The need for and contents of a life cycle management plan for Eskom transmission line servitudes

M.Sc. / The transmission system of Eskom occupies approximately 28 000 km of servitude that crosses a number of biomes in South Africa. The management of these servitudes, with respect to the impacts that the system has on the surrounding environment, as well as the effect of biotic, social and natural phenomena on the electrical system, needs to be carefully managed. This study investigates these bi-directional influences to determine which are pertinent to the management to the transmission line servitudes. This study also derives a number of strategic actions and accountabilities for all participating departments in the Transmission Division of Eskom, who are involved in the management of one or more phases of the life cycle of the servitude.

Easements Master's degree thesis deals with easements and describes historical development of this legal institute, and his form in today's effective civil code 89/2012 Sb. Easements belong to absolute property rights and iura in re aliena, which is the privilege of using a thing of another as if it were one's own. There is an obligation of one person to tolerate something, to refrain from something or to perform something in favour of another person. In this way it allows more people to use one thing without being its owners. The thesis is divided into five chapters. There is an introduction, which describes the aim and division of the work. First chapter explains the institute of easements, its place in today's effective civil code and historical types of easements. There is also short part about the importance of this institute in today's law. Second chapter deals with historical development of this legal institute. First of all there is subchapter about servitutes in Roman Law, because civil code 89/2012 Sb. was inspired with it. Then there is part about regulation in the feudalism period. This thesis deals with the legal institute of easements. These are rights in rem to another person's property which restrict the owner of immovable property in favor of another person so that he is obliged to tolerate something, to refrain from something or to perform something. Easements serve more beneficial usage of immovable property or in favor of a particular person. The thesis consists of ten chapters. The first chapter describes the historical development of easements in five sub-chapters. The second chapter deals with the definition and function of easements. The third chapter examines their sorting. The fourth chapter deals with the content of easements. The most common easements - the right of way and the right to use a flat or a room - are described in two sub-chapters. The fifth chapter deals with an issue of recording easements in the land register. The sixth chapter, the largest, successively pays attention to individual ways of their creation in six sub-chapters. In three sub-chapters of the seventh chapter modification of easements (in their subjects, content and object) is analysed. Servitudes Abstract The aim of this thesis is to analyse the legal institute of servitudes and its issues, especially focusing on its current legal regulation in the Civil Code and related case law. The thesis deals with the problematic issues that arise in connection with the examined institute and tries to find possible ways of overcoming the flaws of the legal regulation. The thesis is divided into four parts. The first chapter briefly outlines the theoretical concept of servitudes. The second part of the thesis analyses the historical development of servitudes from their beginnings in Roman law, when the foundations of the institution under study were formed and, in many ways, survive to this day. It then continues with an explanation of the codifications regulating servitudes. It continues with an explanation of the codifications regulating easements in the Czech territory from the General Civil Code through the communist codifications of 1950 and 1964, in the latter case the most important amendments are described. Then the reasons for the deletion of the term servitude from the applicable law and its replacement by a superior term covering both servitudes and real burdens, which was the state of law until the adoption of the current Civil Code, are discussed. The current status of the Appalachian Trail in the Commonwealth of Virginia is presented, and the role that easements will play in promoting Virginia's efforts to protect the Trail is investigated. Various aspects of easements are analyzed, including approaches to the appraisal of easements, and the effect of easements on income and property taxes. The present diploma thesis studies the topic of landed servitude, which represents one of the forms of restriction of real estate ownership rights. Landed servitudes form part of the real property rights, in particular of the rights in rem to another person's property. This legal institute dates back to Roman law when, like today, it represented a restriction of real estate ownership rights of one property in benefit of a better use of another property. The base of the landed servitudes is twofold: first, there is real estate for whose benefit the servitude is established (the dominant land) and a real estate burdened by an easment for another property (the servient land). Second, the servitudes limit the property rights of one real estate (the servient land) for the benefit of the owner of the other property (of the dominant land). The right of way of necessity : a constitutional analysis

