Trabalho em tempos de crise : a superexploração do trabalho penal nos Centros de Ressocialização Femininos do Estado de São Paulo /

Uma das intenções deste estudo é procurar compreender as razões que incidem sobre o atual processo de encarceramento em massa e o interesse de diversas empresas em oferecer postos de trabalho a essa população. Pressupomos que o fenômeno decorre da necessidade que o sistema do capital tem de minimizar os efeitos mais negativos da crise estrutural que o acomete, advindos, sobretudo, das transformações que as políticas neoliberais vêm provocando sobre as esferas produtiva e subjetiva da classe-que-vive-do-trabalho. A escolha pela análise desse processo nos CR femininos se justifica por dois motivos fundamentais: para que possamos apreender os desdobramentos da crise hodierna, é necessário voltar o olhar para o segmento mais prejudicado por esse processo, o das mulheres. É a elas que cabe o trabalho mais desqualificado, nas piores condições de estrutura, jornada e remuneração. Além disso, a maioria das mulheres presas atualmente cometeu alguma infração relacionada ao tráfico de entorpecentes, em grande parte das vezes, por ligação com o companheiro, filho, tio, pai ou algum homem da família, o que ressalta ainda a condição de opressão de gênero em nossa sociedade. O segundo motivo vem do fato de que aceitar um posto de trabalho é condição essencial para ser aceita no CR, local menos nefasto para as internas do que as prisões femininas comuns. Neste sentido, através de entrevistas com mulheres presas, gestoras das unidades, representantes das empresas, do Estado e da Pastoral Carcerária buscamos entender os distintos sentidos que essa atividade imposta pelo capital adquire no interior da prisão. Tudo indica que estamos diante de mais uma contradição social criada ... / Abstract: The analysis' interest of this research covers various dimensions of women's prison labor. We studied women who are sentenced to closed regime in three Social Rehabilitation Centers (SRC) of the State of São Paulo. One of the intentions is to try to understand the reasons which affect the current mass incarceration process and the interest of several companies in offering jobs for this population. We assume that the phenomenon arises from the needs of the capital system for minimizing the most negative effects of the structural crisis that affects itself; these effects are due to the transformations that neoliberal policies cause on the production and subjective spheres of the working class. The choice of analyzing these processes in women's SRCs is justified by two main reasons: in order to learn about the ramifications of today's crisis it is necessary to look back at the sector that was most affected by this process - women's sector. They bear the most unqualified labor, under the worst conditions of structure, working time and wages. Besides that, most female prisoners have committed some offense related to drug dealing, most of the times because of their partner, or their son, uncle, father or some other male family relative, which further highlights the gender oppression conditions in our society. The second reason comes from the fact that accepting a job position is an essential condition to being accepted in the SRC (which is a less cruel place for the inwards than the ordinary women's prisons). Thus, we tried to understand the different senses this activity (that is imposed by capital) has within the prison, through interviews with female prisoners, unit managers, representatives from companies, from the State and from Prison Pastoral. - Selected Questions of Unconditional Imprisonment The presented diploma thesis dealing with current issues of unconditional imprisonment is led by an effort to analyze problems that are conncted with the imprisonment and to outline possible solutions. The introduction is devoted to the concept of punishment and its purpose. In order to better understanding the current concept of unconditional imprisonment, the second part briefly discusses the historical development of this punishment and the origin of penological systems. This section also includes legislative regulation at both international and national level. The third part examines the unconditional imprisonment in terms of length, while the author concludes that the greatest risk of negative effects is linked to both very short sentences and penalties of over 10 years. The pivotal part of the thesis is the fourth part, which deals with selected actual issues, which must be discussed in connection with the unconditional imprisonment. The author calls for the priority to be given to the problems of prison overcrowding, because without the solution of this problem it is not possible to face other negative phenomenons and effort to reform convicts are often void. Measuring the Effects of the TYC Gainesville Resocialization Program on Juvenile Offender Resiliency Levels

An analysis of the effects of resocialization programming on juvenile offender resiliency levels was conducted with 220 juveniles committed to a maximum security facility. Data were examined on the subjects' age, race/ethnicity, length of time at the facility, level of resocialization, and resiliency score. The resocialization programming contains cognitive and social components that would be instrumental in augmenting juvenile offender resiliency levels. Analysis of the variables did not show a significant increase in juvenile offender resiliency levels. The results did display that students who were at the facility longer and who were in the older age groups had higher levels of resocialization.

