Nusikaltimų asmens privataus gyvenimo neliečiamumui baudžiamasis teisinis vertinimas / Evaluation of crimes against immunity of personal privacy

Pirmoje darbo dalyje aptariama asmens privataus gyvenimo ir jo neliečiamumo samprata ir turinys šiuolaikinėje nacionalinėje konstitucinėje, baudžiamojoje, administracinėje bei civilinėje, taip pat tarptautinėje teisėje, analizuojamos šios teisės užtikrinimo bei ribojimo teisinės priemonės, bei jų reglamentavimas šiandieninėje Lietuvos teisėje. Antrojoje darbo dalyje pateikiama asmens privataus gyvenimo neliečiamumo baudžiamoji teisinė charakteristika, visų pirma analizuojant baudžiamojo įstatymo uždraustų veikų, nukreiptų prieš asmens privataus gyvenimo neliečiamumą, sudėtis bei aptariant baudžiamąją teisinę kvalifikaciją. Trečiojoje darbo dalyje pateikiama praktinio sociologinio tyrimo bei kriminalinės statistikos rezultatų apžvalga, bei šių duomenų analizės metu nustatytos veikų, nukreiptų prieš asmens privataus gyvenimo neliečiamumą, baudžiamumo vertinimas skirtingų visuomenės grupių atstovų tarpe, išskiriant baudžiamosios atsakomybės už šios kategorijos nusikaltimus baudžiamojo teisinio vertinimo (kvalifikacijos) bei praktinio taikymo, taip pat šių veikų kriminalizavimo vertinimo problemas, pateikiant pasiūlymus galimam jų sprendimui. / The first part of the paper is analysing the concept and content of immunity of personal privacy in present national Constitutional, Criminal, Administrative and Civil law, as well as in International law. As well legal restriction of this right and regulations of these legal measures in nowadays Lithuania law being analysed. Second part of the paper describes criminal legal characteristics of actions against immunity of personal privacy focusing on analysis of criminal composition of offences directed against immunity of personal privacy as well discussing its criminal qualification. The third part of presented work reveals data gained during sociological research and observing results of criminal statistic concerning the offences against immunity of personal privacy and the way groups of society ranks these offences as a criminal, emphasizing problems related with theirs criminal qualification and evaluation as well as with the attitude of different groups of society about criminalisation of these kind of offences. At the end of presented paper suggestions on solving revealed problems being presented.

Esta Tese tem por objetivo analisar as práticas de compartilhamento da vida privada no espaço virtual como produtoras de sensibilidades reconfiguradas nas relações de afeto entre sujeitos jovens contemporâneos. Utilizando a netnografia como escolha metodológica, analisei postagens disponibilizadas por dez jovens nas páginas de abertura dos perfis que mantinham nas redes sociais. Devido à fluidez característica do espaço virtual e, em especial, aos deslocamentos dos sujeitos nas redes sociais, o estudo iniciado no Orkut foi sendo ampliado, incluindo a observação focada nestes movimentos e em cenas cotidianas relacionadas ao tema proposto. O trabalho está organizado em quatro partes: na primeira delas, Conectando: cliques e conceitos entrelaçados, apresento motivações que me interpelaram e me conduziram à realização do estudo, desenvolvo conceitos que irão orientar a pesquisa, apresento o espaço do Orkut e os sujeitos envolvidos na pesquisa; na segunda parte, Da etnografia à netnografia, descrevo as trilhas metodológicas que construí contextualizando e justificando tais escolhas; na terceira parte, denominada O Imperativo da conexão: privacidade compartilhada nas redes de relacionamento virtual, desenvolvo análises a partir de dois eixos de pesquisa – o compartilhamento da privacidade como condição para o pertencimento ao grupo de amigos e as formas de ‘consumir’ afetos e relacionar-se na modernidade líquida; na quarta e última parte, Do Orkut ao Facebook: espaços fluídos e sujeitos nômades, abordo os deslocamentos dos sujeitos nas redes sociais e suas implicações na realização deste estudo e na compreensão do tema proposto. Using netnography as a methodological tool, we analyzed messages posted by ten youngsters in the opening pages of their existing blogs kept in the social networks. Due to the typical fluidity of the Cyberspace and, in particular, to the high mobility of people in social networks, the study, which had started in the Orkut, was gradually expanded, including the observation focused on this high mobility and on everyday scenes related to the proposed theme. This work is organized into four parts as follows: in the first part, “Connecting: clicks and entangled concepts”, we disclose the reasons that made us to question the issue, leading us to conduct this study, develop the concepts that guided the research and present the Orkut and the youngsters under scrutiny; in the second part, “From Ethnography to Netnography”, we describe the methodological path built by us, contextualizing and justifying our choices; in the third part, “The Connecting Imperative: privacy shared through the virtual networking spaces”, we develop our analysis in two lines of research - the sharing of personal privacy as a condition for belonging to a group of friends and how to 'consume' affection and establish relationships in the liquid modernity; the fourth and last part, “From Orkut to Facebook: fluid spaces and nomadic people”, we address the high mobility of people in social networks and its implication for developing this study and for comprehending the proposed theme. This problem had stimulated the author to create a work of visual art. Hereafter it documents examples of historical use of ceramic wall tiles with relief decoration . Also it presents the technology of producing wall tiles. The practical part of my diploma thesis contains design, production and installation of wall tiles with relief motive of a{\clqq}snooper`` in the interior of public toilettes . It also photographically doocuments this happening.

