Previous issue date: 2017 / In the philosophical tradition, the philosophy of right is the discipline that thematizes the right as such, not this or that specific right of one or other State, not interested in detail by the right’s reality, but of the right’s concept. For Hegel the right is the objective realization of freedom, but not every law or positive institution is indeed a law of freedom, criteria is necessary to determine when a law or positive institution is justifiable or not, that is, satisfies the demands of reason for freedom. This dissertation aims to determine the criteria for the evaluation and correction of positive law in Hegel and the relation between the concept of right and the actuality of right. The present dissertation will have as main bibliographical reference the work of G.W.F. Hegel, Elements of the Philosophy of Right, as well as complementary works by the author himself (Phenomenology of Mind, Philosophy of History, etc.) and other authors and commentators who contribute to our objective. We will conclude that Hegel conciliates in his Philosophy right the historicity and normativity of freedom, that is, for Hegel, freedom would presuppose norms and would be historically effective, and that the criteria for evaluating and correcting positive law would be historical and normative.

WSP3: a web service model for personal privacy protectionOphoff, Jacobus Albertus January 2003 (has links)
The prevalent use of the Internet not only brings with it numerous advantages, but also some drawbacks. The biggest of these problems is the threat to the individual’s personal privacy. This privacy issue is playing a growing role with respect to technological advancements. While new service-based technologies are considerably increasing the scope of information flow, the cost is a loss of control over personal information and therefore privacy. Existing privacy protection measures might fail to provide effective privacy protection in these new environments. This dissertation focuses on the use of new technologies to improve the levels of personal privacy. In this regard the WSP3 (Web Service Model for Personal Privacy Protection) model is formulated. This model proposes a privacy protection scheme using Web Services. Having received tremendous industry backing, Web Services is a very topical technology, promising much in the evolution of the Internet. In our society privacy is highly valued and a very important issue. Protecting personal privacy in environments using new technologies is crucial for their future success. These facts, combined with the detail that the WSP3 model focusses on Web Service environments, lead to the following realizations for the model: The WSP3 model provides users with control over their personal information and allows them to express their desired level of privacy. Parties requiring access to a user’s information are explicitly defined by the user, as well as the information available to them. The WSP3 model utilizes a Web Services architecture to provide privacy protection. In addition, it integrates security techniques, such as cryptography, into the architecture as required. The WSP3 model integrates with current standards to maintain their benefits. This allows the implementation of the model in any environment supporting these base technologies. In addition, the research involves the development of a prototype according to the model. This prototype serves to present a proof-of-concept by illustrating the WSP3 model and all the technologies involved. The WSP3 model gives users control over their privacy and allows everyone to decide their own level of protection. By incorporating Web Services, the model also shows how new technologies can be used to offer solutions to existing problem areas.

The scope and content of the child's right to identidy in the context of surrogacyRispel, Shane-Leane January 2017 (has links)
Magister Legum - LLM / The development of assisted reproductive technology (ART) has radically changed the
landscape of the conventional family. It has permitted a platform for the creation of
families and family structures with tremendous diversity in their demographic
characteristics. It has also changed the way in which individuals become parents. The
advances in medical and scientific fertility treatments have meant that for many the dream
of having a child of their own has now become a real possibility. Public perception and
attitudes towards infertility treatments and more latterly surrogacy has changed
tremendously and becoming increasingly acceptable. While there are those who have
celebrated the advancement in reproductive technologies and potential freedoms that this
may contain, ART has opened the proverbial Pandora's Box amongst scholars and the public
policy makers, principally in the area of rights.

L'exercice du droit de grève dans le secteur privé / The right to strike in the private sectorVervoort, Maxence 26 November 2015 (has links)
Half way between the law and common practice , the right to strike is the result of a case law open to external influences. Far from being stuck in a theoritical and fixed ideology, the right to strike lies on dynamic grounds and on its ability to challenge the temporary and structural contexts that a company must cope with. In these conditions, how can the right to strike be legally shaped? What are the mutual permanent interactions between a case law and common practice which confers to this right its total effectiveness ? What are the legal and contextual influences that guides its daily practice ?

