Thus, through the study of categories such as sex, gender and patriarchy, there was an attempt to explain the reasons why women are social individuals that occupy historically unequal position compared to men, with important consequences in all spheres of society, including being characterized as the main victims of domestic violence. This way, it was done a study about the relation between Law and gender in which it was found that the regulation of social life is directly under influences of meaning that is attributed to male and female. From this theoretical framework, it was performed the analysis about the thinking of individuals directly involved with the social problem of domestic violence against women, the executors of the law and women victimized by this type of violence. It was made data collection for quantitative and qualitative information concerning the enforcement of Maria da Penha Law, in the district of Ponte Nova, focusing on the qualitative analysis of this data because of the complexity of the subject and the diversity of methods of data collection. The main objective was give meaning to the personal and professional practices of the people involved in the research, comparing factual data and identifying what these people are able to present as new pathways to be faced in order to overcome those practices, identifying difficulties, progress and obstacles to the effectuation of this law. / A violência doméstica e familiar contra a mulher ainda revela-se como um acontecimento de ampla ocorrência nas sociedades contemporâneas, razão pela qual o estudo das circunstâncias que a envolvem constitui um tema de fundamental importância. Dessa maneira, por meio do estudo de categorias como gênero, patriarcado e sexo, buscou-se explicar as razões pelas quais as mulheres são sujeitos sociais que historicamente ocupam posição desigual à dos homens, com reflexos importantes em todos os âmbitos sociais, inclusive sendo as principais vítimas da violência doméstica e familiar. Nesse sentido, foi realizado um estudo sobre a relação entre Direito e gênero em que ficou constatado que a regulamentação da vida social sofre influência direta da significação que se atribui ao sexo feminino e masculino. A partir desse arcabouço teórico, realizou-se a análise sobre o pensamento dos sujeitos sociais envolvidos diretamente com a problemática da violência doméstica e familiar contra a mulher, a saber: os executores da Lei e as mulheres vitimadas por essa violência. Foi feita a coleta de dados de natureza quantitativa e qualitativa referentes à aplicação da Lei Maria da Penha, na Comarca de Ponte Nova, priorizando-se a análise qualitativa desses dados em decorrência da complexidade do tema de estudo e da diversidade de forma de dados coletados. Objetivou-se dar significado às práticas pessoais e profissionais do público pesquisado, contrastando dados fáticos e detectando o que esses sujeitos são capazes de apresentar como novos caminhos a serem enfrentados para superar essas práticas, identificando as dificuldades, avanços e obstáculos à efetivação da referida Lei.