Den nya dataskyddsförordningens påverkan på svenska folkhögskolor : Med fokus på konsekvensbedömning / General data protection regulations effect on Swedish folk high schools : With focus on privacy impact assessment

Syftet med denna studie är att undersöka hur folkhögskolor i Sverige hanterar den nya dataskyddsförordningen (nedan nämnd som förordningen eller GDPR) och fokuset har legat på konsekvensbedömning avseende dataskydd. GDPR handlar till stor del om att stärka den personliga integriteten. Konsekvensbedömning avseende dataskydd är ett nytt krav för organisationer som hanterar personuppgifter. Konsekvensbedömning avseende dataskydd handlar om att förebygga hot och sårbarheter samt att göra riskanalyser. Detta gäller säkerheten kring den tekniska biten såsom system där personuppgifter hanteras men även den mänskliga faktorn. Tidigare studier visar att konsekvensbedömning har funnits med länge men konsekvensbedömning för personuppgifter har inte tidigare varit ett krav. Den här studien visar att vissa folkhögskolor är familjära med processen medan vissa inte har utfört en konsekvensbedömning alls. Den här studien visar även att kunskaperna kring hur den nya förordningen påverkar folkhögskolor förbättrades efter ett utbildande webbinarium. Metoden som använts för denna studie är en intervjustudie som innefattar intervjuer med nyckelpersoner på folkhögskolor i Sverige där dessa har haft olika roller för att få en så bred bild som möjligt. Folkhögskolorna har varit på olika stadier i införandet av förordningen men även många likheter har presenterats. För att få fram svar på forskningsfrågan har intervjuer med fem nyckelpersoner på fyra olika folkhögskolor genomförts. Resultaten kommer att analyseras genom en innehållsanalys och genom analysen kommer rapporten kunna presentera en bild av hur folkhögskolor arbetar med personuppgifter, vilka förändringar kring arbetet som har uppkommit men också vilka utmaningar det finns att implementera GDPR och konsekvensbedömning. Sammanfattningsvis så kom det fram att folkhögskolor är olika i arbetet med konsekvensbedömning. Vissa folkhögskolor prioriterar det medan andra inte arbetar alls med det. Ett specifikt svar på hur folkhögskolor påverkas av GDPR och konsekvensbedömning kan inte ges sedan varje folkhögskola är olika varandra. Det kan bero på att folkhögskolor är frivilliga, till skillnad från grundskola och gymnasium och att folkhögskolor ofta drivs av fristående stiftelser. / The purpose of the work is to study how folk high schools in Sweden are handling General Data Protection Regulation (GDPR) and the focus has been on Privacy Impact Assessment (PIA). GDPR is mostly about strengthening personal privacy. PIA is a new requirement for organizations which are handling personal information. PIA is about preventing threats and vulnerabilities and about risk analyses. Both when it comes to security to systems where the personal information is stored but also about human factors. Earlier studies show that privacy impact assessment has been here for a long time but the privacy impact assessment regarding personal data has not been a requirement. This study showed that some of the folk high schools were familiar with the process, while some have never done that before. The study also shows that the knowledge of how the regulation is affecting folk high schools were improved after an educational webinar. The method that has been used for this work is an interview study which is based on interviewing key figures from folk high schools in Sweden. The respondents have mixed roles in the organizations, to get a wider picture. The folk high schools have been on various stages with implementing GDPR but shares similarities. To get an answer for the research question, the study was based on interviews with five key figures from four different folk high schools. The results were analysed based on a content analysis where the report aims to present an image of how the folk high schools are working with personal data, what changes have been made to meet the requirements for GDPR and privacy impact assessment but also what challenges exist when implementing them. The conclusion was that folk high schools are different when it comes to working with privacy impact assessment. Some are prioritizing it while some are not working with it at all. A certain answer to the question cannot be answered since there are differences between folk high schools. One reason for that is because folk high schools are optional, in difference of primary school and high schools, and often run by independent foundations.