The effects of, and reasons for, the recent reforms in education, health and housingCauldwell, Jonathan Mark January 1996 (has links)
Since 1979 the UK has experienced the most decisive break in the providing style and underlying principles of welfare provision since 1944 to 1948, or perhaps ever. This thesis provides an historical overview of the succession of Acts in regards to state education, health and housing. It looks at the effects of, and reasons for, the reforms in these areas, showing how these have changed each sectors' operational style and ethos. A close insight into the reforms is provided by surveys of head teachers of Grant-Maintained schools, chief executives of NHS trusts, directors of local government housing departments and chief executives of housing associations and of Local Government. The questionnaires investigated issues such as, finances, changes in their functions, effects upon staff and external relations and highlights benefits and disadvantages. In general these sectors have experienced the introduction of a quasi-market, via the separation of the provider, purchaser and enabler roles. The aim has been to increase competition and consumer power in the state sector. In reality, competition is expanding, but these welfare markets have been subjected to increased scrutiny and control from Central Government. The market ethos is spreading across the nation, and although many people who are living through it are unaware of the rapid changes, this period may be looked back upon in history as being the most radical and far-reaching alteration of British economic, social and political structures.

Komparace politických a kulturních aktivit extrémně pravicové scény v ČR a SRN v 90. letech 20. století / Comparison of political and cultural activities of the extreme right in the Czech Republic and Germany during 90's in the 20th centuryPardubská, Martina January 2016 (has links)
Master thesis "The comparison of political and cultural activities of the extreme right in the Czech Republic and Germany during 90's in the 20th century" is firstly defining the terms related to study of the extreme right. Secondly, the thesis is analyzing success of German and Czech extreme right wing parties in the elections, then establishing and forms of membership in the extreme right organizations, making demonstrations, protest events and violent acts with extreme right context which are organized by supporters of the extreme right thoughts. Thirdly, the thesis is focusing on cultural activities, such as live music events with extreme right music artists, with outlining the lyrics of these Czech and German artists. Finally, comparative analysis is describing the form and frequency of all political and cultural activities. Conclusion of the thesis is that forms of the extreme right in the Czech Republic and Germany in the 90's were very similar, however in Germany these activities were more regular and more brutal. KEYWORDS Extreme right wing, ultra - right, neo - Nazism, extreme right wing parties, extreme right organizations, skinheads.

The hemodynamic effects of aminophylline, adenosine, losartan and nitric oxide administered shortly after right heart infarct in a porcine modelSpalding, M. (Michael) 10 May 2001 (has links)
Abstract
Right heart failure may be caused by several etiologic factors such as
pulmonary embolism, post coronary bypass, chronic obstructive pulmonary disease
(COPD) and right heart infarction. Traditionally, treatment has consisted of
fluid loading (volume expansion) and the use of inotropic agents. In the present
series of studies, an experimental model of acute right heart failure was
developed using right heart infarct. Treatment with drugs chosen to specifically
improve right heart performance was then evaluated. The drugs used in this series
were aminophlline, adenosine, nitric oxide (NO) and losartan.
Aminophylline transiently improved cardiac index and pulmonary vascular
resistance, but simultaneously caused an increase in heart rate and a decrease in
stroke volume. Although it may reduce right heart afterload, aminophylline did
not improve overall cardiac function in this experimental model of right heart
infarction.
Adenosine affected an increase in cardiac index during the adenosine
infusion and in stroke index, while pulmonary vascular resistance and mean
pulmonary pressure were decreased. There was a marked decrease in systemic
vascular resistance as a result of the drug. Heart rate remained unchanged by the
infusion. Discontinuation of the drug resulted in a rapid reversal of the
hemodynamic changes. The continuous infusion of adenosine therefore appears to
cause an effective arterial vasodilation, with a consequent unloading of right
heart afterload.
NO treatment significantly reduced right heart afterload. A significant
deterioration was observed in cardiac output as well as in left and right
ventricle stroke work indices. The use of NO in this model of right heart infarct
affected a decrease in both right heart afterload and left heart preload, with an
overall deterioration in global hemodynamics.
Losartan was shown to decrease central venous pressure and wedge pressure,
while cardiac output, left ventricle stroke work and stroke volume all showed
improvement. Compared to the control animals, pulmonary vascular resistance,
systemic vascular resistance and systemic pressures were unaffected by the drug,
as was heart rate. An inhibition of angiotensin II action may therefore be of
benefit in the treatment of right heart failure symptoms during the first hours
after right heart infarct.
