The subject of the dissertation is The fundamental precept as instrument of materialization of the fundamental rights: for a legitimating perspective of the Democratic State of Right". The development of the present study seeks to present the effects that an interpretation concretizadora of the concept of fundamental precept, of the list of having legitimated and of the principle of the subsidiariedade in noncompliance´s arguing of fundamental precept can check in a perspective of legitimating the Brazilian State.The analysis seeks to approach, inside of the limits planed previously, some of the most controversial aspects of the Law no. 9.882/99. The general objective of this dissertation is to attest the property of noncompliance s arguing of fundamental precept as an instrument of popular access to the concentrated jurisdiction of the Supreme Federal Tribunal in defense of the fundamental rights. To this end, the deductive method was used in the delimitation of the concept of fundamental precept, of the elements that compose it, with more detained analysis in the fundamental rights and at the principle of the human person's dignity. Inside of the inductive method, the study proceeds in the understanding of the people concept and of its importance as titular of the state power. Like this, the legitimating base of the State passes referring to the people concept, in a wide and including dimension to Friedrich Müller's way, everything based on the subject introduced in the only paragraph of the art. 1st of the Federal Constitution, that lifts the fact of whole power emanates from the people, that exercises it by means of its elect representatives or directly, in the terms of the Constitution. The study moves forward, then, in the understanding of the function of the judiciary as defender of the fundamental precepts, notedly, the fundamental rights, regarding the characterist of substancialist republic present in Brazil, where the attendance of the social longings justifies a change of the almost absolute theory of the separation of the powers. The positive base of the assertive has supporting, concerning the thematic discussed, in the competence of the Supreme Federal Tribunal as guard of the Constitution,according to the art. 102 of the Federal Constitution. Later on, the attention returns to the theory of the materialization of Müller, a theory that gets the creative activity of the interpreter guided by the program of the norm and for the reality (for the context), seeking to present method and road insurances to understand the list of having legitimated to question violation to fundamental precept and to the principle of the subsidiariedade, uncertain juridical concepts, lacking of complementation for they be applied. The materialization method, in that line, is used as important procedure to avoid the judicial activism and the outrage. To the end, after the analysis of the theoretical and jurisprudential bases more important, and consolidating all the foundations fanned previously, it is advanced about the demarcation of those legitimated to impetrate the noncompliance`s arguing of fundamental precept and of the principle of subsidiariedade applied to this, being supplied position guided by a wide legitimacy, pondered by the filter of transcendency, and for the understanding that the principle of the subsidiariedade should have in mind the ineffectiveness of the actions of the diffuse and concentrated control of constitutionality. / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O tema da dissertação é: O preceito fundamental como instrumento de concretização dos direitos fundamentais: por uma perspectiva legitimante do Estado Democrático de Direito . O desenvolvimento deste estudo visa apresentar os efeitos que uma interpretação concretizadora do conceito de preceito fundamental, do rol de legitimados e do princípio da subsidiariedade em sede de argüição de descumprimento de preceito fundamental pode conferir numa perspectiva de legitimar o Estado brasileiro. A análise visa abordar, dentro dos limites traçados anteriormente, alguns dos aspectos mais controversos da Lei nº 9.882/99. O objetivo geral desta dissertação é atestar a propriedade da argüição de descumprimento de preceito fundamental como um instrumento de acesso popular à jurisdição concentrada do Supremo Tribunal Federal em defesa dos direitos fundamentais. Para este fim, foi utilizado o método dedutivo na delimitação do conceito de preceito fundamental, dos elementos que o compõem, com análise mais detida nos direitos fundamentais e no princípio da dignidade da pessoa humana. Dentro do método indutivo, o estudo segue na compreensão do conceito de povo e de sua importância como titular do poder estatal. Desta forma, a base legitimatória do Estado passa a se referir ao conceito de povo, numa dimensão ampla e abrangente à moda de Friedrich Müller, tudo com base na disciplina carreada no parágrafo único do art. 1º da Constituição Federal, que levanta o fato de que todo o poder emana do povo, que o exerce por meio de seus representantes eleitos, ou diretamente, nos termos da Constituição. O estudo avança, então, na compreensão da função do judiciário como defensor dos preceitos fundamentais, notadamente, os direitos fundamentais, considerando a característica de república substancialista presente no Brasil, onde o atendimento dos anseios sociais justifica uma mudança da quase absoluta teoria da separação dos poderes. A base positiva da assertiva tem sustentação, no tocante à temática discutida, na competência do Supremo Tribunal Federal como guarda da Constituição, conforme o art. 102 da Constituição Federal. Posteriormente, a atenção se volta à teoria da concretização de Müller, uma teoria que preconiza a atividade criativa do intérprete guiada pelo programa da norma e pela realidade (pelo contexto), visando apresentar método e caminho seguros para compreender o rol de legitimados a questionar violação a preceito fundamental e ao princípio da subsidiariedade, conceitos jurídicos indeterminados carentes de complementação para serem aplicados. O método de concretização, nessa linha, é utilizado como importante procedimento para se evitar o ativismo judicial e a arbitrariedade. Ao fim, depois da análise das bases teóricas e jurisprudenciais mais importantes, e consolidando todos os fundamentos aventados anteriormente, avança-se sobre a demarcação dos legitimados a manusear a argüição de descumprimento de preceito fundamental e do princípio da subsidiariedade aplicado a esta, fornecendo-se posição orientada por uma legitimidade ampla, ponderada pelo filtro da transcendência, e pelo entendimento de que o princípio da subsidiariedade deve ter em vista a inefetividade das ações do controle difuso e concentrado de constitucionalidade.

