Examining the provisions of section 87 of the Indian Act as a means to promote economic participation and treaty implementation

Canadian courts, despite recognition in the Canadian Constitution, 1982 that treaties are to govern the Crown-Aboriginal relationship, continue to develop principles of interpretation that narrow Aboriginal and treaty rights, including the taxation provisions of the Indian Act. In Robertson, the Federal Court of Appeal, building on Mitchell v Peguis, articulated a “historic and purposive” analysis, by reliance on a distinctive culture test and an ascribed protection rationale, thereby abrogating the fundamental treaty relationship. As a means to fuller implementation of the spirit and intent of Treaties, taxation provisions must be interpreted in a treaty-compliant manner. The potential for economic participation through a proposed “urban reserve” on the Kapyong Barracks in Winnipeg, Manitoba, as part of a Treaty 1 settlement, is discussed as a case study, and compared with similar developments in New Zealand, under a Waitangi Tribunal settlement, as an example of treaty compliance in economic development. / May 2017

The Diploma Thesis "Teplitz-Schönauer Anzeiger in the 1920s and 1930s" explores the German-written journal which was published in Teplice-Šanov from 1861 to 1945. Firstly the years 1918 and 1938 are briefly described as they were crucial for history of the first independent Czechoslovak state; conditions for press printing during the period of the First Czechoslovak Republic are also depicted. Subsequently the modern history of the town of Teplice-Šanov is introduced, as well as cultural environment of the place. Last but not least the media landscape which the journal entered in 1861 is described. The main part of the Thesis aims at historical development of both journal and C.Weigend Printing Company from the beginning until its transfer under national control and subsequent end of publication in 1948. Each publisher of the newspaper is introduced: first of all the founder of the journal August Copek. Then the attention is paid to four generations of publishers from Weigend family. A sample of articles from years 1918, 1928 and 1938 serves as a source which shows the structure of the journal. The paper follows up on previous analyses of changes in soil microstructure in the process of soil development on dumps around Sokolov, Czech Republic, using the soil thin section method. The distribution of structures in the topsoil of the profile was studied in two chronosequences, one overgrown with spontaneous vegetation and one reclaimed by alder planting. A comparison with historical data obtained at these locations 10 years ago was used, and, therefore, the same methods were also applied (Frouz et al., 2007b). The most distinct trend in the process of soil development over time, as observed through both a comparison of soil thin sections from various areas of chronosequence and changes in particular sites over time, is a gradual reduction of purely mineral structures and their replacement by organic matter - litter and its fragments, faecal pellets of arthropods, earthworms coprolites, and roots. This is illustrative of a high share of biogenic structures and a fundamental contribution of organisms to forming topsoil, a fact also pointed out by other authors. Each expectant mother comes into the hospital with some idea of how the delivery will proceed, including the c-section. These ideas, created on basis lay and professional opinions, can be dramatically different from the resulting reality. This work deals with the choice of anesthesia for planned c-section from the perspective of expectant mothers. The theoretical part of the work is devoted to current possibilities and trends in obstetric anaesthesia. It describes the types of anesthesia (local vs. total) from the perspective of medicine and from the perspective of mothers in preparation to this operational performance. The aim of the empirical part of the work is the comparison of preoperative expectations of expectant mothers with the resulting hospital reality. It was found out by the quantitative questionnaire method. The questionnaire is divided into two parts- the part before the c-section and the postoperative part. The aim of the work is the detection what information sources influence mothers ideas of the course of the operating, the influences for their decisions of the choice of anesthesia, and how the information is valid and objective. In biomechanical analyses, the position of long bone cross-section under study is defined relatively to biomechanical length (BML) of the bone. In damaged bones where BML can not be measured, the position of the cross-section has to be estimated. Sládek et al. (2010) studied the effect of inaccurately located femoral and tibial midshafts on the cross-sectional parameters in a pooled-sex sample from a single period. In the present study we aim to test whether the effect of inaccurately located femoral and tibial midshafts on the cross-sectional parameters is sample-specific and/or sex-specific. We used femora of 29 females and 25 males and tibiae of 24 females and 36 males from two different periods (Late Eneolithic and Early Bronze Age; early modern period). 29 cross-section CT scans per bone obtained at each 1% interval from 40% to 60% of BML and at each 5% interval from 20-40% and 60-80% of BML were available to us. We digitized the cross-section scans and computed the error ranges of the cross-sectional parameters. We compared the mean percentage difference (MD%) and mean accuracy range (MAR) between samples and sexes. Our results are in concordance with the results of Sladek et al. Lecteur radar pour capteurs passifs à transduction radio fréquence / Radar Reader for Radio Frequency Transduction Passive Sensors