Darbo tema - nuteistųjų meninės socialinės edukacijos kaip resocializacijos ypatumai. Tema aktuali, nes sėkmingas nuteistojo integravimasis į visuomenę didele dalimi priklauso nuo resocializacijos proceso, kuris vyksta per adaptacijos, pataisos ir integracijos etapus. Vienas alternatyvių nuteistų asmenų resocializacijos būdų – meninė socialinė edukacija. Šalies įkalinimo įstaigose užsiimama menine veikla, tačiau nepakankamai. Nesudaromos ar nepakankamai sudaromos sąlygos kalinių resocializacijai, trūksta specialistų, silpna materialinė bazė, mažas suinteresuotumas. Darbo tikslas - ištirti Lietuvos įkalinimo įstaigų meninės socialinės edukacijos kaip resocializacijos ypatumus. Darbe analizuojama nuteistųjų resocializacijos samprata, įkalinimo įstaigose vykstančios meninės socialinės edukacijos realijos. Temos aktualumui ir naujumui pagrįsti atlikti kiekybinio ir kokybinio tipo tyrimai. Apklausus 290 nuteistųjų, kalinčių Lukiškių kalėjime, Vilniaus 2–uosiuose pataisos namuose ir Panevėžio moterų kalėjime paaiškėjo, kad nors meninės veiklos užsiėmimai įkalinimo įstaigose vyksta, juos lanko ne visi. Apklausus 33 Vilniaus ir Panevėžio įkalinimo įstaigų vadovaujančio personalo darbuotojus bei meninės veiklos specialistus, dirbančius su nuteistaisiais, nustatyta, kad įstaigose vyksta meninės veiklos užsiėmimai (iš jų dažniausiai - dailės ir muzikos), tačiau ne visiems nuteistiesiems pasiūloma juose dalyvauti, be to, ne visi nuteistieji priima šį pasiūlymą ir noriai lanko užsiėmimus... The topic is relevant because a successful integration of a prisoner into society depends a lot on resocialization process that takes place through adaptation, correction and integration stages. One of alternative resocialization means of convicts is artistic social education. In imprisonment institutions of the country people are engaged in artistic activities, but not sufficiently. There are no conditions or conditions are not satisfactory for resocialization of prisoners, there is a lack of specialists, weak material base and little interest. Aim of the work: to research the peculiarities of artistic social education as resocialization of imprisonment institutions. In the work one analyzes the conception of resocialization of prisoners, and realia of artistic social education that take place in imprisonment institution. This dissertation is focused on role of probation and education programs in area of tertiary prevention of social deviation. Large amount of youngsters usually fail or break the rules during the program. It was my goal to look over a point of view of adolescents to another implication of probation programs for their lives. My dissertation objective was to reveal the reason of probation programs for youngsters, who attend these programs either voluntarily or obligatorily.Probation officers, who choose the youngsters for program, haven't information about how big importance their clients attribute to sense of probation program and what experience they get. My dissertation is divided into two parts. For first theory. Theory is based on study of available literature, which deals with youth crime. Important part is explanation of the fact, what probation programs are and what is the sense and purpose of them. I will describe current experiences but also new knowledge about research of work with youth and successful foreign projects. The theoretical part is followed by empirical part. I've decided to make this research by form of interviews with clients of PMS, who ended the