Portanto, este trabalho teve por objetivo apresentar e discutir quais os conceitos e os principais fatores associados ao abandono do tratamento de saúde mental entre crianças, adolescentes e suas famílias, em publicações científicas. Foram consultadas as bases de dados Scielo, Lilacs, Medline, PubMed e NCBI (National Center for Biotechnology Information), ultilizando - se artigos publicados desde o primeiro estudo divulgado em 1956, através dos seguintes descritores: “pacientes desistentes do tratamento”, “abandono”, “dropout” e “desistência do paciente”, correlacionados à “saúde mental” e “crianças e adolescentes”. Os resultados encontrados evidenciaram o predomínio de trabalhos quantitativos, com significativas divergências conceituais e sobre os resultados produzidos. Alguns fatores foram levantados com maior recorrência entre os estudos como possivelmente associados ao abandono do tratamento entre crianças e adolescentes, tais como a monoparentalidade e sobrecarga do cuidado na figura de um único cuidador; uso abusivo de substâncias psicoativas entre os jovens e seus pais; violência intrafamiliar; baixa escolaridade dos pais; baixo capital econômico; discrepâncias entre as expectativas dos familiares e profissionais quanto ao tratamento; atitudes e comportamentos do terapeuta como empatia e disponibilidade subjetiva; pouca clareza sobre os objetivos e métodos de tratamento; dificuldades na marcação; formas de acolhimento; vinculo terapêutico frágil, natureza das fontes de encaminhamento, dentre outros. Discute-se que conhecer os possíveis preditores para o abandono do tratamento de saúde mental possibilita que os profissionais possam identificar precocemente pacientes pertencentes ao grupo de risco para abandono, oportunizando-lhes trabalhar preventivamente e mais diretamente aspectos que dificultam a permanência desses pacientes e seus familiares na instituição. Apesar da significativa contribuição destes estudos para a produção do conhecimento científico, ressalva – se a necessidade de novos estudos de cunho qualitativo junto aos familiares, usuários e profissionais do CAPSi, a fim de compreender melhor a realidade desse espaço de cuidado tão diverso dos modelos de tratamento ofertados em outros países.

Causal Inference in the Face of Assumption Violations

<p dir="ltr">This dissertation advances the field of causal inference by developing methodologies in the face of assumption violations. Traditional causal inference methodologies hinge on a core set of assumptions, which are often violated in the complex landscape of modern experiments and observational studies. This dissertation proposes novel methodologies designed to address the challenges posed by single or multiple assumption violations. By applying these innovative approaches to real-world datasets, this research uncovers valuable insights that were previously inaccessible with existing methods. </p><p><br></p><p dir="ltr">First, three significant sources of complications in causal inference that are increasingly of interest are interference among individuals, nonadherence of individuals to their assigned treatments, and unintended missing outcomes. Interference exists if the outcome of an individual depends not only on its assigned treatment, but also on the assigned treatments for other units. It commonly arises when limited controls are placed on the interactions of individuals with one another during the course of an experiment. Treatment nonadherence frequently occurs in human subject experiments, as it can be unethical to force an individual to take their assigned treatment. Clinical trials, in particular, typically have subjects that do not adhere to their assigned treatments due to adverse side effects or intercurrent events. Missing values also commonly occur in clinical studies. For example, some patients may drop out of the study due to the side effects of the treatment. Failing to account for these considerations will generally yield unstable and biased inferences on treatment effects even in randomized experiments, but existing methodologies lack the ability to address all these challenges simultaneously. We propose a novel Bayesian methodology to fill this gap. </p><p><br></p><p dir="ltr">My subsequent research further addresses one of the limitations of the first project: a set of assumptions about interference structures that may be too restrictive in some practical settings. We introduce a concept of the ``degree of interference" (DoI), a latent variable capturing the interference structure. This concept allows for handling arbitrary, unknown interference structures to facilitate inference on causal estimands. </p><p><br></p><p dir="ltr">While randomized experiments offer a solid foundation for valid causal analysis, people are also interested in conducting causal inference using observational data due to the cost and difficulty of randomized experiments and the wide availability of observational data. Nonetheless, using observational data to infer causality requires us to rely on additional assumptions. A central assumption is that of \emph{ignorability}, which posits that the treatment is randomly assigned based on the variables (covariates) included in the dataset. While crucial, this assumption is often debatable, especially when treatments are assigned sequentially to optimize future outcomes. For instance, marketers typically adjust subsequent promotions based on responses to earlier ones and speculate on how customers might have reacted to alternative past promotions. This speculative behavior introduces latent confounders, which must be carefully addressed to prevent biased conclusions. </p><p dir="ltr">In the third project, we investigate these issues by studying sequences of promotional emails sent by a US retailer. We develop a novel Bayesian approach for causal inference from longitudinal observational data that accommodates noncompliance and latent sequential confounding. </p><p><br></p><p dir="ltr">Finally, we formulate the causal inference problem for the privatized data. In the era of digital expansion, the secure handling of sensitive data poses an intricate challenge that significantly influences research, policy-making, and technological innovation. As the collection of sensitive data becomes more widespread across academic, governmental, and corporate sectors, addressing the complex balance between making data accessible and safeguarding private information requires the development of sophisticated methods for analysis and reporting, which must include stringent privacy protections. Currently, the gold standard for maintaining this balance is Differential privacy. </p><p dir="ltr">Local differential privacy is a differential privacy paradigm in which individuals first apply a privacy mechanism to their data (often by adding noise) before transmitting the result to a curator. The noise for privacy results in additional bias and variance in their analyses. Thus, it is of great importance for analysts to incorporate the privacy noise into valid inference.</p><p dir="ltr">In this final project, we develop methodologies to infer causal effects from locally privatized data under randomized experiments. We present frequentist and Bayesian approaches and discuss the statistical properties of the estimators, such as consistency and optimality under various privacy scenarios.</p>