Un nouvel axe de recherche sur les réseaux de capteurs a été initié au LAAS par la réalisation de nouveaux capteurs sans fil passifs utilisant une transduction électromagnétique dans la détection de pression et de gaz. Ces capteurs fortement intégrés ne nécessitent aucune alimentation embarquée et leur fréquence de fonctionnement se situe dans la bande de fréquence Ka (26 à 40 GHz). Cette thèse s'inscrit donc dans la conception et la réalisation d'un lecteur adapté à l'interrogation à distance de capteurs à transduction électromagnétique. Son principe de fonctionnement est basé sur une technologie radar de type FMCW. L'avantage principal de la lecture radar des données issues de ce type de capteurs passifs réside dans la possibilité d'avoir des portées de plusieurs dizaines de mètres, bien supérieures à celles classiquement obtenues dans les technologies SAW ou RFID. Dans une première étape est présenté le principe de fonctionnement du lecteur radar et la réalisation de deux prototypes centrés sur les fréquences de 3GHz et 30GHz. Une étude du spectre de la sortie radar, appelé signal de battement radar, est abordée afin de montrer comment les positions et les mesures des capteurs sont lues à distance par ce type de lecteur. Par la suite, un travail d'analyse de la communication sans fil permet de déterminer les paramètres de rétrodiffusion électromagnétique à prendre en compte, tels que les impédances et les fréquences de fonctionnement des capteurs. Ces paramètres sont la base d'une optimisation du système global en termes de sensibilité, de portée radar et des niveaux minimaux de Surface Equivalente Radar (SER) des cibles interrogées. La validation de cette analyse se borne à la mesure de la portée maximale associée à ce type de lecteur et aux différentes mesures de SER de plusieurs types de capteurs dans les bandes de fréquence de 3GHz et 30GHz. Deux principes d'identification de cellules passives sont ensuite présentés. Le premier est basé sur l'utilisation des deux modes de rétrodiffusion de la SER d'un capteur (mode de structure et mode d'antenne) favorisant dans le même temps l'identification sur un mode et la mesure de la grandeur physique sur l'autre, a distance du lecteur. Le deuxième principe utilise le spectre d'un diffuseur multi-bande dont sa SER reconfigurable permet d'associer l'identification de chaque capteur dans un réseau, à la manière d'un code barre. En conclusion, les résultats obtenus dans cette étude valident le principe d'interrogation à longue distance de réseau de capteurs passifs et ouvrent de nouvelles perspectives sur la conception de nouvelles cellules de mesures pour de nouvelles applications dans les secteurs de l'aéronautique, du nucléaire, et de l'environnement. / A new development on sensor networks has been started by LAAS to implement new wireless sensors using passive electromagnetic transduction in the detection of pressure and gas. These highly integrated sensors require no power and the embedded operating frequency is in the Ka band (26 to 40GHz). This thesis is on the design and the realization of a reader suitable for remote sensing of sensor electromagnetic transduction. Its working principle is based on an FMCW radar technology. The main advantage of this radar when reading passive sensors is the ability to have ranges of several tens of meters, much higher than those obtained with conventional SAW or RFID technology. In the first step, the principle of operation of the reader and also the realization of two prototypes focused on the frequencies of 3GHz and 30GHz are presented. A study of the output radar spectrum, called beat signal radar, is discussed to show how the positions and measurements from the sensors are read remotely by the reader. Afterwards, an analysis of the wireless communication is performed to take into account parameters of electromagnetic backscatter such as the impedance and operating frequency of these sensors. These parameters are the basis of an optimization of the global system in terms of sensitivity radar range and the minimal levels of Radar Cross Section (RCS) of the interrogated targets.The validation of this analysis is limited by the reader's maximum range and by various RCS measurements of several types of sensors in the frequency bands of 3GHz and 30GHz. Two principles of sensor passive identification are then presented. The first is based on the simultaneous use of both modes of the sensor's RCS (structural mode and antenna mode), facilitating the identification by one mode and measuring the physical quantity using the other mode. The second principle uses the spectrum of a multiband scatterer where its reconfigurable RCS can associate the identification of each sensor in a network, such as a barcode. In conclusion, the result obtained in this thesis validate the principle of an interrogating network of passive sensors over a long reading range and consequently open a new way of sensor design for future aerospace, nuclear and environment applications.

