A call to modernize police accountability: an evaluation of the law’s response to excess use of force by police in British Columbia

When a police officer exercises their statutory authority to use force against a member of society, and that force results in death, the public must have confidence that the police acted legitimately. The inquiry this thesis facilitates examines current police oversight law that purports to hold police accountable in circumstances of police-involved death in British Columbia. The research is motivated by two assertions: 1. The government’s response to reform the investigatory and legal processes for the determination of allegations of police-involved death is inadequate; the resulting police oversight regime is too complex, and fails to act in the public interest. 2. Oversight and law enforcement agencies limit access to the information required for families and the public to understand the circumstances of, and to fairly assess, alleged police-involved death. While this research does not anticipate a singular resolution to the complex and longstanding questions of police accountability in BC, it draws attention to an unresolved history of police un-accountability as a matter of public interest. Due to the complex nature of the legal framework, this research does not identify an exhaustive list of issues within policing law. / Graduate

Harnessing Power: Exploring Citizen's Use of Networked Technologies to Promote Police Accountability

In this examination of citizen surveillance, I engage with Foucaultian and Deleuzian conceptualizations of surveillance, power, resistance, control, and desire, to explore the motivation(s) of community members who film and disseminate footage of the police. Methodologically, I conducted semi-structured interviews with community stakeholders to study the latent thematic ideas embedded in their responses. These themes represent the underlying motivational factors a citizen surveiller may have when filming the police. In my analysis of these themes, I explore: citizen surveillers’ logic for resisting power; citizen surveillers’ understandings of power; and, citizen surveillers’ reported approaches to both passive and active forms of resistance. Subsequently, there appears to be an underlying desire for power and a resistance to power when filming the police. However, given the exploratory nature of this study, there is a need to continue investigating the theoretical and under substantiated claims about citizen surveillance and its association with race, gender and socio-economic status.

Use of Force Citizen Complaints, Use of Force Violations, and Early Intervention

Abstract Mounting public protests, increasing expensive payouts, and shootings of unarmed victims by police is a call to reexamine options to problem solving, service recovery, and preventing police misconduct as it pertains to the use of force. The purpose of this quantitative study was to examine the correlation between early intervention system data (a) use of force, citizens' complaints (race and gender), and use of force violations (race, gender, and years of service for officers). The disruptive theoretical framework provided an innovative lens to examine police misconduct of a large midwestern large law enforcement agency. This secondary data study did not find significant relationships between stated variables using chi-square analyses. Although consistent with other studies, males were found likely victims of excessive use of force (X2 = 114.093, p =.000) using multiple regression. By expanding the characteristics of basic variables based on a (use of force) continuum model, the data can be treated as a disruptor with potential to reach maintenance or high productivity and sustainability. The fields of healthcare and education have made strides using this model, and this model may also add to the existing knowledge to create greater transparency, service recovery, and policy modification needed to reduce the use of force police misconduct. As society changes with varying political mandates, public opinions and technological communications, it is apparent that law enforcement must also continually improve efforts to enhance accountability and transparency relating to the use of force

Early Intervention Systems: An Evaluative Review of Their History and Use

It is the intention of this thesis to effectively describe what is known about EI systems to date. Many sources of information are used, beginning with peer reviewed journals such as Justice Quarterly, Police Quarterly, Policing: An International Journal of Police Strategies & Management, Police and Society and The American Journal of Criminal Justice. Also reports from criminal justice research affiliates will be used like the National Institute of Justice and the National Criminal Justice Reference Service. This thesis will work towards creating a comprehensive outline of the history of EI and future possibilities. With the aid of extant research, inquiries into the effectiveness of various EI systems, their shortcomings, or even best practices will be addressed. The aim is to review the existing discussion essentially paving the way for future researchers to conduct primary research studies on EI effectiveness. By accumulating, and subsequently compiling available research, the hope is to identify key arguments and perspectives on these systems and their implementation.

A critical assessment of the metropolitan police mandate within a constitutional democratic framework : the case of Gauteng metropolitan police departments

Text in English, with summaries in English, Xhosa and Zulu / This research was directed towards investigating if the metropolitan police mandate, as it is collectively perceived by senior metropolitan police officials in Gauteng, is constructive and aligned to the notion of a democratic South Africa. Qualitative data was collected from all metropolitan police departments in Gauteng through an extensive series of semi structured interviews. By adopting a phenomenographic research approach, collected data was transcribed, analysed and hierarchically arranged into a variety of qualitatively different but intrinsically related categories of description. From these categories of description, multiple collective understandings relating to democracy in South Africa, democratic policing and the metropolitan police role emerged. Further analysis revealed that the senior metropolitan police managers collectively fosters a significantly limited understanding of democracy, predominantly based on rudimentary and general democratic principles and values. The collective understanding participants held in relation to democratic policing was also significantly rudimentary and limited, as it principally revolved around the notion of police accountability. Again, the absence of an explicit relationship between participants and South Africa’s democracy was notable. Sequentially, it emerged that participants predominantly do not understand or perceive the metropolitan police department or its mandate as is appropriate within the framework of South Africa’s constitutional democracy. The democratic features of a preventative and proactive focus, objective professionalism and individual and situational responsiveness are thus remarkably absent from these departments.
