Miranda Reasoning and Competent Waiver Decisions: Are Models of Legal Decision Making Applicable?

Miranda understanding, appreciation, and reasoning abilities are essential to courts' determinations of knowing and intelligent Miranda rights waivers. Despite the remarkable development of Miranda research in recent decades, studies have generally focused on understanding and appreciation of Miranda rights, but have not examined Miranda reasoning and waiver decisions. Therefore, examining the nature of defendants' decisional capacities constitutes a critical step in further developing theoretical and clinical models for competent Miranda waiver decisions. The current study evaluated Miranda waiver decisions for 80 pretrial defendants from two Tulsa-area Oklahoma jails. Previously untested, the current study examined systematically how rational decision abilities affect defendants' personal waiver decisions. Components from general models of legal decision making, such as decisional competence and judgment models, were examined to determine their applicability to Miranda waiver decisions.

“Voluntariness With A Vengeance:” Miranda and a Modern Alternative

One of the most famous opinions in American jurisprudence is that of the United States Supreme Court in the case of Miranda v. Arizona. 384 U.S. 436 (1966). The Court’s prophylactic rule in Miranda has been followed in both state and federal courts with little derogation for over thirty years. On February 8, 1999, in Dickerson v. United States. 166 F.3d 667, the United States Court of Appeals for the Fourth Circuit ignored Miranda, turning instead to 18 U.S.C. § 3501, a relatively obscure federal statute enacted in 1968 in response to the Court’s decision in Miranda. The United State Supreme Court granted certiorari and heard oral arguments early in the summer of last year and on June 26, 2000, the Court reversed the opinion of the Fourth Circuit in Dickerson and reaffirmed Miranda and its progeny. There were many who felt the need for Miranda had passed; indeed, Congress enacted a legislative replacement just a few years after Miranda, and even today educators and politicians continue to criticize the opinion. The discussion in Dickerson focused on whether Miranda was a constitutional rule and thus, whether § 3501 of the United States Code was a proper exercise of Congress’ power. Had that argument been successful, § 3501 would have been validated and Miranda would have faded into quiet disuetude. But the argument failed. The Supreme Court rejcted § 3501 and reaffirmed Miranda and preserved all of its exceptions; exceptions created by the Court itself. Thus Miranda is still the law today, despite its steady erosion by the judiciary over the decades and despite the early attempt by Congress to legislate an alternative.With the opinion in Dickerson, the Court has made it quite clear that Miranda will linger into the uncertain future. Acknowledging Miranda’s survival, this thesis will explore the relevant facts and opinions in some detail then submit an alternative to the unpleasant result reached when a defendant’s voluntary confession is suppressed due to a technical violation of the Court’s famous rule.

