Les ordonnances de non-publication à l'enquête sur mise en liberté provisoire et à l'enquête préliminaire : quand inefficacité rime avec inconstitutionnalité

Le présent mémoire se penche sur la constitutionnalité des articles 517 et 539 C.cr., qui prévoient des ordonnances de non-publication à l'enquête sur mise en liberté provisoire ainsi qu'à l'enquête préliminaire. L'auteur présente d'abord les modalités d'application de chacune de ces ordonnances. Suit ensuite un portrait de la jurisprudence sur la constitutionnalité de ces deux dispositions. L'auteur applique par la suite aux dispositions le test élaboré dans l'arrêt Oakes. Il conclut que l'objectif des dispositions, qui consiste à assurer un procès équitable à l'accusé, est urgent et réel. L'auteur constate ensuite que le critère du lien rationnel n'est pas satisfait puisque, ordonnance ou pas, les informations préjudiciables pour un accusé seront de toute façon dispersées dans le public, notamment grâce aux nouvelles technologies de l'information. À défaut de profiter d'informations fiables retransmises par les médias, le public devra se concentrer sur les rumeurs non vérifiables propagées par le Web. Le critère de l'atteinte minimale est également examiné. L'auteur estime que ni les récusations motivées, ni le changement de venue, ni les directives aux jurés ne sont en mesure de remplacer des ordonnances de non-publication. Enfin, l'auteur estime que les articles 517 et 539 C.cr. échouent le critère de proportionnalité entre les effets préjudiciables et les effets bénéfiques. En conclusion, comme alternative aux interdits de publication, l'auteur propose une réforme du processus de récusations motivées. / This thesis examines the constitutionality of sections 517 et 539 of the Criminal Code, which permits the judge presiding over a bail hearing or a preliminary inquiry to impose a publication ban. The author explains the way these bans are applied. He then reviews the existing case law regarding the constitutionality of these sections of the Criminal Code. In the second part of his thesis, the author applies the Oakes test to both sections. He first deals with the contextual factors to be considered in the analysis. He then examines the objective of the sections, which is to protect the right of the accused to a fair trial. He concludes that this objective is pressing and substantial. On the other hand, the rational connection test is not satisfied, because even with a ban, the prejudicial information will still be transmitted to the public through new technologies such as the Internet. If no information is allowed to be published by the journalists, the public will have to rely solely on rumours and possibly false news circulating on the Web. The minimal impairment test is also examined. Neither challenge for cause, nor change of venue or judicial instructions can replace effectively publication bans. Applying the last part of the Oakes test, the author fails to find that the deleterious effects of publication bans are proportionate to their salutary effects. In conclusion, the author briefly proposes a reform of the challenge for cause process.

中美政府出版品寄存圖書館制度之比較研究 / The Comparative Study of Government Publication Depository Library System Between Taiwan and United States

