L’objectif général de la thèse vise à étudier l’impact des conclusions d’expertises psychologiques et psychiatriques en contexte de détermination d’une peine d’emprisonnement. Plus précisément, il s’agit d’examiner le rôle des finalités pénales (ou motivations à punir) dans la prise en compte d’une information expertale relative à l’altération mentale ou au risque de récidive dans l’attribution d’une peine. L’expertise peut être définie comme « l’ensemble des formes que prend l’introduction d’une rationalité technico-scientifique dans l’institution, le processus et la décision judiciaires » (Dumoulin, 2005, p.202). Les travaux issus de la littérature montrent généralement que l’expertise joue un rôle dans la prise de décision de jurés d’assises. Néanmoins, très peu de travaux (Krauss, Lieberman, & Olson, 2004 ; Krauss, McCabe, & Lieberman, 2012) mettent en évidence les variables interindividuelles pouvant expliquer ce processus décisionnel. Cette thèse propose précisément de s’intéresser aux finalités pénales comme potentielles variables explicatives de l’impact de l’expertise sur la détermination de la peine en France. Le programme de recherche s’articule autour de deux axes. Les deux premières études (axe 1) traitent du rôle des finalités pénales dans la prise en compte d’une information expertale relative à l’altération mentale (étude 1) ou au risque de récidive (étude 2) lors de la détermination de la peine. La troisième étude (axe 2) examine l’impact des antécédents judiciaires et d’une information expertale relative au risque de récidive sur la peine. De manière générale, les résultats de la thèse mettent en évidence la nécessité de prendre en compte la variabilité interindividuelle dans l’étude de l’impact de l’expertise sur les jugements judiciaires. Plus spécifiquement, les résultats suggèrent que l’usage d’une information expertale lors de l’attribution d’une peine à l’auteur d’un crime dépend des finalités que les individus associent à la peine. / The general purpose of the thesis is to study the impact of psychological and psychiatric testimonies in the context of sentencing. More specifically, this consists of examining the role of the motives for punishment in the consideration of expert information relating to altered mental state or the risk of recidivism in the sentencing process. Expertise can be defined as "all the forms that the introduction of a technical-scientific rationality takes in the institution, process and judicial decision" (Dumoulin, 2005, p.202). The literature generally shows that expertise plays a role in the decision-making of jurors. Nevertheless, only few studies (Krauss, Lieberman, & Olson, 2004; Krauss, McCabe, & Lieberman, 2012) highlights the interindividual variables that can explain this decision-making process. This thesis specifically proposes to focus on the motives for punishment as potential explanatory variables for the impact of expertise on sentencing in France. The research programme is divided in two axes. The first two studies (axe 1) deal with the role of the motives for punishment in taking into account expert information relating to altered mental state (study 1) or risk of recidivism (study 2) when sentencing. The third study (axe 2) examines the impact of criminal records and expert information on the risk of recidivism on sentencing. In general, the results of the thesis highlight the need to take into account interindividual variability in the study of the impact of expertise on judicial judgments. More specifically, the results suggest that the use of expert information when assigning a sentence to the perpetrator of a crime depends on the purposes that individuals associate with the sentence.

Možnosti eliminace rizik recidivy u osob podmíněně propuštěných z výkonu trestu odnětí svobody / Elimination of the Risk of Recidivism of People Conditionally Released on Parole

