A partir de uma investigação sobre a conjuntura política da década de 1980 e início de 1990, fez-se uma análise do comportamento político dos partidos, sobretudo do PT, o Partido dos Trabalhadores. Analisamos também a dinâmica assumida pelas tendências internas, ou seja, dos agrupamentos partidários que fizeram parte da construção petista e da definição de sua identidade. Para isso foi necessário analisar os documentos oficiais do período delimitado, assim como publicações realizadas em jornais, revistas, dissertações e teses, que são muito variadas neste momento histórico que estamos vivenciando, pois o Partido dos Trabalhadores após vinte e dois anos de existência, chega a Presidência da República com Luiz Inácio Lula da Silva à sua frente. A dissertação coloca em discussão a mudança que o partido sofre a partir de 1987, quando ocorre o 5° Encontro Nacional, o PT passa a optar pelo abando do marxismo e afasta-se das reivindicações populares, que de certa maneira estavam presentes em suas formulações, influenciadas pelas organizações marxistas-leninistas e também as de tradição trotskista. A preferência petista pela institucionalidade e a ascensão de uma nova postura organizativa, certamente foram consequências das transformações ocorridas no cenário nacional e internacional, como a queda do muro de Berlim, o fim do "socialismo real", e a introdução do neoliberalismo. / Abstract:This present dissertation aims to discuss about the Metamorphosis of the Politic Activities of the Worker's Party (PT), during the period of 1987 to 1991. It is an inquiry into the politics conjuncture from the 80's until the beginning of the 90's, analyzing the political behavior of the parties, especially PT's. The dissertation also considers and analyzes the actions taken in the Worker's Party internal trends, the partisanships and the definition of its identity. For the studies development, it was necessary to compile official documents from the delimited period of time, as well as essays published in periodicals, magazines, newspapers and thesis, which are varied due to the election of the leader of the PT, Luiz Inácio Lula da Silva in 2002, for the President of the Republic. PT finally reaches the power after twenty two years of existence. The research discuss that the PT since 1987, year of its 5° National Meeting, assures the institutional fight, abandoning the Marxism and leaving aside the popular claims, which until that date had always been supported by the party's decisions, also influenced by the Marxist-Leninist organizations and by the Trotskyism tradition. The dissertation concludes that PT's institutional preference is a result of the transformations occurred nationally and internationally, including the fall of Berlin's wall and the end of the "real socialism". Furthermore, the introduction of the neoliberals made PT assume a new kind of organization. / Mestre

Orientador: Gisele Maria Schwartz / Banca: Maria Cristina Rosa / Banca: Catia Mary Volp / Resumo: O presente estudo tem como objetivo investigar a festa do Bumba-meu-boi na configuração do estilo de vida e lazer da comunidade da Maioba como fator decisivo de organização interna do grupo. Os sujeitos dessa pesquisa são os participantes do Bumba-meu-boi da Maioba em suas vivências com a festa, no contexto das interações entre eles, seus atributos simbólicos e as ressonâncias dessa manifestação dentro e fora da comunidade. Os indicadores analisados foram organizados observando-se os hábitos e costumes, relações interpessoais e representação da festa durante no ciclo de apresentações do Bumba-meu-boi no festejo junino em São Luís (MA). O estudo revela que por meio dessa festa a comunidade da Maioba desenvolve uma série de atividades que representam o seu estilo de vida e lazer. Na medida em que os participantes contribuem para a organização do grupo por meio de suas atribuições, estes buscam realizá-las de maneira compromissada e responsável, seja de forma amadora, casual, como passa tempo ou voluntária. Assim, a comunidade se permite reviver sua memória, fortalecer as relações interpessoais, relações familiares, de amizade e devoção aos ritos que ocorrem em face da festa do Bumba-meu-boi. Os momentos vivenciados na festa configuram, portanto, um espaço de divertimento, descontração e lazer para os membros da comunidade, bem como para visitantes de outras localidades. / Abstract: The present study has as objective to investigate the party of the Bumba-meu-boi in the configuration of the lifestyle and leisure in the Maioba's community as decisive factor of the interns' organization of the group. The subject of that research are the participants of the Maioba's Bumba-meu-boi in their experiences with