Le système de justice constitutionnelle colombien est caractérisé par la richesse des moyens de protection de la constitution qu’il consacre. D’une part, il comprend un contrôle concentré dont la légitimité démocratique n’est guère questionnable au regard de son ouverture à la participation des citoyens et de son incidence autant sur la protection abstraite des droits fondamentaux que le sur contrôle des poids et contrepoids institutionnels. D’autre part, il existe un contrôle diffus qui, bien qu’il soit entré en vigueur au même moment que le contrôle concentré, n’a pas été véritablement au centre de la pensée juridique classique en Colombie. Il a fait l’objet d’un traitement très léger par la doctrine, la jurisprudence et la formation universitaire des juristes. En revanche, la culture juridique majoritaire, fortement « légicentriste », a conduit à des craintes autour de son utilisation qui se sont maintenues jusqu’à nos jours, malgré la transformation du droit impliquée par la Constitution de 1991. De plus, les contrôles diffus et concentré ne sont pas nés de manière coordonnée, la fonction de chacun n’étant pas délimitée. Tout au contraire, les dispositions qui les consacrent dans la Charte constitutionnelle octroient une portée très large au deux. Ainsi, l’étude s’achève-t-elle en proposant une conception du contrôle diffus qui interagisse de manière harmonieuse avec le contrôle concentré, afin de régler autant les inconstitutionnalités abstraites que concrètes. La thèse analyse donc quel a été - et quel devrait être - la place du contrôle diffus dans le système de justice constitutionnelle colombien en recourant à diverses méthodes de sciences sociales / The Colombian judicial review system is characterized by its wealth of methods of control. On the one hand, it has a concentrated control that reduces the democratic objection, comparatively speaking, because of the aperture to participation in its procedure and its impact both on the abstract protection of fundamental rights and on the control of respect for the checks and balances system. On the other hand, there is a diffuse control that, despite having entered into force at the same time as the concentrated control, has not been at the center of Colombian legal thought. In effect, its doctrinal and jurisprudential treatment has been scarce and superficial in the training of lawyers and judges. This is explained by a strongly exegetical law culture in which the idea of the non-application of rules was seen as a direct affront. Thus, fears were raised about the use of this mechanism that remain presently, despite the transformation of the concept of law as a result of the constitution of 1991. Indeed, the diffuse and concentrated controls were not conceived in a coordinated way, delimiting the function of each. In fact, the provisions that establish them tend to grant a very broad scope to both of them. Finally, this study proposes a concept of diffuse control that must interact harmoniously with concentrated control to restrain abstract and concrete unconstitutionalities. This thesis then ultimately analyzes the role diffuse control has had in (and should have in) the Colombian system of judicial review through various methodologies of the social sciences

Differences in Seasonality Based on Movie Quality

In recent years, the entertainment industry has begun to announce the release dates of many of their movies years in advance. This leads one to believe that movie studios are not taking into account the quality of a movie when a studio decides its release date. This paper will be an analysis in whether there is a difference in seasonality between different qualities of movies. If a studio announces the release date before filming even begins, it is clear that they do not know, and therefore cannot properly consider, the quality of the movie when they make its release date public. I will use films that make over a million dollars at the box office from 2000-2016 to examine the seasonality of good, average, and bad movies. My models will control for variables that were found to be significant in previous research. These include budget, MPAA rating, genre, and Oscar nominations. I will prove that there is a difference in seasonality between all three of these qualities groups. This will show that the Hollywood is now dismissing a key component in the difficult decision process that is movie release dates.

THE EFFECTIVENESS OF MUSIC THERAPY INTERVENTIONS WITH PERSONS OF CONCERN: AN INTEGRATIVE REVIEW

Immigrants, refugees, asylum seekers, internally displaced persons, and stateless persons, collectively known as “persons of concern,” often have unmet mental health and wellness needs as a result of trauma. With a diverse variety of interventions and approaches, the use of music therapy has the potential to meet the needs of persons of concern. In the present study, the researcher conducted an integrative review to examine the use of music therapy with persons of concern. After conducting a hand-search of music therapy journals and an advanced keyword search through internet databases, the researcher found 17 studies that met inclusion criteria. There were ten studies in which participants were immigrants, six studies in which participants were refugees or asylum seekers, and one study in which participants were displaced persons. Refugees’ countries of origin were: Azerbaijan, Cambodia, Chile, Democratic Republic of Congo, Ethiopia, Iran, Liberia, North Korea, Rwanda, Sierra Leone, Sudan, and Vietnam. Immigrants’ countries of origin were: China, Haiti, India, Korea, Latin America, Malaysia, Mexico, Romania, Russia, and Vietnam. Interventions used in the studies were (in order of frequency) singing, songwriting, instrument play, improvisation, lyric analysis, music listening, music imagery, and music-based relaxation. The needs of persons of concern, music therapy interventions, the rigor and quality of music therapy research, and implications for future clinical practice are discussed.

Developmental Evaluation of a Centralized Denials Management Program

Health care reimbursement is changing, and hospitals are finding it difficult to receive payment due to insurers' denial of services already rendered to patients. A denial can be considered an underpayment by the insurer to the hospital. Using a Six Sigma approach, a large hospital system in the southeast United States found that individual hospitals were not focused strictly on denials, but other tasks as well. Hospital administrators conducted a literature review and found that centralizing denials management team has improved reimbursement outcomes elsewhere. Therefore, the hospital system implemented a centralized denials unit to focus on overturning insurer denials while the patient was still hospitalized. The purpose of the project was to develop an evaluation plan to determine whether the pilot centralized denials management unit could overturn an additional 5% or more of the concurrent denials compared with the current individual hospital-based denials management approach. The quantitative evaluation plan will guide review of data collected from one organization to determine payer trends on the types of denials received and reasons for the denials. Understanding the pattern of denials is expected to uncover opportunities for denials coordinators in the dedicated centralized management unit to challenge payers based on contract language or medical necessity. If the centralized denials management unit is shown to reduce denials, it will be considered for expansion corporate wide. The social change expected through a successful denials management unit program is that the hospitals in the system will recover payment for services rendered and will be able to continue to provide quality care in the communities they serve.

Hannah Arendt desenvolveu uma compreensão da política cujo fundamento é o exercício da cidadania. Este trabalho objetiva investigar a crítica realizada por Arendt acerca das instituições políticas, elegendo como critério o lugar reservado à pluralidade e à ação em uma ordem política instituída. Por um lado, constata-se que o Estado-Nação, por sua própria natureza, não promove a recepção da diferença, de modo a recusar-lhe o atributo da dignidade; por outro, o governo republicano, cuja pluralidade é elemento essencial de sua estrutura, pode entrar em conflito com determinadas coletividades. Parte-se, portanto, da análise das experiências políticas concernentes ao Estado-Nação europeu e à República norteamericana com o fito de compreender os desafios da cidadania em tais ordens. / We aim to investigate Arendt\'s critique of political institutions. The criterion will be the plurality allied to the action. First, we have seen that the Nation-State, by its very nature, does not promote the reception of difference, Second, the republican government, whose plurality is an essential element of its structure, may be in conflict with certain collectivities. Therefore, we will start from the analysis of political experiences concerning the European Nation State and the American Republic in order to understand the challenges of citizenship.