O desenvolvimento da indústria offshore fez com que a demanda por unidades flutuantes para operações em águas ultraprofundas aumentasse e, com isso, surgiu um maior interesse nos fenômenos decorrentes de vibrações induzidas pelo escoamento em plataformas do tipo spar, TLP e semissubmersível, além de torres para produção de energia eólica (instaladas no mar). Para ampliar o conhecimento nesta área, experimentos foram realizados com cilindros flutuantes com baixa razão de aspecto (L/D = 2) e com diferentes geometrias na extremidade livre . Experimentos com a vibração induzida pelo escoamento em cilindros de seção quadrada e cilindros de seção quadrada e arestas arredondadas com baixa razão de aspecto foram realizados em um tanque de reboque. Estas diferentes geometrias de cilindros foram testadas e suportadas elasticamente por um conjunto de molas lineares. Dois ângulos de incidência diferentes foram testados: 0 e 45 graus. Os resultados de amplitude na direção transversal para modelos submetidos à incidência de 0 graus mostraram ser maiores. Além disso, as oscilações em yaw se mostraram importantes em todos os caso analisados. O efeito das arestas se mostrou importante, particularmente na incidência de 45 graus, para velocidades reduzidas maiores que 8. / The development of the offshore industry has meant that the demand for ultradeep water floating units has increased, and with this, a greater interest in the phenomena arising from FIV in spar, TLP and semi-submersible platforms has arisen. In order to increase the area knowledge, experiments were performed with floating cylinders with different geometries, with low aspect ratio (L/D = 2). Experiments of flow-induced vibration in cylinders with sharp aokokoknd rounded square section with low aspect ratio were performed in a towing tank. These geometries have been tested and elastically supported by a set of linear springs to provide low structural damping to the system. Two different incidence angles were tested: 0 and 45 degrees. The transverse response amplitudes for the 0-degree flow incidence were found to be larger. Moreover, yaw oscillations are important for all the cases analyzed. The rounded effect on the cylinders of square section were important, particularly for the the 45-degree incidence at reduced velocities higher than 8.

The work deals with a theoretical description of mathematical model and practical aspects of model simulation. Subsequently, it solves the current flow and the two design versions of the flowing debris trap profile. For the original channel and for the two designed versions two simulations were done for the flows of Q2 and Q5. As part of the work the theoeretical calculation of velocity in two cross sections of the existing channel was realized for the existing channel, which were due to calibration of the model. Results were compared at the same cross sections in the existing channel simulation solutions. Simulations are created in FLOW-3D. The purpose of this thesis is to determine whether the construction of trap profile is feasible.

Construire le corps féminin à travers les pratiques obstétricales à Phnom Penh, Cambodge / Constructing female body through obstetrical practices, Phnom Penh, Cambodia

