This Master's Thesis deals with the legal form of employment of persons with disabilities. This group of people is disadvantaged on the labor market due to their disabilities and thus entitled to special protection within the labour law relations. Their integration on the labour market is supported by the state through many legal tools that are used for both positive and negative employers' motivation. The thesis is divided into four separate chapters according to the areas I am dealing with. The introduction is followed by the first chapter where I define the basic terminology. I focus on the term of employment and its dissimilarities from other work forms. It continues with the definition of a person with a disabilty according to the Employment Act which is, for better understanding, presented in the relevant historical context. At the end of this chapter I also mention other laws defining a person with a disability for their own purposes within the Czech legal system. The second and third chapter are dedicated to the international and European legal regulations on the employment of persons with disabilities. Disabled people belong amongst groups of people, which have difficulties with assertion on the job market due to their specific attributes, and therefore their employment on the open as well as on the protected job market is supported and protected by various legal instruments, which are described in detail in this thesis. The thesis is devided into seven parts. The first part deals with the history of the relationship of disabled persons and the society as it recorded the oldest Greek and Roman sources of law as well as sources in our country. It describes several measures that have been introduced to make the lives of the poor and the sick better until 1948 . The second part provides an overview of the most important international sources and sources of the European Union. It describes the protection that these sources provide to basic human rights, the principle of equality and non-discrimination and to regulate the rights and status of persons with disabilities. Diploma Thesis - Stimulation of person with physical and multiple disabilities through Vojta's therapeutic concept - is about aplication of Vojta's reflex locomotion method at newborns and infants.The theoretical assessment is describing the development, basic principles and the use of this method. Vojta's special diagnosing will be also addressed. The next major chapter will be the description of muscular dystrophy and consisting of basic division, description of diagnosing principals and treatment. One chapter is dedicated to Girdle Muscular Dystrophy and its manifestation and difficulties with the diagnosis. Empirical data is being collected through a questionnaire which was given to parents with newborns and infants and will provide a complex vision analysis on Vojta's method and its application to newborn and infants born with physical and multiple disabilities.

Os documentos legais têm apontado para o acesso e as adaptações durante o processo de ingresso nas Instituições de Ensino Superior (IES) e ações que visem à acessibilidade e permanência desses alunos. Visando conhecer como os alunos com deficiência, transtornos globais do desenvolvimento e altas habilidades/superdotação encontram suporte nessas instituições, a presente pesquisa busca analisar o acesso e a permanência no ensino superior de pessoas com deficiência, a partir de teses e dissertações defendidas nas universidades brasileiras, sob a perspectiva dos próprios alunos. Esta é uma pesquisa bibliográfica de cunho quantitativo e qualitativo, tendo como objeto de estudo 20 produções científicas, entre elas 15 dissertações e 5 teses. Buscando conhecer um panorama geral da educação superior no Brasil, os microdados do censo de 2014 foram abordados e mostraram que 0,4% dos alunos da educação superior são alunos público-alvo da educação especial, estando 63% em IES privadas, 36% em IES públicas e 1% em especiais. As teses e dissertações estudadas apresentaram o perfil dos alunos presentes nesses estudos: alunos com deficiência visual, auditiva/surdez, física e intelectual; os cursos de graduação em diversas áreas do conhecimento, destacando-se o curso de pedagogia em grande parte dos estudos, e as instituições frequentadas, que são públicas e privadas. As adaptações de acesso realizadas durante o vestibular apontaram que grande parte das IES adequam esse instrumento às necessidades dos alunos. As ações de permanência e acessibilidade foram realizadas por Instituições de Ensino Superior, Núcleos de acessibilidade, coordenação de curso e por professores que propiciaram ações que atenderam às necessidades dos educandos, buscando promover condições de permanência, assim como mencionado por documentos oficiais. Além disso, foram apresentadas as barreiras, arquitetônicas, pedagógicas, comunicacionais e atitudinais, encontradas nas IES. Diante disso, pode-se observar que os alunos com deficiência estão nas IES e necessitam de apoio durante o acesso e a permanência. As ações têm sido realizadas pelas diferentes esferas das IES, porém esses alunos ainda têm encontrado barreiras para sua efetiva permanência. / The inclusion of people with disabilities in higher education institution has increased significantly and this reality is recent. Official data was pointed to access and adaptations during the process of joining the Higher Education Institution (HEI) and actions to ensure at the accessibility and permanence of these students. Aiming to know how students with disabilities, global development disorders and highly talented children find support in these institutions, this research wanna analyze the access and permanence in graduate education of people with disabilities -based on theses and dissertations defended in Brazilian universities- from the perspective of the students themselves. This is a quantitative and qualitative bibliographical research, having as object of study 20 scientific productions, among them 15 dissertations and 5 theses. In order to get a general overview of