LEGAL AND INSTITUTIONAL FRAMEWORK FOR MULTI-STAKEHOLDER PARTICIPATION IN OIL AND GAS MANAGEMENT IN NIGERIA: PERSPECTIVES ON THE MULTI-STAKEHOLDER DIALOGUE APPROACH

This thesis explores the potential and practicality of incorporating multi-stakeholder participation into the legal and institutional frameworks for managing Nigeria’s oil and gas. Despite the natural resource wealth embedded in the Niger Delta, her people suffer greatly from social, economic and infrastructural underdevelopment and this thesis argues that failure to respect the right of the Niger Delta communities to participate in Nigeria’s oil and gas management and in developmental projects that affect their lives is the foundation of the resource curse besetting the region. As a solution to the resource curse problem of the Niger Delta and in response to the incessant conflicts, environmental degradation, social, economic and infrastructural underdevelopment and military injustice perpetrated in the region, this thesis promotes the enforcement of the right to participation of the Niger Delta peoples through the incorporation of the United Nations promoted Multi-Stakeholder Dialogue Approach (MSDA) and this argument is based on the Participatory Development Theory (PDT). The thesis proposes legal and institutional frameworks to ensure the effective incorporation of the MSDA into Nigeria’s oil and gas regime. Other than the human rights basis for promoting the participatory development of the Niger Delta peoples, the thesis examines the business case for participatory development as an incentive to encourage oil and gas companies operating in the Niger Delta to inculcate the values of the MSDA. This thesis establishes that incorporating the MSDA into Nigeria’s oil and gas legal and institutional regime in furtherance of the participatory development of the Niger Delta communities will promote environmental sustainability, peaceful coexistence, better informed decision making processes and economic and social sustainability among others. Though there are other rights infringement issues that bear on the development of the Niger Delta communities, it is anticipated that recognition of the Niger Delta peoples as stakeholders and their effective participation in Nigeria’s oil and gas management will give them a voice and opportunity to significantly address other human rights issues and to hold other stakeholders accountable.

1 Victims of the Gravest Crimes: The Role of Victims in Legal Proceedings Before the International Criminal Court Abstract This thesis analyzes the role of victims in the proceedings before the International Criminal Court, or the so-called victims' mandate of the ICC. The purpose is to comprehensively introduce their rights as well as the way in which this regulation is being applied. Therefore, the research question has two parts. The first part inquires into the current design of the victim's rights before the Court, while the second asks about the results of its application to the present day. Answers offered by the author of the thesis appear respectively in the second and the third chapter. The first chapter is focused on a historical development of the position of victims in the system of international criminal justice. It is of introductory nature and serves to highlight the historically unprecedented character of the role of victims before the ICC. Regarding the research method, the thesis analyzes the role of victims of crimes prosecuted by the ICC from both, theoretical as well as empirical angle. The objective of this article is to review and analyze the different arguments and legal excuses made by the Government and the private sector in Peru, this for the purpose of that the first-mentioned institution fails or avoids its juridical obligation of execute the preview consultation process for the indigenous peoples in Peru, this whenever the State is going to adopt a legislative or administrative measure susceptible that will affect directly to the indigenous peoples. In summary, this article seeks to analyze about the juridical problems founded at the moment of the implementation of the preview consultation process in our Legal System. If we consider that Convention 169 ILO, and the right to consult has been in force since February 2nd of 1995, and the Constitutional Court established on binding jurisprudence that the Convention in question is a norm that no needs a legislative development for its effectiveness, thus we can conclude that, rather than arguments is about legal excuses. / El objetivo del artículo es revisar y analizar los diferentes argumentos y pretextos jurídicos utilizados por el Gobierno y el sector privado en el Perú, para que el primero incumpla o evada su obligación jurídica de realizar el proceso de consulta previa con los pueblos indígenas en el Perú, esto cada vez que el Estado prevé adoptar una medida legislativa o administrativa susceptible de afectar directamente a los pueblos indígenas. En buena cuenta lo que hace el artículo es analizar los problemas jurídicos encontrados al momento de implementar la consulta previa en nuestro ordenamiento jurídico. Si tenemos en cuenta que el Convenio 169 de la OIT, y el derecho a la consulta estaban vigentes, y eran exigibles en el Perú desde el 2 de febrero del año 1995, y que el Tribunal Constitucional ha dicho en jurisprudencia vinculante, que el referido convenio es una norma que no necesita desarrollo legislativo para desplegar sus efectos normativos, podemos concluir, que más que argumentos, se trata de pretextos jurídicos.