program successfully. This thesis deals with the current legal regulation of post-penitentiary treatment. It is divided into six thematic areas. The opening chapter defines the concept of penitentiary and post-penitentiary treatment and the concept of resocialization. The second chapter contains an analysis of the legal arrangements for penitentiary treatment, including UN and Council of Europe activities in this area. Attention is also paid to a new way of differentiating sentenced prisoners. Description of the legislation of the treatment programs, including an enumeration of their standardized forms follows. The individual activities of the treatment programs are treated with an emphasis on work and educational activities. The last subchapter deals with the description of the release from imprisonment. The focus of the work lies in the third and fourth chapter dealing with post- penitentiary care and problems of released prisoners. The first sub-chapter focuses on the development of care for the released prisoners on the Czech territory from the collapse of Austro-Hungarian Empire to the present. Pelo prisma das finalidades da sanção penal, nomeadamente, da ressocialização e da reintegração social, o presente trabalho se lançou a analisar o método empreendido pela Associação de Proteção e Assistência aos Condenados (APAC) na administração das penas privativas de liberdade. A APAC é uma entidade civil sem fins lucrativos, parceira do poder público e atuante na execução penal. Dispõe de método próprio, com base religiosa, que preza por iniciativas de valorização humana e satisfação dos direitos elementares da população prisional. Tal metodologia foi sistematizada em torno de 12 elementos, que buscam nortear o cumprimento da pena, tendo em vista o fim de recuperação do indivíduo encarcerado. Assim, para que fosse possível compreender a orientação desses elementos, foi desenvolvida pesquisa de caráter empírico qualitativo, com uso das ferramentas de observação participante e aplicação de entrevistas, na unidade masculina da APAC de Itaúna, Minas Gerais. O corpus linguístico obtido foi analisado com as técnicas de análise de conteúdo. Da intepretação dos resultados obtidos, foi possível franquear a aproximação da experiência apaqueana dos referenciais teóricos escolhidos na delimitação dos sentidos de ressocialização e reintegração social, desembocando em reflexões acerca do local em que se situa a APAC com relação aos paradigmas das finalidades da sanção penal. / From the perspective of the purposes of criminal punishment, namely, resocialization and social reintegration, the present work sought to analyze the method used by the Association for the Protection and Assistance to Convicted (APAC) in the administration of custodial sentences. APAC is a non-profit civil entity, a partner of the public power and an institution active in criminal execution. It has its own method, based on religion, initiatives for human valorization and satisfaction of the elementary rights of the prison population. This methodology was systematized in 12 elements, who seek to guide the penalty management, in order to provide the recovery of the incarcerated individuals. To understand the orientation of these elements, a qualitative empirical research was developed, using the tools of observation and interviewing, at the APAC male unit in Itaúna, Minas Gerais. From the analysis of the results obtained it was possible to approximate the APAC experience of the chosen theoretical frameworks.