Le Cambodge est l'un des neuf pays au monde à avoir atteint l'OMD 5 des Nations Unies, c'est-à-dire à avoir diminué de trois quarts le taux de mortalité maternelle au niveau national entre 1990 et 2015. Ce taux est ainsi passé de 1020 à 161 décès maternels pour 100 000 naissances au cours de ces 25 années. Ce succès est le résultat de politiques publiques volontaristes : une politique de planification familiale, la mise en place de systèmes de financements de la santé, la formation puis le déploiement de milliers de sages-femmes sur le territoire. Cette réussite s'explique également par une mutation sociologique de premier plan : l'accouchement, qui était historiquement un événement avant tout social et qui se déroulait dans l'intimité de la maison, est devenu un événement public pour la femme et sa famille. Alors qu'en 2000 moins de 10% des femmes accouchaient dans une structure médicalisée, elles étaient plus de 80% dans cette situation en 2014, traduisant ainsi la biomédicalisation massive et soudaine de l'accouchement dans tout le pays. Cette recherche sociodémographique remet en question la vision idéalisée des Nations Unies concernant la santé maternelle au Cambodge en rendant visibles et en observant les pratiques obstétricales « par le bas » à partir d'une enquête empirique sur plusieurs terrains à Phnom Penh et en Kandal (milieu rural). La méthodologie développée conjugue une observation participante, à des entretiens semi-directifs auprès de soignants et de non soignants (hommes et femmes), des questionnaires auprès de femmes enceintes puis accouchées (cohorte), ainsi qu'une collecte de données médicales dans quatre maternités de Phnom Penh. Les résultats montrent que certains hôpitaux et cliniques pratiquent des épisiotomies systématiques, ce qui est contraire aux recommandations internationales, et que le taux de césariennes dans la capitale a presque triplé en quinze ans, dépassant depuis le début des années 2000 le seuil de 10% recommandé par l'OMS. Enfin, une pratique répandue de périnéorraphies visant à resserrer fortement le vagin de femmes jeunes et en bonne santé après des accouchements par voie basse, sans indication médicale, est courante dans la capitale. Ces pratiques obstétricales, historiquement construites, vont alors fréquemment être détournées de leur usage médical pour répondre à une demande sociale. Le corps des femmes a été appréhendé dans cette recherche comme un corps social et politique, révélateur des rapports sociaux, sur lequel se jouent de nombreux enjeux de pouvoirs. La thèse a révélé que ces trois pratiques obstétricales faisaient système en se renforçant les unes les autres. A l'intersection entre corps, genre et biomédecine, la recherche a montré que ces différentes pratiques obstétricales pouvaient être conçues comme des instruments de domination. Le genre, tel qu'il est pensé dans la société, va contribuer à fabriquer un sexe féminin, mais aussi à construire un corps féminin de façon plus générale. Mais la thèse a dévoilé également que certaines de ces pratiques vont être saisies par les femmes, afin d'accroître leur attractivité sexuelle, leur permettant de renégocier les rapports de genre, et de maintenir l'harmonie et la stabilité du couple. / Cambodia is one of the nine countries worldwide to have reached the United Nations - MDG 5. A reflection of this achievement is a 75% drop in the national maternal mortality ratio from 1020 to 161 deaths for 100 000 live births between 1990 and 2015. This success is the result of voluntary public policies i.e. a family planning policy; the set-up of health care financing systems; and the training of thousands of midwives across the country. A deep sociological transformation can also help to explain this success. While childbirth in Cambodia used to be a private event, which took place at home, it has now become a public event for women and their families. In 2000, less than 10% of women were giving birth in a medicalized structure. By 2014, this number rose to over 80%, showing the sudden and massive biomedicalization of childbirth across the country. This socio-demographic research challenges the idealized vision of the United Nations regarding maternal health in Cambodia by showing and observing obstetrical practices on the ground, from an empirical study led in several setups in Phnom Penh and in Kandal province (rural sector). This mixed method research draws from participant observation, semi-structured interviews with healthcare professionals and patients (men and women), questionnaires with pregnant women (pre- and post- childbirth), as well as examination of medical records from four Phnom Penh maternity wards. The results show that episiotomies are systematically performed in some hospitals and clinics, in contradiction with international recommendations. Furthermore, the number of caesarean sections in Phnom Penh has almost tripled in fifteen years, and since the beginning of the 2000s it is above the 10% threshold recommended by the WHO. Finally, in the capital city, a common practice is observed: perineorraphy, which aims at tightening the vagina of young and healthy women shortly after a vaginal delivery without any medical indication. These three obstetrical practices have historical roots and are now frequently used outside of their medical purpose, as a response to a rising social demand. In this research, women' body has been considered as a social and political object that reveals social relationships, where many power negotiations occur. The thesis shows that these three obstetrical practices are interconnected and form a system. At the intersection between body, gender and biomedicine, these different obstetrical practices can be understood as tool of domination that seeks to shape the female body according to social expectations. In this way, the perception of gender in a society shapes the female body, and more precisely, the female sexual organs. Nevertheless, some of these practices are nowadays consciously chosen by women to increase their erotic capital, in an attempt to renegotiate gender relationships and preserve marital harmony.

Cesariana, condições pré-natal e pós-natal e leucemia linfoblástica aguda na infância / Cesarean section, prenatal and post-natal conditions and acute lymphoblastic leukemia in childhood