higher education in Brazil, the microdata of the 2014 census were approached and showed that 0.4% of students in higher education are main-target students of special education, 63% in private HEIs, 36% in Public HEIs and 1% in special. The theses and dissertations studied presented the profile of the students approached in these studies: students with visual, hearing/deaf, physical and intellectual disabilities; the undergraduate courses in several areas of knowledge -mainly the pedagogy course in most of the studies- and the institutions attended, which are public and private. The access adaptations carried out during the University Entrance Test indicated that a large part of HEIs adapted this instrument to the students' needs. The actions of permanence and accessibility were carried out by Higher Education Institutions, Accessibility Centers, undergraduate course coordination and teachers who provided actions that met the needs of students, aiming to promote conditions of permanence, as mentioned by official documents. By the way, the architectural, pedagogical, communicational and attitudinal barriers found in HEIs were presented. Aware of this, it can be observed that students with disabilities are in HEI and need support during access and permanence. nÃo hà / A EducaÃÃo Inclusiva repercute uma mobilizaÃÃo mundial que consolida os ideais de igualdade na EducaÃÃo de qualidade para todos e revela-se um desafio da sociedade contemporÃnea. A inclusÃo de alunos com deficiÃncia na escola regular implica profundas mudanÃas na avaliaÃÃo da aprendizagem, que tradicionalmente tem se constituÃdo no exercÃcio da classificaÃÃo, seleÃÃo e exclusÃo, em oposiÃÃo ao seu papel formativo. Considerando a avaliaÃÃo do rendimento escolar pautada num processo dinÃmico, esta pesquisa objetiva investigar como à realizada a prÃtica da avaliaÃÃo da aprendizagem de alunos com deficiÃncia intelectual matriculados nas escolas regulares nos Anos Iniciais do Ensino Fundamental da rede municipal de Fortaleza-CE, na Secretaria Executiva Regional II (SER II). Especificamente, tem o propÃsito de: i) identificar o conceito dos professores sobre a avaliaÃÃo da aprendizagem de pessoas com deficiÃncia intelectual; ii) pesquisar os procedimentos avaliativos utilizados pelos professores junto aos alunos com deficiÃncia intelectual; iii) conhecer as dificuldades no tocante à avaliaÃÃo da aprendizagem dos alunos com deficiÃncia intelectual atravÃs de professores, alunos e seus familiares ou responsÃveis; iv) coletar sugestÃes do professor, e seus familiares ou responsÃveis, para a melhoria de mudanÃas educacionais e de construÃÃo de prÃticas avaliativas de carÃter sistemÃtico e reflexivo. Para esse propÃsito, foi realizada uma pesquisa de natureza qualitativa e quantitativa, na forma de um estudo de caso. Os instrumentos de coleta de dados foram a entrevista semiestruturada e o questionÃrio misto. Os dados obtidos foram categorizados segundo uma anÃlise de conteÃdo. As amostras foram constituÃdas por 16 familiares ou responsÃveis dos alunos com deficiÃncia intelectual e 7 professores das salas regulares, num total de 23 sujeitos. Os resultados revelaram que os docentes apontaram concepÃÃes limitadas e subjetivas acerca da EducaÃÃo Inclusiva, deficiÃncia intelectual e avaliaÃÃo da aprendizagem. Trindade is presented as cultural heritage and built its historical formation process, economic and municipal territory through the traditions of Catholic origins and country music. The emergence of the locality is directly linked to the religious factors that have occurred over several years, dialoguing directly with factors of reception of the person with disability. Trindade is also known for hosting one of the largest institutions in the country that cares and welcomes people with disabilities (Vila São José Bento Cottolengo) and then come the questions: Trindade is designed and planned to receive this population in order to guarantee equal access? How the conflicts between the city's public spaces and disabled people? Is it possible to determine how the appropriation of these public spaces occurs by the person with a disability? In this sense, we seek to understand the historical memory of the city of Trindade (historical documents), the materialization of the space itself from the perspective of people with disabilities who experience this space, in order to understand the socio-spatial relationship of the city's constitution under the aspect of accessibility. Therefore, this study is characterized as a qualitative and quantitative descriptive and exploratory research. Qualitative qualitative research deals with the universe of meanings, motives, aspirations, beliefs, values and attitudes associated with a numerical translation. To collect the analysis data, field observations were made through photographs of the public spaces of the city of Trindade to confront the standards of accessibility, collection of data about the place of residence of the disabled population in the city (through the IBGE - Brazilian Institute of Geography and Statistics, and also of specific organs such as the Association of the Physically Disabled of Trindade - (ADEFITRIN) and Vila São José Bento Cottolengo), data on accessibility and urban mobility policy (City Posture Code and the Organic Law of the municipality). In addition to a bibliographical research about public space, disability (disabled physical people), public policies for people with disabilities, urban mobility and accessibility as an element of support for practical activities. The conclusion of this research that Trindade is a city that has a non-viability of accessibility, compromising not only people with disabilities, but the population as a whole, and planning measures, urban redevelopment need to be effected to receive in an egalitarian way all those who pass through it. / Este trabalho está vinculado à pesquisa de mestrado com a finalidade de analisar a acessibilidade dos espaços públicos da cidade de Trindade- GO para o uso da pessoa com deficiência física. Trindade se apresenta como patrimônio