El presente informe busca analizar la Resolución N° 1547-2024-SUNARP-TR
para evaluar si es posible efectuar la consolidación la propiedad definitiva sobre
dos secciones de propiedad exclusiva de un régimen de propiedad horizontal
constituido sobre una edificación superficiaria, con la adquisición en simultáneo
de los derechos de propiedad temporal sobre las referidas secciones de
propiedad exclusiva, del 5.29% de acciones y derechos sobre el derecho de
superficie respectivo y del 5.29% de acciones y derechos sobre el predio matriz.
Para ello, se recurrirá a los conceptos desarrollados por la doctrina extranjera y
nacional en lo relacionado al derecho de superficie, a la propiedad superficiaria,
a la propiedad horizontal, a la consolidación de derechos reales y a la extinción
de derechos reales. La principal conclusión del informe será que no es posible
consolidar la propiedad definitiva sobre las dos secciones de propiedad exclusiva
por la inaplicabilidad de la figura de la consolidación a los derechos de propiedad
temporal, por la imposibilidad de extinguir el derecho de superficie sobre
secciones de aire del sobresuelo, y por la imposibilidad de dividir el predio matriz
con la presencia de una edificación superficiaria. Igualmente, se evidenciará la
afectación a los principios registrales de legalidad, de prioridad excluyente y de
legitimación. Por último, se dispondrá cual es la manera adecuada por la cual
establecer derechos de propiedad definitivos sobre las secciones de propiedad
exclusiva. / This legal report seeks to analyse Resolution No. 1547-2024-SUNARP-TR in
order to assess whether it is possible to consolidate the definitive property rights
of two sections of exclusive property of a horizontal property regime constituted
on a superficial building, with the simultaneous acquisition of the temporary
ownership rights over the referred sections of exclusive property, of 5.29% of
shares and rights over the respective surface right and of 5.29% of shares and
rights over the parent property. For this end, it will be used the concepts
developed by foreign and national doctrine in relation to the surface right, the
surface property, the horizontal property regime, the consolidation of real rights
and the extinction of real rights. The main conclusion of this report will be that it
is not possible to consolidate the definitive property rights of the two sections of
exclusive property due to the inapplicability of the figure of consolidation to
temporary property rights, due to the impossibility of extinguishing the surface
right only on aerial sections of the upper floor, and due to the impossibility of
dividing the parent property with the presence of an surface building. It will also
be shown how the principles of legality, exclusionary priority and legitimacy are
affected. Finally, it will be provided the appropriate manner by which to establish
definitive property rights over the sections of exclusive property.

El presente trabajo de investigación se sustenta en la Resolución Nº 3450-2023-
SUNARP-TR el cual sirvió como discusión en el CCLXXXI Pleno Registral, por el cual
se dictaminó la transferencia de los aires reservados en la partida matriz sin su previa
independización, quedando aprobado como Precedente de Observancia Obligatoria.
A lo largo de la investigación sustentaremos que dicha decisión del Tribunal Registral
es insuficiente, e inadecuado a nivel registral, puesto que si bien estamos de acuerdo
que los aires no tienen la obligación legal de independizarse para su transferencia, en
base al sistema declarativo de los bienes inmuebles, consideramos que las razones
para llegar a dicha conclusión es insuficiente en tanto el Tribunal se basa solamente en
la Directiva de SUNARP sobre el Régimen de Propiedad Exclusiva y Propiedad Común,
y en el Reglamento de Inscripciones de Registro de Predios.
Asimismo, si bien sostenemos que los aires pueden no ser independizados ante su
transferencia, ello cambia en el régimen de Propiedad Exclusiva y Propiedad Común,
en tanto los aires se computan como zonas comunes siendo necesaria su
independización para no colindar y generar confusiones con los bienes comunes
inscritos en la partida matriz. Siendo por tanto, exigible su independización en el régimen
anteriormente mencionado. / The present research work is based on Resolution 3450-2023-SUNARP-TR which
served as a discussion in the CCLXXXI Full Registry, which ruled the transfer of reserved
airs in the heading matrix without its previous independence, being approved as a
Mandatory Observance Precedent.
Throughout the investigation we will maintain that this decision of the Registry Court is
insufficient, and inadequate at the registry level, since although we agree that the airs do
not have the legal obligation to become independent for their transfer, on the basis of
the real estate declaratory system, we consider that the reasons for reaching such a
conclusion are insufficient, since the Court is based solely on the SUNARP Directive on
the Exclusive Property and Common Property Regime, and the Rules of Registration of
Premises.
Likewise, although we maintain that airs may not be independent before their transfer,
this changes in the regime of Exclusive Property and Common Property, while the airs
are computed as common areas being necessary their independence to avoid colliding
and generate confusion with the common goods registered in the matrix item. Its
independence under the above-mentioned regime is therefore required.