Introdução: A leucemia linfoblástica aguda (LLA) é a neoplasia pediátrica com maior incidência no mundo. Sua etiologia é resultante de múltiplas interações entre herança genética e exposição a agentes ambientais potencialmente carcinogênicos nos períodos pré-natal, nascimento e pós-natal. O parto cesáreo tem sido apontado como fator de risco para LLA em crianças. No Brasil, país com altas taxas de cesariana, são poucos os estudos que avaliaram a associação de cesariana com LLA na infância. Objetivos: Investigar a associação de cesariana e condições pré-natal e pós-natal com LLA em crianças nascidas no estado de São Paulo. Métodos: Estudo caso-controle de base populacional. Os casos de LLA, crianças nascidas no estado de São Paulo a partir de 1999, foram recrutados em oito hospitais de 2003 a 2009. Os controles foram emparelhados com os casos por sexo, idade e cidade de nascimento. As informações utilizadas nesse estudo foram obtidas em entrevistas com as mães ou responsáveis pelas crianças por meio de questionário estruturado. Informações adicionais foram adquiridas no banco de Declarações de Nascidos Vivos (DNV), que integra o Sistema de Informações de Nascidos Vivos (SINASC) da Secretaria Municipal de Saúde de São Paulo e do Ministério da Saúde. Após o linkage probabilístico dos bancos de dados, a amostra final comporta 133 casos e 459 controles, relação de 3,4 controles por caso. Análises de regressão logística não condicional e condicional foram conduzidas para estimar a associação entre cesariana, condições pré-natal e pós-natal e LLA, com estimava dos odds ratios (OR) e respectivos intervalos de 95% de confiança (IC 95%). Três modelos de regressão logística foram elaborados: 1) ajuste por idade e sexo da criança, idade e escolaridade da mãe; 2) ajuste pelas variáveis anteriores, mais raça e número de consultas; 3) ajuste por todas as variáveis anteriores e a inclusão de idade gestacional e peso ao nascer. Resultados: A análise de regressão logística não condicional, com base no Modelo 2, revelou discreto risco de LLA na exposição à cesariana (OR=1,10; IC95% 0,71-1,70), proteção na condição de mãe com 12 ou mais anos de escolaridade (OR=0,46; IC95% 0,24-0,89) e idade da criança de 6 a 8 anos no diagnóstico (OR=0,30; IC95% 0,13-0,67). Resultados similares foram observados na análise de regressão logística condicional no Modelo 2: cesariana (OR=1,18; IC95% 0,69-2,00), mães com 12 ou mais anos de escolaridade (OR=0,56; IC95% 0,25-1,24). Conclusões: Há uma tênue associação entre cesariana e LLA na infância, sem significância estatística. Alta escolaridade da mãe e crianças na faixa etária entre 6 e 8 anos foram fatores de proteção para LLA. Crianças com síndrome de Down apresentaram seis vezes o risco de LLA. Os resultados obtidos por análise regressão logística condicional foram similares aos da regressão logística não condicional. / Introduction: Acute lymphoblastic leukemia (ALL) is the most common pediatric neoplasia worldwide. Its etiology results from multiple interactions between genetic inheritance and exposure to potentially carcinogenic environmental agents during the prenatal, birth, and postnatal periods. Cesarean section has been identified as a risk factor for ALL in children. In Brazil, a country with high Cesarean section rates, few studies have evaluated the association of Cesarean section with ALL in childhood. Objectives: To investigate the association of Cesarean section, prenatal and postnatal conditions with ALL in children born in the state of São Paulo. Methods: Population-based case-control study. The cases of ALL, children born in the state of São Paulo from 1999, were recruited in eight hospitals from 2003 to 2009. Controls were matched with cases by sex, age and city of birth. The information used in this study were obtained through interviews with mothers or guardians of the children, using a structured questionnaire. Additional information were get from the Live Births Database, stored in the Live Birth Information System at the São Paulo Municipal Health Department and at the Brazilian Ministry of Health. After the databases probabilistic linkage, the final sample entails 133 cases and 459 controls, 3.4 controls per case ratio. Non-conditional and conditional logistic regression analyzes were conducted to estimate the association between cesarean section, pre- and postnatal conditions, and ALL with estimation of odds ratios (OR) and respective 95% confidence intervals (95% CI). Three models of logistic regression were elaborated: 1) adjustment by age and sex of the child, age and schooling of the mother; 2) adjustment for the previous variables, more race and number of queries; 3) adjustment for all previous variables and the inclusion of gestational age and birth weight. Results: The nonconditional logistic regression analysis, based on Model 2, revealed a slight risk of ALL on cesarean section exposure (OR = 1.10, 95% CI 0.71-1.70), protection on the condition of mothers with 12 or more years of schooling (OR = 0.46, 95% CI 0.24-0.89), and age of child from 6 to 8 years at diagnosis (OR = 0.30, 95% CI, 0.13-0, 67). In the conditional logistic regression analysis in Model 2, similar results were observed: cesarean (OR = 1.18, 95% CI 0.69-2.00), mothers with 12 or more years of schooling (OR = 0.56, 95% CI, 0.25-1.24). Conclusions: There is a weak association between cesarean section and ALL in childhood, with no statistical significance. Mother with high education level and children in the age range between 6 and 8 years were protective factors for ALL. Children with Down syndrome had a six-fold risk of ALL. The results obtained by conditional logistic regression analysis were similar to those of non-conditional logistic regression.