This natural scenario justifies the natural water scarcity in the region, which depends on the construction of reservoirs as a strategic measure to its socioeconomic development. The semi-arid climatic conditions have influenced the structure and composition of phytoplankton community of the reservoirs and therefore the phytoplankton primary productivity. Thus, the objective of this research was to identify and evaluate the seasonal dynamics and primary productivity of phytoplankton community Pereira reservoir Miranda, municipality of Pentecoste, Ceará, and link them to climate variables, hydrological and limnological. Water samples were collected monthly in 2015 to determine physical variables (temperature, water clarity and turbidity), chemical (dissolved oxygen, conductivity, pH, total phosphorus, orthophosphate, ammonia, nitrite, nitrate and silica) and biological ( chlorophyll a and primary productivity), and phytoplankton collections for identification, counting and calculating the Shannon diversity index - Wiener. The data were statistically analyzed by analysis of variance (ANOVA) for primary productivity and multivariate principal component analysis (PCA) to order the physical and chemical variables and express the relationships between them. As a result, there were changes in limnological characteristics with prolonged drought. There was no significant difference (p> 0.05) in primary productivity during the months studied. However, there was a higher primary productivity in the rainy season. Thirty have been identified and a phytoplankton species, especially Microcystis sp. (Unitary), with dominance in the rainy season, and plenty of Aphanocapsa elachista in the dry season. The Shannon diversity index - Wiener was down for both periods, with plenty of few species, and increase from the end of the rainy season. Thus, it can be inferred that the dry scenario observed during the study interfered with limnologic conditions and phytoplankton diversity in Pereira de Miranda reservoir, i.e., changes in physical and chemical factors of water, enhanced by prolonged drought affected adversely the primary productivity of Pereira de Miranda reservoir. / A região semiárida do Nordeste brasileiro é caracterizada por regime de chuvas sazonais, variável no espaço e no tempo, estiagens anuais prolongadas e secas interanuais recorrentes e por temperaturas elevadas e praticamente constantes durante o ano. Este cenário natural justifica a escassez hídrica natural da região, que depende da construção de reservatórios como medida estratégica para o seu desenvolvimento socioeconômico. As características climáticas do semiárido tem influênciado a estrutura e na composição das comunidades fitoplânctônicas dos reservatórios e, consequentemente, a produtividade primária fitoplanctônica. Diante disso, o objetivo desta pesquisa foi identificar e avaliar a dinâmica sazonal e a produtividade primária da comunidade de fitoplâncton do reservatório Pereira de Miranda, município de Pentecoste, Ceará, e associá-las às variáveis climáticas, hidrológicas e limnológicas. Amostras de água foram coletadas mensalmente em 2015 para determinação de variáveis físicas (temperatura, transparência da água e turbidez), químicas (oxigênio dissolvido, condutividade elétrica, pH, fósforo total, ortofosfato, nitrogênio amoniacal, nitrito, nitrato e sílica) e biológicas (clorofila a e produtividade primária), além de coletas de fitoplâncton para identificação, contagem e cálculo do índice de diversidade de Shannon - Wiener. Os dados foram tratados estatisticamente por análise de variância (ANOVA) para produtividade primária e análise multivariada em componentes principais (ACP) para ordenar as variáveis físicas e químicas e expressar as relações entre elas. Como resultado, observaram-se alterações nas variáveis limnológicas com o prolongamento da estiagem. Não foi observada diferença significativa (p > 0,05) na produtividade primária durante os meses estudados. No entanto, observou-se maior produtividade primária no período chuvoso. Foram identificadas trinta e uma espécies fitoplanctônicas, com destaque para Microcystis sp. (unitária), com dominância no período chuvoso, e abundância da Aphanocapsa elachista no período seco. O índice de diversidade de Shannon – Wiener foi baixo para ambos os períodos, com abundância de poucas espécies, e aumento a partir do final do período chuvoso. Assim, pode-se inferir que o cenário de seca observado durante a pesquisa interferiu nas condições limnológicas e na diversidade de fitoplâncton no reservatório Pereira de Miranda, isto é, as mudanças nos fatores físicos e químicos da água, intensificados pela seca prolongada, afetaram negativamente a produtividade primária do reservatório Pereira de Miranda

Effects of Impaired Verbal Abilities on Miranda Comprehension and Reasoning: "Do You Understand Your Rights?"

In Miranda v. Arizona (1966), the Supreme Court of the United States required that custodial arrestees be informed of their constitutional and continuous rights to silence and to legal counsel. Moreover, the ruling mandated that waivers be considered valid only if they were made knowingly, intelligently, and voluntarily. However, in the decades that followed, evidence from both caselaw and empirical scholarship clarified that, for many vulnerable populations, these rights are in jeopardy. Among these vulnerable populations, those with limited cognitive capacities (LCCs) have been functionally excluded from research which primarily focused on persons with intellectual disabilities. This thesis offers a novel exploration of the role of specific cognitive impairments on Miranda comprehension and reasoning, with a focus on verbal intelligence (VIQ). Using a large archival sample of pretrial defendants (N = 820), current results suggest that defendants struggled with Miranda abilities regardless of other, individual characteristics. However, verbal intelligence emerged as a very strong predictor of Miranda comprehension such that those with lower VIQ were considerably more vulnerable to impaired comprehension. More so, data suggest that several compounded vulnerabilities (i.e., minoritized racial/ethnic identity status, limited academic achievement, illiteracy) are essential to understanding the extent of vulnerability in the criminal legal system in addition to the negative impacts of cognitive impairments. Several crucial implications for clinical practice and legal decision-making are explored. Finally, essential areas for future research are presented.

La re-visión de la Historia en la ficción de mujeres latinoamericanas: Isabel Allende, Gioconda Belli, Carmen Boullosa y Ana Miranda analiza cuatro obras representativas del corpus de nuevas novelas históricas latinoamericanas, de acuerdo a las características formuladas por Seymour Menton, escritas por mujeres, contrastándolas con dos novelas escritas por hombres; La campaña, de Carlos Fuentes, y Maluco, de Napoleón Barcino Ponce de León, para determinar si existen suficientes elementos comunes diferenciadores que justifiquen una clasificación independiente dentro de la nueva novela histórica. El apoyo teórico que se utilizó para el análisis de las obras aquí mencionadas fue los postulados desarrollados por la critica feminista latinoamericana, principalmente los de Lucía Guerra-Cunningham, Sara Castro-Klarén y Elodia Xavier. Se recurrió también como auxiliares en el análisis a la narratología, los conceptos de Jacques Derrida para la descontrucción de los mitos culturales de la feminidad, así como, los conceptos literarios elaborados por Mijail Bajtin de heteroglosia, polifonía, parodia, y lo carnavalesco. En el análisis de las obras se encontraron suficientes características diferenciadoras que justificarían su clasificación en una categoría diferente dentro de la nueva novela histórica, comprobando la hipótesis planteada. Entre las principales se encuentran: 1) La transgresión del discurso tradicional patriarcal que rompe con la dependencia y subordinación al hombre, utilizando un discurso propio diferente al patriarcal, y exponiendo libremente lo que fue silenciado u olvidado en la historiografía oficial. 2) La trasmisión, a través de los relatos, de la Weltanschauung de la mujer, confrontándola a la visión masculina del mundo, la cual se equipara, aun hoy en día, a la conciencia humana como verdad absoluta. 3) La inscripción del cuerpo en el texto, con lo que la mujer trasciende los antiguos tabúes, haciendo mención directa de su sexualidad, mostrando explícitamente una carga libidinal específica donde los tabúes concernientes a las funciones biológicas y psíquicas del cuerpo femenino son tratados abiertamente. 4) El uso preponderante de la primera persona y el tono confesional intimista donde la protagonista busca a través del autoconocimiento la condición de sujeto que le ha sido tan frecuentemente negada en la sociedad falocrática en la que se encuentra inserta.