cultural e construiu o seu processo de formação histórica, econômica e território municipal através das tradições de origens católicas e raízes sertanejas. O despontar da localidade está diretamente vinculado aos fatores religiosos que ocorreram ao longo de vários anos, dialogando diretamente com fatores de acolhimento da pessoa com deficiência. Trindade também é conhecida por abrigar uma das maiores Instituição do país que cuida e acolhe pessoas com deficiência (Vila São José Bento Cottolengo), e daí surge os questionamentos: Trindade é pensada e planejada para receber essa população de forma a garantir a igualdade de acesso? Como se apresentam os conflitos existentes entre os espaços públicos da cidade e a pessoa com deficiência? É possível determinar como ocorre apropriação desses espaços públicos pela pessoa com deficiência? Nesse sentido, buscamos, com essa forma de análise, entender a memória histórica da cidade de Trindade (documentos históricos), pela materialização do próprio espaço a partir da perspectiva de pessoas com deficiência que vivenciam esse espaço, de modo a compreender a relação sócio-espacial da constituição da cidade sob o aspecto da acessibilidade. Por isso, o presente estudo caracteriza-se como uma pesquisa qualiquantitativa de cunho descritivo e exploratório. A pesquisa qualiquantitativa ocupa-se do universo de significados, motivos, aspirações, crenças, valores e atitudes associada a uma tradução numérica. Para coleta dos dados de análise foram realizadas observações de campo através de fotografias dos espaços públicos da cidade de Trindade para o confronto com as normas de acessibilidade; coleta de dados sobre o local de residência da população com deficiência na cidade (através do IBGEInstituto Brasileiro de Geografia e estatística, e também de órgãos específicos como a Associação dos deficientes físicos de Trindade – (ADEFITRIN), e da Vila São José Bento Cottolengo); dados sobre a política de acessibilidade e mobilidade urbana (Código de postura da cidade e Lei Orgânica do município). Além de uma pesquisa bibliográfica sobre espaço público, deficiência (pessoa com deficiência física), políticas publicas para a pessoa com deficiência, mobilidade urbana e acessibilidade como elemento de suporte para as atividades práticas. Concluiu-se com esta pesquisa que Trindade é uma cidade que apresenta uma inviabilidade de acessibilidade, que compromete não só as pessoas com deficiência física, mas a população como um todo, e que medidas de planejamento, reordenamento urbano precisam ser efetivadas para receber de modo igualitário todos que ali transitam.

Introduction: Persons with disabilities (PWDs) living in rural areas are known to have a higher risk of living in poverty as they have the lowest levels of employment. To assist persons with disabilities to overcome these challenges, the South African government has developed interventions such as social assistance programmes which aim to prevent poverty and assure the basic minimum standard of living. Over the past five years minimal research has been published which focused on the disability grant in the South African context. More specifically, no research has been conducted in the Northern Cape, home to a high proportion of persons with disabilities. Of the research conducted in other parts of South Africa, no studies have sought to understand the experiences of persons with disabilities while engaging in the disability grant process. The research question for this study was, “How are PWDs experiencing the disability grant processes occurring at the SASSA Springbok branch in the NC?” This study therefore aimed to describe the experiences of disabled persons with the disability grant processes as they occurred at the South African Social Security Agency (SASSA) in Springbok, Northern Cape. Method: A single instrumental case study research design was utilised. Five participants were purposively sampled. Data were collected through document review of pertinent SASSA documents, non-participant observation, and semi-structured interviews. Data were analysed inductively, taking a thematic approach. Findings: The theme that emerged was Respecting differences is part of humanity. The main findings reveal that engaging with persons with disabilities as humans and not disregarding their humanity because of their disability are imperative to how they experience the disability grant process. Two categories, For us, human dignity matters, and the Impact of context on occupational rights, encapsulate two specific areas that relate to the theme. Conclusion: The experience of the disability grant process in this case study was influenced by stakeholder engagement with participants, mandatory protocols implemented due to the novel coronavirus, and the administrative aspects of the process. Recommendations for an improved overall experience of the disability grant process include streamlining the disability grant application process, the implementation of consistent Batho Pele principles by all stakeholders, suitably accommodating the disability grant application process for all types of disabilities, as well as maintaining the logistical structures put in place (albeit unintentionally) from the year 2020.

Experience of patients with disabilities and their close persons during hospitalisation demonstrates insufficient understanding to the needs of such people. This issue is also discussed in foreign literature, wherein the need to establish the position of a specialized worker who knows very well the conditions of the health care facility and the needs of people with disabilities is emphasized. The objective of this thesis is to point out the complex issue of the needs of people with learning disability and their close persons during hospitalisation. Hospitalisation itself is a difficult and demanding situation in any person's life. For persons with learning disability, this situation is even more serious. The thesis aims at describing the experience of persons with learning disability so that it may serve as the basis for improving their health care.