the party, in the context of the interactions among them, their symbolic attributes and the resonances of that manifestation inside and out of the community. The analyzed indicators were organized being observed the habits, interpersonal relationships and representation of the party during the presentations' cycle of the Bumba-meu-boi in religious feasts in honor to the saints, in São Luís (MA). The study reveals that through that party the community of the Maioba develops a series of activities that represent the community's lifestyle and leisure. Day by day the participants contribute to the organization of the group through their attributions, thus, they to search to execute these attributions with compromise and responsibility, be in way amateur, casual, as pastime or volunteer. Like this, the community allows to revive their memory, to strengthen the interpersonal relationships, family relationships, of friendship and devotion to the rites that happen due the Bumbameu- boi's party. The moments lived at the party configure, therefore, an entertainment space, amusement and leisure for the community's members, as well as for visitors of (the) other places. / Mestre

As questões que motivaram o desenvolvimento da presente pesquisa foram decorrentes do debate permanente acerca do significado dos partidos políticos na atualidade. Partiu-se da hipótese de que a estrutura e as normas institucionais de determinado partido, ou ainda os seus resultados eleitorais, seriam insuficientes para explicar tanto o funcionamento interno como o papel da organização partidária no sistema político-eleitoral. A dinâmica do partido decorreria, isto sim, do resultado das relações entre os filiados, especialmente dos vínculos estabelecidos com os líderes partidários, com vistas a atender seus objetivos políticos. Por meio de uma abordagem que articula os padrões relacionais, os resultados eleitorais e a ocupação de cargos na Comissão do Diretório Estadual do partido, foi possível identificar os fatores que explicam a organicidade e a capilaridade do PSDB/SP. A análise de redes revelou as posições de poder na organização e os atores que as ocuparam ao longo da trajetória do partido. A partir da definição do padrão relacional da organização realizou-se um mapeamento dos atributos e vínculos dos líderes partidários e dos membros que compuseram as diversas gestões da Comissão Executiva do diretório estadual. Os dados obtidos foram referência para análise dos resultados eleitorais do período. Tais procedimentos possibilitaram ainda mapear geograficamente a base eleitoral do partido e identificar a capacidade do capital político de determinados atores de influenciar os resultados eleitorais. Comprovouse a hipótese de que a dinâmica funcional do partido decorreu das relações entre os atores políticos, os quais, por sua vez, consideraram os aspectos institucionais... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This thesis analyses the organizational dynamic of the Brazilian Social Democratic Party (PSDB) in the state of São Paulo, between 1988 and 2006. The questions that motivated the development of this research emerged from the permanent debate around the significance of political parties nowadays. The research stems from the hypothesis that the institutional structure and norms, or even that the electoral results of any given party, would be insufficient to explain its internal functioning and the role of the organization in the political-electoral system. The dynamics of the party arise from the result of the relations between its members, especially in the links established with the party's leaders, in regard to achieving its political objectives. Through a process which articulates the standard relations, the electoral results and the filling of positions on the party's State Directors Commission, the explanatory factors for the PSDB's organizational and capillary dynamics have been identified. The analysis of networks revealed the positions of power in the organization and the actors who have occupied them during the trajectory of the party. After defining the organization's relational model, this study mapped the attributes and links of the party's leaders and members that made up the numerous mandates of the Executive Commission of the State Directory. The results obtained were used to analyze the electoral results of the period. These procedures ensured even to map geographically the electoral base of the party and to identify the capacity of the political capital of specific actors in influencing the electoral results. It proved the hypothesis that the party's functional dynamics arise from the relations between the political actors which consider the