政府出版品是探討一國政府施政運作與績效的重要紀錄,也是民眾瞭解政府施政成果的主要憑藉,被視為現代圖書館重要的參考資料之一。此類出版品無論從內容、資料來源、出版及發行等層面來看,都具有相當程度的權威性、時效性、廣泛性及非營利性等特性,可視為國家重要的資產。由於政府出版品具備上述重要特性,使得一國政府能否建立公開、即時且平等的政府資訊傳佈政策,乃成為民主社會發展的重要指標及基本要求之一。從政府出版品管制度層面而言,先進國家對於政府出版品多規劃有「寄存」及「銷售」兩大途徑,作為提供政府出版品的主要服務窗口。 審視美國地區政府出版品聯邦寄存制度建置迄今已擁有百餘年的發展經驗,而我國政府出版品寄存制度初期的規劃藍圖,大體輪廓皆源自於美國的經驗,惟受到國情、社會文化與經濟條件上的差異性,使兩地區在規劃寄存圖書館制度運作策略上仍各有特色,且彼此間具有可比性。因此,為瞭解中美寄存圖書館制度的形成與未來電子寄存服務的發展及角色定位,本研究擬以政府出版品寄存圖書館制度為論述主題,利用比較研究法對中美寄存圖書館制度相關議題,進行深入的比較分析,據以瞭解其制度的發展歷程。 本研究採比較研究法,配合文獻分析法進行。分別運用「描述」、「解釋」、「併排」及「比較」四個主要研究步驟,探討中美兩國政府出版品寄存圖書館制度之發展。主要的研究目的有四:一、分析中美兩國寄存圖書館制度發展的歷史沿革及制度形成之宗旨、任務與功能;二、探討中美寄存圖書館制度運作的相關法源依據、主管機關組織、管理作業運作現況及電子化寄存服務之發展趨勢;三、探討中美政府資訊公開理念及政府出版品著作權的規範現況,對寄存圖書館制度發展之影響;四、比較中美寄存圖書館制度規劃與運作現況之異同與未來發展趨勢,並據以提出對國內未來規劃寄存圖書館制度之具體建議。為達成前述研究目的,研究者分析、報導中美政府出版品寄存圖書館制度之相關文獻後,綜合歸納制度的比較研究結果,提出六項結論暨十項建議,茲分項臚列如下: 一、結論部份 目的在於綜理上述各章所作的現況探討,具體比較中美兩國政府出版品寄存圖書館制度在規劃與現況運作上的差異性、現況發展及趨勢,並歸納提出免費提供政府出版品之寄存圖書館制度,未來仍有其繼續存在的必要性。比較分析的項目分別有: (一) 中美政府出版品寄存圖書館制度之發展歷史;  (二) 中美政府出版品寄存圖書館制度之相關法源;  (三) 中美政府出版品寄存圖書館制度管理現況;  (四) 中美政府資訊公開政策與寄存制度之發展;  (五) 中美政府出版品電子化寄存服務之發展趨勢;  (六) 政府出版品寄存圖書館制度之存與廢之探討。 二、建議部份  (一)積極爭取上級機關重視與經費支援;  (二)健全政府出版品管理制度法源基礎;  (三)建立正確的政府資訊利用觀念;  (四)暢通寄存圖書館制度的溝通與合作管道;  (五)訂定明確的寄存圖書館作業標準及規範;  (六)釐清政府出版品著作權的授權與合理使用;  (七)建構完善的寄存制度績效與評估獎勵模式;  (八)規劃並建置我國電子化寄存服務環境;  (九)重視寄存館員在職訓練與服務內涵的提昇;  (十)強化政府出版品之灰色文獻的整理與利用。

Factors influencing access to electronic government information and e-government adoption in selected districts of Tanzania

E-government is a means of improving provision of government information and services to citizens. The aim of this study was to investigate the current situation and factors influencing access of e-government information and e-government adoption in Tanzania. A triangulation approach for data gathering was adopted. Specifically, a semi-structured questionnaire was used to collect data from 448 respondents. In addition, interviews involving five policy makers were conducted to complement the questionnaire survey. Factor analyses were performed and multiple linear regression analyses were carried out to assess the relationships between variables. The findings revealed that, the current state of e-government in the selected districts of Tanzania is characterized by web presence stage. Various enhancing factors and challenges for e-government were noted in this study. The enhancing factors include necessary knowledge, necessary resources, awareness, confidence to use the website, availability and reliability of internet connections, positive incentives that have resulted from using the internet to search for government information, and getting information on demand. Other enhancing factors are guidance for internet use, possession of ICTs, availability of up-to-date information in the website, education, income and social influence. There are some e-government adoption barriers that include worrying about security and privacy of information, lack of support from the government, unreliable power supply, inaccessibility of internet services due to geographical locations, and people not getting as much information about the services as possible. Other barriers are system quality, cultural barriers, age, and information content produced in English, which is a language that the majority do not understand. The study has implications for policy makers and to e-government project teams. Policy makers should consider e-government adoption barriers in order to formulate policies of eliminating them. Likewise, e-government project teams should consider these barriers in order overcome them before the implementation of e-government systems. / Information Science / D. Litt et. Phil. Introduction Multimodal pain therapy (MPT) has been established accounting for biopsychosocial consideration in diagnostic and therapy. MPT seems to be effective, but comparability of studies is limited due to diversity of study designs and outcome measurements. The presented study aims to develop a core outcome set consisting of a minimum of outcome measures deemed necessary for medical and therapeutic decision-making, which must be measured in all clinical trials and non-randomised intervention studies.