Often, the minimum penal law is not considered regarding strongly sanctioned penal law, supported by society, which does not see any more solutions to the growing criminality, and thus accepts any quick and strong response, even if in practice it brings just an illusion of safety. Indeed, the maximum penal law does not show reduction of criminality, and the application of the rule is getting more and more trivial, with discredit in its function of general prevention, concerning so many criminal kinds, high penalties, and so much impunity. In many situations, a mere apology brings more benefits to the ones involved, and avoids that the whole judicial apparatus is moved. The restoring justice will be analyzed as an alternative to the sanctions imposed, bringing a smaller recidivism when applied, and consequently, a more adequate and proved resocialization / O presente trabalho tem como temática a aplicabilidade, função e execução da justiça restaurativa, como alternativa às penas privativas de liberdade. O direito penal mínimo muitas vezes é esquecido frente a direito penal fortemente sancionador, sustentado pela sociedade que não vislumbra mais soluções para a criminalidade crescente e, assim, aceita qualquer resposta rápida e forte, mesmo que traga, na prática, apenas uma ilusão de segurança. Com efeito, o direito penal máximo, não mostra redução na criminalidade e a aplicação da norma se mostra cada vez mais banalizada, com descrédito em sua função de prevenção geral, frente a tantos tipos penais, penas altíssimas e tanta impunidade. Em muitas situações, um mero pedido de desculpas confere mais benefícios aos envolvidos e evita com que se mova todo o aparato judiciário. Será analisada a justiça restaurativa, como alternativa às sanções impostas, trazendo números menores de novos crimes, cometidos pelo mesmo indivíduo, quando aplicada e, consequentemente, uma ressocialização mais adequada e comprovada

With based on the theme "resocialization of adolescents in conflict with the law," according to the guarantees that make up the National System of Socio-Educational Services (Sinase), sought to be reflected in dissertations his notes about re-socialized function in conjunction with materialized records in Statute of Children and Adolescents (ECA) and the practice of the regulations surrounding it. The theoretical concept grounded in the world of historical and dialectical materialism, which uses elements that guide the study, supported in understanding the multiple relationships involving the object, took place through literature review and consultation of the publications of classic authors and contemporary tune with the theme, added to set out the measures that advocated Sinase, the ECA and dissertations in various fields of knowledge dealing with social policy for children and adolescents in conflict with the law. The results indicate, through the presentation of the depicted objects and subjects, gaps and biases that have not been addressed, prioritized stigmatizing categories, outdated methodologies, strengthening the social invisibility of poor adolescents and abandonment of these subjects to inadequate everyday experiences for their full development. / Esta dissertação, baseada nos procedimentos de um estado da arte, constitui-se da investigação de caráter inventariante de produções científicas dos cursos de Pós- Graduação Stricto Sensu de diferentes áreas do conhecimento da Pontifícia Universidade Católica de Goiás e da Universidade Federal de Goiás. Com base no tema “Ressocialização dos adolescentes em conflito com a lei”, de acordo com as garantias que constituem o Sistema Nacional de Atendimento Socioeducativo (Sinase), buscou-se evidenciar nas dissertações seus apontamentos acerca da função ressocializadora em conjunto com os registros materializados no Estatuto da Criança e do Adolescente (ECA) e da prática das regulamentações que o envolvem. A concepção teórica embasada no universo do materialismo histórico-dialético, que utiliza elementos que norteiam o estudo, sustentado na compreensão das múltiplas relações que envolvem o objeto, deu-se por meio da pesquisa bibliográfica e das consultas das publicações de autores clássicos e contemporâneos afinados com o tema proposto, somados aos enunciados das medidas que preconizam o Sinase, o ECA e as dissertações de várias áreas do conhecimento que tratam da política social das crianças e adolescentes em conflito com a lei. Os resultados indicam, por meio da apresentação dos objetos e sujeitos retratados, lacunas e vieses que não foram abordados, categorias estigmatizantes priorizadas, metodologias ultrapassadas, reforçando a invisibilidade social dos adolescentes pobres e o abandono desses sujeitos às experiências cotidianas inadequadas para seu pleno desenvolvimento.

Para tanto, abordam-se as garantias mínimas dos direitos fundamentais do Sentenciado em face da Constituição Federal, considerando-se a finalidade da pena e a responsabilização do Estado. Diante da difícil tarefa de demonstrar a responsabilidade objetiva do Estado por omissão, em face da falência do sistema prisional, procurou-se descrever a situação penitenciária contemporânea, especialmente do Estado de São Paulo, para o que contribuiu uma coleta de depoimentos de presos. Therefore, it deals with the minimum guarantees of fundamental rights of one sentenced in the face of the Federal Constitution, considering the purpose of punishment and governmental liability. Faced with the difficult task of demonstrating the strict liability of the State for failure to act in the face of the collapse of the prison system, we sought to describe the contemporary prison conditions, especially in Sao Paulo, for which a collection of testimonies from prisoners contributed. With the presentation and analysis of these data, we sought to expand the understanding of the requirements for the transformation of society as a whole.