institutional aspects to establish their politicalelectoral strategies. Delimitamos o bairro de Moema localizado na Região Sul da metrópole paulista para estudar o papel desses serviços na sua relação com a festa. O consumo realizado nesses lugares e o uso de forma temporária também aparecem imersos ao longo da análise. A produção da festa é estudada a partir do desenvolvimento da vida de bairro e da metrópole, que comporta mudanças nos hábitos de consumo para o qual a festa agora possui lugar. / Abstract: The aim of this study is to investigate the daily life of the city of São Paulo by analyzing places where parties are held - the buffets. We have chosen Moema neighborhood, located in the South Region of São Paulo to study the role of such places in relation to the parties. The consumption taking place in these locations and their occasional use are also objects of this investigation. The production of parties is studied, taking into consideration the neighborhood life and metropolis development, which can shed light into the understanding of consumption habits such as the existence of parties. / Mestre

Orientador: Enoque Ribeiro dos Santos / Banca: Antônio Rodrigues de Freitas Júnior / Banca: José Carlos de Oliveira / Resumo: O trabalho visa investigar a admissibilidade da terceirização no setor público, suas peculiaridades e a responsabilização do ente público, haja vista a ausência de norma específica em relação à responsabilidade, em caso de terceirização, construída através de entendimentos jurisprudenciais, a qual encontra questionamentos acerca da responsabilização diante do que dispõe a Lei de Licitação, em seu art. 71, em confronto com as disposições contidas nos artigos 1º, 37, par. 6º, 170, 173 e 193 da Constituição Federal. O intérprete da norma jurídica não se deve ater apenas à interpretação gramatical, sobretudo no que diz respeito à responsabilização dispensada à Administração Pública na Lei de Licitação, devendo o intérprete utilizar-se da interpretação lógico-sistemática e teleológica da Lei de Licitação em confronto com o disposto constitucionalmente, permitindo a responsabilização do ente público, nos casos de terceirização. Esta no setor público sofre limitações, diante do comando legal insculpido no inciso II do art. 37 da Carta magna, que exige a prévia aprovação, em concurso público, para a investidura em cargo ou emprego público, à exceção dos cargos de livre provimento. A terceirização no setor público tem como traço diferencial, com o setor privado, a não formação de emprego com a Administração direta, indireta ou fundacional. A terceirização é uma tendência mundial irreversível, mas não podemos deixar que ela seja utilizada para fraudar os direitos dos trabalhadores, contribuindo, deste modo, para a perpetuação das injustiças, tornando-se cada vez mais perversa, o que, em última análise, acaba gerando o fim da própria terceirização. / Abstract: This study aims to investigate the admissibility of the third party in the public sector, its peculiarities and the liability of the public entity, as there is an absence of a specific procedure in relation to the responsibility in the case of the third party, composed through jurisprudence agreements, finding questionings regarding the liability before what is determined to the Licitation Law in its article 71 in confrontation to the dispositions included in the articles 1st, 37, paragraph, 6th, 170, 173 and 193 of the Federal Constitution. The interpreter of the juridical procedure should not detain themselves only to the grammatical interpretation, above all in regards to the liability bestowed to the Public Administration in the Licitation Law, where the interpreter should use the logic-systematic and teleological interpretation of the Licitation Law in confront to the constitutional determination, allowing the liability of the public entity in the third party cases. The third party in the public sector suffers limitations, before the legal command inscribed in the proposition II of article 37 of the magna letter, which demands the previous approval in a public examination for the investiture in an office or public employment, in exception to the offices of the free administrative acts. The third party in the public sector has as a differential aspect with the private sector, the non-formation of employment with the direct, indirect or foundational Administration. The third party is a worldly and irreversible tendency, but we cannot allow that it is used to fraud the laborers' rights, contributing to the perpetuation of the injustices, becoming more and more perverse, and that as a last analysis, this ends up by generating the termination of the third party itself. / Mestre