Thus, the espoused constitutional right of privacy has come to be the way for individuals (and groups) to stave off society's attempts to control or divert the individual from his right to be let alone. This work examines both state and federal court cases in an attempt to show that privacy has come to be a basic, constitutional right to be used against society's intrusions in areas of personal and sexual privacy.

La protection des données personnelles en droit international privé

Les nouvelles technologies et l’arrivée de l’Internet ont considérablement facilité les échanges transnationaux de données entre les entreprises publiques et/ou privées et également entre les personnes elles-mêmes. Cependant cette révolution numérique n’a pas été sans conséquences sur l’utilisation de nos données personnelles puisque cette abondance de données à la portée de tiers peut conduire à des atteintes : la commercialisation des données personnelles sans le consentement de l’intéressé par des entreprises ou encore la diffusion de sa photographie, de son nom, de son prénom à son insu en sont des exemples. La question qui vient alors se poser est en cas de litige, c’est-à-dire en cas d’atteintes au droit à la protection de nos données personnelles, présentant un ou des éléments d’extranéité, quels tribunaux pouvons-nous saisir ? Et quelle est la loi qui sera applicable ? Les droits québécois, de l’Union européenne, et suisse présentent différents critères de rattachement intéressants et adaptés à des situations prenant place hors et sur internet. Le droit commun de chacun de ces systèmes est envisagé, puis appliqué aux données personnelles dans le cadre d’une situation normale, et ensuite à internet si la situation diffère. La doctrine est également analysée dans la mesure où certaines solutions sont tout à fait intéressantes, et cela notamment sur internet. Un premier chapitre est consacré à la compétence internationale des tribunaux et aux critères de rattachement envisageables en droit commun à savoir notamment : le tribunal de l’État de survenance du préjudice, le tribunal de l’État de la faute ou encore le tribunal du domicile de la victime. Et ceux prévus ou non par la doctrine tels que l’accessibilité et le ciblage par exemple. Les conflits de lois sont étudiés dans un deuxième chapitre avec également l’énumération les différents facteurs de rattachement envisageables en droit commun comme la loi de l’État du préjudice, la loi de l’État de la faute ou encore la loi de l’État favorisant la victime. Et également ceux prévus par la doctrine : la loi de l’État « offrant la meilleure protection des données à caractère personnel » ou encore la loi de l’État où est établi le « maître du fichier ». Le tribunal le plus compétent au regard des principes généraux de droit international privé en cas d’atteintes au droit de la protection des données personnelles hors et sur internet est le tribunal de l’État du domicile de la victime. Et la meilleure loi applicable est la loi de l’État du domicile ou de la résidence principale du demandeur et du défendeur à l’instance, et dans le cas où la situation ne présente pas d’éléments d’extranéité, la meilleure loi est la loi favorisant la victime. / New technologies and the rising of the Internet boosted international data trade between public and/or private companies and even between individuals. However, this digital revolution is coming with its consequences: this exchange of data leads to personal data transactions (personal information or pictures for example) without users’ will. In case of violation of personal data, it is still unclear how to bring a case before the courts? Which Law is applicable? Quebec Law, European Union Law and Swiss Legislation show similarities in real life and on the internet. First, we consider the common law, then personal data real life and on the Internet if there are any differences. The conceptual doctrine is also analysed as it reveals new Internet specific issues. The first chapter tackles the international jurisdiction of the courts, potential criteria of ordinary law: the court where the damage occurs, the court where the conduct occurred or the court where the plaintiff lives; and those that are and are not covered by the doctrine as the accessibility and the targeting for example. Law conflicts and multiple potential criteria of ordinary law are studied in the second chapter. The State of the damage, the State of the misconduct and the State that benefit to the victim among others. The regulation that ensures the best personal data protection and the law that identifies the file master. From the international private law perspective, the most competent court is the one located in the State where the plaintiff is living when damage occurs. And the best regulation to follow is the he law of the country of domicile or the law of the law that promotes and protects the victim.
