Die Suid-Afrikaanse Witskrif van die Departement van Korrektiewe Dienste, is vasberade om die rehabilitering van die oortreder te bevorder. Die fokus van die studie wentel om die rehabilitasie van die oortreder en die vraag of hierdie doelwit binne die korrektiewe stelsel haalbaar is. Heelwat klem word op die noodsaaklikheid van alternatiewe vonnisse geplaas asook rehabilitasie as strafoogmerk tydens vonnisoplegging. Sentencing practice in military courts

The purpose of this study is to investigate the sentencing practice of the military courts. Since an independent and impartial military judiciary is essential to ensure that justice is done a further aim of this study is to investigate whether the military courts are impartial, independent and affords the accused his fair trial rights. The sentences imposed by military courts are investigated and concerns regarding the imposition of these sentences are identified. Finally the appeal and review procedures followed by the military courts are investigated with specific reference to the military accused’s right appeal and review to a higher court as provided for by the Constitution. The sentencing phase of a trial forms an important part of the whole trial process. This is also true for military trials, yet no research has been done on military sentencing practice. Because of the potential influence of the draft Military Discipline Bill and the Law Reform Commission’s revision of the defence legislation on sentencing, research in this area is critical in the positive development of sentencing law in the military justice environment. An extensive literature study is undertaken to evaluate current military sentencing practices against civilian practices. The result of this study identifies certain concerns regarding the independence of the military courts, the treatment of military offenders and the appeal and review powers of the military reviewing authority. To a large extent it is also found that many concerns are based on the apparent rather than the existence of any real dangers to the independence of the military courts or the rights of the military accused. This thesis contributes to the accessibility of military law for a civilian audience, creating a platform for the development of future military sentences. / Jurisprudence / LLD

The role of Deterrence and Retribution in sentencing in South African Courts Since the early history of the existence of humanity punishment has been meted out to transgressors of the laws of society. Informal sanctions, including ostracism are imposed by members of society for social transgressions. Formal punishment is imposed by courts through a system of criminal justice. This dissertation deals with the concept of punishment. It considers the significance of the theories of punishment in the sentencing process with particular reference to deterrence and retribution, the philosophical rationale for their use and thus their role in sentencing. In this study the historical evolution of retribution is traced and the recognition accorded particularly to retribution and deterrence as well as reformation and prevention as penal objectives at various periods in history is examined. Case law has been cited to determine their recognition by judicial practice in criminal courts. Sentencing the juvenile accused

The abolition of corporal punishment in S v Williams and Others 1995 (3) SA 632 (CC) provided the state with the impetus to consider alternative sentencing options. Unsystematic efforts by the government to reform the juvenile justice system have failed abysmally. The government was forced to review its policies on juvenile sentencing. An examination of international trends reveals the imposition of stricter measures of punishment for serious and violent juvenile offenders. Community-based sentencing options are used mainly for first-time offenders. The focus has also shifted from punishment and retribution to prevention and treatment. It is advocated that serious and violent juvenile offenders be incarcerated in secure-care facilities and/or juvenile prisons and that community-based sentencing options be utilised for first-time offenders. The South African death sentence under a new constitution

Although s 9 of the new Constitution 1 guarantees the right to life, there is no express provision which abolishes the death sentence. Whereas in the past the death sentence could only be avoided by the exercise of judicial discretion or political and public pressure, its imposition will now have to be entirely re-evaluated. Not only are all the laws of the country subject to the new Constitution, 2 but so too a Constitutional Court will be operational which will have the power to test the constitutionality of any such laws. By looking at the standards and relevant issues which are considered to define the constitutionality of the death sentence internationally, reviewing current application of the death sentence in South Africa, drawing comparisons, and by studying the problems unique to the South African situation, it will be the aim of this dissertation to determine how the death sentence will fare under a Constitutional Court. / Criminal & Procedural Law / LL. Ethical issues in the bioprediction of brain-based disorder