Factors associated with noncompliance to hand hygiene standards among nurses at one hospital in Windhoek, Namibia

The purpose of this study was to describe factors associated with noncompliance to hand hygiene standards among nurses in one public hospital in Windhoek, Namibia. A quantitative, descriptive, cross-sectional research design was employed using a stratified sample comprising three categories of nurses (registered, enrolled and auxiliary nurses). Data collection was done using a structured questionnaire. Based on the results, there were more institutional than individual factors associated with noncompliance to hand hygiene. Compliance to hand hygiene was found to be lowest when nurses provide care for patients in non-isolation rooms, when the perceived risk of acquiring infection from patients was low and following brief encounters with patients. Dryness of the skin caused by hand hygiene agents and lack of active participation in hand hygiene promotion at individual level contributed to noncompliance to hand hygiene among nurses. In addition, the results showed that, institutionally there were no rewards/encouragement for hand hygiene, no sanctions for non-compliers and no workshops, seminars and continuing educational courses on hand hygiene. The study produced interesting insights into the vital role that good leadership plays in the implementation of hand hygiene policy guidelines. The key recommendations for this study included development of good leadership, characterized by dedication for hygiene standards to encourage staff to maintain hygiene practice and to ensure that there are adequate resources for the implementation of hand hygiene policy as well as rewards/incentives for compliers and sanctions for noncompliers / Health Studies / M.A. (Nursing Science)

Thesis: The main contribution of D. Orem's self-care theory is that, using adequate methods, it leads the nurses to respect patients' own conception of self-care. Key words: Patient - nurse relationships, Self-Care Deficit Nursing Theory, D. E. Orem, human actions, respect for autonomy, NANDA taxonomy, non-compliance, responsibility. This dissertation thesis deals with the issues of a relationship between a patient and a healthcare worker, or more precisely a nurse, all from the point of view of patient self-care in the sense of deliberate action that is conducted by the patient for the purpose of sustaining their health and realizing their life plans. Ethical aspects of Orem's Self-Care Deficit Theory consist in the approach to a person that emphasizes the human nature of a human being that develops within the community - among other people, that becomes unique and that cares about their own being. Self-care deficit nursing theory is compared to NANDA taxonomy II with respect to a patient's autonomy. Both approaches to nursing care are studied from the point of view of their assumptions, theoretical basis, the diagnostic process, communication, personal competence of nurses and the aims of health care. This study used narrative inquiry to answer the question “What are the stories of older adults who choose not to share information with health care professionals?” The study explored the experiences of older adults who did not share information with health care professionals (HCPs), who they defined as doctors. A thematic analysis of five participants’ stories revealed three themes: Illusions of Care, describing the participants’ experiences with doctors before they chose not to share information; The Last Straw, revealing the final incident that caused participants to choose not to share information; and The Mask of the Non-sharing Older Adult, describing how participants interacted with their doctors after they decided not to share information. Relationship development between older adults and their doctors, sensitive topics, issues and perceptions of ageing, and structure of the health care system contribute to the complex issue of older adults not sharing information. The decision not to share information with health care professionals may adversely affect the health and health care of older adults.