Por fim, foi feita uma análise de como a escritora apresenta, em sua a obra, a situação da mulher, problematizando e questionando a sociedade patriarcal a partir de temas como o casamento. Para fundamentar este trabalho, foram destacadas várias criticas feministas da literatura, que formularam importantes contribuições sobre a situação da mulher, assim como nomes icônicos da teoria feminista, especialmente, Simone Beauvoir e Virginia Woof. / Ana Miranda is a writer recognized of the Brazilian contemporary literature having been awarded important prizes by Brazilian critics. Shiite has been highlighted by critics for her interlocution between a story and a literature. The present work investigated the novels Desmundo (1996) and Dias e Dias (2003) analyzing the representation of religion in the novel, as well as a presentation of the women's representation in the novels. The novels have a background a vision and a process of independence, as well as a reading of the; history of Brazil, a way of making a critical critique of Miranda makes of the history with Translation, of classic texts, like the Letter of Caminha. Finally, an analysis was made of a writer in her work of a woman, to problematize a patriarchal society, starting with themes such as marriage. The foundation of the work was highlighted by several active women in literature, especially in relation to the situation of women and iconic names in feminist theory, especially Simone Beauvoir and Virginia Woolf.

Esta dissertação tem como objetivo examinar o método de composição das comédias de Sá de Miranda e a maneira como o autor utilizou o processo de recriação poética denominado imitatio para promover o diálogo intertextual com seus paradigmas. Trata-se aqui de analisar intertextualmente textos gerados dentro de um contexto histórico-literário específico, em que o imitar era a regra. O autor tem como primeira intenção ao compor esse tipo de obra inserir-se numa tradição poética que aceita e pressupõe a alusão a textos precedentes, ou seja, uma tradição poética autônoma, em que as relações intertextuais se dão de maneira consciente e técnica e a obra de imitação resulta da reelaboração criativa de modelos. O primeiro capítulo vem situar a obra cômica mirandina no contexto histórico-cultural em que foi gerada. O segundo capítulo trata de imitatio e intertextualidade, estabelecendo terminologia e métodos para a análise intertextual, especificamente, de obras que têm a apropiação intencional de textos como princípio de criação literária. O terceiro capítulo apresenta um breve histórico do teatro latino, das origens até o surgimento da fabula palliata, adaptação latina da Comédia Nova Grega, que foi o modelo de comédia imitado pelos poetas renascentistas italianos, cujas obras se tornaram também paradigmas para o poeta português. O último capítulo é dedicado à análise intertextual das comédias de Sá de Miranda. / The objective of this dissertation is to examine the method of composition of Sá de Miranda?s comedies and the way the author made use of the poetic recreation process denominated imitatio to promote the intertextual dialogue with their paradigms. It concerns to the intertextual analysis of texts produced within a specific historical and literary context in which imitating was the rule. The author who composes literary works under this rule has as his first intention to get into a poetic tradition which accepts and presupposes the alusion to preceding texts, i. e., an autonomous poetic tradition in which the intertextual relations take place in a conscious and technical manner and the work of imitation results of the creative re-elaboration of the patterns. The first chapter comes to situate Sá de Miranda?s comic work in the historical and cultural context in which it was generated. The second chapter deals with imitatio and intertextuality, establishing terminology and methodology for intertextual analysis of specifically literary works which have the intentional appropriation of texts as literary creation principle. The third chapter presents a brief history of the Roman theater, from its origins up to the arising of the fabula palliata, the Roman adaptation of the Greek New Comedy, which was the model of comedy imitated by the Italian poets of the Renaissance, whose works became paradigms to the Portuguese poet too. The last chapter is dedicated to the intertextual analysis of Sá de Miranda?s Comedy.