Abstract The thesis titled - The possibility of eliminating the risk of recurrence of persons conditionally released from prison (the prison sentence) can illuminate current topic of criminal recidivism at a time whenmore and more discussion about prison overcrowding and the improvement of efficiency and alternative sanctions is debated in society. The theoretical part is divided into four chapters, in which I try to clarify the key issues. I explain different terms, mention the statistical data, I describe possible relapse prevention tools e.g. treatment programs or alternative sanctions. I refer to innovation tools of the criminal policy, e.g. Electronic monitoring or Probation Homes. I mention subjects dealing with prevention of criminal recidivism. The empirical part describes the research and it is divided into two chapters. To achieve its objective, I chose the strategy of qualitative research, an interrogation method and semi - structured interview technique. The first part was realized on a research sample of nine clients conditionally released from prison with a supervision of the probation officer. The second part of the research was conducted on a sample of eight probation officers from the Probation and Mediation Service (PMS) in the South Bohemia. The main goal was to map the instruments used in the context of prevention of recurrence of persons conditionally released from prison by probation officers. Results showed that the list of instruments is extremely diverse. Analysis of self - assessment, professional interview and assistance of the other organizations e.g. Labor office, police, NGOs or debt counseling are the most preferred ones. The first sub - objective was to findopinions of probation officers on implementing new instruments helping to reduce recidivism and to reveal their possible advantages and disadvantages of them. Results showed that electronic monitoring as a new tool is welcomed by probation officersand they are believed to increase efficiency of the home imprisonment sentence. The most of respondents identified the implementing of Probation Homes as useful, particularly in the area of strengthening the social functioning of the client. The second sub - objective was to describe differences in risk of recurrence from the perspective of persons conditionally released from prison to probation officers. The research results showed that probation officers and their clients have different points of view on the matter. The officers said their clients were not able to see "yourself", they had no lack of self - reflection and the ability to learn from the crime they had committed. People released from prison are the most feared of drug addictionand gambling or job loss. This thesis is supposed to bring insight into reducing the risk of recurrence issue and recently introduced tools in this field. Furthermore, to point out the difference in the view and riskassessment of recurrence between probation officers and their clients.

Efektivní zacházení s pachateli násilných trestných činů s poruchami osobnosti v podmínkách penitenciární péče / Effective Treatment of Violent Offenders with Personality Disorder wihin the Penitentiary Custody

This paper addresses the question of whether individual delinquent behaviour, or criminogenic risks that lead to it, can be reduced for convicted violence offenders with personality disorder, using the newly developed offence-oriented therapeutic program TERČ ("TARGET"). If so, how will these changes manifest in the recidivism rate, and how they will reflect the personality characteristics of inmates. TARGET was first systematically applied within a special treatment unit for prisoners with mental and behavioral disorders in Liberec Remand Prison in 2008. It is based on selected elements of the Ambulant intensive program (AIP) from Switzerland. A total of 100 convicts were entered TARGET from 2008 to 2015. 65 individuals completed the program successfully, and 57 were released again. The already released graduates of TARGET re-offended within 12 months in 10.4%. Of all admitted TARGET participants, a total of 30.2% either relapsed or failed during the program since 2009. Graduates showed positive, statistically significant changes in the monitored areas of life satisfaction, emotional stability, insight, self-control and aggression, while on scales representing personality disorder no positive, statistically significant effect was observed. Unit management in prisons

Research into unit management in prisons was necessitated by a need to change the way in which South Africa deals with prisoners. The lack of respect for human dignity, poor control in prisons before and after demilitarisation and the need to reduce crime in South Africa are some of the reasons why the study became important. Topics addressed include the role of architecture in corrections, direct supervision to enhance active custody, renewed emphasis on individuals by means of case management and decentralised delivery of development and treatment programmes. Apart from the aspects mentioned above, the philosophy of unit management is spelled out. Imprisonment in countries such as Australia, Canada, Germany, Japan, South Africa and the United States of America is discussed against the background of the unit management philosophy. During any process of incarceration, documentation forms an integral part of the process. In this study, the researcher discussed those documents that could play an important role in unit management. The importance of unit management in prisons cannot be overemphasised. The investigation contributes largely to scientific knowledge in that the importance of sentence planning for each individual within the Criminal Justice System is emphasised. Individual case plans, active involvement from both the inmate and the correctional official and the positive role of prison design are aspects that should form part of all new generation prison systems. / Penology / D.Litt. et Phil.
