increasing interest among academics and business practitioners globally. This thesis contributes to the discourse on CSR in the context of the Nigerian oil industry with regard to corporate-community relations. Specifically, the thesis constitutes a critique of CSR initiatives by multinational oil companies (MOC) operating in the Niger Delta region and their impact on the traditional livelihoods of local communities. The research attempts to understand the link between CSR and Psychological contract from the perspective of both the host communities and the MOCs. This thesis examines community perceptions, expectations and seeks to interpret the relationship between the host communities and the MOCs. The study provides empirical data through the use of twenty-eight semi-structured interviews and three focus groups. This is significant given that most of the research conducted into CSR in this region has been limited to descriptive and extensive theoretical explanations. Findings from the research suggest that the relationship between the host communities and the MOC is a very complex one and that the impact of the MOCs activities can be interpreted from the host communities’ negative actions. The thesis makes an important contribution to the emerging literature on social license to operate (SLO) and in what manner the local communities seek to enforce it. It also offers an alternative approach to CSR based on need assessment and stakeholder involvement rather than corporate obligations and expectations from society in general.

In the practical part is used qualitative method. The research is based on interviews with teachers. The aim of this thesis is to obtain information related to teacher's authority. The thesis describes a biosocial model of status stratification in face to face groups. The model is based on the belief that human status behavior is evolutionary extension of animal status behavior (especially primates). Each person of a group is equipped with a signaling mechanism that signals the status of domination or submision (or the status he ought to have). Status communication is among humans very subtle and primarily occurs at a nonverbal level. Status stratification often takes place automatically without the knowledge of the subjects. The biosocial model criticizes classical authors of social stratification, who explain the mechanism primarily at the cognitive level. In the practical part, the thesis attempts to use new methodology to verify the main assumption of an implicit stratification mechanism that is able to function without the involvement of cognition. The research works with a group of people with 6 probands. To indicate status in a group, playing cards were used. In each group, individuals were artificially assigned positions by playing cards. Subsequently, it was recorded how these artificial positions were reflected in the real position of member of the group. Topic of this diploma thesis is the usage of professional methods of assistance and control applied by social workers in practice. Theoretical part consists of a description of history of assistance and control in social work area, assistance and control in the context of a systematic approach and the risk of abusing of power by social workers while realising controls of clients. Furthermore, the diploma thesis mentions the helper syndrome and the occupational burnout syndrome that is common in social professions and, in connection to that, the importance of maintaining a certain psycho-hygiene and the significance of supervision. The aim of this diploma thesis is the monitoring of professional work methods of assistance and control by social workers directly engaged with the clients. In accordance with this goal, there were three research questions established relating the goal of the diploma thesis. Social workers answered questions questioning them how they use the assistance and control in the direct engagement with the clients and how they perceive the distinction between the assistance and control in their practical experience. In order to achieve the goal, there was used a qualitative research that was implemented by using the method of a semi-structured interview. Data analysis was evaluated by using the method of the categorization of data. In conclusion, it can be stated that the goal of the diploma thesis, alongside with the research questions, were achieved. Based on the results, two hypotheses were established. The first one is that social workers are not aware of the professional work methods of control and assistance in practice, the second is that the unfamiliarity with these methods causes less effectivity level of their performance. Outcomes of this diploma thesis may be used as a study material for a theoretical teaching and as a feedback for social workers as this diploma thesis brings the information about which work methods they are using in their practice.