Erdheim-Chester disease (ECD) represents a clonal non-Langerhans histiocytosis, which manifests under an extensive variety of clinical symptoms. This creates a challenge for the physician, who is required to recognize and diagnose the disease in the early stages. Despite this considerable challenge, in the last decade there has been a dramatic increase in ECD diagnoses, in most part due to an increasing awareness of this rare disorder. Involvement of the axial skeleton is exclusively uncommon with no official recommendations for the treatment of the bone lesions. Here, we present a case report of a young male patient with isolated lesions of the spine, ribs, and pelvis, who was successfully treated with a combination therapy of alfa-interferon and zoledronic acid.

The in vivo kinetics of RNA polymerase II elongation during co-transcriptional splicing

RNA processing events that take place on the transcribed pre-mRNA include capping, splicing, editing, 3′ processing, and polyadenylation. Most of these processes occur co-transcriptionally while the RNA polymerase II (Pol II) enzyme is engaged in transcriptional elongation. How Pol II elongation rates are influenced by splicing is not well understood. We generated a family of inducible gene constructs containing increasing numbers of introns and exons, which were stably integrated in human cells to serve as actively transcribing gene loci. By monitoring the association of the transcription and splicing machineries on these genes in vivo, we showed that only U1 snRNP localized to the intronless gene, consistent with a splicing-independent role for U1 snRNP in transcription. In contrast, all snRNPs accumulated on intron-containing genes, and increasing the number of introns increased the amount of spliceosome components recruited. This indicates that nascent RNA can assemble multiple spliceosomes simultaneously. Kinetic measurements of Pol II elongation in vivo, Pol II ChIP, as well as use of Spliceostatin and Meayamycin splicing inhibitors showed that polymerase elongation rates were uncoupled from ongoing splicing. This study shows that transcription elongation kinetics proceed independently of splicing at the model genes studied here. Surprisingly, retention of polyadenylated mRNA was detected at the transcription site after transcription termination. This suggests that the polymerase is released from chromatin prior to the completion of splicing, and the pre-mRNA is post-transcriptionally processed while still tethered to chromatin near the gene end.

Temporary loss of moral behavior in a patient undergoing chemotherapy with cisplatin - breaking bad

Background: Behavioral disturbances following chemotherapy with cisplatin are rare. Here, we report a patient with temporary loss of moral behavior in the setting of cisplatin-based chemotherapy for treatment of tonsillar cancer. Case presentation: A 66-year-old Caucasian male with no psychiatric or violent history was started on chemotherapy with cisplatin for treatment of tonsillar cancer. During the following weeks, the patient developed profound personality changes involving volatile emotions and impulsive aggression with verbal and physical assaults on others. Admitted to the hospital, the patient lacked any awareness that his behavior was wrong. Chemotherapy was discontinued and the patient was prescribed risperidone. Aside from mild cognitive impairment, comprehensive neuropsychological, neuroradiological and lab testing were unremarkable. Three weeks following cessation of chemotherapy, the patient had recovered to his original mental state and he was completely aware of his wrongdoing and social misconduct. Conclusion: Since neurotoxic effects of chemotherapeutics on the brain are not yet sufficiently elucidated, our case emphasizes that early signs of behavioral abnormalities in patients receiving chemotherapy should trigger comprehensive psychiatric evaluation and ongoing monitoring of the patients’ mental state.

Meta-analýza vlivu minimální mzdy na cenovou hladinu / A Meta-Analysis of the Effect of Minimum Wage Increases on Prices

As an economically as well as politically sensitive topic, labor market interventions stir up discussions among professionals as well as general public. Most economists take negative stance against minimum wage policies providing arguments backed by theoretical reasoning rather then sound empirical evidence. Knowledge of labor market outcomes and their transmission channel to other segments of the economy are till nowadays limited and inconsistent. Neither empirical research in the field contributes to a uniform consent on the impact of minimum wage hikes on the price level. Moreover, the reported estimates display large heterogeneity and after a brief inspection reveal that the field is infested with publication selectivity. A uniquely constructed dataset consisting of 469 estimates of the price effect of minimum wage changes and their associated characteristics is analyzed using a set of statistical tools generally known as meta-analysis. The method is a powerful tool nowadays widely used in empirical research to synthesize and systematically evaluate sometimes inconsistent research results. While the study finds no consistent evidence of an actual link between minimum wage hikes and inflationary pressures, the empirical results show strong presence of publication selectivity.