Thesis (LLM)--Stellenbosch University, 2013. / ENGLISH ABSTRACT: The right of way of necessity is a special type of praedial servitude that is established over neighbouring property in favour of landlocked property – that is, property without access to a public road. The purpose of granting the landlocked property a right of access to a public road is so that it can be put to efficient use. The servitude is created by operation of law and it binds the surrounding properties as of right at the moment when the property becomes landlocked. It can, however, be enforced only against a specific neighbouring property. This servitude can only be enforced by way of a court order, against the will of the owner of the neighbouring property. This servitude, specifically the manner in which it is established, may raise significant constitutional issues as regards the property clause of the South African Constitution. Therefore, it was necessary to investigate the constitutionality of the right of way of necessity in view of section 25 of the Constitution. To this end, the study provides an overview of the law relating to the right of way of necessity and the general principles regulating this servitude in South African law. Subsequently, the justifications for the right of way of necessity and specifically for allowing the courts to enforce this servitude are analysed in terms of public policy, jurisprudential views and law and economics theory. The conclusion is reached that, in terms of these justifications, there are sufficient policy, social, and economic reasons for having the right of way of necessity and for the courts to enforce it without cooperation and against the will of the affected servient property owner. These justifications are used to examine the constitutionality of the right of way of necessity, specifically to determine whether the enforcement of this servitude by court order constitutes a section 25(1) arbitrary deprivation or even a section 25(2) expropriation of the affected owner’s property rights. The study concludes that the granting of the right of way of necessity will not amount to an expropriation and, following the FNB methodology, does not constitute arbitrary deprivation of property either. Therefore, if all the requirements are met, the granting of a right of way of necessity will be constitutionally compliant. / AFRIKAANSE OPSOMMING: Die saaklike serwituut wat ten gunste van grond wat van openbare verkeersweë afgesny is (blokland) oor naburige eiendom gevestig word, staan bekend as noodweg. Die rede waarom toegang tot ’n openbare pad aan blokland toegeken word, is sodat die grond effektief gebruik kan word. Hierdie serwituut word deur regswerking geskep en dit bind omringende eiendomme vanaf die oomblik dat die blokland van openbare verkeersweë afgesluit word. Dit kan egter slegs teen ’n spesifieke naburige eiendom afgedwing word. Die serwituut kan slegs deur middel van ’n hofbevel afgedwing word, teen die eienaar van die naburige eiendom se wil. Wat die eiendomsklousule van die Suid-Afrikaanse Grondwet betref, kan hierdie serwituut en veral die wyse waarop dit gevesig word belangrike grondwetlike vrae opper. In die lig van artikel 25 van die Grondwet was dit dus nodig om die grondwetlike geldigheid van noodweg te toets. Om hierdie doel te bereik, verskaf die studie’n oorsig van die regsbeginsels aangaande noodweg en die algemene beginsels van hierdie serwituut in die Suid-Afrikaanse reg. Met verwysing na openbare beleid, regsfilosofiese benaderings en Law and Economics-teorie analiseer die tesis vervolgens die regverdigingsgronde vir noodweg, spesifiek vir die feit dat die howe dit afdwing. Die gevolgtrekking is dat daar ingevolge hierdie regverdigingsgronde genoegsame beleids-, sosiale en ekonomiese redes bestaan vir die serwituut van noodweg en vir die howe se bevoegdheid om dit sonder die dienende eienaar se medewerking en teen sy wil af te dwing. Hierdie regverdigingsgronde word gebruik om die grondwetlike geldigheid van noodweg te ondersoek, spesifiek om vas te stel of die afdwinging daarvan neerkom op ’n arbitrêre ontneming vir doeleindes van artikel 25(1) of op ’n onteiening vir doeleindes van artikel 25(2) van die Grondwet. Hierdie studie kom tot die slotsom dat die toestaan van ’n noodweg nie as ’n onteiening kwalifiseer nie en dat dit, indien die FNB-metodologie nagevolg word, ook nie op ’n arbitrêre ontneming van eiendom neerkom nie.