The development of predictive biomarkers in neuroscience is increasingly enabling bioprediction of adverse behavioural events, from psychosis to impulsive violent reaction. Because many brain-based disorders can be thought of as end-states of a long development, bioprediction carries immense therapeutic potential. In this thesis, I analyse issues raised by the development of bioprediction of brain-based disorder. I argue that ethical analysis of probabilities and risk information bioprediction provides is confounded by philosophical and social structures that have, until recently, functioned nominally well by assuming categorical (binary) concepts of disorder, especially regarding brain-disorder. Through an analysis of the philosophical concept of disorder, I argue that we can and ought to reorient disorder around probability of future harm and stratify disorder based on the magnitude of risk. Rejection of binary concepts in favour of this non-binary (probability-based) one enables synergy with bioprediction and circumnavigation of ethical concerns raised about proposed disorders of risk in psychiatry and neurology; I specifically consider psychosis and dementia risk. I then show how probabilistic thinking enables consideration of the implications of bioprediction for two areas salient in mental health: moral responsibility and justice. Using the example of epilepsy and driving as a model of obligations to protect others against risk of harm, I discuss how the development of bioprediction is poised to enhance moral responsibility. I then engage with legal cases and science surrounding a predictive biomarker of impulsive violent reaction to propose that bioprediction can sometimes rightly diminish responsibility. Finally, I show the relevance of bioprediction to theories of distributive justice that assign priority to the worse off. Because bioprediction enables the identification of those who are worse off in a way of which we have previously been ignorant, a commitment to assign priority to the worse off requires development of and equal access to biopredictive technologies.

La déontologie policière au Québec : les facteurs associés aux jugements de culpabilité et aux sanctions imposées aux policiers

La présente étude s’intéresse aux facteurs associés aux différents types de décisions rendus par le Comité à la déontologie policière du Québec. Pour ce faire, 267 jugements rendus entre 2009 et 2013 sont analysés. La régression logistique est utilisée pour déterminer les facteurs associés (1) à la décision de culpabilité (2) à la décision sur sanction et (3) à la sévérité de la sanction (sanction de courte durée ou de longue durée). Les facteurs utilisés dans les modèles sont des facteurs légaux (nature, gravité de l’inconduite et plaidoyer de culpabilité) ainsi que des facteurs extra-légaux -tels que les caractéristiques des policiers et des plaignants, le contexte de l’intervention ainsi qu’un facteur lié au processus décisionnel du comité (la durée des procédures)- disponibles dans les jugements. Les résultats montrent que le verdict est majoritairement influencé par la qualité de la preuve et que la sévérité de la sanction dépend principalement des facteurs légaux. Toutefois, certains facteurs extra-légaux influencent le verdict, dont le grade du policier. Parmi les facteurs extra-légaux qui influencent la décision sur sanction, il y a le grade, le sexe et le service de police du policier. Malgré tout, le Comité à la déontologie policière prend des décisions relativement cohérentes et les décisions prises sont justifiables légalement sauf pour quelques caractéristiques du policier et pour la durée des procédures. Ces derniers montrent la nécessité de faire davantage d’études sur le sujet. / Even though disciplinary systems are criticized for their lack of coherence and fairness, there is currently no study specifically focusing on the predictive factors related to the outcome of the officers’ sentencing process. The present research aims to investigate the factors associated with the different types of decisions rendered by the Deontology Committee of Quebec. A total of 267 hearings were analyzed between the year 2009 and 2013. Logistic regression models are used to predict the outcomes of the sentencing on three levels: (1) the determination of guilt, (2) the decision on the sanction, and (3) the severity of the sanction (short- or long-term sanction). The factors used in the models are legal factors - specific to the nature and the severity of the misconduct - and extralegal factors - related to the complainant’s and officer’s characteristics, the situation and the length of procedures - available in the judgments handed down by the Committee. The analyses in this paper show that the different outcomes are mostly due to the legally relevant factors. On the other hand, some extralegal factors like the officers’ rank have an influence on the determination of guilt. And, some officers’ characteristics like the officers’ rank, sex, police department and the length of procedures tend to influence the outcomes of the sentencing. Thus, the findings show that decisions rendered by the Committee are mostly taken in accordance with its mandate and are legally justifiable. The latter results show that more research is needed concerning the impact of extralegal factors on the outcomes.

Foreign bodies : the prison's place in a global world

This thesis examines the treatment and experiences of foreign national prisoners in England and Wales. It contains two main arguments. First, I contend that dominant prison theories rely on an outmoded understanding of the nation-state, and as a result, tend to ignore the effects of globalisation. Second, I argue that current prison practices reaffirm the boundaries of the British nation-state and promote an exclusionary notion of British citizenship. I conclude that research attuned to the affective, embodied dimensions of incarceration can help criminologists to develop a more ‘global’ perspective on state power. This argument begins and builds from ethnographic research. As a whole, the thesis is based on more than 200 interviews conducted over the course of a year in and around five men’s prisons in the north, southwest, and center of England. Structurally, it proceeds from a theoretical critique of prison studies, to an ethnographic account of prison life, to a conclusion about the purpose of prison scholarship. Thematically, it focuses on the relationship between identity and imprisonment, and in particular, on the ways in which normative beliefs about race, gender, sexuality, and class get infused in incarceration practices.
